Cultural and Collective Rights of Indigenous Peoples in Venezuela

In this chapter, the authors attempt to demonstrate that respect for cultural identity of all human groups should be seen as a fundamental right. Ignoring Collective rights of indigenous peoples, those related to their cultural traditions, generally causes the lack of respect. Thus, knowledge of the cultural manifestations and their origin and meaning (as part of the history of the territories they inhabit) can conquer this respect on a par with its defense. This obviously with comprehensive training aimed to sensitize the general population in the positive assessment it deserves it different. The actions of nation-states governments with strong indigenous population has been characterized, until recently, by a remarkable disregard for indigenous cultures, having as a result the result of which such attitude, today from the non - indigenous perspective indigenous cultural manifestations are reduced to colorful folklore shows, when not seen as backward and primitive traditions. This chapter delves deeply into the legal framework for the protection of collective and cultural rights of indigenous peoples. The authors also attempt to show the weaknesses of the law and how states should act to strengthen them. Proposed article does emphasis on indigenous traditional knowledge and not in a wider debate on the topic of knowledge in general.

This textbook offers insights into the recently established special rights regime on indigenous peoples’ rights at international level. The reader is guided from the early beginnings of this issue in the 1970s to current jurisprudential developments. International and regional norms are introduced and contrasted with societal and political challenges. The book also opens broader debates on the politics of recognition and decolonisation, multilateral systems and global governance, the pluralisation of society and its institutions, collective rights and the meaning of civil, political, economic, social and cultural rights. This group-specific field of the international human rights protection system is viewed through the lenses of international law and socio-political approaches.

Indigenous peoples have long critiqued the harmful effects of Eurocentric research processes upon Indigenous cultures and communities. This paper—which is grounded in the author's knowledge and experience as an Aboriginal Australian academic—examines three threshold considerations relevant to non-Indigenous scholars who seek to enter into respectful research relationships with Indigenous peoples or knowledges. The first is the question of whether the research should be conducted at all. The second is positionality and how this affects research. The third is the need for scholars to comprehensively inform themselves about ethical research principles, including in relation to free, prior and informed consent, and Indigenous cultural and intellectual property.

There are many accounts of the history of the treaties between the Crown and the Indigenous peoples in Canada. This paper summarizes and analyses two of them. J.R. Miller, history professor emeritus at the University of Saskatchewan, gives an account of treaties one through seven in his article, “The Southern Numbered Treaties,” which is contained in his book Compact, Contract, Covenant: Aboriginal Treaty-Making in Canada. Sharon Venne, an accomplished First Nations lawyer and member of the Cree Nation, also writes about the treaties in southern Canada, focusing particularly on treaty six, in “Understanding Treaty 6: An Indigenous Perspective.” These two articles analyze the processes of treaty making, and offer perspectives contrary to the popular narrative, as well as arguing that the popular narrative does not include the entire history. This paper starts by summarizing each article separately, then analyses some of the main points. The analysis will argue in favour of the arguments put forth by Venne and Miller.

The history of the Indigenous Australian novel begins in the second half of the twentieth century and can be traced to the traditions of the Aboriginal and Torres Strait Islander peoples of Australia. The Indigenous novel combines elements of the oral and performance traditions of classical Indigenous cultures with one of Western modernity's central narrative forms. The traditions of storytelling and poetic narration that underpin the Indigenous novel have always occupied a central place in the cultural expression of Indigenous peoples. The chapter considers Indigenous Australian novels published in four different periods: before and during the mid-1970s, 1978–1987, 1988–2000, and 2000 to the present. These include David Unaipon's (Ngarrindjeri) My Life Story (1954), Shirley Perry Smith's (Wiradjuri) Mum Shirl: An Autobiography (1981), Ruby Langford Ginibi's Don't Take Your Love to Town (1988), Kim Scott's Benang (2000), and Alexis Wright's Carpentaria (2006).

Historically, hunger was used as a tool of coercion and manipulation, and as a weapon to eradicate Indigenous populations. Through policy decisions, the support for and removal of Indigenous children, and other assimilative practices, social work has contributed to the perpetuation of ‘helping practices’ which damaged Indigenous cultures and well-being. Today, experiences of hunger are still tied to colonialism. There is a need to examine the complex history of feeding Indigenous peoples in Canada and to work to reclaim and heal Indigenous food systems. For social work, this requires an emphasis on Indigenous ways of helping led by Indigenous peoples.

Abstract The purpose of this article is to conduct an exercise in historic anthropology and an anthropology of territory, based on an ethnography of the experiences of domination and resistance experienced by the indigenous peoples of Pantanal, in particular the Terena, within the processes of colonization, formation of nation states and capitalist development in South America. We will analyze experiences of indigenous autonomy against and in the state, and their dialectical territorial expression in the colonial world and in the contemporary dynamics of territorial and interethnic conflict in twenty-first century Brazil.

Many indigenous peoples now practice their own laws, their own cultural traditions and customs. In doing so, they draw on history, reconstructing their legal pasts, recreating—or even creating—their identities. At the same time, historical research has increasingly pointed out the intense interaction between indigenous peoples and European invaders during colonial period. Thus, it has become clear that many of the so-called ‘indigenous’ or ‘colonial’ legal traditions are more properly seen as hybridizations of indigenous and colonial laws and legal practices. This chapter introduces this historiography and its relevance to law and presents some methodological challenges in writing the history of indigenous rights in Latin America resulting from this fairly recent shift in (legal) historiography.


This book explores the tumultuous history of North American state-making in the middle decades of the nineteenth century from a continental perspective. Today’s political map took its basic shape in the continental crisis of the 1860s, marked by Canadian Confederation (1867), the end of the U.S. Civil War (1865), the restoration of the Mexican Republic (1867), and numerous wars and treaty regimes conducted between these states and indigenous peoples through the 1870s. This crisis transformed the continent from a patchwork of foreign empires, republics, indigenous polities, and contested no-mans-lands into the nation states of Mexico and the United States and the Dominion of Canada, an expanding, largely self-governing polity within the British Empire. Key to this process was the question of sovereignty, or the power to rule. Battles over sovereignty ran through the struggles waged not only by the nation states that came to dominate the North America, but also those that failed, like the Confederate States of America, and others—like the European empires and indigenous peoples—that came into conflict with the three main states. In light of the global turn in 19th-century historiography, this book examines these political crises as an inter-related struggle to redefine the relationship of North Americans to new governments. This volume brings together distinguished experts on the history of Canada, indigenous Americans, Mexico, and the United States to re-evaluate an era of political transformation that has had profound consequences for the future of the continent.

Rapid climate change is altering Arctic ecosystems and significantly affecting the livelihoods and cultural traditions of Arctic Indigenous peoples. In the Inuvialuit Settlement Region (ISR), an increase in the harvest of Pacific salmon indicates largescale changes influencing Inuvialuit fisheries. In this project we recorded and synthesized Inuvialuit knowledge of Pacific salmon. We conducted 54 interviews with Inuvialuit fishers about the history of Pacific salmon harvest, how it has changed in recent decades, and concurrent changes to local environments and fish species. Our interviews show that historic, incidental salmon harvest in the ISR ranged from infrequent to common among western communities, but was rare or unprecedented among eastern communities. Participants in all six communities reported a recent increase in salmon harvest and attributed this shift to regional environmental change. Fishers were concerned that salmon would negatively affect their cultural traditions and preferred fish species. Given uncertainty about the effects of salmon on local fisheries, research on salmon diets in the Arctic, their subsidies to Arctic freshwater systems, and the likelihood of their establishment is vital.

This article examines examples of settler-initiated political alliances with Indigenous peoples in Canada over the twentieth century, placing them in their social and historical context, and assessing their insights as well as ideological and material limitations. I explore four very different examples, ranging from protests over the dispossession of land to attempts to preserve Indigenous cultures to the post-World War II organization of the Indian Eskimo Association and youth Indigenous projects associated with the Company of Young Canadians. Past settler efforts to create alliances or speak on behalf of Indigenous peoples incorporated multiple intentions and political ideas; they included both efforts at advocacy and partnership and paternal replications of colonial thinking. Assessing their complex histories is an important part of our efforts to grapple critically with Canada’s history of colonialism.
