Tujuan penelitian menganalisis penerapan sanksi pidana terhadap persetubuhan yang dilakukan oleh anak. dan pertimbangan hakim dalam menjatuhkan sanksi pidana terhadap persetubuhan yang dilakukan oleh anak. Metode penelitian yang digunakan adalah penelitian hukum yuridis empiris. Hasil penelitian bahwa.) Penerapan sanksi pidana terhadap tindak pidana persetubuhan yang dilakukan oleh anak sama dengan penerapan sanksi pidana untuk orang dewasa karena menerapkan pidana penjara selama 8 bulan penjara. Pertimbangan hukum oleh hakim bahwa terdakwa telah terbukti melakukan persetubuhan akan tetapi hakim kurang memperhatikan asas legalitas dimana undang-undang tersebut berlaku setelah perbuatan pidana terjadi. Dengan pertimbangan penerapan undang-undang tersebut akan lebih adil baik bagi pelaku maupun korban yang masih berstatus anak. The research objective was to analyze the application of criminal sanctions against sexual intercourse by children. and the judge's consideration in imposing criminal sanctions on copulation committed by children. The research method used is empirical juridical legal research. The results of the study show that.) The application of criminal sanctions against criminal acts of sexual intercourse committed by children is the same as the application of criminal sanctions for adults because of imprisonment for 8 months in prison. Legal consideration by the judge that the defendant has been proven to have intercourse, but the judge does not pay attention to the legality principle where the law applies after the criminal act has occurred. With the consideration that the application of this law will be fairer for both the perpetrator and the victim who is still a child.

Penelitian ini bertujuan untuk menganalisis penerapan sanksi berdasarkan Undang-Undang Sistem Peradilan Pidana Anak dengan permasalahan penelitian, Pertama, Bagaimana penerapan Sanksi Pidana dan Tindakan Menurut Undang-undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak? Kedua, Bagaimanakah hambatan-hambatan apa yang ditemukan dalam penerapan Sanksi pidana dan Tindakan Menurut Undang-undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak. Metode penelitian menggunakan penelitian hukum normatif dan penelitian hukum empirik. Hasil penelitian menunjukkan, Pertama, Penerapan sanksi pidana menurut Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradila Pidana Anak bahwa Penegak mencari alternatif penyelesaian terbaik bagi kepentingan anak. Kedua, Hambatannya yaitu belum adanya persamaan persfektif dalam penanganan terhadap anak yang berhadapan dengan hukum di antara para penegak hukum serta hambatan dari faktor masyarakat yaitu banyak masyarakat yang belum mengerti tentang peraturan undang-undang yang berhubungan dengan anak. This study aims to analyze the application of sanctions based on the Child Criminal Justice System Law with research issues, First, How is the application of Criminal Sanctions and Actions According to Law Number 11 of 2012 Concerning the Child Criminal Justice System? Second, what are the obstacles found in the application of criminal sanctions and actions according to Law Number 11 of 2012 concerning the Criminal Justice System for Children. The research method uses normative legal research and empirical legal research. The results showed, First, the application of criminal sanctions according to Law Number 11 of 2012 concerning the Criminal Justice System for Children that the Enforcement Seekers seek the best alternative solutions for the interests of children. Second, the obstacle is the lack of equality in the perspective of handling children in conflict with the law among law enforcers as well as obstacles from community factors, namely that many people do not understand the laws relating to children

This research aimed to: (a) obtain the forms of copyright infringement of songs and/or music (with or without lyrics); (b) understand the role of the police, in this case the Police Precinct, in the law enforcement; (c) identify the factors that influenced the law enforcement. The research method used the normative-empirical legal research, with the initial stages of specifying norms in order to get the proper picture, and then specifying empirical events in order to get the real picture. The research results showed several matters: 1) The forms of copyright infringement of songs and/or music (with or without lyrics) found included: the distribution of the works or the copies, the performances of the works, and the announcements of the works; 2) Police Precinct did notultimately carry out their role as a law enforcer for the copyright infringement of songs and/or music (with or without lyrics); and 3) The factors that influenced the law enforcement on the copyright infringement of songs and/or music (with or without lyrics), namely: legislation factor, in the matter of complaint offenses; law enforcement factor, in terms of the capacity of members; less supportive factor of facilities and infrastructure; legal awareness factor, in the problem of the lack of legal counseling; and cultural factor, related to the differences in norms in the copyright law between those in society and those in regulations.

Penelitian ini bertujuan untuk mengkaji perlindungan hukum terhadap korban pencemaran nama baik melalui media online dan menjelaskan pemenuhan restitusi yang seharusnya diterima korban pencemaran nama baik melalui media online. Pencemaran nama baik merupakan perbuatan melawan hukum, dikarenakan telah menyerang kehormatan atau nama baik seseorang. Rumusan tindak pidana pencemaran nama baik melalui media online diatur dalam Pasal 27 ayat (3) Undang-Undang Infomasi dan Transaksi Elektronik. Sanksi pidananya diatur dalam Pasal 45 ayat (3) Undang-Undang ini. Dalam Undang-Undang ini belum diatur sanksi pidana yang berbentuk restitusi, sehingga kurang melindungi korban pencemaran nama baik melalui media online. Metode penelitian ini adalah yuridis normatif dengan menggunakan bahan hukum primer, sekunder, dan tersier, Berdasarkan hasil penelitian ditemukan bahwa ancaman pidana pada Pasal 45 ayat (3) Undang-Undang Infomasi dan Transaksi Elektronik belum memenuhi rasa keadilan dan memberi manfaat kepada korban. Karena pada pasal ini belum mengatur sanksi pidana yang bersifat ganti rugi terhadap korban. Reformulation of  Criminal Sanctions on Defamation Through Online Media This study aims to examine the legal protection of victims of defamation through online media and explain the fulfillment of restitution that should be received by victims. Defamation is an act against the law, because it has attacked someone's honor or reputation. The formulation of criminal defamation through online media is regulated in Article 27 paragraph (3) of the Information and Electronic Transactions Law. The criminal sanctions are regulated in Article 45 paragraph (3). This law has not yet regulated criminal sanctions in the form of restitution, so it does not protect victims of defamation through online media. The research method is a normative juridical by using primary, secondary, and tertiary legal materials. The results found that the criminal threat in Article 45 paragraph (3) of the Law on Information and Electronic Transaction had not fulfilled a sense of justice and benefited for victims. It is because this article does not yet regulate criminal sanctions that are compensation for the victim.

An auction is an activity of selling of goods in public by means of a verbal-bid to get the higher price or to get lower prices and the price quote can be done in a closed and written. This is done by the way of collecting the prospective buyers of the auction led by officials of the auction. In this case, the intended auction was the sale of goods that are held publicly. The auction, according to the regulations of security right, is when the debtor made a breach, the holder of the security rights have the right to sell the security rights’ objects over its own power through a public auction as well as taking payment of account receivable from the sale proceeds. An auction is an alternative to the sale of an undertaken asset by way of inviting prospective buyers at a particular time and place in which the last highest bidder in writing or orally is determined as the winner. The author used socio-legal research as his research method. To meet the forth standards set by the law, the auction should be widely announced to the public, either through printed file, electronic or visual. A legal certainty as a basis which concerned with propriety and justice is very closely related to the principle of auction sales in another. As the formulation of the problem of the form of identification of the problem, namely how the legal protection of the auction buyers encountered the obstacles as well as the solution.Keywords: Auction; Legal Protection; Mortgage Right

Labor is something that is needed by an employing company in carrying out its economic activities. This can be seen in the constitutional arrangements of the Republic of Indonesia in Article 27 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. In the implementation of the working relationship between workers and the employing company, there are several rights and obligations that must be fulfilled between the two parties. Because there are provisions regarding work agreements that are differentiated based on the form of the agreement, each worker has different rights where these rights must be guaranteed by the company based on law. From this, the problems that will be examined are legal protection for workers with an unwritten work agreement at the employing company, as well as legal remedies that can be taken by workers with an unwritten agreement in the event of a violation of rights by the company. The research method used is normative legal research, namely legal research conducted by examining existing library materials. By examining problems by looking at existing regulations, and describing problems that occur in practice or in everyday life in society. From the research conducted, it was found that legal protection for workers with an unwritten work agreement at the employing company is regulated based on Law Number 13 of 2003 concerning Manpower where the basis is that the applicable work agreement is an indefinite work agreement so that the rights obtained under the provisions of the law. Then efforts that can be made if there is a violation of the law in work relations is based on Law Number 20 of 2004 concerning Industrial Relations Dispute Settlement, namely in the form of Bipartite, Tripartite (Mediation, Consoliation and Arbitration) negotiations, as well as through Trials at the Industrial Relations Court.

The large number of state officials who commit corruption due to abuse of authority while exercising their authority can lead to losses to State finances. This study aims to determine the regulation of corruption by state officials in Indonesia, as well as to determine the sanctions for state officials who commit corruption for abuse of power. The research method used in this research is normative legal research with a statutory approach. The results showed that the regulation of corruption committed by state officials in the Corruption Eradication Law No. 20 of 2001, which defines that the act is committed by everyone against the law only to enrich himself or others including corporations which categorized as causing financial losses to the country's economy. There are two sanctions for officials who commit corruption for abuse of office, namely the death penalty and imprisonment.

The internet is an electronic and information medium that is developing very rapidly. The internet is widely used in various activities, namely trade, trading activities that use the internet known as e-commerce. Trading on the internet itself raises many problems related to the law and all its risks. Problems that can arise include default. The research aims are to analyze the rights and obligations of the parties in buying and selling transactions via Instagram and the legal consequences that arise if the seller in the sale and purchase transaction through Instagram defaults. The research method used is normative legal research, with using statutory approach. Primary sources of legal materials, sources of secondary legal materials were analyzed using systematic interpretation techniques. The result shows that in the buying and selling activities carried out on Instagram, there are often deviations in rights and obligations that are no longer in accordance with existing norms in society and legal remedies that can be taken if there is a default from one of the parties, be it the seller. and buyers who make online transactions can be sued within the environment of the general court or outside the court and can be subject to direct fines for parties who do not perform in default.

ABSTRACTOne of the police authorities is a discretionary action, where the action can also be done at the time of the investigation in dealing the juvenile offenders to protect children’s right to get justice and maximum legal protection. In the Law Number 11 of 2012 on the Juvenile Criminal Justice System stipulate about the investigator authority to carry out action of diversion, but this only applies to children under sentence of less than 7 years in prison and does not apply in children who are subject to punishments of more than 7 years in prison. This is contrary to the 1945 Constitution and the Law Number 23 of 2002 which emphasizes the protection of children before the law an the efforts to avoid imprisonment of the juvenile offenders.The thesis describes the police authority and the legal mechanisms and policies by the investigator in protecting the right on the juvenile offenders that puts the principles of legal protection. In order to avoid negative effects on children, therefore the police discretion is needed to avoid restrictions on freedom of the children’s right. The method used is a normative legal research method, where the normative or library legal research method is done by examining existing library materials.The writer suggested to the government to be more serious in dealing with the problems of children, especially for the juvenile offenders so that the welfare and right of children are protected and to avoid restrictions on freedom and minimize for juvenile offenders.

Current sports activities are quite closely related to tourism. Tourism is the main source of livelihood for the people of Bali. Along with the development of sports in Bali, the implementation of sports tourism was also developed as an option in the development of local tourism. Bali Provincial Sports Regulation regulates sports tourism in Bali. However, the provisions of Article 14 paragraph (2) of the regulation require regional government recommendations prior to the implementation of sports tourism, which if not fulfilled can be subject to criminal sanctions in contravention of the SKN Law and the implementing regulations give rise to norm conflicts. The purpose of this study is to study the implementation of sports tourism based on the Bali Province Sports Regulations and analyze criminal sanctions for not being given the recommendations of the regional government by the organizers. The method used in this study is a normative legal research method with a statutory approach. The results of the study show that based on the Bali Provincial Sports Regulations the implementation of sports tourism must obtain recommendations from the regional government as Article 14 paragraph (2) of the Provincial Regulation on Sport in Bali. However, higher legal provisions related to sports, namely the SKN Law does not regulate this. The SKN Law which is a reference for organizing sports only requires a recommendation from the relevant organization of sports branch as Article 51 paragraph (2). The criminal provisions as Article 65 paragraph (1) of the Bali Province Sports Regulations for organizers who do not have a recommendation from the regional government are irrelevant and seem excessive considering the recommendation is an administrative requirement for an activity, it will be more relevant if administrative sanctions are imposed rather than criminal sanctions. In the event that this occurs, it will refer to the provisions of the SKN Law as well as the implementation rules. Kegiatan olahraga saat ini cukup erat kaitannya dengan pariwisata. Pariwisata merupakan sumber mata pencaharian utama bagi masyarakat Bali. Seiring dengan berkembangnya olahraga di Bali, penyelenggaraan pariwisata olahraga juga dikembangkan sebagai salah satu pilihan dalam pengembangan pariwisata lokal. Perda Keolahragaan Provinsi Bali mengatur pariwisata olahraga di Bali. Namun ketentuan Pasal 14 ayat (2) pada perda tersebut yang mewajibkan rekomendasi pemerintah daerah sebelum penyelenggaraan pariwisata olahraga, yang apabila tidak dipenuhi dapat dikenakan sanksi pidana bertentangan dengan UU SKN maupun peraturan pelaksanaannya memunculkan konflik norma. Tujuan studi ini yakni untuk mengkaji penyelenggaraan pariwisata olahraga berdasarkan Perda Keolahragaan Provinsi Bali dan menganalisis sanksi pidana atas tidak dikantonginya rekomendasi pemerintah daerah oleh penyelenggara. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil studi menunjukkan bahwa berdasarkan Perda Keolahragaan Provinsi Bali penyelenggaraan pariwisata olahraga wajib mendapatkan rekomendasi dari pemerintah daerah sebagaimana Pasal 14 ayat (2) Perda Keolahragaan Provinsi Bali. Namun ketentuan perundang-undangan yang lebih tinggi terkait dengan keolahragaan, yakni UU SKN tidak mengatur demikian. UU SKN yang merupakan acuan dari penyelenggaraan keolahragaan hanya mewajibkan adanya rekomendasi dari induk cabang olahraga yang bersangkutan sebagaimana Pasal 51 ayat (2). Adapun ketentuan pidana sebagaimana Pasal 65 ayat (1) Perda Keolahragaan Provinsi Bali bagi penyelenggara yang tidak mengantongi rekomendasi dari pemerintah daerah tidaklah relevan dan terkesan berlebihan mengingat rekomendasi adalah sebuah syarat administrasi dari sebuah penyelenggaraan kegiatan, maka akan lebih relevan jika dikenakan sanksi administratif daripada sanksi pidana. Dalam hal itu terjadi, maka akan mengacu pada ketentuan UU SKN maupun aturan pelaksanaannya.

This research studies the legal status of a material guarantee for the bankruptcy process of Indonesia. The purpose of this research is to find out the legal status of whether the material guarantee that has been declared bankrupt by the appraisal because of not fulfill of repayment of the debtor to the creditor can be transferred on non-bankruptcy status? Moreover, what is the creditor's execution rights to the debtor's material guarantee? This research uses a normative legal research method, namely: legal research that is done with the purpose of discovering the principles and philosophical base (dogma or doctrine) of positive law, and the research of legal discovery efforts in concreto that is suitable to be implemented to solve a particular legal case. The result of this research is that material guarantees that have been determined as Bankruptcy cannot be transferred to their status when they are sold with a non-bankrupt status before a written decision by the judge justified the status. This shows obedience to the principles of legality and legal certainty, that selling the bankrupt assets with the status of (non-bankrupt assets) cannot be justified according to the law. If the curator still continues to sell the bankrupt assets, that process is illegal, including the execution of the selling according to the law. When it was being declared of bankrupt the total value of the material guarantee is assessed by the appraisal to be sufficient for paying all debts to the creditor, then it became the guarantee of repayment of the debtor, but if the value of the material guarantee valued by the appraisal is smaller than the debt, then there must be a reassessment in order to make justice for debtors and creditors. Mortgage-holding creditors, fiduciary guarantees, mortgage rights, mortgages, or other collateral rights, can execute their rights as if Bankruptcy did not occur, but there are several receivables that must be matched before executing their separatist rights.
