Human Rights, Poverty Reduction, Opportunities, and the Multinational Enterprise

There is near universal agreement the human rights of all individuals should be respected. Yet in practice, there are differences of opinions over the universality and application of human rights in specific situations. Instead of advocating excessive scrutiny and regulation of human rights based on a single set of values, thus discouraging FDI in the least developed countries of the world; it is argued multinational enterprises can have the most positive impact on human rights by actively seeking out opportunities to operate in the areas of the world most affected by poverty. By concentrating on doing what the private sector does best, creating livelihood and purchasing options which individuals have the right to choose or reject, the private section can have a significant impact on creating wealth and reducing poverty.

In Art. 3, para. 5, the Treaty on European Union (TEU) lays down the objectives of the Union in relations with the wider world, which are further explained in detail in Art. 21. In the first place, para. 5 refers to the promotion of the Union’s values. The list of values can be found in Art. 2 TEU (“The Union is founded on…”), which lists the principle of democracy, the rule of law and respect for human rights, human dignity, freedom and equality. They are to be upheld and promoted by the Union in the wider world. Thus, they are directly linked to external policy. Next, the list of values in Art. 2 is repeated in Art. 3, para. 5 as objectives of the Union’s external policy and in Art. 21, para. 1 as principles. For this reason, international agreements concluded between the EU and third countries all contain a “human rights clause” as an essential element of the agreement, the violation of which might result in the suspension of the agreement. This article focuses on the human rights clause in relations between the EU and selected non-democratic Sub-Saharan African countries. The main legal basis governing bilateral relations between the EU and those countries is the Cotonou Agreement. The “human rights clause” is to be found in Art. 9 thereof. This clause is especially interesting since it is the only one that has been implemented in practice. Moreover, it is often presented as the most elaborate one, and as a consequence is very often shown as a “model” that should be followed in other international agreements, especially in association agreements. So, the “human rights clause” contained in the Cotonou Agreement has its own characteristic features. Firstly, as it was mentioned above, it is the only one that has been activated in practice. Secondly, the “non-execution clause” is much more detailed, and finally, much more emphasis is laid on political dialogue and on the consultation procedure. This paper provides a propaedeutic analysis of legal cooperation between the EU and selected non-democratic Sub-Saharan countries in the area of human rights protection. Its main objective is to answer the following questions: to what extent the EU cooperates with such countries? What are the issues the clause covers? Is it effective? To what extent could it be enhanced? For analysis, the following countries have been chosen: Chad, Ethiopia, Rwanda, Uganda, and Zimbabwe. According to the Freedom House’s annual Freedom in the World report, the Global Freedom Scores for all these countries do not exceed 35 points, which equates to lack of democracy. Moreover, another feature which all of them have in common is a very low score on the Human Development Index (HDI), which means that all of them belong to the poorest and least developed countries in the world.

The basic principles that guide the United Nations to allocate specific groups of countries requiring special attention from the international community to the problems of their sustainable development are described. The difference in the scale and structure of aid to the least developed countries; landlocked developing countries; small island developing countries and heavily indebted poor countries is analyzed. The specificity of the approach of the World Trade Organization to the definition of countries with preferential access to the markets and the countries with differential treatment regime is revealed. The criteria that guided the International Monetary Fund and the World Bank to identify those developing countries which have the right of access to preferential lending conditions are analyzed. It is proposed to divide all the developing countries on: high-income emerging economies; middle-income frontier economies and least developed countries.

The Right to Development is a relatively new right in human rights law. Although its roots may be traced to pre-world war era, Right to Development took concrete shape with the passing of the UN Declaration on the Right to Development in 1986. Some renowned academic institutions in India are making recent efforts to make the “Right to Development” a Fundamental Human Right. Climate change poses a direct threat to human rights of people, especially in tropically situated countries of the south (including India), which are coincidentally home to a large number of vulnerable/marginalized people who are considerably poor to concern themselves with issues such as climate change. Due to mounting pressure from least developed countries (LDCs) and small island developing countries (SIDSs), international community has lately shown greater interest in establishing a direct link between climate change and human rights. This interest may be a reaction to the recurrent failures in reaching a consensus in the climate change negotiations through mechanical Conference of Parties (COPs). Similar to a bottom-up approach that seems to have worked well for the Paris agreement, it was believed by experts that linking human rights to climate change would shake the conscience of the reluctant parties to act expeditiously. The importance of a human rights–based approach to climate change will be highlighted in the light of two recent developments in the climate change discourse: First, the recognition by scientists of several extreme disaster as climate change events directly violating the human rights of the vulnerable; second, the dilution of the differentiation created between developing and developed nations by the Common But Differentiated Responsibilities (CBDR) principle in the recent climate change agreements. This paper seeks to establish the efficacy of the human Right to Development (through tools such as Greenhouse Development Rights) in effectuating the third world approaches to the issue of climate change in the global south.

The aim of the article was to examine the provisions of the Agreement on Trade-Related Aspects of Intellectual Property Rights adopted under the World Trade Organization, an attempt to answer the question of whether it is possible to reconcile the protection of intellectual property with the human right to health.</p>

In order to reduce poverty and achieve Goal 1 of the 2030 Agenda for Sustainable Development, countries’ foreign trade flows must be a driving force for productive activity, as proposed by the WTO-led (World Trade Organization) Aid for Trade initiative. This work analyzes the evolution of international trade in goods and services between Africa’s Least Developed Countries and customers and suppliers from other countries between 2005 and 2015, based on the information provided by UNCTAD and the World Bank. The results confirm a greater degree of trade openness and especially an increase in service imports. Overall, the data show that the purchases made in the international market have a greater marginal effect on GDP than sales, leading to the conclusion that changes in trade policy are needed, at both international and national level. Actions should be aimed at ensuring that the growing integration of these economies in the world trade system does not result in continued deficits in the trade balance but, on the contrary, does contribute to GDP growth and poverty reduction.

Almost 50 per cent of the world population is constituted by the women and they have been making substantial contribution to socio-economic development. But, unfortunately their tremendous contribution remains unrecognized and unnoticed in most of the developing and least developed countries causing the problem of poverty among them. Empowering women has become the key element in the development of an economy. With women moving forward, the family moves, the village moves and the nation moves. Hence, improving the status of women by way of their economic empowerment is highly called for. Entrepreneurship is a key tool for the economic empowerment of women around the world for alleviating poverty. Entrepreneurship is now widely recognized as a tool of economic development in India also. In this paper I have tried to discuss the reasons and role of Women Entrepreneurship with the help of Push and Pull factors. In the last I have also discussed the problems and the road map of Women Entrepreneurs development in India.

A partir de uma pesquisa teórico-normativa e descritiva, busca-se descrever a Educação em Direitos Humanos (EDH) na educação básica, que está traçada na 1ª fase do Programa Mundial para Educação em Direitos Humanos (PMEDH) e no Plano Nacional de Educação em Direitos Humanos (PNEDH). Consoante o primeiro, a EDH na educação básica é direito de todas as crianças, e prática educativa que deve ser desenvolvida nos sistemas de ensino primário e secundário; e, segundo o último, ainda, na comunidade escolar em interação com a comunidade local. Constata-se que a concepção de EDH contida nesses documentos é permeada pelo elemento da universalidade, havendo resguardo da diversidade quanto à prática.  Based on a normative and descriptive research, the goal is to describe Human Rights Education (HRE) in basic education that is outlined in the first phase of the World Program for Human Rights Education (WPHRE) and in the National Human Rights Education Plan (NHREP). According to first, HRE in basic education is the right of all children and the educational practice that must be developed in primary and secondary education systems; and, according to latter, still in the interation between the school community and the local community. It is verified that the concept of HRE contained in these documents is permeated by universality, protecting the diversity in the practice.

In recent years, all economically developed countries of the world experience formation of knowledge economy as the highest stage of postindustrial economy development. International companies, basing their activity on accumulation of human capital according to the principles of innovativeness, scientific nature, continuity and progressiveness, play an important role in activation of this process. Owing to global nature of their activity it influences all spheres of human life in the world, improving it, as well as having an adverse impact (enhancement of poverty in some regions of the word, environment pollution, etc.). Achievement of these conditions of sustainable economic growth is possible just by the way of prevention of the adverse impact, which, among other things, depends on the active social position of the management of international companies. Therefore this paper is aimed at identification of priority focuses of socially responsible activity of international companies. This goal was achieved through generalization of basic program initiatives of the activity of three companies, leading in innovations (Apple, Samsung and IBM). Adoption of the above-mentioned initiatives by other companies of the world as guides while developing their own development strategy has to facilitate the growth of positive effects from enhancement of knowledge economy in the world.

Soon after its creation, Pakistan confronted many issues including refugee problem, scarcity of able political leadership, absence of mutual consensus between both wings of the country and confusing nature of the relationship between Islam and state etc. took almost nine years to frame the permanent constitution for Pakistan. Constitution, the basic document of a state, determines the shape of its laws, structure of governance and system of rights and duties. The effectiveness of a constitution is judged by its practicability in the given area where it is enforced by the state machinery. Although, all civilized states of the world do possess a constitution, yet a good constitution is one which must protect the basic human rights by ensuring the independence of judiciary. Due to countless hurdles at the beginning of its journey, Pakistan’s constitutional development in the right direction could not take place. The main objective of the present study is to provide deep insight into the events and factors causing a delay in the constitution-making for the newly created state of Pakistan. The various events which took place from 1947 to 1956 have been analyzed in a subtle way.
