Abstract: Land Acquisition for public interest in Kulon Progo Regency is a procedure that must be implemented before initializing the new airport, which will replace the function of Adisutjipto airport. It facing much rejection during the process, so that it takes long time in completion. That also causing the identification and inventory process to be inhibited so that the land valuation process can’t be done perfectly. Their compensation won’t be given directly to the land owner, but through the consignment procedure that deposited at the District Court. This research is conducted by descriptive qualitative method. The results show that the assessment of the land is done well, although there is a discretionary decision, so that re-assessment is conducted in different time. The payment mechanism of compensation through consignment also done according to procedures, although the requirement of rejection letter from the party who is not eligible can’t be fulfilled, because it can be suspended due to the large interest for the land acquisition process of the new airport. Keywords: land assessment, consignment, land acquisition Intisari: Pembangunan bandara udara baru yang dapat menggantikan fungsi bandara udara Adisutjipto sudah tidak dapat dielakkan lagi. Pembangunan bandara udara baru dilaksanakan melalui prosedur Pengadaan Tanah untuk Kepentingan Umum. Penolakan terhadap pembangunan bandara udara terjadi dalam kegiatan tersebut. Penelitian ini bertujuan untuk mengetahui mekanisme penilaian dan mekanisme konsinyasi terhadap bidang tanah yang mengalami penolakan oleh pihak yang berhak pada kegiatan pengadaan tanah tersebut. Jenis penelitian yang digunakan adalah penelitian deskriptif dengan pendekatan studi kasus dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa dalam pelaksanaan penilaian bidang tanah secara keseluruhan sudah sesuai prosedur yang ada, akan tetapi terdapat putusan diskresi terhadap bidang tanah yang sebelumnya tidak dapat dilakukan penilaian secara keseluruhan kemudian dilakukan penilaian ulang di luar waktu yang telah ditentukan. Mekanisme pembayaran ganti kerugian melalui konsinyasi sudah sesuai dengan peraturan perundang-undangan yang berlaku, hanya dalam proses permohonan registrasi konsinyasi terdapat satu syarat terkait dengan surat penolakan dari pihak yang berhak yang tidak dapat dilampirkan, hal tersebut dapat ditangguhkan mengingat besarnya kepentingan kelancaran proses pengadaan tanah pembangunan bandara udara baru ini. Abstract: The construction of Bendung Slinga in Purbalingga Regency begins with land acquisition carried out in 2009 and 2010, but the land acquisition process has not been completed in the land rights certificate, especially the object that comes from the village cash lands of Banjaran. The purpose of this research is to explain the implementation of land acquisition for Development of Bendung Slinga in Banjaran Village, Bojongsari District, Purbalingga Regency and explain the constraints faced and the solution. This research uses qualitative method with descriptive approach. The results show that the implementation of land acquisition for the construction of Bendung Slinga until the payment of compensation has been implemented in accordance with the prevailing regulations, namely Perpres 65/2006 and Perkaban 3/2007. Problems that occur is not complete the condition of the release of cash land Banjaran village which became the object of land acquisition. Terms of release that can not be fulfilled are village regulations, permission of the bupati, and permission of the governor. In addition, replacement land for disbursed village cash lands has not been fully controlled by the Banjaran Village Government and has not yet registered its land rights on behalf of the Banjaran Village Government. Intisari: Pembangunan Bendung Slinga di Kabupaten Purbalingga diawali dengan pengadaan tanah yang dilaksanakan pada tahun 2009 dan 2010, Namun proses pengadaan tanahnya belum selesai pada tahap sertipikasi hak atas tanah, terutama objek yang berasal dari Tanah Kas Desa (TKD) Banjaran. Tujuan dari penelitian ini adalah untuk menjelaskan pelaksanaan pengadaan tanah untuk pembangunan Bendung Slinga di Desa Banjaran, Kecamatan Bojongsari, Kabupaten Purbalingga dan menjelaskan kendala yang dihadapi dan solusinya. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa pelaksanaan pengadaan tanah untuk pembangunan Bendung Slinga sampai dengan pembayaran ganti rugi telah dilaksanakan sesuai dengan peraturan yang berlaku, yaitu Perpres 65/2006 dan Perkaban 3/2007. Permasalahan yang terjadi adalah belum lengkapnya syarat pelepasan TKD Banjaran yang menjadi obyek pengadaan tanah. Syarat pelepasan yang belum dapat dipenuhi yaitu peraturan desa, izin bupati, dan izin gubernur. Selain itu, tanah pengganti untuk tanah kas desa yang dilepaskan belum sepenuhnya dikuasai oleh Pemerintah Desa Banjaran dan belum didaftarkan hak atas tanahnya atas nama Pemerintah Desa Banjaran. Foreign investment in Indonesia in the plantation sector has a positive impact on national development. The need for encouragement and support in the plantation business by creating policies,which one is able to increase foreign investment in the plantation business. The purpose of this research is to analyze from the perspective of the prevailing law in Indonesia and to find out the factors that hinder the restriction of foreign investment in the plantation sector. This study uses a normative juridical method, namely by using a qualitative approach. The conclusion of this study is that the mechanism for limiting foreign investment in the plantation sector is regulated in Law Number 25 of 2007 concerning Foreign Investment and Law Number 39 of 2014 concerning Plantations, where these regulations must be considered by foreign investment in investing in plantation sector in Indonesia. The factors that hinder foreign investment are the usual business actors bribing State officials, the problem of being limited to opening a business entity because the land acquisition process is too long.

Land acquisition in Bangladesh for development activities is considered a critical issue. This study attempts to explore the existing scenario of the governance in the land acquisition process at Shreehatta Economic Zone, Moulovibazar, Bangladesh. This study is based on both the primary and secondary sources of data. The primary data was collected from 55 respondents which include both administrative officials and the project affected people and the secondary data was collected from different renowned journals, official documents of the administration, newspapers, and other relevant sources. The study reveals that there exists malpractices in the land acquisition process, where project-affected people do not get fair compensation and they are forced to pay bribe for getting compensation. In spite of having national and international guidelines for land acquisition, officials unethically acquire the agricultural land by misusing their discretionary power which leads the project affected people to more vulnerability.

This article discusses the implementation of community participation in compensation for road widening in Praya City, Central Lombok Regency. The land acquisition process does not involve the community given an active opportunity, so that input and support in the implementation of land acquisition. Not optimal. Other consequences, lack of public information on the process of land acquisition activities, and implementation of compensation. This study is an empirical normative study using a statutory, sociological, philosophical approach, and analyzed descriptively qualitatively. The results of this study indicate that the implementation of community participation in compensation for road widening in Praya City has been carried out based on the provisions of Law Number 2 the Year 2011. In a justice, perspective raises differences of opinion based on the point of view where judging the justice side, from substantive truth and procedural fairness. Barriers to the implementation of community participation in Praya City are conflicts that occur between communities but can be resolved by deliberation.Artikel ini membahas tentang pelaksanaan peran serta masyarakat dalam pemberian ganti rugi pelebaran jalan di Kota Praya, Kabupaten Lombok Tengah. Proses pengadaan tanah tidak melibatkan masyarakat secara diberi kesempatan aktif, sehingga masukan dan dukungan dalam penyelenggaraan pengadaan tanah tidak maksimal. Akibat lain, kurangnya informasi masyarakat terhadap proses kegiatan pengadaan tanah serta pelaksanaan pemberian ganti rugi. Penelitian ini merupakan penelitian normatif empiris menggunakan pendekatan perundang- undangan, sosiologis, filosofis, dan di analisis secara deskriptif kualitatif. Adapun hasil penelitian ini menunjukkan bahwa penyelenggaraan peran serta masyarakat dalam pemberian ganti rugi pelebaran jalan di Kota Praya telah dilaksanakan berdasarkan ketentuan Undang-Undang Nomor 2 Tahun 2011. Dalam perspektif keadilan menimbulkan perbedaan pendapat berdasarkan sudut pandang mana menilai sisi keadilan, dari sisi keadilan substantive dan keadilan prosedural. Hambatan pelaksanaan peran serta masyarakat di Kota Praya adalah konflik-konflik yang terjadi antar masyarakat akan tetapi dapat diselesaikan dengan musyawarah.

Land acquisition for generic interests can be made through two systems, namely the release of authority over land and cancellation of authority over land. However, the State must provide consequences in the form of compensation (consignment). This research covers the land acquisition process for public interest according to Law Number 2 of 2012, as well as to find out the procedures for depositing compensation (consignment) for public interest in court in the context of land acquisition. The research method used is normative legal research and problem approach by examining statutory regulations. The results showed that in Law no. 2 of 2012 there is a procedure for providing land which includes the process of planning, preparation, implementation and submission of results. Then, regarding the custody of compensation in court, there are 7 procedures such as the application must be submitted in writing in Indonesian, signed by the applicant and attached with supporting documents for the collector to pay the down payment through the bank, completed with applicant registration, negotiation of repayment, termination and reserve of compensation money. as well as revocation of compensation money.

In 1988, PT. BMS Acquired Cultivation Rights Title (CRT/HGU) for 6.925 acres in Kabupaten Rejang Lebong. The land acquisition process after CRT has been given through land relinquishment, however PT. BMS only able to relinquish people’s land for 2.046 acres. This condition caused uncertainty of land rights upon community. Later on, the condition caused overlapping of land ownership and authorization of PT. BMS CRT, ended by the reclaiming and cancellation upon the land right. Formal legal perspective and descriptive analytic study describe several issues related to the constraints of the right and status of land for the farmers. This study found some fundamental issues, first related to objects of CRT as state land. Legally, it was considered flawed because the company only released less than half of the rights, triggering reclaimings by the residents who assumed that it was their land. Therefore, the state should seek ways to strengthen the rights of peasants with the scheme of redistribution or the reinforcement of the right to avoid land right conflicts. This review offers main alternative policy solution scheme: Redistribution, the granting of a Right License, or a plasma core plantation scheme. Pada tahun 1988, PT BMS memperoleh Hak Guna Usaha seluas 6.925 Ha di Kabupaten Rejang Lebong. Proses perolehan tanah HGU-nya lewat pembebasan lahan masyarakat, namun PT BMS hanya mampu membebaskan tanah masyarakat 2.046 Ha sehingga menimbulkan ketidakpastian hak atas tanah masyarakat. Kondisi tersebut kemudian mengakibatkan terjadinya tumpang tindih pemilikan dan penguasaan tanah pada areal HGU PT BMS yang berakhir dengan reklaiming dan pembatalan hak atas tanah. Perspektif legal formal dan deskriptif analitis kajian ini menjelaskan beberapa hal terkait kendala kedudukan hak dan status bagi petani penggarap. Kajian ini menemukan beberapa hal mendasar, pertama terkait obyek HGU sebagai tanah negara yang cacat hukum karena perusahaan hanya membebaskan kurang dari separo hak yang diberikan, sehingga menimbulkan gelombang reklaiming oleh warga yang merasa lahan tersebut adalah miliknya. Oleh karena itu, negara semestinya berupaya memberikan penguatan hak bagi petani penggarap dengan skema redis atau penguatan hak untuk menghindari konflik ketidakpastian hak garapannya. Kajian ini menawarkan skema solusi alternatif kebijakan utamanya: Redistribusi, pemberian Surat Izin Hak Garap, atau skema perkebunan inti plasma.
