Corruption is considered a great crime and requires special handling. In handling corruption, special handling is needed by using the proof reversed or reversal of the burden of proof but in a balanced manner. The purpose of this study is to explain the reverse evidence of corruption from a human rights perspective. This research uses the empirical normative legal research method, namely the combination of normative legal provisions (laws) with practical elements (legal events in society/social elements). The study results state that the theory of reverse proof of corruption cases based on a human rights perspective does not violate the principles and respect for the rights of the defendants in the general principles of criminal law.

This legal research is carried out aimed at finding a common ground and meeting point of reversing the burden of proof  to obtain clarity, firmness, and legal certainty and not to violate human rights. The system of reversing the burden of proof of corruption is  proof beyond the norm of the evidence system in Indonesia, besides that the application of the reversal of the burden of proof tends to violate human rights (HAM). This legal research uses the normative legal research method with a statutory approach and a conceptual approach. The results of the study concluded that between the legislation resulting from the ratification Act has a different character, so that the reversal of the burden of proof needs to be harmonized so that in its implementation there is no overlapping. Keywords: Corruption; Harmonization; Proof. Penelitian hukum ini dilakukan bertujuan untuk mencari suatu kesamaan dan titik temu dari pembalikan beban pembuktian agar diperoleh kejelasan, ketegasan, dan kepastian hukum serta tidak melanggar HAM. Sistem pembalikan beban pembuktian tindak pidana korupsi merupakan pembuktian diluar kelaziman sistem pembuktian di Indonesia, disamping hal tersebut penerapan pembalikan beban pembuktian cederung melanggar hak asasi manusia (HAM). Penelitian hukum ini menggunakan metode penelitian hukum normative dengan pendekatan Perundang-undangan (Statute Approach) dan pendekatan konsep (Conseptual Approach). Hasil penelitian menyimpulkan bahwa antara undang-undang hasil legislasi dengan Undang-undang hasil ratifikasi memiliki karakter yang berbeda-beda, sehingga pembalikan beban pembuktian perlu dilakukan harmonisasi, agar dalam pelaksanaannya tidak terjadi tumpang tindih (overlapping).Kata Kunci: Harmonisasi; Korupsi; Pembuktian.

Legal protection is one form of human rights that must be obtained by everyone, especially with regard to the application of criminal law that can have the impact of violations and restrictions on the freedom of others as a form of human rights. It is not uncommon for people's rights to be questioned or even contested when dealing with criminal law. To answer this problem, a study was conducted using the legal research method through a normative jurudical approach which was intended to collect secondary data obtained from the literature in the form of primary legal materials, secondary legal materials and tertiary legal materials. The materials collected were analyzed qualitatively descriptive. Based on the analysis conducted, it is clearly seen that people's rights in criminal law are part of human rights that must get respect and protection in order to maintain human dignity through efforts that include: equality before the law, presumption of innocent, non-retroactive and legal assistance, and not tortured, punishment or cruel, inhumane treatment, degrading human dignity and dignity, and not treated arbitrarily.

The environment as a place to live and at the same time as a storage for waste from human activities. Can return to normal if the waste does not damage the environment. Environmental pollution has a bad impact on society. Research and reports from related institutions noted Indonesia's environmental problems, namely polluted rivers, the quality of the water must be considered because it is widely used by the community. The research method in this writing uses normative legal research, first examining the problem using the basis of statutory law. Discussion of issues regarding legal arrangements for criminal acts of environmental pollution and responsibility for criminal acts of environmental pollution according to criminal law in Indonesia. In this case, the legal provisions for criminal acts of environmental pollution are regulated in Law No.32 of 2009 concerning Environmental Protection and Management. The accountability may be imposed on individuals, corporations and authorized officials.

Indonesia is a rule of law which gives relief to prisoners every year, referred to as remission, is a policy of the government in order to reduce criminal penalties for each suspect caught in criminal law. Remission is given to those who during the sentence meet the provisions as people who are entitled to remission as well-behaved, and comply with any applicable regulations at the place of punishment. For someone who during his sentence is always against the rules cannot be given a remission. This study aims to determine the regulation of reducing the criminal period and determine the provision of remissions for narcotics offenders. The research method used is a type of normative legal research conducted by the method of recording and assessment based on legal materials. Researchers study and gather information through legal science books without deviating from positive law in order to conclude a conclusion. The implementation of the remission for narcotics offenders, namely the determination of the remission, is carried out by the decision of the head of the regional office on behalf of the minister, after issuing the stipulation of the head of the regional office must submit a report on the determination of the reduction of the criminal period to the minister of the Ministry of Justice and Human Rights cq. Directorate General of Corrections.

Human trafficking grows and develops rapidly, with various motives and types of crimes. Various obstacles are faced in handling human trafficking cases, ranging from inadequate legal instruments to weak law enforcement. This study overviewed the international legal instrument on human trafficking cases, following the identification of the recent forms and issues in enquiring how international legal instruments deal with human trafficking. This study used legal research method by referring to international laws as the source of law in compiling this human trafficking research. This study found that various instruments and international cooperation have dealt with human trafficking cases. However, in various related studies, these different legal instruments did not have a clear and binding force when the issue occurs in the domestic state. In addition, human trafficking in various legal instruments also had many types, and all of them are interrelated. This study highlighted and concluded that in making various international legal instruments effective in this case, more intensive international cooperation was needed, both regionally and globally. This paper is a comprehensive study of the problems of criminal law as a remedy for human rights and freedoms in the modern world. The relevance of this subject lies in the systematic violations of constitutional human rights and freedoms and the inaction of the criminal law in such cases. Nowadays, the criminal law as a remedy for human rights and freedoms in national and international law is described by imperfection in its adaptation to rapidly changing social relations, which, accordingly, leads to problems in their legal protection. There are various reasons for this in the legal sphere, such as gaps in the legal provisions, conflicts of legal regulation and inconsistency of the rules of legislation with existing public relations in the state. All of the above determines the relevance of the subject matter of this study. Thus, the purpose of this study was a comprehensive analysis of theoretical and applied issues relating to the remedies for human rights and legitimate interests against socially dangerous encroachments, and the formulation of scientifically sound proposals for improving the current legislation of Ukraine and the practice of its application in this area. Ultimately, this study identified the legal characteristics of human rights and freedoms at both the national and international levels. The remedies for rights were demonstrated through the lens of criminal law. In addition, the study analysed the forms of implementation of international practice in the national legislation of Ukraine as a remedy for human rights and freedoms in the modern world. The significance of the results of this study was expressed in the further research of related subjects concerning this issue, namely the history of the development of EU criminal law standards and the historical establishment of the concept of human and citizen rights and legitimate interests. Furthermore, the materials of this study can be used in the preparation of educational materials, methodological recommendations, as well as training in various fields of legal science. This, in turn, will allow properly using the criminal law protection of human rights and freedoms without violations on the part of criminal justice bodies

Progressive law puts forward the sociology of law rather than legal certainty which is the focus of legal positivism. In Indonesia, this law was coined by Satjipto Rahardjo. This study aims to determine the formulation of progressive law in future criminal law, and to determine the actualization of the concept of progressive law in regulating corruption in Indonesia. The research method used is a normative legal research method with statute and conceptual approaches. The technique of collecting legal materials in this study is a descriptive method that aims to obtain the meaning of reality related to the problems to be discussed and solved in this study. The results show that in the current Criminal Code Bill, progressive law has been regulated, to be precise in Article 2 paragraph (1) and (2). Progressive law is also regulated in Law no. 48 of 2009 concerning Judicial Power. Then, the actualization of progressive law in regulating corruption in Indonesia is a judge with the powers that take into account the sociological context of society in making decisions. Judges, prosecutors and lawyers can certainly discuss together in eradicating corruption. Efforts are also being made to reconstruct and redefine the power of law enforcement. This arrangement can also encourage the KPK to be more progressive in eradicating corruption, as well as building law enforcers who have morality so that they can become role models and increase public participation, for example by forming NGOs in preventing or fighting corruption in various agencies.

Smoking belongs to the right of all people, but smoking can interfere with Human Rights because the distribution of cigarette smoke produced by smokers can interfere with the health of people around. In Bali, tourist attractions are one of the non-smoking areas. This is stated in the Regional Regulation of Badung No. 10 of 2017 concerning Non-Smoking Areas. Related to this, the study examines two things, that is, the regulation of No-Smoking Areas in the tourist attractions in Badung Regency and the implementation of the Regional Regulation of Badung No. 10 of 2017 on the tourist attractions. The research method used is empirical legal research that is conducting a direct research followed by analyzing data and presented in qualitative manner. In its regulation, Civil Service Police Unit (Satpol PP) as the enforcer of the regional regulation has conducted supervision on tourist attractions and sanctions given in accordance with the Article 21 Number (10) of 2017 of the Badung Regency Regional Regulation. Its application has been done through socialization to the manager of tourist attractions, but the lack of public knowledge about the non-smoking areas in tourist attractions has been appearing as an inhibiting factor.

Penelitian ini bertujuan untuk menganalisis yurisdiksi Pengadilan Pidana Internasional dengan Pengadilan HAM Indonesia. Masalah penelitian Bagaimana yurisdiksi dibandingkan dengan pengadilan kriminal internasional dan pengadilan HAM di Indonesia? dan Apa Peluang untuk Pengenaan Yurisdiksi Pengadilan Pidana Internasional di Indonesia? Metode penelitian menggunakan penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa perbandingan yurisdiksi Pengadilan Pidana Internasional dan Pengadilan Hak Asasi Manusia dapat dilihat dari yurisdiksi pidana, pribadi, temporal dan teritorial. Indonesia bukan negara pihak dan bukan negara yang menerima yurisdiksi Mahkamah Pidana Internasional. Meski begitu, Yurisdiksi Mahkamah Pidana Internasional dapat diterapkan di Indonesia mengingat perbedaan yurisdiksi pidana kedua pengadilan tersebut, karena ada 2 (dua) kejahatan yaitu kejahatan perang dan kejahatan agresi yang tidak diatur dalam Pengadilan HAM Indonesia. , jika ada situasi di Indonesia yang dirujuk oleh Dewan PBB dan keamanan Indonesia dianggap tidak mau dan tidak dapat membawa para pelaku kejahatan untuk diadili di pengadilan. This study aims to analyze the protection of labor rights in this case Indonesian migrant workers abroad within the framework of the ASEAN Economic Community and Law no. 18 of 2017 concerning Protection of Indonesian Migrant Workers' labor rights within the framework of the ASEAN Economic Community. Research problems, First, What is the Form of Protection for Indonesian Migrant Workers, Second, What is the Form of Legal Efforts for Indonesian Migrant Workers who are disadvantaged? The research method uses socio-legal research by observing the ASEAN Declaration of Human Rights and Law No. 18 of 2017, as well as other Indonesian Laws and Regulations. The results showed that the Protection of Indonesian Migrant Workers (PMI) is all efforts to protect the interests of prospective PMI and their families in realizing guaranteed fulfillment of rights in all their activities. The author will analyze the issue of the extent to which the state protects labor rights in this case Indonesian migrant workers abroad within the framework of the ASEAN Economic Community and Law No. 18 of 2017 concerning Protection of Indonesian Migrant Workers.

This research tried to elaborate implementation of human rights and principles of suitability types, hierarchy, and material of regional regulation making. The main problem was whether in the making regional regulation of Nias Barat Regency, No. 8 / 2014 on Provisions of shift appeal of Civil Servants in Nias Barat Local Government neighbourhood, have paid attention to human rights and the principles of suitability types, hierarchy, and material of regional regulation making. It aimed to find out the implementation of human rights principles, especially right to develop their potency and its implementation. Hopefully, it also could contribute and have the benefit of knowledge of legislation and understanding for lawmakers related to the implementation of human rights and the principles of suitability types, hierarchy, and material of regional regulation making. It was a normative legal research method with analytical descriptive type. Tujuan dari penulisan ini adalah untuk mengetahui penerapan prinsip hak asasi manusia khususnya hak untuk mengembangkan diri dan penerapan asas kesesuaian antara jenis, hirarki dan materi muatan peraturan perundang-undangan dalam pembentukan Peraturan Daerah Kabupaten Nias Barat tentang Ketentuan Usul Pindah Pegawai Negeri Sipil di Lingkungan Pemerintah Kabupaten Nias Barat. Tulisan ini juga diharapkan dapat memberikan kontribusi dan berguna bagi pengembangan ilmu pengetahuan perundang-undangan serta dapat memberikan pemahaman bagi organ pembentuk peraturan daerah terkait penerapan prinsip HAM maupun asas kesesuaian antara jenis, hirarki dan materi muatan peraturan perundang-undangan. Metode penelitian yang dipergunakan adalah penelitian hukum normatif dengan sifat deksriptif analitis. Hasil penelitian menunjukkan bahwa ketentuan Peraturan Daerah Nomor 8 Tahun 2014 tentang Ketentuan Usul Pindah Pegawai Negeri Sipil di Lingkungan Pemerintahan Nias Barat tidak memperhatikan prinsip HAM khususnya hak untuk mengembangkan diri dan tidak memperhatikan asas kesesuaian jenis, hierarki dan materi muatan peraturan perundang-undangan. Kata Kunci: Pegawai Negeri Sipil; Pemerintah Daerah
