Abstract As a novel market-based water-saving mechanism, the Water Saving Management Contract (WSMC) project faces interruption risk caused by emergencies like the coronavirus disease-2019 (COVID-19) pandemic. An interruption risk assessment model of WSMC projects is established through a quantitative evaluation of the impact of emergencies on water users based on input-output theory. First, the concept of the interruption risk index (IRI) is defined as a function of the duration of enterprise shutdown (DES). Second, the DES is divided into two parts: the duration caused by COVID-19 and the that under other types of emergencies. Third, the risk tolerance threshold is given to estimate the interruption result, and its different consequences are discussed. Finally, a WSMC project in China is taken as a case study, and its interruption risks are analysed. The results show that the IRIs of this WSMC in both 2020 and 2021 are theoretically greater than the risk tolerance thresholds, and the high pandemic prevention standards and conservative pandemic estimates are the main reasons for the above results. The model established in this study provides a reference for WSMC participants to deal with emergencies and provides the theoretical support for the extension of the WSMC.

Flexibility of the employer’s ability to manage human resources during the several-month “lockdown” due to the COVD-19 pandemic has proven crucial to the survival of a Slovak company. However, this flexibility, unlike other contractual relationships, is strictly regulated by the Slovak Labor Code. Given the scope of the problem, the paper focuses only on issues related to the possibility of creating and changing employment in the Slovak Republic, which must be addressed by the management of all companies. The main purpose of the study is to assess flexibility in creating and changing employment. In processing this managerial issue, analysis, synthesis, deduction, and comparison are used. It was found that the Slovak Labor Code is flexible enough and fulfills its purpose. Despite its flexibility, it also provides an employee with the necessary protection in employment relations and allows him, in agreement with an employer, to grant more rights than he himself guarantees. However, in the current information age, it does not allow for electronic conclusions of legal acts and still prefers the paper form. Another disadvantage is the finding that it does not regulate the institute of a management contract, which objectively causes problems between the employer and the manager, especially in the issue of stability of a managerial position.  AcknowledgmentThis scientific paper was created within the project VEGA [1/0320/21] “The Role of Universities in Building the Knowledge Economy” and was supported by funds from Comenius University in Bratislava, Faculty of Management.

Energy saving income distribution mode is of great significance to the energy industry. With the continuous application of new technologies, the problem of excess energy saving income distribution has become one of the obstacles to the appreciation of energy performance. At present, the distribution of risk and income is mainly based on the contribution of risk and income, which has some limitations. The benefit distribution of energy saving negotiation between energy saving service companies and clients can be regarded as a bargaining process where an effective range satisfying both parties can be obtained. This provides a new perspective in solving the problem of excess energy saving income distribution in energy management contract projects.

ObjectivesThe aim of this study was to explore the extent of implementation of the General Medical Services 2018/2019 ‘frailty identification and management’ contract in general practitioner (GP) practices in England, and link implementation outcomes to a range of practice and Clinical Commissioning Group (CCG) factors.DesignA cross-sectional study design using publicly available datasets relating to the year 2018 for all GP practices in England.SettingsEnglish general practices.DataThe analysis was conducted across 6632 practices in 193 CCGs with 9 995 558 patients aged 65 years or older.OutcomesFrailty assessment rates, frailty coding rates and frailty prevalence rates, plus rates of medication reviews, falls assessments and enriched Summary Care Records (SCRs).AnalysisSummary statistics were calculated and multilevel negative binomial regression analysis was used to investigate relationships of the six outcomes with explanatory factors.Results14.3% of people aged 65 years or older were assessed for frailty, with 35.4% of these—totalling 5% of the eligible population—coded moderately or severely frail. 59.2% received a medications review, but rates of falls assessments (3.7%) and enriched SCRs (21%) were low. However, percentages varied widely across practices and CCGs. Practice differences in contract implementation were most strongly accounted for by their grouping within CCGs, with weaker but still important associations with some practice and CCG factors, particularly healthcare demand-related factors of chronic caseload and (negatively) % of patients aged 65 years or older.ConclusionCCG appears the strongest determinant of practice engagement with the frailty contract, and fuller implementation may depend on greater engagement of CCGs themselves, particularly in commissioning suitable interventions. Practices understandably targeted frailty assessments at patients more likely to be found severely frail, resulting in probable underidentification of moderately frail individuals who might benefit most from early interventions. Frailty prevalence estimates based on the contract data may not reflect actual rates.

Abstract At the moment, two trust-like constructions co-exist in the law of Ukraine – the institution of property management and trust property. The article analyses the positions of well-known Ukrainian lawyers on the place of these legal structures in the civil law of Ukraine, as well as possible ways in which they might be further development. The author defines the concepts and researches the features of the institution of property management and trust property, establishes their common and distinctive features, and also emphasises the fundamental difference between it and the institution of trust, which exists in the common law. Particular attention in the article is devoted to defining the concept and specifics of securities management as a specific subject of civil law. The definition of the term ‘securities management contract’ and its characteristics are analysed.

Green building practices play an important role in achieving sustainability, especially in the construction industry. Green buildings are built to minimise the impact on the environment while reducing the impact of the building on the occupants. Unfortunately, the focus is on building green rather than in its maintenance. Correspondingly, Total Productive Maintenance (TPM) is a tool that has been promoted for its simplicity and the advantages of maintaining a delivery system. It assures the maintenance effectiveness of each industry, such as improving project quality, reducing waste, reducing production costs, increasing hardware accessibility and enhancing organisational support conditions. Meanwhile, procurement is considered to be the key to strengthen the maintenance operation of the construction industry. This study adopts the TPM concept for the maintenance of green buildings in Malaysia and aims to present the TPM concept for the maintenance of green buildings, and to establish the best procurement to adopt TPM for the maintenance of green buildings in Malaysia. This study has employed a qualitative approach where face-to-face and telephone interviews have been adopted. Interviews have been conducted with seven prominent respondents who possess more than 5 years of experience in green building maintenance. Content and thematic analyses have been used to analyse the data that are collected from the interviews; findings show that most of the respondents agreed that TPM could be adopted in the maintenance of green buildings. It has also been identified that for a public project the most appropriate procurement method is the facilities management contract whereas for private project the most popular procurements for green building maintenance are the lump sum contract, out-tasking contract and term contract. The results of this study provide practitioners with a new insight into the impromptu creation of a total productive maintenance concept that could improve the current building maintenance sector.

Jouska is an independent financial advisory company that provides offline and online consulting services that recently went viral in social media and had a strong brand image as a financial consultant related to today's needs. In July 2020, social media was outraged by the complaint, which claimed to have been harmed by them, because Jouska allegedly directed their clients to determine an Investor Fund Account Management Contract (RDI) with PT Mahesa Strategies Indonesia, whose shares are affiliated with Jouska. However, during the development, the client experienced a significant loss in the shares. This situation turned out to be similar complaints from other clients until Jouska underwent a crisis that led to the government's blocking, and the case ended in the realm of law. This study aims to analyze the communication that presents Image Restoration Theory through a lens. The method used in this research is descriptive qualitative, and it was found that Jouska did not yet have a clear SOP for communication with clients and had not implemented crisis management appropriately. There are several recommendations that Jouska can achieve to restore public trust, including collaborative action with various parties, building a communication strategy, and optimal media relations.
