Introductioan: Indonesia is a country that upholds the protection of human rights . One of the human rights pillars of concern for Indonesia is legal protection for Persons with Disabilities.Purposes of the Research: The study aims to determine whether the national regulations in Indonesia have accommodated the implementation of the Right to Work in accordance with Article 27 of the Convention on the Rights of Persons with Disabilities (CRPD) and the availability of regulation at the regional level, especially in Ambon as a form of protection for the Disability Right to Work.Methods of the Research: This research was conducted using normative methods. The results of this study were presented in a descriptive analysis report.Results of the Research: The results showed that the Act and regulations in Indonesia have not been maximal in providing protection for workers with disabilities because not all rights in Article 27 of the CRPD were regulated in national regulations. Relating to the protection of the right to work for persons with disabilities in the city of Ambon, there was no district regulations.

Revista da Faculdade de Direito da UFRGS, Porto Alegre, n. 38, p. 220-233, ago. 2018. RESUMOABSTRACTConquanto não haja previsão explícita no ordenamento pátrio, o direito à felicidade tem sido estampado em diversas decisões judiciais como desdobramento do princípio da dignidade da pessoa humana, relacionando-se, ainda, com a concretização dos direitos sociais e dos valores sociais do trabalho, fundamentos previstos constitucionalmente. Elencado como direito mínimo e indispensável à garantia de uma existência digna, tendo como escopo a preservação, o direito ao trabalho livre e emancipador é constitucionalmente previsto, de importância reconhecida para o pleno desenvolvimento do indivíduo, tanto para suprir suas necessidades essenciais, possibilitando sua existência digna, mas também como forma de se realizar pessoal e socialmente. Este artigo visa analisar os contornos do direito ao trabalho, sua relação com o direito à busca pela felicidade e a concretude desses na realidade do indivíduo no mundo contemporâneo do trabalho. Trata-se de uma pesquisa de natureza teórico-exploratória, pautada no método de levantamento de dados por meio da técnica de pesquisa bibliográfica, e, como método de abordagem, o indutivo. A análise proposta evidencia a necessidade de se implementar políticas públicas de conscientização que prezem pela efetivação dos direitos humanos, sociais e trabalhistas, de forma a promover o direito ao trabalho digno, realizador e emancipador, que corrobore com o bem-estar do trabalhador, possibilitando, assim, a felicidade em sua plenitude, tanto coletiva como subjetiva.  Although there is no explicit provision in the country's legal system, the right to happiness has been printed in several judicial decisions as a result of the principle of the dignity of the human person, and is related to the realization of social rights and social values of work, fundamentals provided for in the Constitution. Classified as a minimum and indispensable right to guarantee a dignified existence, having as its objective the preservation, the right to free and emancipatory work is constitutionally foreseen, of recognized importance for the full development of the individual, both to meet their essential needs, enabling their existence dignified, but also as a way of achieving oneself personally and socially. This work aims to analyze the right to work contours, its relation to the right to pursuit happiness and the concreteness of both rights in person’s reality in the contemporary world of work. This is a theoretical and exploratory research guided by a data collection method through literature research technique, and as an approach method, it will be used the inductive method. The proposed analysis evidences the need to implement public awareness-raising policies that promote the realization of human, social and labor rights, in order to promote the right to decent, fulfilling and emancipatory work that corroborates the worker's well-being, thus making happiness possible in its fullness, both collective and subjective.PALAVRAS-CHAVEKEYWORDSDireito Social ao Trabalho. ABSTRAKPenelitian ini bertujuan untuk mengetahui perlindungan hukum dan konsep ideal perlindungan hukum terhadap warga negara akibat penggusuran dikaitkan dengan hak untuk mendapatkan penghidupan yang layak Metode yang digunakan dalam penelitian ini adalah metode studi kepustakaan dengan pendekatan yuridis normatif dalam bentuk deskriptif. Hasil penelitian ini menunjukkan bahwa Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum belum mampu memberikan perlindungan hukum dan memberikan penghidupan yang layak sesuai dengan amanat konstitusi Pasal 27 ayat (2) Undang-Undang Dasar Tahun 1945 menyatakan tiap-tiap warga Negara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan, terhadap warga negara sebagai akibat penggusuran.Kata kunci: perlindungan hukum; penggusuran; penghidupan yang layakABSTRACTThis study aims to determine legal protection and the ideal concept of legal protection against citizens due to evictions associated with the right to obtain a decent livelihood. The method used in this study is the literature study method with a normative juridical approach in descriptive form. The results of this study indicate that Law Number 2 of 2012 concerning Land Procurement for Development in the Public Interest has not been able to provide legal protection and provide decent livelihoods in accordance with the constitutional mandate of Article 27 paragraph (2) of the 1945 Constitution stipulating each Citizens have the right to work and a decent living for humanity, towards citizens as a result of eviction.Keywords: legal protection; eviction; decent livelihood

The use of foreign workers in Indonesia is increasingly in demand by companies. The Ministry of Manpower of the Republic of Indonesia (Kemnaker) noted that throughout 2016 there were 74,183 TKA in Indonesia). The Foreign Workers are to meet the needs, skilled and professional workforce in specific fields that cannot yet be filled by workers, Indonesia and to encourage the transfer of knowledge and technology. With the normative juridical case approach method, this study conducted to analyze how legal certainty and justice related to regulation. The 1945 Constitution of the Republic of Indonesia states that every citizen has the right to work and a decent life. Consequently, citizens have the right to receive compensation and fair treatment in employment relations and the state has the constitutional responsibility to guarantee the fulfilment of the right to work (TKI) and Foreign Workers (TKA) to create legal certainty and legal protection between them.Keywords : Legal Protection, Foreign workers, Principle of Certainty and Justice. AbstrakPenggunaan tenaga kerja asing di Indonesia semakin banyak diminati oleh perusahaan. Tenaga Kerja Asing tersebut adalah untuk   memenuhi kebutuhan, tenaga kerja yang terampil dan professional di bidang tertentu yang belum dapat diisi oleh tenaga kerja, Indonesia serta mendorong alih ilmu dan teknologi. Dengan metode pendekatan kasus yang bersifat yuridis normative, penelitian ini dilakukan untuk menganalisis tentang bagaimana kepastian dan keadilan hukum terkait regulasi. Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyebutkan bahwa setiap warga negara berhak atas pekerjaan dan hidup yang layak. Konsekuensinya, warga negara berhak untuk mendapat imbalan dan perlakuan yang adil dalam hubungan kerja dan negara memiliki tanggung jawab konstitusional untuk menjamin terpenuhinya keseimbangan hak atas pekerjaan Tenaga Kerja (TKI) dan Tenaga Kerja Asing (TKA) guna tercipta perlindungan kepastian dan keadilan hukum di antara keduanya.Kata Kunci : Perlindungan Hukum, Tenaga Kerja Asing, Asas Kepastian dan Keadilan.

Indigenous peoples were placed as second-class citizens, that have fallen behind in all aspects of life than any other citizen. In fact, indigenous people in any country has gained international legal protection through 'the United Nations Declaration the Right of Indigenous People' since 2007. In the entity, within the indigenous peoples, including women and children. The form of response to the declaration, each country develop policies in the form of regulation and followed by action programs targeting indigenous peoples. It has been over 10 years of the declaration proclaimed, but the indigenous peoples still face a lot of problems in the social, cultural, economic, political, legal, land and natural resources; not even the women and their children. This situation requires the presence of a social work profession, in which the role of professional help to acquire rights, improve the quality of life and well-being of indigenous peoples. The right to work has been recognized through artice 23(1) of the Universal Declaration of Human Right 1948. But, opportunity and participation of Person With Disabilities (PWDs) in the workforce is still a challenge in Malaysian context. Various efforts and initiatives have been continuously undertaken to secure inclusion of PWDs in the workforce. Malaysia introduced Supported Employment (SE) through Job Coach programme largely provided by the Department of Social Welfare and other Non-Govermental Organizations (NGOs) focuses on helping PWDs in securing employment in the workplace. This conceptual paper discuss about the effectiveness Job Coach to PWDs enhancing participation in the open job market. Implications of the study to the organisation in particular and to the general public at large are also examined and to be considered in order to ensure PWDs inclusion in the workplace and their well-being could be continuously and effectively promoted.

Abstract In the present study we propose to offer a series of doctrinal solutions regarding the legal analysis of the patrimonial right to use the work of the authors, under Law no. 8/1996. The importance of the approach lies in the in-depth understanding of the institution, the logical and legal motivations of the Romanian legislator’s options and the doctrinal and jurisprudential solutions in the field. Concerning the importance of legal protection of the author’s patrimonial rights, we will mention here only the argument accepted by the opinionated that social development and well-being are inextricably linked to the legal protection of intellectual creation. We assume that the individual would not be encouraged to create in the absence of legitimate protection of the creation of his intellect
