ResumoO artigo reflete sobre as possibilidades de formulação de uma política pública de tombamento voltada especificamente para a proteção dos sítios detentores de reminiscências históricas dos antigos quilombos, conforme prevê o art. 216, §5º, da CF. Para tanto, é organizado tópicos os quais refletem a posição do autor a respeito do processo de construção de direitos, a saber: a) negação, no qual apresenta os quilombos como um fenômeno insurgente da Modernidade e do colonialismo brasileiro; b) luta, em que trata da ação dos quilombos para se inserirem na narrativa do Estado-Nação; c) reconhecimento, o qual relaciona o processo de reconhecimento de exemplos da patrimonialidade negra como formas ressignificadoras de conceitos jurídicos clássicos, a exemplo do tombamento; d) inclusão, abordando as (re)existências das comunidades quilombolas às formas homogeneizantes do Estado Nacional. Como conclusão, sugere a necessidade do campo da patrimonialidade quilombola ser melhor desenvolvido, nomeando-se novas categorias, a partir de diálogos com as comunidades, o que proporcionará a possibilidade de formulação de novos direitos para as comunidades quilombolas, a partir do dispositivo contido no art. 216, § 5º da Constituição. A metodologia consistiu na revisão crítica de literatura e pesquisa documental em processos que tramitam junto ao IPHAN.Palavras-chave: Constitucionalismo. Patrimônio cultural. Quilombos. Políticas públicas. AbstractThe article aims to analyze the possibilities for formulating public policies of heritage concerning specially the protection of sites that bring up the historical reminiscences of the ancient “quilombos”, according to Brazilian Constitution, article 216, § 5º. The methodology consisted in a critical review of literature and documental research through proceedings submitted to IPHAN. Therefore, the work has been organized in chapters, which reflect the author’s opinion concerning the process of rights establishment, such denial, in which the “quilombos” are presented as an insurgent phenomenon of the Modernity and of Brazilian colonialismo, struggle, in which the action of “quilombos” for being accepted in the State-Nation status quo is approached, in a process of disputes and negotiations for their national identity, in 1988’s Constitution as well, recognition, in which the processes of recognizing examples of black patrimoniality are approached by reframing classical juridical concepts, such as the heritage itself e inclusion, approaching the (re) existences of “quilombolas” communities to the homogeneous ways of National State and the political and administrative phenomenon of “non decision”. As a results and conclusions, the work suggests the necessity of a better development for “quilombola” patrimoniality, by naming new categories, from dialogues with the community, bringing up the formulation of new rights to these people, concerning the article 216, § 5º of Brazilian Constitution.Keywords: Constitutionalism. GÊNERO E POLÍTICAS PÚBLICAS: DESAFIOS E PROPOSIÇÕES PARA SUPERAÇÃO DO PROBLEMA JURÍDICO DA DESCONTINUIDADE E DESARTICULAÇÃO GOVERNAMENTAL GENDER AND PUBLIC POLICIES: CHALLENGES AND PROPOSALS TO OVERCOME THE LEGAL PROBLEM OF GOVERNMENTAL DISCONTINUITY AND DISARTICULATION  RESUMO: O presente artigo volta-se a analisar a problemática referente à descontinuidade e desarticulação governamental na adoção de políticas públicas de gênero, apontadas como os principais obstáculos à consecução de uma política pública eficaz no que concerne às discriminações de gênero. Objetiva-se, a partir da análise dessa problemática, a realização de proposições não só no que tange à formatação de políticas públicas, mas também no que se refere ao difícil processo de escolha, pelo Poder Público, quanto à política que deve ser priorizada pelo Estado, com vistas a conferir maior eficácia à atuação estatal na efetivação de direitos e garantias fundamentais. A partir das proposições efetuadas, busca-se o estabelecimento de um novo caminho jurídico e, ao mesmo tempo, desburocratizado, que seja capaz de propiciar a superação dos referidos obstáculos. PALAVRAS-CHAVE: Gênero; Políticas Públicas; Descontinuidade e desarticulação governamental; Novas Proposições; Direitos e Garantias Fundamentais. ABSTRACT: This paper turns to the analysis of the problems related to governmental discontinuity and disarticulation in adopting public policies of gender, which are pointed as the main obstacles to achieving effective public policies with respect to gender discrimination. The objective is, from the analysis of this problem, to carry out propositions not only in regard to the formulation of public policies, but also with regard to the difficult process of choice, by the Government, of the policy that should be given priority by the State, with a view to give greater effectiveness to the State's actions towards the enforcement of fundamental rights and guarantees. The 1945 Constitution contain a ruling obligating the government to protect and preserve all cultural objects, manifestation of the nation’s culture, as cultural heritage.  It is conceded that the political will as reflected in regulations made from time to time on the protection of the nation’s cultural heritage are oriented towards preservation of the Indonesian identity and furthering social welfare. In reality however, cultural heritage objects are vulnerable to looting, willful destruction or lack of care. Using a juridical normative method, the author shall examine existing rules and regulation regarding protection of cultural heritage.  One important finding from this research is that low quality of cultural heritage protection is the result of low societal understanding of the importance of cultural heritage in the making of the national identity.

Liszt's Mélodies hongroises d'après Schubert, a solo piano transcription of Schubert's four-hand Divertissement à l'hongroise, provides an interesting example of the complex relationship between centers and peripheries, and between personal patriotism and public nationalism. The first transcription (S. 425, 1838–39) stands at the very beginning of Liszt's career as a “national composer,” the most significant aspect of this rather overlooked fact being Liszt's transformation of the second movement—a naive, dance-like march—into “republican” heroic music driven toward an apotheosis à la Beethoven. This heralded a new type of national genre, and Liszt deemed the march movement important enough to be published on its own in numerous versions between 1838 and 1883. Yet this Marche hongroise was not merely nationalist: it related to other, non-Hungarian identities, most notably French and Austrian. Later versions (from 1859 onward) allowed Liszt to express a progressive, liberal Hungarian identity in the face of a rising tide of chauvinism. Four transcultural readings of the work, both complementary and conflicting, follow Liszt's revisions in roughly chronological order, interpreting the work as, in turn, a nationalist reclamation of Hungarian music, a republican response to the political status quo, the construction of an Austro-Hungarian identity, and a discontinuous text in which new, modernist ideas often merge or conflict with older ones, forcing a fresh renegotiation of national identity.

In recent years prominent companies have migrated call centre services to India provoking much-publicized fears for the future of UK employment. This article challenges the widely-held assumption that offshoring voice services is a seamless undertaking, principally through an investigation of the Indian call centre labour process. This enquiry is informed initially by an analysis of the political-economic factors driving offshoring and shaping the forms of work organization to have emerged in India. A critical review of literature on call centre work organization provides a conceptual framework, through which Indian developments are analysed. Data comes from fieldwork conducted in India and a complete audit of the Scottish industry, through which UK trends can be evaluated. We conclude that the Indian industry reproduces in exaggerated and culturally-distinctive forms, a labour process that has proved problematical for employers and employees alike in the UK and elsewhere.

Further research relating to this activity and the recognition of its importance would culminate in a deeper discussion about the evaluation process of public policies, as well as in the enhancement of the state management capacity. Utilizing a literature review, this study presents key concepts related to the subject of public policies, evaluates the political aspects about the policy cycle of public policies in Brazil, and examines the importance of strengthening the evaluation of public policies in the country.Resumo: A avaliação de políticas públicas no Brasil é uma área ainda incipiente do ponto de vista conceitual e metodológico. Acredita-se que o fortalecimento desta atividade e o reconhecimento de sua importância culminariam em uma maior preocupação e discussão a respeito do processo avaliativo de políticas públicas, além de um aprimoramento da capacidade de gestão do Estado. Com base em uma revisão bibliográfica, este trabalho apresenta conceitos-chave ligados ao tema das políticas públicas, avalia os aspectos políticos do ciclo da política pública no Brasil e examina a importância do fortalecimento da atividade de avaliação de políticas públicas no País.

This paper contributes to the debate on racialized and deracialized representations of the category of indigeneity in Mexican cinematography during the Golden Age (1935–1959) as a response to the post‑revolutionary nation‑building project. Based on the analysis of representative movies of that period, I argue that the cinematography reflected indigenista public policies, aimed at homogenizing the society by incorporating indigenous people to the society as Mexicans. Insofar as the state narrative displaced the notion of indigeneity towards the “past” – as a foundation of the national cultural heritage – movie industry romanticized and exoticized the indigenous, but at the same time, it portrayed indigenous characters as submissive and even obsolete, thus perpetrating the colonial archetype of oppression. Images situated in the present, however, rejected any ethnic differentiation, and instead replaced it with a class‑based model of social interactions, but in reality the “raceless” ideal of national identity would continue to ascribe indigeneity to lower social strata.

The present article undertakes a critical review of the new book of Jean Tirole, the winner of the 2014 Nobel Prize in Economics, “The theory of cor- porate finance”, which has recently been published in Russian. The book makes a real contribution to the profession by summarizing the whole field of corporate finance and bringing together a big body of research developed over the last thirty years. By simplifying modeling, using unified analytical apparatus, undertaking reinterpretation of many previously received results, and structuring the material in original way Tirole achieves a necessary unity and simplicity in exposition of extremely heterogeneous theoretical and empirical material. The book integrates the new institutional economic theory into classical corporate finance theory and by doing so contributes to making a new type of textbook, which is quite on time and is likely to become essential reading for all graduate students in corporate finance and microeconomics and for everyone interested in these disciplines.

This article examines the development of political opposition in Scotland from 1695 to 1701 in the context of the Company of Scotland Trading to Africa and the Indies. It is argued that the potency of the political movement inspired by Darien derived from the view that King William was directly implicated in the failure of the colony. Three episodes in the Company's history—the loss of subscriptions in Hamburg, the appearance of memorials in the new world prohibiting English aid to the colony and the imprisonment of Darien sailors by the Spanish authorities—are examined in detail. The ramification of these controversies was increasingly seen as the result not of English interference, but rather the crown's refusal to act on behalf of the Company. Because a significant proportion of the population was invested in the Company, and because the press helped to keep Darien in the forefront of public consciousness, these issues transformed Darien into a major political grievance that united disparate political factions in support of a single cause. Although the alliance inspired by Darien was temporary, it, nonetheless, played a crucial role in disrupting the political status quo.
