The European Court of Justice, and courts in general, were key actors in the creation of the European Union (EU). However, they cannot change major policy without political supporters to lobby and litigate for implementation. We argue that part of the resolution of this apparent paradox comes from complementing existing work on the activities of EU courts and litigants with a focus on a third actor: implementing bureaucracies, whose effect on law and politics has not been a focus of studies of EU legal development. Their calculations about whether to pay attention, lobby, and comply shape the impact of the law. Those calculations are variable and patterned; when and how bureaucracies listen to courts varies in predictable ways. We find evidence for this proposition in the case of EU health care services law, both in the secondary literature and in empirical studies of France and Spain.

Health of the population is one of the basic factors of social development. The results of empirical studies indicate a number of factors determining the level of health of the population related to access to health care services, the level of environmental pollution and the wealth of society. It must be assumed that the observed disparities in the health depend on distributions of particular determinants. The aim of the article is to assess the significance of the main factors affecting the occurrence of spatial disparities in the level of social development districts NTS-4 in terms of health of the population. The analysis was based on estimates of the Spatial Durbin Model (SDM) which takes into account the impact of neighborhood spatial units on level of dependent variable and the explanatory variables. The size of the level of social development in terms of health of the population in the study was approximate by the aggregate value of the index, which is the local component of the Local Human Development Index LHDI.


This book explores the impact of the judgments of the Court of Justice of the European Union (CJEU) outside the borders of the EU on the legal systems of countries in the European neighbourhood. Considering that ‘export’ of some of the acquis communautaire to neighbouring countries appears to be an EU policy objective, and that legal approximation provisions are included in all of the EU’s agreements with these countries, one must ask whether this objective applies also to EU case law, or only to written laws and regulations. If actual harmonization of rules and standards is desired, the rules must be interpreted and implemented similarly to how this is done in the EU. And where CJEU judgments are cited and followed in neighbouring countries, what are the factors bringing about such influence? Is it a result of these international obligations of legal approximation, or are other, more unilateral and spontaneous modes of influence of CJEU judgments at work, such as territorial extension or the ‘Brussels Effect’? We have brought together scholars from the countries involved who have each explored, documented, and analysed the extent of citing of CJEU judgments in their respective country and assessed what influence such judgments have had on their legal systems. The contributions cover the legal systems of Armenia, Azerbaijan, Georgia, Israel, Jordan, Russia, Switzerland, Tunisia, Turkey, and Ukraine, and also the Eurasian Economic Union. There are also chapters on the modes of external influence of the CJEU, and on how the CJEU uses external sources.

The present paper tackles the development of the notion of public policy in the definition of the concept of marriage. It starts from brief remarks on the case law of the Court of Justice of the European Union in the field of the right to free movement of people and of the European Court of Human Rights on the right to private and family life. Then, it analyses the uncertainties stemming from the national divergences. Further, the impact of the Coman case on the applicability of EU measures on civil judicial cooperation and on the notion of public policy is examined. Conclusively, the paper submits some considerations on the modern function of the public policy.

This chapter focuses on the European Court of Justice (ECJ), one of the three courts that make up the Court of Justice of the European Union (CJEU); the others are the General Court and the EU Civil Service Tribunal. It first provides an overview of the ECJ’s structure and functions before discussing some of its main rulings and their significance. It then considers rulings on the powers of the institutions, some key legal judgments made in response to questions referred to the ECJ by national courts, the impact of ECJ rulings on EU policy, and post-Maastricht trends in the ECJ and EU law. It also assesses the evolving political reactions towards the judgments of the Court, along with the debate over whether the member states have lost control of the process of European integration because of the ECJ’s radical jurisprudence.

This article uses a recent ruling of the High Court of Justice of England and Wales as the starting point for an enquiry into the interpretation of Protocol no. 10 to the Act of Accession 2003 and, more particularly, into its effects on requests for the recognition and enforcement of Cypriot court judgments formulated on the basis of the Brussels I Regulation. The High Court's ruling is of some significance, not only because Protocol no. 10 becomes, for the first time since its adoption, the subject matter of judicial interpretation but, also, because of its value as a test case on the European judiciary's perception of the impact of the reforms wrought by the Brussels I Regulation on the status quo ante in this field and as an illustration of the wider legal complications inherent in the participation in the European Union of a de facto divided Member State. This article also anticipates some of the arguments that the Court of Appeal and, eventually, the European Court of Justice and the European Court of Human Rights might be faced with in deciding how best to address the broader legal issues that this case raises.

У статті досліджено вплив Суду Європейського Союзу (ЄС) на впровадження і застосування Угоди про асоціацію між Україною та ЄС, що викликало безпрецедентні політичні, економічні та правові реформи в Україні. Зокрема, розглядаються конституційні виклики, які постали перед державою під час виконання Угоди в правовій системі. Крім того, досліджено два питання. Перше – ефективне впровадження та застосування Угоди про асоціацію між Україною та ЄС в українській правовій системі. Друге – сумісність і відповідність Угоди Конституції України. Проаналізовано останні політичні та правові події в Україні через призму ефективної реалізації Угоди про асоціацію між Україною та ЄС і зростання проєвропейського правового активізму в державі. На закінчення стверджується, що Угода про асоціацію між Україною та ЄС посилює пристосованість національного конституційного устрою до цілей досягнення європейської інтеграції та застосування європейських спільних цінностей в Україні. Угода про асоціацію між Україною та ЄС створила стійку інституційну та правову основу для застосування acquis ЄС (правового доробку ЄС), включаючи прецедентне право ЄС та комплексне законодавче наближення між законодавством України та ЄС. Однак інституційні реформи, які вже відбулися, не можна вважати цілком достатніми. Верховній Раді України не вдалося запровадити основні та процедурні засади для застосування та впровадження Угоди в правовий порядок України. Однак ця прогалина частково заповнюється зростаючим судовим активізмом в Україні. Вітчизняні судді вже почали посилатися на Угоду про асоціацію між Україною та ЄС і відповідні частини acquis ЄС у своїх рішеннях, тим самим закладаючи основу для регулярного застосування загальних принципів права ЄС у процесі виконання й імплементації Угоди про асоціацію між Україною та ЄС.

The past few decades of ongoing war in Iraq has had a dramatic impact on the health of Iraq’s population. Wars are known to have negative effects on the social and physical environments of individuals, as well as limit their access to the available health care services. This paper explores the personal experiences of my family members, who were exposed to war, as well as includes information that has been reviewed form many academic sources. The data aided in providing recommendations and developing strategies, on both local and international levels, to improve the health status of the populations exposed to war.

National high courts in the European Union (EU) are constantly challenged: the European Court of Justice (ECJ) claims the authority to declare national standing interpretations invalid should it find them incompatible with its views on EU law. This principle noticeably impairs the formerly undisputed sovereignty of national high courts. In addition, preliminary references empower lower courts to question interpretations established by their national ‘superiors’. Assuming that courts want to protect their own interests, the article presumes that national high courts develop strategies to elude the breach of their standing interpretations. Building on principal-agent theory, the article proposes that national high courts can use the level of (im-) precision in the wording of the ECJ’s judgements to continue applying their own interpretations. The article develops theoretical strategies for national high courts in their struggle for authority.
