This study is a normative legal research which aims at discovering answers of two fundamental questions, namely, first, how is the status of the decisions of the Indonesia’s Constitutional Court according to the country’s constitutional system; secondly, what legal remedies may be pursued by the Indonesian citizens who are followers of indigenous beliefs whose constitutional rights to embrace such beliefs remain infringed despite there has been the decision of the Indonesia’s Constitutional Court Number 97/PUU-XIV/2016 which confirms the constitutional guarantee of such beliefs.  With respect to the first issue, the study found that the status of the Court’s decision was equal to Law because it was the product of a negative legislator. In addition, because the Court was also the interpreter of the Constitution (UUD 1945), then its decision was the Court’s constitutional interpretation concerning the issue at hand. As to the second issue, the study found that the followers of indigenous beliefs could file several legal remedies, namely citizen suit; class action; individual law suit; and submitting a formal complaint to the president, as the highest chief administrative officer, asking the president to reprimand its subordinates and to instruct them to observe the Court decision. Kajian ini adalah sebuah penelitian hukum normatif yang bermaksud menemukan jawaban atas dua pertanyaan mendasar yaitu, pertama, bagaimana kedudukan dari putusan Mahkamah Konstitusi menurut sistem ketatanegaraan Indonesia; kedua, jalan hukum apa yang dapat ditempuh oleh warga negara Indonesia penghayat kepercayaan yang hak konstitusionalnya untuk menganut keyakinan tersebut tetap dirugikan meskipun telah ada Putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 yang menegaskan jaminan konstitusi terhadap hak tersebut. Terhadap isu pertama, kajian ini menemukan jawaban bahwa kedudukan putusan Mahkamah Konstitusi adalah setara dengan undang-undang karena merupakan produk dari negative legislator. Sebagai tambahan, oleh karena Mahkamah Konstitusi juga merupakan penafsir Konstitusi (UUD 1945), maka putusannya adalah penafsiran konstitusional Mahkamah terhadap masalah yang sedang ditanganinya. Terhadap isu kedua, kajian ini menemukan jawaban bahwa penghayat kepercayaan dapat mengajukan beberapa upaya hukum, yaitu gugatan warga negara, gugatan kelompok, gugatan individual, dan membuat pengaduan resmi kepada presiden, selaku kepala pemerintahan tertinggi, dan meminta agar presiden memperingatkan bawahannya serta memerintahkan mereka untuk mematuhi putusan Mahkamah Konstitusi.

This study aims the death penalty in Indonesia. We know where the death penalty is contrary or not in terms of the constitution and Islamic law, then we can conclude that if the legal implementation of the death penalty in Indonesia continue to be done or should be abolished. Based on research and the analysis conducted, conclude that Indonesia According to the Indonesian Constitution that the death penalty in Indonesia is constitutional. Constitutional Court Decision No. 2-3 / PUU-V / 2007 states that the imposition of the death penalty was constitutional. Any law governing capital punishment is not contrary to the Constitution of the State of Indonesia. However the legislation in Indonesia death penalty is still recognized in some legislation. There are three groups of rules, namely: Criminal Dead in the Criminal Code, Criminal die outside the Criminal Code, Criminal die in the Draft Bill. According to Islamic law that the death penalty could be applied to some criminal act or jinazah, either hudud qishahs, diyat or ta'zir among others to: Apostate, Rebel, Zina, Qadzaf (Allegations Zina), Steal (Corruption), Rob (Corruption), Murder.

The purpose of this paper is to criticize the Constitutional Court Decision Number 18 / PUU-XVII / 2019, which determines that the phrases "executorial power" and "are the same as court decisions having permanent legal force" in Article 15 paragraph (2) of Law Number 42 of 1999 concerning The Fiduciary Guarantee contradicts the 1945 Constitution. From the norms contained in this article, there is a power of execution that the fiduciary security holder can carry out (creditors), which then causes many problems, both related to the constitutionality of norms and implementation. Thus, the authors question two things, first how is the juridical analysis of the Constitutional Court decision No. 18 / PUU-XVII / 2019 regarding breach of contract in the fiduciary agreement? Second, what is the juridical implication of MK Decision No. fiduciary? The writer's research type is library research, a literature study (library research) with a descriptive qualitative research type. The data collection technique used was documentation techniques, and the approach method used in this study was juridical normative. The results of this study conclude that 1) The Constitutional Court's decision has not provided a sense of justice as in Article 27 paragraph (1) and Article 28D paragraph (1) of the 1945 Constitution, because in this Constitutional Court decision gives more exclusive rights to the debtor because in this case, the creditor does not get legal protection rights in the event of undesirable things (2) This decision has implications for various parties, namely the Court, which now often receives requests for execution and the process will be lengthy, for notaries must add and clarify default clauses in detail. For business people whose creditors (fiduciary recipients) cannot carry out unilateral execution of the object of fiduciary security but must submit a request for performance to the Court. There is a concern that lousy faith will occur from the community's debtor when the creditor is submitting a request for execution to the Court.

Thework will discuss the problems arising from the thesis that the economic opportunities are incompatible with the person's primary law - the right to life and equality of treatment. An actively maintained hypothesis claims that the country's economic opportunities and funding should not restrict or reduce a person's right to life and health. In this aspect, it will also study the role of the constitutional court. The author points to the fact that the adoption of such, here the Supreme Court decision, successive constitutional court for a preliminary inaccurate claim and interpretation of the country's economic interests, could deny the right of people to life only after the consideration that they are of no use and financially expensive to be maintained.

Artikel ini mencerminkan pendapat penulis yang tidak setuju dengan keberadaan KPK dan Teori Konstitusi yang mendasarinya. Artikel ini didasarkan pada teori trias politica klasik dan mengajukan pendapat bahwa keberadaan badan-badan yang bersifat eksekutif harus sesuai dengan preskripsi teori unitary executive. Sesuai dengan teori unitary executive, presiden harus diberikan kewenangan to appoint and remove setiap pejabat eksekutif secara eksklusif. Kaidah ini didasarkan pada status presiden sebagai Chief Executive. Berdasar pengertian ini, KPK, sebagai badan independen, inkonstitusional. Seturut dengan Putusan Mahkamah Konstitusi No. 36/PUU-XV/2017 yang mengkualifikasikan KPK sebagai eksekutif, tata konstitusional kita yang abnormal, dengan keberadaan KPK, harus dinormalkan sesuai dengan teori unitary executive. This article expresses the author’s view to disagree with the existence of the KPK and its supporting Constitutional Theory. This article is based on classical model of the trias politica theory and suggests that the existence of executive bodies should conform with the prescription of unitary executive theory. According to the unitary executive theory, the president should have the power to appoint and remove any executive official exclusively. This norm is based on the status of the president as the Chief Executive. According to this notion, the KPK, as independent agency, is unconstitutional. In line with the Constitutional Court Decision No. 36/PUU-XV/2017, qualifying the KPK as executive, our abnormal constitutional order, with the existence of the KPK, should be normalized in accordance with the unitary executive theory.

Sepuluh tahun yang lalu putusan Mahkamah Konstitusi Nomor 3/PUU-VIII/2010 telah menegaskan bahwa  bahwa pemberian hak pengusahaan perairan pesisir (HP3) oleh pemerintah kepada pihak swasta bertentangan dengan konstitusi, terutama dengan Pasal 33 ayat (4) UUD 1945. Pembentuk undang-undang kemudian merespon putusan tersebut dengan merevisi UU Nomor 27 Tahun 2007 menjadi Undang-Undang Nomor 1 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil. Revisi tersebut telah mengubah Rezim HP3 dari UU 27/2007 menjadi rezim perizinan dalam UU 1/2014. Sayangnya, perubahan tersebut justru menimbulkan berbagai persoalan mulai dari konflik antara undang-undang serta peraturan dibawah undang-undang yang pada akhirnya sangat berpotensi merugikan hak-hak konstitusional masyarakat pesisir pantai. Penelitian ini memfokuskan pada aspek yuridis maupun sosiologis terkait perlindungan hak-hak konstitusional masyarakat pesisir pantai setelah Putusan Mahkamah Konstitusi Nomor 3/PUU-VIII/2010. Penelitian ini secara mendalam membahas mengenai tindaklanjut putusan MK a quo oleh pembentuk undang-undang, pemerintah pusat hingga pemerintah daerah dan stakeholder serta pemenuhan hak-hak konstitusional masyarakat pesisir pantai. Penelitian ini merupakan penelitian hukum normatif dengan cara meneliti Putusan MK Nomor 3/PUU-VIII/2010. Pembahasan secara deskriptif digunakan untuk memahami politik hukum pengelolaan wilayah pesisir sebagai upaya memenuhi hak-hak konstitusional masyarakat pesisir pantai. Disamping itu, Pengelolaan wilayah pesisir secara terpadu yang merupakan proses yang dinamis, multidisiplin, dan berulang untuk mempromosikan pengelolaan kawasan pesisir yang berkelanjutan. Termasuk seluruh siklus pengumpulan informasi, perencanaan, pengambilan keputusan, manajemen dan pemantauan implementasi. Ten years ago, the Constitutional Court Decision Number 3/PUU-VIII/2010 confirmed that the granting of concession rights for coastal waters (after this: HP3) by the government to private parties was contrary against the constitution, especially Article 33 paragraph (4) of the 1945 Constitution. Legislators then respond to the decision to revise Law No. 27 of 2007 as Law No. 1 of 2014 on the Amendment of Law No. 27 of 2007 on the Management of Coastal Areas and Small Islands. The revision has changed the HP3 regime from Law 27/2007 to the licensing regime in Law 1/2014. Unfortunately, these changes would lead to various juridical problems ranging from conflict between the laws and regulations under legislation that ultimately is potentially detrimental to the constitutional rights of coastal communities. This research focuses on juridical and sociological aspects related to the coastal communities protection of constitutional rights after the Constitutional Court Decision Number 3/PUU-VIII/2010. This research in-depth discusses the follow-up of the Constitutional Court decision a quo by legislators, central government, local governments, stakeholders, and the fulfilment of the constitutional rights of coastal communities. This research is normative legal research by examining the Constitutional Court decision Number 3/PUU-VIII/2010. The descriptive discussion used to understand coastal zone management law's politics to fulfil the constitutional rights of coastal communities. Besides, integrated coastal zone management (Integrated Coastal Zone Management) is a dynamic process, multidisciplinary, and repeated to promote sustainable coastal areas' sustainable management. It includes the whole cycle of information collection, planning, decision-making, management, and implementation monitoring.

Tulisan ini hendak membahas mengenai konsistensi putusan-putusan mahkamah konstitusi dalam pengujian undang-undang berdasarkan asas preseden. MK beberapa kali dipandang tidak konsisten karena kerap mengeluarkan putusan yang bersifat overrulling. Namun, sebenarnya tidak sedikit juga putusan MK yang konsisten mengikuti preseden. Meskipun penggunaan asas preseden hanya dikenal di negara yang menganut tradisi common law, MK ternyata juga menerapkannya. Putusan MK tentang pengujian UU Pencegahan Penodaan Agama adalah salah satu bentuk dianutnya asas preseden di MK. Putusan ini secara konsisten menyatakan bahwa UU Pencegahan Penodaan Agama tetap konstitusional karena akan terjadi kekosongan hukum apabila UU Pencegahan Penodaan Agama diputus inkonstitusional. Dalam perkara tersebut, MK mempertahankan ratio decidendinya terhadap konstitusionalnya UU Pencegahan Penodaan Agama karena meskipun MK sadar bahwa UU a quo banyak mengandung kelemahan. Konsistensi standing MK terhadap UU Pencegahan Penodaan Agama ini merupakan salah satu bentuk dari dipraktekannya doktrin preseden.This paper will discuss the consistency of the constitutional court decision in the judicial review cases based on the principle of precedent. MK several times deemed inconsistent because often issued a ruling that is overruling. However, there were actually a lot of MK decisions that consistently followed the precedent. Although the use of the precedent principle is only known in common law tradition, the Constitutional Court apparently also applies it. The Constitutional Court’s decision regarding the Blasphemy Prevention Act was one form of the principle of precedent in the Constitutional Court. This decision consistently states that the Blasphemy Prevention Act remains constitutional because a legal vacuum will occur if the Blasphemy Prevention Law was decided to be unconstitutional. In this case, the Court retained its ratio decidendi to the constitutionality of the Blasphemy Prevention Law, even though the Court was aware that the Law contained many weaknesses. The consistency of the Constitutional Court on the judicial review of the Blasphemy Prevention Act is one form of the practice of precedent doctrine.

The Constitutional Court Decision No. 88/PUU-XIV/2016 grants a possibility for a woman to be a candidate for Governor and Vice-Governor in the Special Region of Yogyakarta. As the only province in Indonesia where the executive leaders are only able from the royal family of the Ngayogyakarta Hadiningrat, the decision then triggers a polemic among people in the region. This is due to the current governor, Sri Sultan Hamengku Buwono X, does not have a son as his successor to the throne. Thus, this paper reveals institutional disputes’ settlement mechanism in the Ngayogyakarta Hadiningrat Sultanate if any disputes ever appear. The outcome finds that the Sultanate has yet clear mechanism of dispute settlement among the royal family and no official institution which possesses authority to settle royal disputes. Insofar, the Sultanate has had a customary law or paugeran adat in which a female figure might taking the throne to be the Sultanah and the governor of the province. Nevertheless, the authors recommend to establish an institution to settle royal disputes for the continuation of the Ngayogyakarta Hadiningrat Sultanate. Abstrak: Putusan Mahkamah Konstitusi No. 88/PUU-XIV/2016 meniscayakan adanya kemungkinan untuk seorang perempuan menjadi kandidat Gubernur dan Wakil Gubernur di provinsi Daerah Istimewa Yogyakarta. Sebagai satu-satunya pronvisi di Indonesia dimana pemegang kekuasaan eksekutif daerah hanya boleh berasal dari keturunan kerajaan Ngayogyakarta Hadiningrat, keputusan tersebut nyatanya memicu polemic diantara masyarakat di daerah. Hal ini disebabkan oleh tidak adanya keturunan laki-laki dari gubernur atau sultan yang sedang menjabat saat ini, yaitu Sri Sultan Hamengku Buwono X, untuk melanjutkan tahta kepemimpinan. Oleh sebab itu, artikel ini bertujuan untuk melihat mekanisme penyelesaian sengketa institusi di Keraton Ngayogyakarta Hadiningrat jika terjadi sengketa. Hasil yang ditemukan adalah tidak adanya mekanisme penyelesaian sengketa di dalam Keraton serta tidak adanya institusi resmi yang dapat memutus dan menyelesaikan sengketa tersebut. Hingga saat ini, Keraton hanya menerapkan hukum adat atau paugeran adat dimana mengizinkan untuk seorang perempuan mengambil alih tahta dan menjadi seorang Sultanah sekaligus gubernur. Namun demikian, penulis menyarankan untuk tetap dibentuknya sebuah lembaga yang memiliki otoritas untuk menyelesaikan sengketa antar anggota Keraton guna keberlanjutan Keraton Ngayogyakarta Hadiningrat kedepannya. Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, yang merubah/menambah norma hukum Pasal 43 Ayat (1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan adalah salah satu bukti nyata akan peran lembaga Pengadilan dalam memikirkan nasib dan masa depan anak yang lahir diluar perkawinan itu terhadap laki-laki sebagai ayah biologisnya, maka dengan norma hukum baru itu, Hakim-hakim pengadilan Agama sesuai dengan kewenangannya diharapkan mampu menjabarkan hak-hak keperdataan anak luar nikah dalam putusan-putusannya, agar kedepan hak-hak keperdataan anak seperti itu terhadap laki-laki sebagai ayah biologisnya terjamin sehingga dapat menjalani kehidupannya dengan wajar sebagaimana mestinya tanpa diskriminasi. Kata Kunci: Mahkamah Konstitusi, Perkawinan Children Married Outside After The Decision Of The Constitutional Court Number: 46 / PUU-VIII / 2010 Relating To Protection Against Civil Rights Child Outside Of Marriage Constitutional Court Decision No. 46 / PUU-VIII / 2010, which modified / legal norm of Article 43 Paragraph (1) of Law No. 1 of 1974 on Marriage is one of the first concrete evidence of the role of the Court in thinking about the fate and future of children born outside the marriage of a man as the biological father, then the norms of the new law, judges court religion in accordance with the authority is expected to describe the civil rights of children out of wedlock in its decisions, that future civil rights to children as against men as the biological father assured so as to live it to the fair as it should without discrimination.
