LABOR REFORM: precarious work and the challenges for unions

The paper proposes to identify the initial impacts of the labor reform on trade unionism, in a context that is unfavorable to workers and to collective action, resulting from the transformations in the reconfiguration of the working classes, with the growth of precariousness and crisis of the labor market. The analysis focuses on the impacts of this reconfiguration of the working classes and the fragmentation of trade unions, as well as the impacts of the labor reform on union strategies and actions and on collective negotiation. The methodology combined quantitative labor market research with documents (collectives work contracts, commercial and trade union press materials) and participant observation. The results show that the trade unions are searching to adapt to the new context with some substantive innovations in action and organization. The latest negotiations have been, at the same time, spaces of resistance and legitimization of the content of the reform.

Key words: Trade unionism; Labor reform; Precariousness; And collective bargaining

ABSTRACT This discussion seeks to discuss the impact of Law 13467/2017 on trade unionism, regarding the prohibition of deduction or collection without the prior and express consent of the worker and the voluntariness of its occurrence. Thus, from a historical context, the essence of the creation of the union contribution is sought, a greater understanding of the effects of the reform on the subject, in order to make the contribution optional, and if specifically to the workers, this faculty can contribute to freedom of association in Brazil, and, on the other hand, there is a problem of financing trade unions and, consequently, the defense of the workers themselves. It will also be sought to find out whether the union uniqueness imposed by the 1988 Constitution could harm Convention No. 87 of 1948 which deals with freedom of association. And if the amendment promoted by the Labor Reform can bring the unions closer to the workers, influencing the agreement with the discount of the union contribution.KEYWORDS: Law 13467/2017; Trade Unionism; Union Contribution; Labor Reform; Freedom Of Association.

This chapter explores the challenges of developing trade union responses to immigration at the European level. The issue of immigration is exacerbated at the European level by the search for a common framework of meaning and initiatives in the context of different national experiences and responses. This chapter draws on interviews with trade union officials at the European level and participant observation of initiatives around immigration to consider the way in which trade union policy on immigration has developed. Our research demonstrated that initiatives in European trade unionism were mainly aimed at increasing awareness of the issues surrounding immigration and to share and develop 'good practice' responses in trade unions and to benchmark these responses. One initiative that we document, ETUC's Workplace Europe project.

The process of proletarianization and its role in the shaping of working class consciousness has captured the attention of French social historians over the last ten years. Until recently, works on French labor history generally neglected the formation of the working class to concentrate on the origins of national working-class parties or trade unions; thus, general histories of the political ‘workers’ movement' abound, to the detriment of occupational or regional studies. As early as 1971, Rolande Trempé's thèse asserted that the transition from godfearing peasant to socialistic proletarian had only just begun when a man put down his hoe and took up a pickaxe. In Les mineurs de Carmaux, Trempé showed the evolving social and political conditions which led coalminers in southwestern France to espouse trade unionism and socialism. The recently published thése of Yves Lequin, Les ouvriers de la region lyonnaise, provides another benchmark in the study of nineteenth-century working class history. Lequin reveals that, for the pre-1914 period in the Lyonnais region of France, the dynamics of proletarianization were more important in promoting worker militancy than its end result, the appearance of an industrial proletariat.

We examine the effects of and the incentives for increasing input efficiency within a spatially segregated Cournot duopoly with monopoly trade unions whose utility functions depend on both wages and employment. We show that with neoclassical as well as Leontief technology, unions raise wages to appropriate fully the gains from labor-saving technological (or organisational) improvements, leaving the firm with no incentive to invest in increasing the efficiency of workers. However, capital-saving technological improvement may be profitable depending on the elasticity of substitution. Finally, we examine the implication of a fixed minimum wage (or competitive labor market) in one country.
