This article comments on the Spanish Constitutional Court’s order of 17 October 2019, ATC 119/2020, regarding the exhumation and transfer of the remains of Francisco Franco Bahamonde from the Valley of the Fallen. Franco’s relatives brought a constitutional complaint before the Constitutional Court against the resolutions of the Council of Ministers of 15 February and 15 March 2019, which concerned the exhumation of the dictator’s remains and their transfer to the Mingorrrubio Cemetery in El Pardo. This was done against the wishes of the family, who had indicated another location. The applicants submitted, inter alia, that their right to respect for private and family life had been violated. In fact, certain issues relating to the treatment of the body of a deceased person fall within the scope of the right to privacy. However, the Spanish Court did not accept the applicants’ plea and held that there was no violation of the constitutional right. It justified its decision on the grounds that the right to protection of private and family life is not absolute and is subject to limitations, and that the measures applied in this case were in line with a “constitutionally legitimate aim,” proportionate and necessary. The Court’s decision is correct, although its reasoning leaves much to be desired. The Court could have strengthened its argumentation with, first, a more in-depth analysis of proportionality, and, second, with reference to Strasburg standards. In particular, as the Court pointed out, the historical and political importance of the person at the head of the political regime established after the civil war and acting as head of state meant that the decision on where to bury his remains went beyond the dimension of an individual private matter.

The right to the confidentiality of listening, telephone conversation, telegraph and other correspondence of separate categories ofpersons is researched in the article. It is establishes that despite all legal guarantees, the right to the confidentiality of correspondenceis provided differently for separate categories of persons. The least secure of this right are those sentenced to imprisonment, and peop -le’s deputies, lawyers and other persons in respect of which a special procedure of criminal proceedings is carried out have the highestimmunity from illegal or arbitrary interference with the right to confidentiality of correspondence. Two scientific concepts of understandingthe right to the confidentiality of correspondence are characterized. The so-called “personal” concept, which considers thisright as a component of the right to privacy and family life, and the second concept justifies the independence of this right, the contentand purpose of which is broader than the protection of privacy. The perception of the right to confidentiality of correspondence in thecontext of the right to private and family life is common. It is substantiated that the “personal” concept is characterized by the connectionbetween the right to confidentiality of correspondence and the right to private and family life, as well as the consideration of theright to confidentiality of correspondence as a separate element of the right to privacy. Instead, the second concept considers the rightto confidentiality of correspondence as an independent right that has a relative connection with the sphere of private life and is a separatepersonal human right. It is noted that the Constitutional of Ukraine derives the right to confidentiality of correspondence in a separatearticle from the inviolability of private and family life, which leads to the conclusion that it is inexpediency to narrow the right toconfidentiality of listening, telephone conversation, telegraph and other correspondence only in privacy or family life.An analysis of the latest normative changes in the legal regulation of ensuring the right to confidentiality of correspondence inUkraine of separate categories of persons, in particular on the restriction of the right to convicted and higher guarantees of the right toconfidentiality of correspondence of deputies of Ukraine, are committed.

AbstractDespite a constitutional right to water, challenges remain for access to sufficient water in South Africa. This article considers the degree to which current legal provisions perpetuate approaches that are antithetical to genuinely eco-socio-sustainable water access. Water in South Africa has largely been re-cast as a commodity, exposed to market rules, proving problematic for many and giving rise to various responses, including litigation. In the seminal case of Mazibuko, the Constitutional Court failed to provide robust protection to the right to water, providing impetus for the formation of “commons” strategies for water allocation. Indeed, “commoning” is beginning to represent not only an emerging conceptual strand in urban resource allocation, but also a dynamic, contemporary, eco-sensitive, socio-cultural phenomenon, driving innovative, interactive and inclusive forms of planning and social engagement. Against the backdrop of unequal water access, commoning offers glimpses of an empowering and enfranchising subaltern paradigm.

The focus of this note is to analyze whether the Cybercrimes and Cybersecurity Bill provides a harmonization between search and seizure and the constitutional right to privacy. This will be achieved by discussing the State powers of search and seizure in cyberspace vis-à-vis the right to privacy as envisaged in the Protection of Personal Information Act. Further, this note investigates whether the Cybercrimes and Cybersecurity Bill achieves the purpose of combatting cybercrimes without the infringement of the right to privacy. Subsequently, the article provides plausible recommendations on how the State should lawfully conduct searches and seizures of articles related to cybercrimes.

Paper that had the title: "Juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the Legal Protection for the Rights to be Eelected." This explores two issues: 1) how the legal protection of the settings selected in the state system of Indonesia ; 2) what are juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the legal protection for the rights to be elected. To solve both problems, this paper uses normative legal research methods. Approach being used is the statute approach, case approach, and a conceptual approach. Further legal materials collected were identified and analyzed using descriptive analysis techniques. Legal protection for the right to be elected in the state system of Indonesia can be traced from the 1945 opening, the articles in the body of the 1945 Constitution, Article 27 paragraph (1), Article 28D (1) and paragraph (3) and Article 28 paragraph (3) 1945 Second Amendment, MPR Decree Number XVII/MPR/1998, Article 43 of Law Number 39 of 1999, Article 21 of the Universal Declaration of Human Rights, and Article 25 of the International Covenant  on Civil and Political Rights. Discussion of the juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the legal protection for the rights to be elected have been included: a) only on the juridical implications of representative institutions no longer marked with specified requirements as stipulated in Article 60 letter g of Law Number 12 Year 2003 in Law Number 10 Year 2008; b) juridical implications of the political field for the right to be elected is the absence of any discriminatory treatment in legislative product formed by the House of Representatives and the President as well as products of other legislation forward.

Los métodos que utilizan algunos periodistas para recabar información generan importantes conflictos. En nuestro país, las técnicas de investigación periodísticas han cobrado interés como consecuencia de que la STC 12/2012 ha determinado la prohibición constitucional del uso de la cámara oculta. Se trata de una decisión polémica, pues algunos profesionales de la información consideran que dicho pronunciamiento supone el fin del periodismo de investigación, con los consecuentes efectos negativos para el funcionamiento del sistema democrático. Si bien se considera que en los casos estudiados por el TC hasta el presente momento deben prevalecer los derechos a la intimidad y a la propia imagen sobre la libertad de información, no se comparte su prohibición total, pues pueden existir casos límite que, como consecuencia de la imposibilidad de utilizar otros métodos alternativos para obtener la información y de la gran relevancia pública de lo informado, podrían justificar la utilización de la cámara oculta. De no admitir esta posibilidad, se impediría a la prensa ejercer su papel de «perro guardián público» y, por ende, no serían de conocimiento público muchas cuestiones esenciales para el autogobierno de los ciudadanos.The methods used by some journalists to get information generate important conflicts. Journalistic investigation techniques have gathered interest in our country due to the constitutional prohibition of the use of hidden camera in the STC 12/2012. It is a polemic decision, as some professionals of information consider it implies the end of investigative journalism and therefore a negative effect on democratic system’s running. Up to now, in the cases studied at the Constitutional Court, it has been considered that the right to privacy and one’s own image should prevail over the freedom of information. Even so, the complete prohibition of the hidden camera is not shared as there may be extreme cases in which its use could be justified both due to the impossibility of using other alternative methods as well as to the public relevance of the information. If that possibility was not to be admitted, the press could not practice its role as «public watchdog» and therefore essential matters for the self-government of citizens may not be public.

On 13 February 2014, the Spanish Constitutional Court came to a final decision regarding the fate of Mr Stefano Melloni. The story of the case is worthy of attention not only from the perspective of the interaction between the Spanish Constitutional Court and the Court of Justice of the European Union (CJEU), but also from the standpoint of the conflicting levels of rights' protection in Europe. The story of Melloni can be described in three acts: setup, confrontation, and resolution.First, the setup: in 2011, the Spanish Constitutional Court made its first and (so far) only preliminary reference to the CJEU. The Constitutional Court was faced with a collision between the constitutional right to fair trial of persons convicted in absentia and the obligation under EU law to execute a European arrest warrant (heretofore EAW). This setup generated great anticipation, both because of the protagonists and the type of conflict, since in this case what obstructed one member state from complying with EU law was its higher level of constitutional protection for the right in question.

 Timbulnya pengakuan kesehatan sebagai hak asasi menunjukan perubahan paradigma yang luar biasa, karena kesehatan tidak lagi dipandang hanya sebagai urusan pribadi namun sebagai bentuk tanggung jawab negara dan hak hukum (legal rights). Tujuan diberlakukannya berbagai undang-undang terkait kesehatan adalah untuk memberikan jaminan konstitusionalitas hak atas kesehatan, namun dengan diberlakukannya berbagai undang-undang tersebut tidak berarti terjaminnya hak konstitusional atas kesehatan, hal ini tergambar dengan banyaknya uji materi terhadap berbagai undang-undang tersebut. Banyaknya permohonan uji materi tersebut menarik untuk diteliti terhadap prinsip-prinsip atau asas-asas yang melandasi materi muatan berbagai undang-undang terkait kesehatan dan konsistensi antar putusan Mahkamah Konstitusi (MK) dan konsistensi Putusan MK dengan prinsip atau asas yang melandasi materi muatan undang-undang terkait kesehatan. Dengan menggunakan metode penelitian yuridis normatif disimpulkan bahwa prinsip-prinsip atau asas mempunyai arti penting sebagai landasan materi undang-undang sehingga dapat dijadikan sebagai batu uji dalam melakukan pengujian undang-undang. Kesimpulan lainnya yakni terdapat inkonsistensi antar putusan MK dan inkonsistensi putusan MK dengan prinsip atas asas yang melandasi materi muatan berbagai undang-undang terkait kesehatan.The emergence of the recognition of health as a human right shows an extraordinary paradigm shift, because health is no longer seen only as a private matter but as a form of state responsibility and legal rights. The purpose of the enactment of various laws related to health is to provide a constitutional guarantee of the right to health, however, the enactment of these various laws does not mean the guarantee of constitutional rights to health, this is showed by the number of judicial review of various laws. The number of requests for material tests is interesting to be examined on the principles that underlie the contents of various health related to laws and consistency between decisions of the Constitutional Court (MK) and consistency of decisions of the Constitutional Court to the principles that underlie the content of laws related to health. By using the normative juridical research method, it can be concluded that principles have an important meaning as a basis for the material of the law so that they can be used as a touchstone in conducting the testing of laws. Another conclusion is that there are inconsistencies between the Constitutional Court's decisions and the inconsistency of the Constitutional Court's decision to the principle on the basis of the material content of various laws related to health.

This paper analyzes the role of the Constitutional Court of Bosnia and Herzegovina for the promotion of social justice under the conditions of a triple transformation from war to peace and from a communist regime based on the Titoist self-management ideology to a liberal-democratic political regime and economic market system in three parts. The first section describes the political, constitutional and economic context during and after the collapse of the former Socialist Federal Republic of Yugoslavia and the war in Bosnia-Herzegovina. The second section describes and analyzes the constitutional and institutional arrangements established under the General Framework Agreement for Peace, concluded in Dayton/Ohio and Paris, 1995. The third section deals with the role of the Constitutional Court and analyzes with reference to its case law the interpretative doctrines developed in its adjudication of the right to property concerning different concepts of property and the right to work in the context of the constitutionally guaranteed right to return of refugees and restitution of property.

Article 28E paragraph (1) of the 1945 Constitution states "Every person shall be free to choose and to practice the religion of his/her choice, to choose one’s education, to choose one’s employment, to choose one’s citizenship, and to choose one’s place of residence within the state territory, to leave it and to subsequently return to it.” In paragraph (2), everyone has the right to the freedom to believe in his/her beliefs, to express his/her views and thoughts, according to his/her conscience. The constitutional guarantees for believers can also be seen in Article 29 of the 1945 Constitution stating that the state shall be based upon the One and Only God and the State guarantees all persons the freedom of worship, each according to his/her own religion or belief. The Constitutional Court affirms that the right to adhere to a religion or belief in God Almighty is a citizen's constitutional right, not a gift from the state. Therefore, the state is obliged to protect and guarantee the fulfillment of the rights of it’s the citizens to embrace a belief other than the six religions developed in Indonesia. However, in practice the dissolution of beliefs is actually carried out by community organizations. In this study, two things will be discussed namely: 1) What is the legal position of adherents of belief in the national legal system? 2) Do community organizations have the authority to dissolve religious beliefs? This research is normative juridical research, in which the problems in this research are analyzed qualitatively.

Nowadays, everyone tends to use the right to freedom of speech without limitation, such as emergences of hate speech expression on various social media platforms. However, such expression is regulated by Article 28, paragraph (2) of the ITE Law and deemed to be contrary to public order. On the other hand, this law was considered by some people as a criminalization towards the right to freedom of speech. This paradox becomes a big issue that never ceases to be discussed. That is why Constitutional Court had conducted judicial review on some norms related to freedom of speech. This study aims to analyze the Constitutional Court decision towards the polarity of the right to freedom of speech and the public order. This study uses normative research with the statutory, analytical and comparative approach. Therefore, the results show the importance of limitation in implementing the freedom of speech to protect the constitutional right of society as stated in the 1945 Constitution. Despite the already decided judicial review by the Court, there is still an urgency to revise The ITE law in order to clarify certain rules related to hate speech in social media.
