The Ruling on Aborting the Fetus and Its Effect on Inheritance: A Comparative Study between the Four Sunni Schools, Indonesian Law and Malaysian Law

Abortion is an act of killing to life which is forbidden in Islam. Abortion gives rise to differences of view among past and contemporary scholars on its enabling and prohibition. So, this study is to examine the views of scholars and laws in Indonesia and Malaysia related to abortion and its impact on inheritance ownership. This situation affects the inheritance of property to the mother from the aborted baby. The method of this study is qualitative descriptive. The approach of this research method is descriptive of content through literature. Books, journals, newspaper clippings, and legal regulations are the premier references to this study. This study finds that there are similarities and differences between sharia law and the rules applied in Indonesia and Malaysia. In terms of similarities, Islamic law and the laws in Indonesia and Malaysia provide for the prohibition of abortion. But, in certain circumstances, the fetus can be aborted for certain reasons, such as harming the mother or for medical reasons. In addition, this study found differences in punishment for women who had an abortion for no valid reason. Therefore, this study reveals the harmonization of Islamic law with the laws conducted in Indonesia and Malaysia. So, this study recommends forming a better in-depth study of efforts to harmonize the larger Islamic law to the rules regulated in Muslim countries.

The Role of Financing Higher Education in Nigerian Universities in Achieving Sustainable Development

The current study aims to identify the role of financing higher education in Nigerian universities in the state of Kano and its impact on sustainable development. The study problem lies in the low funding of higher education in Nigerian universities, which will negatively affect the sustainability of higher education and sustainable development. The importance of the study is highlighted by highlighting the importance of financing higher education in Nigerian universities and the sources of obtaining this funding as one of the most important factors through which students can complete their studies. The study followed the qualitative approach with the aim of obtaining more accurate information about traditional higher education financing sources and its impact on the sustainability of education and achieving sustainable development. The study population reached the number of three Nigerian universities, which are a governmental, federal and private university, to learn about the impact of financing higher education in Nigerian universities on sustainable development. The sample of the study was about three out of five of those responsible for financing higher education in Nigerian universities. Also, the study followed unstructured or open interviews in order to obtain more information about financing higher education and whether or not it is suitable for the idea of a monetary endowment. The results of the study showed that the sources of financing for higher education in traditional Nigerian universities are varied, including what can be obtained through the endowment and donations fund that can be made through community initiatives, and the results of the study also indicated that the idea of a monetary endowment faces great challenges in its application, so the idea is subject to acceptance and rejection. According to the nature of the university and the nature of the subjects taught. The study recommended the necessity of expanding the study of the impact of financing higher education in Nigerian universities by expanding the scope of study to include all Nigerian states.

Factors Influencing Online Shopping Among Residents in Lasanod Somalia

Due to the advancement of technology, many businesses moved from physical locations to online businesses where they do business online. The objective of this paper is to investigate the factors affecting online shopping behavior among residents of Lasanod Somalia. This paper used a quantitative research approach. Data were collected from residents of Lasanod Somalia through questionnaires. 160 questioners were collected from respondents who were selected using a simple random sampling technique. The results showed that factors such as trust, firm reputation, functionality, privacy, reliability, and firm value have an influence on consumers’ online buying behavior. The study found out there is a strong positive correlation between trust and firm reputation with an R-value of .612 and a significant level of .000 which is way below 0.01. This research focused on Lasanod city and cannot be generalized to the whole of Somalia. Furthermore, the sample size was not large.

Al-Qāḍī ʻIyāḍ and His Method in Studying the Noble Hadith: “A Book with Bughyah Al-Ra’id Lima Tadammanahu Hadith Ummi Zar’ min al-Fawa’id The Pioneer Endeavour for Benefits in Ummi Zar’s Report”: As an Example

Al-Qāḍī ʻIyāḍ’s explanation of the hadith of Ummi Zara’ is considered one of the most authentic explanations and was approved by the early and later scholars. The aim of this research is to clarify the method employed by Al-Qāḍī ʻIyāḍ in the study of the noble hadith through his explanation “Bughyah al-Ra’id Lima Tadammanahu Hadith Ummi Zar’ min al-Fawa’id”. The researcher relied on the inductive approach in introducing Al-Qāḍī ʻIyāḍ and his efforts in this explanation, and the analytical approach in order to highlight Al-Qāḍī ʻIyāḍ’s innovative methodology, which distinguished this explanation from others. The research concluded that Al-Qāḍī ʻIyāḍ established the rules of a new approach in dealing with the religious text, based on comprehensiveness and integration, which explains his extraction of a huge number of jurisprudential and Arabic issues, with unique investigations and wonderful references.

The Role of Senior Management in Public Shareholding Companies in the Telecommunications Sector in the United Arab Emirates in Supporting the Internal Audit Unit

Internal audit has become one of the most important means of organizations controlling tasks and achieving objectives. As the internal audit is an important activity for the organization to achieve its goals, adhere to regulations and legislation, and reduce cases of fraud, financial and administrative corruption. Therefore, the research aims mainly to identify the role of senior management in public shareholding companies in the telecommunications sector in the United Arab Emirates in supporting the internal audit unit. The study population consisted of 3 public shareholding companies in the UAE. To achieve the objectives of the research, the research relied on the analytical research method and the comparative research method, and the analysis of secondary data obtained from performance governance reports, and the most important findings of the research: There is administrative support for internal audit units by the boards of directors of public shareholding companies in the telecommunications sector in the United Arab Emirates And administrative support includes the five forms: planning, organizing, directing, leadership, motivating and controlling, and there is appropriate independence for the internal audit units, and the boards of directors take and implement the observations of the internal audit units.

Quality of Academic Life during COVID-19 Pandemic as Perceived by Taibah University Students

The current study aimed to identify the quality level of academic life during COVID-19 pandemic from students' perception of Taibah University, Yanbu branch. To this end, a descriptive approach was used to answer the following main research question: What is the quality level of academic life during COVID-19 pandemic from students' perception of Taibah University? The study tool consisted of a questionnaire to measure the quality level of the students’ academic life. The tool was ensured for reliability and validity and composed of three sections that contained indicators to measure the quality of academic life; academic practices, academic satisfaction, and academic support. The sample of the study consisted of 187 male and female students. Results showed high perceptions for the respondents in the quality of academic practices section (M=4.15, SD=1.03). The statement No.9 entitles “Rate the precautionary actions provided to you to activate the online education as an alternative to face-to-face education during COVID-19 pandemic” obtained the highest rank (M=4.63). The second section that measured the level of academic satisfaction recorded (M=1.76, SD=1.10), obtaining 58.71%. The statement 6 entitles “I felt my love to home increased during COVID-19 pandemic” obtained the highest rank (M=4.63, SD=.81, 98.93%). The academic support dimension recorded (M=4.33, SD=.93), Indicating that the level of academic support for students during COVID-19 pandemic was excellent (86.65%) as perceived by the study sample. The statement 5 which entitles “Rate the extent to benefit from academic counseling during COVID-19 pandemic” got the highest rank (M=4.67, SD=.72, 93.485). The most challenges encountered the students gradually categorized from the highest to the lowest were the poor Internet network, non-availability of laptop computers, low experience in working with blackboard, and poor technical experience. The study recommended the significance of academic support and suggested doing further studies on and the reality of quality of academic life from faculty members perspectives and the role of precautionary health during COID-19 pandemic to enhance the national loyalty for the university students.

Prinsip-Prinsip Perundangan Islam: Konsep Dan Aplikasinya Dalam Pentadbiran Pandemik Covid-19 Di Malaysia

Prinsip-prinsip perundangan Islam merupakan di antara faktor yang menyumbang kepada pencapaian Maqasid Syariah. Ia berkesan merealisasikan Islam sebagai satu sistem kehidupan yang unggul dan sempurna. Hal ini kerana setiap peraturan undang-undang yang digubal bukan sahaja berasaskan jaminan kemaslahatan, bahkan juga penolakan mafsadah daripada masyarakat. Ketika situasi negara Malaysia adalah membimbangkan ekoran pandemik Covid-19, kerajaan telah mengambil pelbagai inisiatif dan tindakan dalam usaha memutuskan rantaian wabak. Dalam kajian ini, terdapat lima pentadbiran pandemik pada tahun 2020 telah dianalisis menggunakan prinsip-prinsip perundangan Islam. Data-data dari (Kementerian Kesihatan Malaysia), (Majlis Keselamatan Negara), (Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia), (Kementerian Pendidikan Malaysia) dan (Jabatan Kehakiman Syariah Malaysia) telah dihimpun secara induktif serta dianalisis menggunakan pendekatan analisis kandungan. Hasil kajian menunjukkan bahawa kerajaan Malaysia telah pun menerapkan dengan baik prinsip-prinsip perundangan Islam sekaligus mencapai maqasid syariah yang paling utama. Kajian lanjutan perlu dilaksanakan bagi menyatukan sokongan masyarakat terhadap agenda perlindungan keselamatan rakyat dan negara. Pembangunan Digital Solat Ketika Sakit: Sorotan Literatur Sistematik di Malaysia

Pembelajaran dan pengajaran solat memasuki dimensi baru apabila kepesatan pembangunan teknologi maklumat dimanfaatkan sepenuhnya. Kajian mengenai solat juga dilihat semakin luas apabila skop kajian mengenai perlaksanaan solat ketika sakit mendapat tempat dalam kalangan pengkaji tempatan yang berkolaborasi antara satu bidang dengan bidang yang lain. Kajian ini bertujuan untuk melihat objektif, reka bentuk dan kandungan aplikasi digital dalam kajian-kajian yang pernah dijalankan bagi menyesuaikan kajian pembangunan pendidikan kesihatan digital solat pesakit. Bagi mencapai objektif kajian ini, satu tinjauan literatur sitematik dijalankan. Sebanyak 422 artikel, tulisan dan kajian yang telah ditemui yang membincangkan mengenai perlaksanaan modul solat. Saringan dan analisis dijalankan bagi melihat kriteria yang diperlukan dalam kajian pembentukan aplikasi digital solat pesakit yang dijalankan. Hasil tinjauan literatur sistematik mendapati sebanyak enam kajian secara khusus pernah dijalankan dalam membangunkan aplikasi digital solat dalam keadaan sakit melalui modul solat yang direka bersesuaian dengan situasi sasaran objektif kajian masing-masing.

From this point of view, this study came to discuss a topic that is much needed in every time and place, and it has to do with the purposes of Sharia, which is the jurisprudence of Benefits and Evils, and to highlight some of the efforts of one of the prominent Islamic scholars, and his contributions to it, as the scholars of the religion in his time and beyond agreed to testify to him with firmness in knowledge and integrity and contributes to the Sharia a great contribution, and he is Imam Abu Al-Fath Taqi Al-Din Muhammad Ibn Daqiq Al-Eid, died in the year: 702 AH. This topic dealt with the study of the jurisprudence of Benefits and Evils through the explanation of Ibn Daqiq al-Eid in his book, Explanation of Knowledge of a Hadith from the shortest sayings of the Prophet (peace and blessings of Allah be upon him), which of many principles and rulings of Islamic Shari'ah revolves on it. The study clarified some of the important aspects that are closely related to this science, especially the benefits and evils and the rules related to them, and the very important applications that branched from them for Ibn Daqiq al-Eid, and precise benefits associated with them.

A Review of the Criminal Procedure System and its Causes A Model Study on the Arab Countries

Reconsideration is one of the methods of extraordinary objection to the final judgments, i.e. those that have acquired the authority of the res judicata and become unobjectionable by appeal or cassation, and it is one of the regular means granted to litigants by virtue of which they can file a lawsuit for the damage they have suffered as a result of a judgment or decision. In their interest, and in this sense, it is a license granted by the system to the litigants to show the defects of the judgment issued in the case and to demand the competent judiciary to cancel it or amend it in a way that removes its defects. Some laws and regulations in Arab countries call it reconsideration, others petition, and the other retrial. With these different names, it became clear to the researcher, after studying these means, especially in the statutory reasons and justifications that their existence requires to object accordingly to reconsider a decision or a judicial ruling issued in the interest of the objector to obtain a decision or a judicial ruling in his favor, and he found that there is a problem in some of them, which It lies in the fact that only the litigants have the right to use it, so no objection is accepted from another person who is not a party to the lawsuit. Therefore, the researcher in this study will shed light on it through the use of the inductive and descriptive approach in order to show its importance in achieving judicial justice, which guarantees the litigants to resolve the dispute between them by reconsidering the final ruling, in order to arrive at a new ruling that expresses the desired truth, and he divided it into two sections, The first is a definition of the concept of reviewing the system of criminal procedures and its legal nature, and the second of the reasons for which litigants may request a review of the system of criminal procedures based on the final rulings and the legal nature of these reasons.
