EXPERIENCE OF MEDIATORS IN THE FAMILY MEDIATION PROCESS IN THE CASES OF VIOLENCE IN PARTNER RELATIONSHIPS ABSTRACT The paper presents the experience of mediators in the family mediation process in the cases of violence in partner relationships based on the results of a research conducted in seven social welfare centres in which twelve experts adequately trained for the implementation of family mediation participated. The aim of the research was to describe and analyse the experience of the mediators in the family mediation process with the partners who had experienced violence and to determine the possibility of its application in such cases. The qualitative approach was used, and the procedure of topic analysis was used. The research results show that the mediators point out some specific features of the management of the mediation process with the partners who have experienced violence with regard to the safety of the process, establishment of the balance of power and a constructive dialogue of the parties in mediation, which demands the mediators to apply certain techniques and skills. Additionally, the results of the research indicate that the mediators perceive the possibility to implement family mediation with the partners who have experienced violence and that, apart from the basic prerequisites for the implementation of mediation, they emphasise the necessity to recognise the specific prerequisites, such as the time distance from violence, the influence of violence on the victim, creation of safe conditions, good level of the mediators’ education and the application of some procedures which should be conducted in terms of the assessment of violence, safety and selection of the mediation model. Until Professor Trina Grillo’s article warned readers of its process dangers, the family mediation process was viewed as a positive antidote to extensive and costly litigation and as a valuable opportunity for families to work together informally to resolve their custody, support, and property issues. Grillo, an academic and a practicing mediator, asserted that family mediation was not living up to its potential, that mediators hurt women and minorities by mandating participation without lawyers, and that its use created a false sense of empowerment. She was concerned that some mediators were not neutral, failed to focus on clients’ individual needs, and were unable or unwilling to deal with women’s emotions, especially reasonable anger and frustration....

This paper presents a model of the implementation of mediation in cases where a power disbalance between partners exists. The model includes relevant theoretical concepts which are important for understanding of violence phenomenon in the family, and the contemporary approaches to the work on balancing unequal power in relationships. In creating the model of family mediation in cases including violence, some basic concepts of mediation procedures are modified or adjusted (neutrality, confidentiality), as well as the concept of circular causality and complementary relationships from a systemic perspective. Implementation of interdisciplinary approach is proposed for efficient work on balancing the power in relations and using various working domains. The confession of violent behavior and the acceptance of personal responsibility by the offender, and the readiness of both sides to take part in restoration of a relationship are basic principles of restorative justice that is fundamental for victim- offender mediation. Therefore, those conditions are also necessary for a family mediation in cases including elements of violence, if the security for the victim is provided and guaranteed.

Nowadays television plays an important role in the socialization of children and adolescents, by making available a wide range of models of behaviour. However, watching television is an activity that takes place, mainly, in a family context. Therefore, the family has an important mediating role. A study conducted in Coimbra with students from the 4th, 6th and 8th grades, suggests that family mediation should be more intentional and more frequent, in order to promote the development of active and critical TV viewers. La televisión desempeña un papel fundamental en la socialización de la infancia, proporcionando desde muy pronto un amplio repertorio de pautas de conductas. La familia es el primer contexto en el que se genera el contacto con el medio televisivo. En este trebajo se recoge un estudio realizado en la ciudad portuguesa de Coimbra, con alumnos de 4, 6 y 8 años, a través de un cuestionario de hábitos televisivo, cin una muestra de 820 alumnos en el que se concluye que la televisión debería ser un instrumento más rentabilizado en la familia con fines educativos. A televisão desempenha um papel fundamental na socialização das crianças, proporcionando desde cedo um amplo leque de modelos de comportamento. A família é o primeiro contexto em que o contacto com este medium ocorre, pelo que deve constituir-se como mediadora da relação que a criança estabelece com a televisão. Um estudo efectuado em Coimbra, com alunos dos 4º, 6º e 8º anos, sugere que o uso da televisão pela família pode e deve ser mais rentabilizado pa a fins educativos.

Conflict-related and disputable situations have been present in our lives since ancient times, when people have become aware of the need to protect their rights and interests, sometimes at odds with the aspirations of others. The conflict that emerges between people disturbs their relationships and poses a threat to the proper functioning of people, bringing with them negative emotions. However, it can be an opportunity for development, be treated as a change in interpersonal relationships and can ultimately produce positive effects. Mediation offers a possibility of converting the negative aspects of the conflict into constructive solutions. Being voluntary, confidential, non-formal, out-of-court proceedings, it enables the parties to come to an agreement, offering them the opportunity to actively participate in shaping the legal and social situation and exercising their rights and interests in the spirit of consensus. In the mediation process, the parties use the support of a professional, impartial, neutral mediator. The authors of the article promote the idea of mediation with full conviction that it is a valuable and effective way for conflicted parties and third parties and their relatives to reach a consensus on various issues, including family matters.

Social politicians in harmony are raising an alarm for strengthening precautions, as more effective and in consequence also and cheaper in the financial dimen­sion. In the present article they made the presentation of two methods of the preventive social work with the family; of Conference of the Family Group and family mediation, pointing to benefits from applying them.

Abstrak: Proses mediasi merupakan  upaya alternatiif dalam menyelesaikan permasalahan pada aspek hukum keluarga terutama pada hak dan kepentingan anak-anak. Tujuan penelitian ini untuk dapat memastikan adanya perlindungan pada anak-anak akibat perceraian orang tuanya melalui jalur mediasi. Target khusus  yang ingin dicapai dalam penelitian ini agar anak-anak korban perceraian tidak dirugikan akan hak-haknya. Metode dalam penelitian ini adalah penelitian hukum normative, setelah mengkaji sumber data yang didapatkan melalui kepustakaan juga menelaah hasil  mediasi di Pengadilan Agama yang terdapat dalam Akta Perdamaian.Kata Kunci: mediasi, peradilan, Akta PerdamaianAbstract: The mediation process is an alternative effort in the family law, particularly in solving problems on the rights and interests of the child. The purpose of this research is to ensure the protection of children of divorced parents through mediation. The specific targets to be achieved in this study is that children as victims of divorce are not deprived of their rights. The potential of family members to serve as mediators of learning from television has received increasing amounts of attention in the literature. At the same time, the involvement of parents in their children's viewing has been found to be low. Using sample episodes from an ethnographic research study, this article describes several types of family mediation that have not been emphasized in the literature: contextual mediation, informal verbal mediation that occurs outside of the viewing situation, and mediation by families' organization in time and space. The authors suggest that ethnography can contribute to our understanding of the mediation of television by the family by documenting mediational influences that are unintentional, nonverbal, or occur at times other than during viewing.

Este artigo objetiva analisar a constituição das identidades familiares através das relações vivenciadas com o gênero melodramático, exploradas em suas várias dimensões e manifestações, o que inclui a telenovela e o bumba meu boi; tendo como ponto de partida o estudo de uma família em três gerações. O referencial teórico apoia-se nos estudos culturais e nos estudos de recepção. Optou-se pela pesquisa de abordagem qualitativa e trabalhou-se com o método da história oral em seu desdobramento na técnica história de família. Entre outros resultados, destaca-se: a caracterização das práticas culturais evidenciou, na trajetória da família, o contato com as narrativas ficcionais e melodramáticas, isto é, outros modos da família conviver com a novela, com outros formatos que têm por gênero o melodrama; a história de família revelou que a novela (o folhetim, a radionovela e a fotonovela), enquanto tradição popular melodramática antecede à telenovela, isto é, a novela vista na televisão.Palavras-chaveIdentidade. História oral.AbstractThis article aims to analyze the constitution of family identity through the lived relations with the melodramatic genre, ex-plored in its various dimensions and manifestations, including the telenovela and the bumba meu boi; taking as its starting point the study of three generations of one family. The theoretical reference is based on cultural studies and reception studies. We opted for the qualitative research and worked with the method of oral history, as it unfolds in the technique of family history. Among other results, it is emphasized that the characterization of the cultural practices showed the family's trajectory with the fictional and melodramatic narratives, i.e. other ways to live with the soap opera and with other formats that also present the melodrama genre. Furthermore, the family history revealed that the soap opera (the newspaper serial, the radio soap opera and the fotonovela), as popular melodramatic tradition, precedes the telenovela, which is, the soap opera seen on television.KeywordsIdentity.
