The article is devoted to the analysis of public control as an independent direction of interaction of administrative courts with the public. It is proved that the formation of civil society in Ukraine is the basis for effective public control over administrative courts. Features of modern civil society in Ukraine are characterized. The concept of public control over administrative courts is presented as an independent direction of interaction of administrative courts with the public. The content of public control as an independent direction of interaction of administrative courts with the public is revealed. The features of public control over administrative courts in Ukraine are considered. General and special principles of public control over administrative courts are defined. Forms of exercising public control over administrative courts have been established. Methods of conducting public control over administrative courts are revealed. Problematic issues of public control over administrative courts have been identified. The ways of improving the activity of civil society in Ukraine in exercising public control over the activity of administrative courts are outlined. The ways of increasing the effectiveness of civil society interaction with the administrative courts of Ukraine are outlined. The peculiarities of the foreign experience of civilian control over the judiciary are analyzed. Ways of borrowing foreign experience in exercising public control over the activities of the judiciary are proposed. The directions of improvement of public control over administrative courts are defined.

The paper is devoted to the analysis of the limits and the possibility of using international and foreign experience of its organization and functioning in optimizing the institution of public control in the Russian Federation. The author defines the concept of public control in the Russian Federation. The necessity of using international and foreign experience in the organization and functioning of the institution of public control in the process of optimizing this institution of civil society in Russia in the following areas is substantiated: 1) regarding the formulation of the concept of the institution of civil society control over public authority; 2) in terms of its consolidation in regulatory legal acts; 3) by definition of its basic principles, goals and objectives; 4)on consolidation of the list of objects in respect of which control is exercised; 5) on the development and implementation of the main forms and methods of this control; 6) to institutionalize the diversity of its subjects, as well as their authority. In this regard, a number of amendments and additions to the current legislation of the Russian Federation regulating issues of public control are proposed. The author applies a number of methods of scientific research, in particular: historical, comparative legal, and formal logical analysis. This will not only solve modern problems that arise during the organization and functioning of public control in the Russian Federation, but also ensure its full development as a promising civil society institution. The paper proposes a number of changes and additions to the current legislation of Russia, regulating issues of public control. The results can be used both in educational and scientific, and in practical activities, including in lawmaking.

Over the latest 5–10 years, the vocabulary of Ukrainian civil society has increasingly used such concepts as «public monitoring», «public expertise», «public control». This technology is of particular importance in the context of the fact that public control is the basic component of democratic governance. European practice has various forms of such control in its arsenal, which has become a good tradition and a guarantee of democracy in the past world. Back in 2008, the Cabinet of Ministers of Ukraine, namely on November 5, 2008, by Resolution No. 976 adopted the Procedure for Assisting in the Public Expertise of the Executive Authorities Activity. This means that the establishments of civil society, can assess the effectiveness of the activities of any executive authority of Ukraine, according to a certain procedure, as well as they can carry out the procedure for taking into account the latest results of public expertise. Public expertise makes it possible to assess the activities of public authorities, as well as to influence their policies and execution of decisions. The study and unambiguous understanding of public expertise will help to avoid problems in the practical implementation of human and civil rights and freedoms through difficulties. Thus, the concept of public expertise has not yet been sufficiently defined either in normative legal acts or in scientific literature. It should be noted that this concept, namely public examination, is a new phenomenon for domestic science and practice, therefore this concept requires a comprehensive and deep research. So, in our opinion, public expertise is a tool or form of public control which is aimed at achieving transparency in the work of state authorities and local self-government, ensuring the implementation and protection of the rights and freedoms of citizens, as well as such expertise is used for forming and developing civil consciousness. As for the public expertise of executive authorities, it should be noted that it is still more an assessment of their activities and the effectiveness of their decision-making and implementation of these decisions.

The article also discusses the state guarantees and support for the protection of non-governmental organizations. In legal democracies, strong governance is largely the responsibility of civil society institutions. At the same time, the direct participation of the public in the implementation of governance will be expanded. A self-governing society is based on strong non-governmental structures.

In modern conditions of formation of civil society in Ukraine, more and more opportunities are created for the emergence of new forms, methods and other tools for public control over the activities of public administration bodies, including the police. Today, the police play an extremely important role in the state and public life of the country. After all, the police are the structure that has the ability to legally use coercion, and therefore can respond quickly to violations of human rights and freedoms, compared to other bodies. The article reveals the features of public control over the functioning of the National Police in Ukraine. The public and authoritative nature of the administrative activity of the National Police bodies, which is always under the purposeful public supervision and consists in the implementation of the administrative and legal powers assigned to the National Police in the interests of society, is analyzed. Citizens’ appeals are considered as a tool of public control over police activities and also one of the key tools by which the public responds to police activities.

The article highlights the author’s approach to improving coopera- tion mechanisms of the State Border Service of Ukraine with public organiza- tions and population. There has been analyzed public control as a means their cooperation and priorities of improving the cooperation, particularly, forms and methods of organizing citizens’ feedback, introduction of the assessment pro- cedure of the efficiency of the SBSU and population and public organization. There have been stated conceptual pillars of the public control development in the SBSU, developed by the author, including public control forms and resource provision. There has been considered a mechanism algorithm of the public par- ticipation in the development of the border administration through submitting petitions or proposals concerning a legally enforceable enactment draft (or the legally enforceable enactment currently in force). There has been represented a mechanism model of discussing legally enforceable enactments and public peti- tions, developed by the author. It is noted that one of the mechanisms of interac- tion of the SBSU with the public is effective public control, which becomes an in- tegral part of ensuring national security and political stability. The conditions of permanence of Ukraine's threats in the border area, and in certain areas and their exacerbation, along with further reforms of the institutes of Ukrainian statehood, cause the problem of establishing and implementing public control in the border area as an important and urgent one.It is proved that public control is intended to determine the correctness of the military-force policy in the border area, the validity of the scale and optimality of the forms of activity of the border guards. In accordance with all this, in the subject area of public control should be: political decisions on issues of border security, including international agreements; the expediency and validity of government programs for the provision and reform of the border authorities of Ukraine, assess- ment of the effectiveness of these programs and the procedure for making changes to them.

The article is devoted to the research of goals and functions of lobbying activity. The author has processed the ideas of domestic and foreign scientists, proposed his own approaches to the definition of goals and functions of lobbying activities through the prism of public administration. As a result, a generalized vision of the goals and functions of lobbying activities as interrelated elements of the lobbying system was proposed, and a forecast for further evolution of the goals and functions of domestic lobbying was provided. The analysis of lobbying functions allowed us to notice the tendencies in shifting the goals of this activity. If the objectives were fully covered by functions such as mediation between citizens and the state, the information function and the function of organizing plurality of public interests, then the role of strengthening the self-organization of civil society and the function of compromise become increasingly important in the process of formation in the developed countries of civil society and the development of telecommunication technologies. Ukrainian lobbyism will not be left to the side of this process. Already, politicians of the highest level, leaders of financial and industrial groups have to act, adjust their goals (even if they are — declared), taking into account the reaction of the public. In the future, this trend will only increase. The analysis of current research and political events provides all grounds for believing that, while proper regulatory legislation is being formed in Ukraine, the goals and functions of domestic lobbying will essentially shift towards a compromise with the public. It is noted that in spite of the existence of a basic direction of action, lobbying may have several ramified goals. Guided by the goals set, lobbyism can manifest itself in various spheres of the political system of society, combining the closely intertwined interests of various actors in the lobbying process, or even — contrasting them.

It uses the writings of Tom Clancy and Clive Cussler,two authors whose names on a novel guarantee best-seller status. It will do so in the context of what a civic community and civil society are, and how they relate to the public-private question, a question that has renewed life in public administration.

The system of governance in contemporary Poland is founded mainly on a negative narrative of distrust. That narrative brought to power the country’s present scaremongering rulers. They continue feeding the public with frightening stories of an influx of refugees, threats of war and terrorist attacks, evils of globalisation and a loss of cultural identity to foreign ways of life. A balance between distrust of rulers and trust in them is part of democracy’s constitutional identity. Those currently in power sow distrust in liberal democracy and its values – they violate the constitution, stir up distrust of elites, and make attempts at bringing the judiciary to heelwhile staging judges bashing propaganda campaigns. Distrust of European law and European institutions is part and parcel of this process. The negative narrative weakens and threatens to disenfranchise civil society, blurring the line between law and lawlessness. It also weakens those in power.
