Pedagogical education in a legal higher educational institution

In this paper, the role of pedagogy in higher education and its significance in the system of vocational education are analyzed. The main trends of education, including legal ones, are indicated. The paper also identifies the problems of pedagogical education and suggests ways to address them.

The article analyzes the role of free choice disciplines in the formation of universal or functional competencies, which are also called soft skills. It has been proven that mastering soft skills ensures both personal success in life and professional implementation, as well as further career growth of a modern graduate of a higher educational institution. Based on the analysis of scientific sources, the main approaches to defining the essence and classification of soft skills in the works of both domestic and foreign scientists are determined and characterized. The publication analyzes and summarizes the ways of forming soft skills among students in the practice of higher educational institutions of Ukraine. Among them: the creation of a special educational environment, the restructuring of the educational process, which is dominated by such types of learning as project, problem-based, etc.; variety of forms and methods of teaching; extracurricular system, etc. It has been proven that a cycle of selective disciplines or author's courses plays an important role in ensuring the formation of soft skills. A significant place among them is occupied by the course "Pedagogy of Success", which in the 2020-2021 academic year was chosen by applicants for the first (bachelor's) level of higher education. The course is aimed at increasing the productivity of independent educational work and a positive attitude towards it among students of higher educational institutions, equipping them with strategies of self-esteem, the formation of a positive "I-concept"; effective distribution of time (time management); search, evaluation and information processing; active reading; improved memorization; submitting your own educational achievements; communication, ways to ensure personal work ability, etc.

abstractThis paper describes a character that lived in the twentieth century and was instrumental in developing Islamic higher education in South Sulawesi.  The  role  of  this  figure  is  not  known  by the recent generations because it is not much publicized. The struggle of the figure is shown by, among  other  things,  his  achievement  as  the  first man in this area who earned a degree in religious college and his role as the founder and head of an Islamic higher educational institution. Data and information on the figure obtained through written sources and interviews with people who’ve hung out with him like his close relatives, fellow professors at university, friends in the organization and direct observations of the author of a number of activities during his lifetime. The information based on those sources is combined into a brief biography as part of a study of history. An explanation of the figure refers to the standpoint of leadership theory, particularly the nature and personality of a leader as well as his effective leadership.Keywords: Leaders, educators, Islamic Universities educational abstraktulisan ini menjelaskan seorang tokoh yang hidup pada abad dua puluh dan banyak berjasa dalam mengembangkan pendidikan tinggi Islam di sulawesi selatan. Data dan informasi tentang tokoh diperoleh melalui sumber tertulis dan wawancara dengan orang-orang yang pernah bergaul dengannya seperti kerabat dekat, sesama dosen di kampus, sahabat dalam organisasi dan pengamatan langsung penulis terhadap sejumlah aktivitas tokoh semasa hidupnya. Informasi berdasarkan sumber-sumber itu dipadukan menjadi suatu biografi singkat sebagai bagian dari kajian sejarah. The study provides an insight into administrative and legal aspects of licensing higher educational institutions, analyses changes in the licensing system of higher educational institutions and examines measures aimed at nhancing the role of this institution in addressing the problem of quality assurance of higher educational institutions. The author investigates the legal nature and administrative aspects of licensing in higher education and proves that licensing in higher education is an administrative procedure, which takes into account the specific nature and characteristics of the activities of an educational institution, that are stipulated by the corresponding regulatory documents. The paper determines licensing as a legal phenomenon, which means that licensing activity belongs to the system of state-executive relations, the core of which is the organizing the citizens and the legal entities’ activities in the spheres where steadfast adherence to definite requirements and certain legal behavior is expected. One of the key research questions of this paper was the ambiguity of the concept of licensing in scientific literature, which combines the norms of administrative and civil law. Social and legal functions of licensing higher education institutions with the aim of their effective functioning in social and legal environment are outlined. Further, the author identifies the characteristic features of licensing in education. This article also address the research questions of licensing in education and offers the conclusions regarding the features of licensing as a legal phenomenon. The role of licensing activity in the system of state-executive relations and its contents and constituents are determined.

The relevance of the chosen topic is determined by the importance of interaction between teachers and students in modern higher education, as well as the need to cover the psychological features of such interaction from the point of view of developing a qualitative assessment of their role and place in the educational process of a higher educational institution. The purpose of the study is to formulate psychological aspects of “teacher-student” communication within the educational space to identify methods of its regulation. The leading approach of the research is a combination of theoretical analysis of the main aspects of pedagogical interaction between teachers and students in an educational institution taking into account the main functions and tasks of each of the groups under consideration and structural synthesis of the features of this type of interaction based on psychological factors of communication on the scale of a higher educational institution. The research considers issues related to the psychological features of pedagogical interaction between teachers and students in modern higher education. Qualitative indicators of communicative relations of subjects of the educational process, in particular teachers and students, are determined. The key psychological features of pedagogical interaction in the “teacherstudent” system are highlighted, including the development of trust in the authority of the teacher, taking into account students' individual factors in the process of studying subjects within the programme, maintaining a positive psychological climate in subject-subject relations. The necessity of developing a qualitative assessment of the level of communication between teachers and students as an objective factor for further assessment of the overall level of their pedagogical interaction effectiveness and the psychological characteristics of each of the groups under consideration is emphasised. The results and conclusions of the research are of practical value both for modern applicants for higher education and for representatives of the teaching staff of modern higher educational institutions concerned with the problems of building high-quality communication among each other, taking into account the individual characteristics and qualities of each group

Problem setting. Leasing out property that is involved in educational, academic, training and production, scientific activities by the public institutions of higher education often leads to violation of the rights of other participants in educational activities. They are sure to be a result of violating the limits, established by the current legislation, of exercising the rights to leasing out property by the public institutions of higher educational. Analysis of recent researches and publications. The issues of state property lease have been studied by many scholars. Basic research in this area has been conducted by I. Spasibo-Fatieieva, O. Lipetsker, Ye.Kazarenko, V. Steshenko, M. Pronina, S. Puhinsky, T. Potapenkova, Yu.Basin, D. levenson, N. Khashchivska, N. Milovska and other scientists. Target of research. The aim of the paper is a comprehensive study and analysis of the limits of exercising the rights by the public institutions of higher education to leasing out their own property. To achieve this goal the following tasks should be solved: 1) to define the limits of exercising the rights by the public institutions of higher education to leasing out their own property; 2) to determine the legal consequences of concluding lease agreements by the public higher educational institutions in violation of current legislation. Article’s main body. The article conducts a general study and analysis of the right of the public institutions of higher education to lease property. The author emphasizes that public higher educational institutions have the right to lease out only real estate and other individually identified property. The legal consequences of concluding lease agreements by public higher educational institutions in violation of the current legislation have been studied. Conclusions and prospects for the development. Summarizing the results of the study we can formulate the following conclusions. The public institutions of higher education have the right to lease out real estate and other individually determined property in the manner prescribed by law and subject to statutory restrictions (without the right of redemption and sublease, when it does not worsen the social and living conditions of persons studying or working in the educational institution). While leasing the property, the public higher educational institution realizes primarily their own property interests, at the same time, indirectly realizing the property interests of the state. If the lease agreement of real estate and other individually determined property of higher educational institutions is recognized as invalid, it may be recognized as invalid only for the future.

Higher education as a subject of study of this article in the summer provides for the process of teaching pedagogical disciplines. When conducting seminars in a higher educational institution, the cognitive activity and creativity of students of individual methods of developing physical activity for the purpose of research. Recognition of students and creative activity of children. conversation “brainstorming”, “game activities” “round table” competition of practical works and methods of their discussion is used. It recognizes students on the basis of methods, determining the conditions for the development of culture and creativity. Specific recommendations are given. Student creativity the fact that active learning has a great influence on improvement, also identified. Results in higher educational institution to improve the process of teaching pedagogical disciplines contributes to. This article is recommended for university professors for use in seminars.

Article is devoted to consideration of questions of transformation of a modern role of the teacher of high school which changes and supplements a substantial basis of its professional competence and demands reconsideration and acceptance of new concepts. The role and the functions of the teacher connected with problems of education of youth in educational space of high school that promotes formation of communicative skills and social intelligence of competitors of higher education which of objects of influence become its subjects is characterised. It is defined that consulting preceptorship of group carries out adviser – the key subject of the socially-humanitarian influence which functions essentially differ from functions of the curator in traditional understanding. Socially-humanitarian functions and roles of adviser of groups of competitors of higher education are presented, socially-humanitarian directions and forms of its work. Status definition in educational process of an institution of higher education of student's advisers is proved, the purpose of their activity, the primary goals and functions. The conclusion, concerning modern development of the Ukrainian higher school, its European orientation which demands from teachers of performance of a certain number of roles – not as instructors and a source of knowledge and as couch, facilitator, the tutor, the moderator, the mentor and adviser of an individual educational trajectory of competitors of higher education is drawn.

Higher educational Institutions all over the world are grappling with increased student population, several domains of learning and varied disciplines and instructors with varied experiences in using instructional design technologies. The chapter focuses on how it is possible to facilitate instructional design experiences for the stakeholders in higher education for creative learning. The chapter addresses the emergence of Instructional Design Technology (IDT). The role of IDT and its importance in higher educational institutions is studied with current practices in the field. The impact that this field had made in the evolution of instructional frameworks across the different layers of tertiary educational system is studied especially with regard to improving the teaching and learning experiences of educators and students respectively. The role of Creative Learning technologies' is discussed based on the success that these systems have enjoyed in improving instructional design.

Behavioural economics have become hot topic in research and debate in last few decades. In the context of behavioural economics, it is possible to summarize resemblances and create a system based on predication and regularities of errors, by analysing consumer’s behaviour, which allows to solve issues of future process development. In paper “Applying behavioural economics in education: study of undergraduate practices of selecting educational institutions” the authors identify key factors which influence undergraduates to choose higher education institution. The purpose of this paper is therefore to identify key elements of the behavioural economics that can be used to influence undergraduate selection development in favour of higher education institution. Additionally, within the framework of the study are applied insights of behaviour economics, which help guidance general understanding of undergraduate decision making. Particularly focusing on heuristics, that undergraduates are using to ease the complexity of decision making, which can lead to systematic errors and bias. This study per se synopsizes the definite findings of developing behavioural economics, which allows to apply this knowledge to study undergraduate choice in selecting higher educational institution. In this study were used numerous methods, including literature review, interviews with representatives of higher education and behavioural economics experts and surveying undergraduates.

Purpose This paper aims to study waqf practice in Pakistan with regard to its utilisation in funding for higher educational institutions (HEIs) and investigates waqf raising, waqf management and waqf income utilisation. Design/methodology/approach The paper is based on the views of 11 participants who are actively involved in the waqf, its raising, management and income utilisation, and is divided into three subcategories: personnel of higher educational waqf institution, personnel of waqf regulatory bodies and Shari’ah and legal experts as well as archival records, documents and library sources. Findings In Pakistan, both public and private awqaf are existing, but the role of private awqaf is greater in higher education funding. However, due to lack of legal supervision private awqaf is considered as a part of the not-for-profit sector and legitimately registered as a society, foundation, trust or a private limited company. Waqf in Pakistan is more focusing on internal financial sources and waqf income. In terms of waqf management, they have firm guidelines for investing in real estate, the Islamic financial sector and various halal businesses. Waqf uses the income for developmental and operational expenditure, and supports academic activities for students and staff. Waqfs are also supporting some other HEIs and research agencies. Thus, it can be revealed that a waqf can cater a sufficient amount for funding higher educational institutions. Research limitations/implications In Pakistan, both public and private awqaf are equally serving society in different sectors, but the role of private awqaf is much greater in funding higher education. Nevertheless, the government treats private awqaf as a part of not-for-profit sector in the absence of a specific legal framework and registers such organisations as society, foundation, trust or private limited company. The waqf in Pakistan mostly relies on internal financial resources and income from waqf assets. As the waqf managers have over the time evolved firm guidelines for investment in real estate, Islamic financial sector and various other halal businesses, and utilisation of waqf income on developmental and operational expenditures, academic activities of students and educational staff, other HEIs and research agencies, it can be proved that the waqf can potentially generate sufficient amount for funding HEIs. Practical implications The study presents the waqf as a social finance institution and the best alternative fiscal instrument for funding works of public good, including higher education, with the help of three selected waqf cases. Hence, the paper’s findings offer some generalisations, both for the ummah at large and Pakistan. Social implications The paper makes several policy recommendations for policymakers, legislators and academicians, especially the government. As an Islamic social finance institution, the waqf can help finance higher education anywhere around the world in view of the fact that most countries grapple with huge fiscal deficits and are hence financially constrained to meet growing needs of HEIs. Originality/value The study confirms that the waqf can be an alternative source for funding higher education institutions whether it is managed by the government or is privately controlled.
