In study of Islamic law there is an interesting topic to discuss, that is maqasid al-shari‘ah. Recently some Muslim scholars study further the applying of principle of daruriyat al-khamsah in a legal problem. Unfortunately Islamic jurists often apply the principle of daruriyat al-khamsah independently apart from other sciences besides usul al-fiqh. Difficulties and failure in deciding many contemporary legal problems rise to the result. Jasser Audah, a Muslim scholar from Egypt and lives in London proposes new idea to cope with this problem. According to Audah, at first we must separate maqasid al-shari‘ah from usul alfiqh in order to be independent knowledge. Then we combine it with modern sciences in studying legal problem. Only through this method, Auda believes that Islamic law will be more adaptable with the changing situation. In order to do his idea in developing maqasid al-shari‘ah, Auda specifically suggests five steps, that are: validating all cognitios, holism, openness and self-renewal, multi-dimensionality, and purposefulness.

In this research paper, the scholar has given a detailed illustration on the importance of Ijma’, its usefulness, technical problems and definition in the light of the thoughts of Allama Iqbal.

Based on an observation through many communities, it is obviously that people are very careless on the possession of property, or even merely to get the advantage from it. They used not to think about, but prefer to neglect, the rightness of owning, the rightness of acquiring and the rightness of spending the property. In their mind is whatever they can gain, irrespective to the ethic and moral on the way of reaching and gaining, is totally belong to them, and they are free to do so ever. It is a very liberal concept of property.As a way of life, Islamic order ruled all aspects of life including the ownership of the property. There many verses of Al Qur’an as well as the teaching of the prophet Muhammad PBUH about the property. But the problem is there are many muslim scholars who has interpreted Al Qur’an on the fact and reality based only, and not due to the core of the mission of Al Qur’an. Not to pick the Qur’an teaching up to the life, or to build up the life depend on the doctrine of Qur’an, as it is ought to.Imam Muhammad Abu Zahrah, the famous and prominent Egyptian muslim scholar in the first twentieth century who has great intention and desire of the implementation of Islamic law was one who has keen interest on the issue of economy, especially on the issue of usury (riba). He has written several articles, papers and a book as well, on the subject of riba. Moreover, he has also written a set of Qur’anic Interpretation (Tafsiir) in which he commented on some verses concerning the property and wealth.

<p>Islamic Law Compilation is still an interesting topic to study by Muslim scholars in Indonesia. The Islamic Law Compilation is a typical Indonesian jurisprudence used as reference for religious court judges. This article aims to identify the use of the Shafi'ite school on the rules of marriage in the Islamic Law Compilation. This article comes from normative research with a descriptive approach. The results of this study show that the influence of the Shafi'i school is more dominant in the Islamic Law Compilation. However, the compilers of the Islamic Law Compilations used the opinion of other schools. The articles relating to the requirements, pillars and procedures for implementing marriage are absorbed from the provisions of the Shafi'ite jurisprudence. Such as marital proposal, marriage guardian, ijab qabul, and dowry. the  Islamic Law Compilation is not only collecting or adopting the classical jurisprudence of Islamic scholars, but it also provides a new provision that has not yet existed in the treasures of the previous Islamic jurisprudence.</p>Kompilasi Hukum Islam masih menjadi bahan menarik untuk dikaji oleh sarjana muslim di Indonesia. Kompilasi Hukum Islam merupakan fiqh khas Indonesia yang dijadikan rujukan bagi hakim pengadilan agama. Artikel ini bertujuan mengidentifikasi penggunaan mazhab Syafi’i pada aturan perkawinan dalam Kompilasi Hukum Islam. Artikel ini berasal dari penelitian normatif dengan pendekatan deskriptif. Hasil penelitian ini menujukkan bahwa Pengaruh mazhab Syafi’i lebih dominan dalam penyusunan Kompilasi Hukum Islam. Meskipun demikian, para perumus Kompilasi Hukum Islam menggunakan pendapat mazhab lain. Pasal-pasal yang berkaitan dengan syarat, rukun dan tata cara pelaksanaan perkawinan diserap dari ketentuan fiqh mazhab Syafi’i. Seperti peminangan, wali nikah, ijab qabul, mahar. Kompilasi Hukum Islam bukan hanya sekedar mengumpulkan atau mengadopsi pandagan ulama fiqh klasik. Akan tetapi memberikan ketentuan baru yang belum ada dalam khazanah fiqh terdahulu.

Abstract: Feminism always be a favorable discussion among academics. It is supported by the increasing blending of non-dichotomous intellectual and study area, between the pure-Islamic studies and anti-Islamic studies. The studies were started to be integral since the 19th century marked by the emergence of the various Islamic studies. Muslim scholars have conducted research on women from various perspectives, family-law, and humiliation in the society. The study of women has attracted attention of international Muslim scholar that respond to the methodological reconstruction. It occurred due to the concern of women existence especially for women who require a distinct protection. This paper employed a historical-methodological approach which analysed the views of two Muslim scholars which are well-known with western education and concern about women’s issues, namely Khaled Abou el Fadl who reviewed the notes on the fatwa of the middle eastern scholars at the CRLO institutions (council for scientific research and legal opinion) and Ziba Mir Hosseini who studies about the sacredness and profanity of Islamic law, especially the position of women in family law.الملخص: إن الحديث عن المساواة بين الجنسين حديث جذّاب عند الأكاديميين. هذا الواقع مؤيّد بارتقاء  الثقافة الأكاديمية وعدم التفريق بين الدراسات الإسلامية المحضة وما في خارجها. بدأ أن اتّحدت العلوم في القرن التاسع عشر بظهور أنواع العلوم الإسلامية. ثمة من العلماء المسلمين قاموا بالدراسات عن النساء من وجهات نظر متعددة بداية من مكانتها في فقه الأحوال الشخصية، ووصمة عار المجتمع، بل وإن الدراسات عن النساء تثير اهتمام الخبراء المسلمين في المستوى العالمي وتدفعهم إلى إعادة البناء المنهجي. هذه الحالة نوع من اهتمام الخبراء المسلمين تجاه النساء لكونهن في حاجة إلى الرعاية الخاصة ولكثرة الحديث عن وجودهن. استخدم هذا المقال المدخل التاريخي المنهجي ويناقش رأي العالمين المسلمين المعاصرين الكائنين في لب التربية الغربية ومهتمين تجاه قضايا النساء ( خالد أبو فضل وزبا مر حسين) . انتقد خالد الفتاوى التى أصدرها علماء الشرق الأوسط في مؤسسة  CRLO (council for scientific research and legal opinion)  ، وزيبا قامت بدراسة قدسية الأحكام الإسلامية، خاصة مكانة المرأة في فقه الأحوال الشخصية.Abstrak: Feminisme merupakan kajian kontemporer yang selalu hangat dibicarakan di tengah-tengah insan akademik. Hal ini didukung oleh semakin meningkatnya budaya intelektual dan wilayah kajian yang non dikotomis, antara kajian Islam murni dengan pengetahuan di luarnya. Keilmuan mulai bersifat integral sejak abad ke-19 yang ditandai dengan munculnya berbagai keilmuan Islam. Banyak intelektual Islam yang melakukan penelitian tentang perempuan dari berbagai sudut pandangnya, mulai kedudukannya dalam hukum keluarga, stigma masyarakat, bahkan kajian mengenai perempuan menyita perhatian Muslim scholar Internasional yang menciptakan respon Muslim scholar kontemporer untuk melakukan rekonstruksi metodologis. Tindakan ini adalah bentuk kepedulian Muslim scholar terhadap perempuan yang keberadaannya banyak diperbincangkan dan memerlukan perlindungan khusus. Artikel ini dengan menggunakan pendekatan historis-metodologis mengulas pandangan dua intelektual Islam kontemporer yang berjibaku dengan pendidikan Barat, dan konsen terhadap isu-isu perempuan, yaitu Khaled Abou el Fadl yang memberikan catatan terhadap fatwa Muslim scholar Timur Tengah dalam lembaga CRLO (council for scientific research and legal opinion) dan Ziba Mir Hosseini yang melakukan kajian sakralitas dan profanitas hukum Islam, terutama kedudukan perempuan dalam hukum keluarga.

Islamic thinking on war divides roughly into two main schools, classical and modern. The classical (or medieval) view commands offensive war to spread Islamic rule ultimately across the entire world. The modernist view, predominant since the nineteenth century, limits war to defensive aims only. This paper compares the views of two important Muslim scholars, the classical scholar Ibn Ishaq (d. 767) and the modernist scholar Mahmud Shaltut (d. 1963). This comparison reveals that the modernist project of rethinking the Islamic law of war is a promising though as-yet-unfinished project that can benefit from the insights of Western scholars applying the historical-critical method to the study of early Islamic sources.

The division of marital joint property after the breakup of marriage, whether dropping out of marriage due to divorce or due to death, is a new thing in Islamic jurisprudence (fiqh). This is because the concept of mutual treasure is not known in the books of classical Islamic jurisprudence of Muslim scholars of the schools at their times, in which their work are always made as referral in the legal cases up to the present days. In Indonesia, the distribution of common property is regulated in the Compilation of Islamic Laws Articles 96 and 97, which stipulate the rules of distribution of joint property for married couples whose married are off as a result of divorce or death. Article 97 of the Compilation of Islamic Law actually provides an overview of the flexibility of the distribution of common marital property, including in certain cases because the article is regulating (regelen) rather than forcing (dwigen), so that the division is not absolutely divided equally between husband and wife, and casuistically the provisions of that article may be disregarded.

The Muslim minorities in the West who are currently dealing with a multitude of problem receives attention from Muslim scholars. Syaikh Yūsuf al-Qaraḍāwī is the first Muslim scholar who attempted to provide a solution to the problems, especially related to the implementation of religious teachings, as he outlined it in the framework of fiqh al-aqalliyāt. In principle, this is not something new in Islamic jurisprudence, because its legal sources are still the same. Nevertheless, this kind of fiqh is different in the sense that it does not merely talk about legal issues, but also the problems of theology and morals that the Muslim minorities in the West are currently dealing with in their relations with non-Muslims. Fiqh al-aqalliyyāt is also characterized by the use of the principle of al-taysīr as clearly prominent in the fatwās by Syaikh Yūsuf al-Qaraḍāwī, such as on the validity of both performing Friday prayer in the morning due to limited time for religious sermon (khuṭbah) and during ẓuhr time in some countries. This article suggests a new way of looking at the preeminent methodological principles informing the oeuvre of Yusuf al-Qaradawi, the greatest Muslim scholar of our generation, specificallywith regard to his rulings for and about Muslims living in Europe.The case study presented here is taken from the field of Muslimprayer law, a field that has to date been subjected to very little research.By comparing the discussions of classical Muslim scholarson the topic with the new interpretations proffered by al-Qaradawi,one can notice the process of change undergone by the Shari‘ahconcerning prayer under extraordinary circumstances from Islam’searly days down to the present. We can also see how his politicaloutlooks have influenced his ruling on this issue and the discussionthereof among Muslims who do not reside in the West.

This study discusses about itsbat talak (legal recognition of divorce) pronounced by husbands out of court in the perspective of Marriage Law in Indonesia. There are three issues answered in this study. First, how is the legal problem of out-of-court divorce in the perspective of Marriage Law in Indonesia and Fiqh? Second, what is the urgency of itsbat talak in the view of fiqh and Marriage Law in Indonesia? Third, what is the review of the Marriage Law in Indonesia on the itsbat talak out-of-court? To answer this problem, a library study was conducted. The data was collected through searching of the research results, books, fiqh books, laws or regulations and electronic as well as digital data through websites. The study found that there are some legal problems of itsbat talak for out-of-court divorce such as its legality, the probability of talak for twice, no legal protection, the couple blocked from other marriage, and the lost of post-marriage rights. Itsbat talak for out of court divorce can be recognized in the Marriage Law in Indonesia. Studi ini mengkaji tentang itsbat (pengakuan hukum) talak yang telah dijatuhkan suami di luar pengadilan dalam perspektif hukum perkawinan di Indonesia. Ada tiga persoalan yang akan dijawab dalam studi ini. Pertama, bagaimana problematika hukum talak di luar pengadilan dalam perspektif Hukum Perkawinan di Indonesia dan Fikih ? Kedua, bagaimana urgensi itsbat talak dalam pandangan Fikih maupun Hukum Perkawinan di Indonesia ? Ketiga, bagaimana tinjauan Hukum Perkawinan di Indonesia terhadap itsbat talak  perceraian di luar pengadilan ? Untuk menjawab permasalahan ini dilakukan studi kepustakaan. Data tentang talak di luar pengadilan atau itsbat nikah dikumpul melalui penelusuran hasil-hasil penelitian, buku-buku atau kitab fikih, undang-undang atau peraturan dan data elektronik melalui website. Data ini diolah, dianalisis dan dijadikan bahan untuk mengkaji itsbat talak dengan menggunakan metode kajian hukum normatif. Hasil penelitian menemukan jawaban, pertama; ada lima problem hukum talak di luar pengadilan, seperti keabsahannya, kemungkinan terjadi talak dua kali, tidak adanya perlindungan hukum, pasangan talak di luar pengadilan tidak dapat melakukan penikahan resmi dengan yang lain, tidak bisa mendapatkan  hak-hak setelah talak. Itsbat talak dapat diakui dalam hukum perkawinan di Indonesia.

This type of research used here is a type of empirical research where this research is carried out on the real situation in a community or the surrounding environment with the aim of finding facts or existing legal problems The results of this study indicate that the legal power of mediation in the trial process at the Badung Religious Court namely with the peace deed the results of the peace agreement get legal certainty
