<p>In a land sale and purchase transaction, if the conditions for making a Sale and Purchase Deed by a Land Deed Official cannot be fulfilled, the parties can make a Commitment of Sale and Purchase Agreement by a Notary as a preliminary agreement to bind the parties. In practice, the making of a Commitment of Sale and Purchase Agreement is often accompanied by Absolute Power of Attorney which cannot be revoked. This Absolute Power of Attorney often creates legal problems because its use is prohibited by the prevailing laws and regulations. The formulation of the problems studied in this research mainly concerns about the regulation of the Notary’s authority in making deeds that use Absolute Power of Attorney in land sale and purchase transactions and the Notary’s responsibility regarding cancellation of a deed due to the use of Absolute Power of Attorney. The research methods used are juridical normative with empirical juridical support. Research results show that Notary is authorized to make a Commitment of Sale and Purchase Agreement accompanied by Absolute Power of Attorney. In addition, the Notary cannot be sued to give a responsibility for the cancellation of the deed. According to the law, making of the deed is valid. This is because the use of Absolute Power of Attorney is not a prohibited act, as long as its use meets the requirements stipulated by statutory regulations and based on legally justifiable reasons.</p><p><strong>BAHASA INDONESIA ABSTRACT:</strong></p><p>Dalam rangka pelaksanaan jual beli tanah, apabila syarat-syarat pembuatan Akta Jual Beli di hadapan Pejabat Pembuat Akta Tanah belum dapat dipenuhi, maka biasanya akan dibuat Perjanjian Pengikatan Jual Beli (PPJB) di hadapan Notaris sebagai perjanjian pendahuluan untuk mengikat para pihak. Pada pembuatan PPJB dengan objek tanah, biasanya terdapat pemberian kuasa yang berisi ketentuan tidak dapat dicabut kembali atau dikenal sebagai kuasa mutlak. Pemberian kuasa mutlak ini sering menimbulkan permasalahan yang berakibat akta menjadi batal demi hukum karena penggunaannya merupakan hal yang dilarang oleh peraturan yang berlaku. Rumusan permasalahan yang dikaji dalam penelitian ini pada pokoknya menyangkut pengaturan tentang kewenangan Notaris dalam pembuatan akta yang menggunakan kuasa mutlak dalam transaksi jual beli tanah dan tanggung jawab Notaris terhadap akta yang dibatalkan karena menggunakan kuasa mutlak. Metode penelitian yang digunakan adalah yuridis normatif dengan dukungan yuridis empiris. Hasil penelitian menunjukkan bahwa Notaris berwenang untuk membuat PPJB yang disertai dengan pemberian kuasa mutlak. Selain itu, Notaris tidak dapat dituntut untuk memberikan pertanggungjawaban atas dibatalkannya akta yang dibuatnya. Secara hukum, pembuatan akta tersebut adalah sah. Sebab, pemberian kuasa mutlak bukan merupakan tindakan yang dilarang, sepanjang penggunaannya memenuhi syarat-syarat yang ditentukan oleh peraturan perundang-undangan dan memiliki alasan yang dapat dipertanggungjawabkan secara hukum.</p>

A sale and purchase agreement is one of the most frequently made agreements. One of the most traded objects is land. According to customary law, land sale and purchase is a legal act of transferring land rights. The legal act of sale and purchase is carried out by a land deed official who has the authority to make a sale and purchase deed. Sometimes, the sale and purchase deed cannot be made because there are conditions that have not been fulfilled, so the parties first make a preliminary agreement called the binding sale and purchase agreement. Usually, the binding sale and purchase agreement is followed by power of attorney to sell. The formulation of the problem in this thesis is whether the inclusion of the power of attorney to sell is permissible, and if the recipient of the power of attorney misuses the power, what form of legal protection can be given to the authorizer. The author uses normative legal research methods that are supported by interviews to answer these problems. The inclusion of a power of attorney to sell within the binding sale and purchase agreement is permitted as long as it is not an absolute power that is prohibited by law. Legal protection that can be given to the authorizer is divided into two forms: preventive protection, a legal protection aimed at preventing the occurrence of disputes, and repressive protection, a protection that serves to resolve in the event of a dispute.

The development of globalization in era of free market economy has caused many problems to protection of plant varieties. Therefore, it’s deemed necessary to make specific arrangements of supervision in the protection of plant varieties in Indonesia. The writing of this article aims to examine the regulatory aspects of supervision in plant varieties and the importance of regulating of supervision in plant varieties. This article uses normative legal research methods, which research the laws and regulations that have legal problems. The results of the study shows that the aspects of supervision in regulations relating to the protection of plant varieties haven’t been regulated in detail and concretely. The absence of regulations regarding the supervision, causes supervision can’t be carried out optimally, and the supervision can’t be said to be legal according to law. Supervision is very important to regulated, because it carried out with the aim of preventing the emergence of fraudulent practices such as deception, monopolistic practices, and other activities that have a negative impact on the economy in terms of protecting plant varieties. Juridical arrangements regarding supervision related to the protection of plant varieties need to be carried out to provide a foundation for the relevant agencies in carrying out their supervisory duties as well as to increase protection or provide legal certainty for parties holding the rights to protect plant varieties. In addition, it’s also to prevent fraudulent acts committed by irresponsible persons. Perkembangan globalisasi di era ekonomi pasar bebas, menimbulkan banyak problematika terkait dengan perlindungan varietas tanaman. Oleh karena itu, dipandang perlu melakukan pengaturan secara spesifik mengenai aspek pengawasan dalam perlindungan varietas tanaman di Indonesia. Penulisan artikel ini bertujuan untuk mengkaji mengenai pengaturan aspek pengawasan dalam perlindungan varietas tanaman serta arti penting pengaturan aspek pengawasan dalam perlindungan varietas tanaman di Indonesia. Adapun metode penelitian dalam penulisan artikel ini menggunakan metode penelitian hukum normatif, berupa penelitian dengan mengkaji peraturan perundang-undangan yang memiliki kaitan dengan permasalahan hukum yang terjadi. Hasil studi menunjukkan bahwa aspek pengawasan dalam peraturan perundang-undangan yang berkaitan dengan perlindungan terhadap varietas tanaman belum diatur secara mendetail dan konkrit. Ketiaadan pengaturan mengenai pengawasan terkait perlindungan varietas tanaman  menyebabkan pengawasan tidak dapat dilaksanakan secara maksimal, serta pengawasan yang dilakukan oleh instansi terkait tidak dapat dikatakan sah menurut hukum. Pengawasan pada dasarnya merupakan hal sangat penting untuk diatur, karena pengawasan dilaksanakan dengan maksud untuk mencegah timbulnya praktik kecurangan seperti penipuan, praktik monopoli, maupun kegiatan lain yang menimbulkan dampak negatif terhadap perekonomian dalam hal perlindungan varietas tanaman. Pengaturan secara yuridis mengenai pengawasan terkait perlidungan varietas tanaman perlu dilakukan untuk memberikan landasan berpijak kepada instansi terkait dalam melaksanakan tugasnya terkait pengawasan sekaligus guna meningkatkan perlindungan maupun memberikan jaminan kepastian hukum bagi pihak yang memegang hak perlindungan varietas tanaman. Selain itu juga untuk mencegah terjadinya tindakan kecurangan yang dilakukan oleh oknum-oknum yang tidak bertanggungjawab.

A trend is emerging in the Latvian legal system to refer to patient duties more and more, thus consolidating the idea of patient duties. Deficiencies are found, however, in the interpretation of the idea of patient duties, which lacks consistent distinction from related notions. Nowadays, not only is the attention to patient duties in the medical treatment relationship growing, but changes are also taking place which are directed at expanding the interpretation of patient duties, creating groundwork for new patient duties in medical treatment. The aim of the research is to analyse the notion of patient duties, find deficiencies in its interpretation and propose specific solutions to improve the definition of patient duties. The following primary research methods have been used in the study: analytical, systemic, teleological. The research results include an interpretation of the definition of patient duties, distinguishing it from related notions and analysing the trend of expanding the interpretation of patient duties. Based on this interpretation, a proposal is made for improvement of the laws and regulations.

Absolute power of attorney is a power of attorney containing an irrevocable element by the authorizing party. Since the Instructions of the Minister of Home Affairs Number 14 Year 1982 concerning the Prohibition of Absolute Power of Attorney as the Transfer of Land Rights took effect on 6 March 1982 and Government Regulation Number 24 Year 1997 concerning Land Registration took effect on 8 July 1997, the use of absolute power of attorney has been banned. But in the practice, the use of absolute power of attorney in the Binding Sale and Purchase Agreement of Land is still found. This is what often causes conflict because the use of absolute power of attorney is considered contrary to the laws and regulations in Indonesia. The formulation of the problem in this thesis is how the validity of the use of absolute power of attorney in the Binding Sale and Purchase Agreement of Land made by a public notary and how the legal consequences of the Binding Sale and Purchase Agreement of Land that use absolute power of attorney. The results of the study showed that regarding the use of absolute power of attorney in the Binding Sale and Purchase Agreement of Land is legal and does not violate the laws and regulations. In addition, the legal consequences arising from the use of this absolute power of attorney in the Binding Sale and Purchase Agreement of Land are still recognized and remain valid and binding for the parties who have made them.

The Land Deed official (the PPAT) is a public official given the authority to make an authentic document related to the conveyance of land. In the land conveyance, many parties employ a power of attorney or a proxy to represent him or herself in committing an act of law, one of which is the act of buying and selling of land. The problem formulation of this thesis is how the implementation of the provisions of article 39 paragraph (1) letter d of the Government Regulation Number 24 of 1997 about the practices of making the land sale deeds by the PPAT in the Klungkung Regency, and what the responsibilities of the PPAT in carrying out their duties as officials who make the land sale deed based on an absolute power of attorney. The research methodology used in the study is juridical empirical research. It can be seen from the scope of discussion namely on what is written in the legislation (das sollen) and the deviations found in the practices of making the land sale deeds made by the PPAT (das Sein). This thesis uses the nullification, the legal affectivity, the responsibility, and the law enforcement theories. The findings of the research showed that there were some irregularities of the implementation of Article 39 paragraph (1) letter d related to the land sale deed by an absolute power of attorney found in the Regency of Klungkung, for instance, there was an indication that a PPAT accepted a privately-made absolute power of attorney to make a land conveyance certificate. This was made because of the creditor's debt agreements. Other irregularities found, that there was a land conveyance certificate made under a stand-alone power of attorney that irrelevant to the land deed of sale. The accountability of a PPAT who accepts an absolute power of attorney in making the land conveyance certificate lies exclusively on his/her own discretion because the PPAT is not under a government agency. It is always possible that those who feel harmed by the malpractice shall be entitled to a civil action for redress. By the routine monitoring and guidance, it is expected that no violations shall be committed by the PPAT otherwise, he or she may be exposed to a lawsuits in the future.

Research study problems; First, the principle of village regulation according to the Village Law, Second, the position of the village regulations according to Law Number 6 of 2014 concerning Villages. Research Methods using normative juridical research methods. Research Results that, First, In the case of the principle of village regulation, of course, it must refer to the Village Law on rural areas, which in the provisions explains the various principles in its formation. Second, the position of village regulations according to the Village Law is no longer domiciled as a further elaboration of the higher legal regulations. Aside from being domiciled as a legislation that is recognized. The emergence of Law Number 6 of 2014 concerning villages immediately affirms the regulation of Law Number 12 of 2011 concerning the establishment of laws and regulations.

One of the banking products in the credit sector that is becoming a trend in Indonesia is a credit card. Almost everyone who has worked has a credit card. Credit cards are usually used to facilitate payment transactions when shopping. This research aims to explain about credit cards, credit card regulations in Indonesian laws and regulations, and legal problems in the use of banking credit cards. The method used in this research is normative legal research, using a statutory approach. The research results explain that a credit card is a card-based payment instrument that can be used to make payments for obligations arising from an economic activity, including spending transactions and / or to make cash withdrawals, where the cardholder's payment obligations are first fulfilled by the acquirer or issuer, and the cardholder is obliged to make payments at the agreed time, either in lump sum (charge card) or by payment in installments. Legal problems that often occur between banks and customers using Credit Cards are defaults committed by customers because they don’t pay Credit Card bills or fines billed to them and the use of debt collector services by the bank in invoicing credit card users.

The existence of industrial relations courts until now still can not provide adequate legal protection to justice seekers. This article begins with the existing legal problems in the form of not implemented legally binding of industrial relations court verdicts. The unapplied verdicts have resulted in the exclusion of the rights of justice seekers. This paper identifies the problem related to normative perspective and provide solutions through legal reconstruction from the normative view. Then, the problems are examined using normative legal research methods based on statute approach and historical approach as well as case approach. By examining several research results it is known that the legal vacuum which regulates sanctions against those who do not intend to enforce industrial relations court rulings that have legal force still need to be addressed immediately to guarantee the rights of the seekers of justice in the industrial relations court. This paper recommends to establish a Supreme Court Regulation on the implementation of institutional force on industrial relations disputes cases and the need for amendment of Law Number 2 Year 2004 on Industrial Relations Dispute Settlement.

The purpose – perfection of the techniques for controlling speed-strength capabilities and endurance of the rotator cuff muscles of biathletes during the period of sport skills perfection. Research methods and organization. The study involved 204 biathletes aged 15-17. We tested the speed- strength abilities and endurance of rotator cuff muscles with the Skierg Concept2 ski ergometer (USA). Research results. Significant changes in the endurance of rotator cuff muscles of biathletes occur in the age period from 15 to 16 years. The change in speed-strength abilities of female biathletes, in contrast to male biathletes, occurs against the background of an increase in the number of ski pole movements per minute. We processed the obtained data using the method of determining the boundaries of confidence intervals. Based on the data processed, we developed the standards for assessment of the speed-strength abilities and strength endurance of rotator cuff muscles of biathletes during the period of sport skills perfection with the Skierg Concept2 ski ergometer (USA). We tested applicability of the developed standards for speed-strength abilities and strength endurance of rotator cuff muscles in a one-year educational experiment. Conclusion. We proposed a methodology for testing speed-strength abilities and strength endurance of rotator cuff muscles with the Skierg Concept2 ski ergometer (USA) in the framework of our study. The developed stand- ards for assessing speed-strength abilities and strength endurance of rotator cuff muscles of biathletes during the period of sport skills perfection help to identify strong and weak points of fitness and to predict the possibility of achieving certain results by individual parameters.

Suku Bangsa Minangkabau adalah suku yang terkenal dengan kebiasaan merantau. Salah satu tempat di Semarang yang banyak ditemukan orang Minangkabau adalah Sekaran. Penelitian ini dilakukan untuk mengetahui bagaimana strategi adaptasi orang Minang terhadap bahasa Jawa, makanan Jawa dan norma masyarakat Jawa. Penelitian ini dilakukan dengan menggunakan metode penelitian kualitatif. Teknik pengumpulan data yang digunakan adalah observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan strategi adaptasi orang Minang terhadap bahasa Jawa adalah dengan lebih sering menggunakan bahasa Indonesia untuk berkomunikasi dengan orang Jawa agar mengurangi adanya kesalahpahaman, serta tetap berusaha untuk belajar bahasa Jawa. Strategi adaptasi orang Minang terhadap makanan Jawa adalah dengan memilah-milah makanan yang pedas sesuai dengan selera atau dengan memasak sendiri. Orang Minang yang mempunyai tempat usaha warung makan khas masakan Minang meyesuaikan menu dengan selera masyarakat sekitar. Strategi adaptasi orang Minang terhadap norma masyarakat Jawa adalah dengan berusaha mematuhi segala tata tertib yang ada dan menyesuaikan dengan tradisi Jawa serta menggunakan panggilan Jawa yang sering digunakan oleh orang Jawa. The Minangkabau is well-known for its migration habit. One of the places in Semarang with many Minangkabau people is Sekaran. The study was conducted to examine the adaptation strategies of Minang people to Javanese people, Javanese food and the Java community norms. The research was conducted using qualitative research methods. The results showed that the Minang adaptation strategies for the Javanese language is by more often by using the Indonesian language to communicate with Javanese in order to reduce the misunderstandings, though they are still trying to learn the Javanese language. Adaptation strategies of Minang people to Javanese food is by sorting out the spicy foods according to their taste or cook for themselves. Minang people who have a small restaurant usually cook dishes tailored to the taste of the surrounding communities. Adaptation strategies of Minang people is by trying to comply with Javanese norm all the discipline, and adjust to the traditions of Java and using Javanese calls that are often used by the Javanese.
