AbstractThe goal of this paper is to establish the interplay of functionality and syntactic adaptations in the translation of legal texts. We will attempt to gain insight into the choices the translators of legal texts make and how these can be justified by the function of the target text in the legal target culture. The comparison of the syntactic means used by the text producer to achieve a particular aim and the syntactic structures the translators chose in order to transfer the source text meaning functionally into the target culture is expected to yield insight into if, how and why the translators employed (or not) the stylistic inventory of the target system.

This paper aims to account for sustainable development of different cultures in the context of globalization from the perspective of cultural functions of translation, which wield enormous power in constructing representations of the foreign culture and have far reaching effects in the target culture. According to cultural communication of translation, the major task of translation is to turn the cultural information in one language into another. Therefore, in the process of translating, the translator should try his utmost to allow his target language reader to acquire cultural information of the source text in order to promote mutual understanding between Western people and Eastern people and make different cultures co-exist peacefully and achieve sustainable development.

http://dx.doi.org/10.5007/1980-4237.2014n16p91O teórico e crítico de tradução francês Antoine Berman afirma que as traduções literárias em suas formas tradicionais e dominantes representam um ato culturalmente etnocêntrico, isto é, que traz tudo à sua própria cultura, às suas normas e valores, buscando fazer com que se esqueça que se trata de uma tradução. Para se opor a essa prática dominante, o autor propõe uma tradução que não esconda o elemento estrangeiro na obra traduzida, e que para isso seja fiel à “letra” (lettre) do original. Essa oposição é muito conhecida também nos termos utilizados pelo teórico norte-americano Lawrence Venuti, que fala em “domesticação” (domestication) e “estrangeirização” (foreignization) para se referir respectivamente às práticas tradutórias que ocultam as diferenças culturais, adaptando tudo à cultura de chegada, e àquelas que mantêm a estranheza do texto original e da cultura de partida. Interpretações mais radicais das ideias desses autores podem levar a pensar a tradução como dividida nessas duas possibilidades, e muitas vezes à escolha de uma delas como ideal e a outra como condenável. Entretanto, assim como com dicotomias mais antigas (literal x livre, equivalência formal x equivalência dinâmica, etc.), também estas não são duas categorias estanques, podendo haver diferentes combinações de ambas na tradução de um mesmo texto, além de estratégias híbridas ou soluções que não representam nem uma nem outra posição. Neste trabalho discuto a problematização dessa dicotomia, incluindo exemplos de minha tradução do italiano para o português do livro infantojuvenil O diário de Gian Burrasca, de Luigi Bertelli (Vamba).ABSTRACTFrench translation theorist and critic Antoine Berman states that in their traditional and dominant forms literary translations represent a culturally ethnocentric act, which adapts everything to its own culture, standards and values, seeking to make readers forget that they are reading a translation. To oppose this dominant practice, the author suggests a kind of translation that would not hide the foreign element in the translated work, one that is faithful to the “letter” (lettre) of the original text. A similar opposition to that / to Berman’s is also well-known through the terms “domestication” and “foreignization” as defined by American theorist Lawrence Venuti, who uses them to refer to translation practices that on one hand conceal cultural differences, adapting everything to the target culture, and on the other keep the strangeness of both source text and culture in the translation. Radical interpretations of these authors’ ideas may lead to the misconception that translation is divided into those two possibilities, and often to the judgement that one of them is ideal and the other condemnable. Nevertheless, as with other older dichotomies (literal vs. free translation, formal vs. dynamic equivalence, etc.), these are not clearly distinguishable and opposed categories. There may be different combinations of them in the translation of a text, as well as hybrid strategies or solutions that do not represent either one of them. In this paper I discuss the problems of such dichotomy, drawing examples from my translation of Luigi Bertelli’s book Il giornalino di Gian Burrasca from Italian to Portuguese.Keywords: foreignization; domestication; dichotomy.

In an electronic publication environment, a scienti¼c article can be structured more e¬ectively and e~ciently if it is presented as a coherent collection of well-characterized and explicitly linked modules, rather than as a traditional linear essay. In a linear printed article, the abstract primarily ful¼lls a selection and substitution function. In a network of modular electronic articles, the abstract is primarily an orientation tool providing insight into the ½ow of the discourse. In order to ful¼ll this function, the abstract must provide a balanced representation that explicitly refers, in the informative mode, to the main stages in the problem-solving process. The orientation can be facilitated by hypertext links that connect phrases of the abstract to the related modules, enabling the reader to switch smoothly between the abstract and its source text. Each link has to carry a label that informs the reader about the speci¼c relationship between the phrase at hand and the module referred to.

AbstractThe present study aims to gain insight into the translation of audiovisual humour displayed in the verbal manifestations of Officer Crabtree, the fictional character in the BBC sitcom ‘Allo ‘Allo! (1982–1992), especially focusing on its Hungarian dubbed version of the series. Being a research domain with insights from audiovisual translation (AVT), humour studies, and discourse analysis, the article introduces the reader to AVT, more particularly, to dubbing, to research carried out in the domain of audiovisual humour, and to humour studies, especially focusing on incongruity and superiority theory. These theoretical elements are applied in the analysis of the corpus comprising the English voice track as source text (ST) and its Hungarian counterpart as target text (TT), highlighting the humorous effects achieved in both of them and especially pointing at the creative solutions translators resorted to in rendering the idiosyncratically mangled English texts into Hungarian. The analysis aims to provide counterexamples to the frequent claim that verbal humour is untranslatable.

The aim of this paper is to examine and describe similarities and differences in the use and distribution of modal verbs by contrasting English and Serbian legal texts. The corpus consists of an English version of The Convention on the Rights of the Child and its official Serbian translation. We started from an assumption that modal verbs are more frequent in legal texts in English than in Serbian, where we expected to find examples of lexical items with modal meanings instead. In addition, we assumed that due to its specific use in legal texts of this kind, the English modal ‘shall’ will show the highest frequency of occurrence. A total of one hundred and twenty six (126) modal verbs and a semi-modal ‘need not’ were found in the source text. The results of the analysis support the initial presumption that ‘shall’ will stand out as the most frequent of all modal verbs (60% of all occurrences). Despite the high occurrence rate of the legalistic ‘shall’ in the source text, translation solutions in the target language only rarely take the form of the modal verb. Most often deontic notions of imperative directness and necessity in Serbian legislative writings are expressed by means of the present indicative. The analysis also indicates that translation solutions for the remaining English modal verbs most often take the form of a modal verb or a modal lexeme with a corresponding meaning in Serbian.

Purpose The purpose of this paper is to analyse the effects of carousel fraud on the average price of goods, as one of the negative economic aspects of carousel fraud. Design/methodology/approach This paper is primarily based on the description of selected legal cases and the modus operandi of carousel fraud, the analysis of legal texts (legislation and judgments of courts) and the discussion, from the point of view of price manipulation. Findings The results of the analysis specify the negative impact of carousel fraud in the form of the distortion of reported average prices and suggest that the authorities should monitor usual or fair prices to detect cases where there is a risk of carousel fraud. Originality/value This paper brings new insight into the issue of carousel frauds by understanding the principle of carousel fraud, the motives for it, and the possibilities for detecting this type of tax fraud, which is necessary to prevent tax evasion and to preserve a state’s income.

This paper addresses the topic of the law and legal vocabulary in William Shakespeare’s The Winter’s Tale and its Polish translations. Focus has been directed towards the trial scene of Hermione, one of the major characters of this play. By comparing the Polish renditions of the scene against the English original, the article attempts to present how Polish translators have reflected on the law as presented by Shakespeare and whether they have managed to recreate the law-embedded images and reconstruct the legal language of the source text in the target culture.

The aim of this paper is to find out the important of cultural filtering that used by translator in language translation. As we know that language and culture being inextricably interwoven, the transference of the linguistic expression is precisely an attempt to integrate elements of one culture into another. Translation, thus, becomes a cross cultural event and the translator has to formulate his translation strategies to translate source culture into target culture. To deal with these cultural problems, translator is supposed to insert cultural filter in the initial stage of understanding and analyzing codification of the source text in the first stance. Here the cultural filter helps translator in obtain various elements of source culture which cannot go as they are in the target culture because of cultural differences.

On February 9, 1965, the premiere of Kenneth MacMillan’s full-length dance adaptation of William Shakespeare’s Romeo and Juliet to a score by Russian composer Sergei Prokofiev took place at the Royal Opera House, Covent Garden. This chapter uses the figures of the three harlots in MacMillan’s ballet—characters that do not appear in Shakespeare’s play—to explore the real, practical, and pragmatic business of adaptation. The harlots, typically represented by soloists or first soloists within the ballet companies, appear prominently in the work’s ensemble scenes. As non-Shakespearean characters, they embody the gap between the source-text and MacMillan’s translation. This is a gap worth examining, offering an insight into the creative afterlife of a Shakespearean text and the infidelities that arguably constitute the success of any adaptation.

SummaryThe aim of the following paper is to examine the complementarities (and divergences) between the ‘Paleo-liberal’ Adam Smith and the Ordoliberal Walter Eucken. Following the hypothesis that Smith is among the forerunners and predecessors of Ordoliberalism and Social Market Economy, we try to provide the reader with an insight into the socio-political philosophy of Smith and Eucken pointing at similarities and differences alike. Therefore, we base our examination on a systematic primary source text analysis comparing the books and essays written by Eucken and Smith. The paper tackles these questions in two main steps: The first part highlights Smith’s and Eucken’s complex and interdependent system of natural liberty. The second section reviews Smith’s and Eucken’s philosophy of the state.
