Basically the law enforcement authority granted to juridical constitutional judiciary and its parts. The parts in question here include, police, prosecutors, and the Judiciary, and in addition there are also other parts like, Lawyer (Advocate), Community Organization in the field of law, such as the Legal Aid Institute (LBH), and others. Therefore, in addition to the judiciary and its parts are one of the agencies that have functions in the field of law enforcement, but the agency today has a function in the field of law enforcement. This paper explains the bases of legal aid in Islamic law through a critical study on the concept of hakam reduced from the Quranic interpretation Surah al-Nisâ’ verse 35. As a primary source of Islamic law, the Quran is believed guarantying the universal principles of Islamic law that is relevant with law enforcement. It is also implemented practically and comprehensively in the line of the bases of legal aid and developed it into the concept of hakam. Therefore, it can be seen as one of Islamic law contribution within the rule of law in Indonesia through the concept of hakam which can be formed for development of legal aid concept and its application within the law of legal aid in Indonesia.

Criminal law policy of the authority of the Corruption Eradication Commission the authority associated with the Corruption Eradication Commission (KPK) is the state agency that are unconstitutional, although not spelled out in the state constitution is the 1945 Constitution. Corruption eradication commission (KPK) was formed to look at the nature of the corruption itself is an extraordinary crime, so it requires an independent institution to fight corruption in Indonesia. Background The Commission is not due to the formation of the constitutional design rigidly interpreted, but rather incidental issues in the country and the common will of the people of Indonesia to combat corruption. Position of the Commission as a state agency is independent and free from the influence of any power, it is meant for combating corruption Commission did not get the intervention of any party. The establishment of the Commission was also a response to the ineffectiveness of the law enforcement agency performance so far in combating corruption, which impressed protracted in handling even indicated there was an element of corruption in the handling of his case. The authority granted by the Act prosecution to the Commission under the authority of the legitimate .The authority of the Commission is constitutional, it is reinforced by a number of decisions of the Supreme constitution..

В статье рассматриваются правовые и правоприменительные проблемы посещения адвокатами подозреваемых и обвиняемых, содержащихся под стражей. Проанализирована правоприменительная практика нарушений права подозреваемых и обвиняемых на получение своевременной квалифицированной юридической помощи. Обоснована необходимость наличия отлаженного государственного механизма реализации предусмотренных законом прав подозреваемых и обвиняемых. Перечислены проблемы, связанные с предоставлением свиданий адвокату с подозреваемыми и обвиняемыми, находящимися в следственных изоляторах уголовно-исполнительной системы. Проанализированы основания предоставления свиданий адвокату с подозреваемыми и обвиняемыми, содержащимися под стражей, в соответствии с действующим законодательством и нормативными актами ФСИН России. Исследован порядок посещения адвокатами подзащитных, содержащихся в следственных изоляторах уголовно-исполнительной системы, регламентированный как ведомственными нормативными актами ФСИН России, так и решениями адвокатских образований. Приведен механизм работы центра субсидируемой юридической помощи по вопросу организации посещений адвокатами подзащитных, содержащихся в следственных изоляторах. Раскрыт положительный опыт ФСИН России организации дистанционных свиданий адвокатов с подзащитными с использованием систем видеоконференц-связи. На основе рассмотренных проблемных вопросов сформулированы выводы и предложения по совершенствованию правоприменительной деятельности органов и учреждений уголовно-исполнительной системы. The article examines the legal and law enforcement problems of visits by lawyers to suspects and accused in custody. The law enforcement practice of violations of the right of suspects and accused to receive timely qualified legal assistance is analyzed. The need for a well-functioning state mechanism for the implementation of the rights of suspects and accused provided by law is substantiated. The problems associated with granting visits to a lawyer with suspects and accused persons who are in pre-trial detention centers of the penal system are listed. The author analyzes the grounds for granting visits to a lawyer with suspects and defendants in custody, in accordance with the current legislation and regulations of the Federal Penitentiary Service of Russia. The procedure for visiting by lawyers of clients held in pre-trial detention centers of the penal system, regulated by both departmental regulations of the Federal Penitentiary Service of Russia and decisions of lawyers' associations, has been investigated. The mechanism of work of the center for subsidized legal aid on the issue of organizing visits by lawyers to clients held in pre-trial detention centers is presented. The positive experience of the Federal Penitentiary Service of Russia in organizing remote meetings between lawyers and clients using videoconferencing systems is disclosed. On the basis of the considered problematic issues, conclusions and proposals were formulated to improve the law enforcement activities of the bodies and institutions of the penal system.

The challenges of drug and food supervision in the era of the 4.0 industrial Revolution, as well as the drug abuse phenomenon, traditional drug circulation, cosmetics and illegal health supplements are marbling to be addressed with a systematic performance. This research was done in a descriptive, i.e. showing surveillance data and BPOM function and a legal approach related to the surveillance function of BPOM which is so far used. The results of the analysis of the philosophy, sociological and juridical aspects show that the strengthening of BPOM one of the most important is having a special legal umbrella in the field of drug and food control. AbstractThe reality in the society of equality before the law and the protection of the law can�t easily be realized. Differences in ability, both economically and intellectually, make it difficult for justice seekers to access justice. Discrimination often occurs against marginalized communities, ranging from rule-making, implementation, to law enforcement. Therefore, we are motivated to do the devotion by providing socialization, counseling, consultation and assistance for residents of Kuningan Regency in this case the citizens of the IIA Kuningan class correctional institution who want to seek justice. this activity received a very good response, not only for the assisted citizens, but also for the officers and employees in charge. The material given in the form of film screenings about legal aid made by BPHN and the Ministry of Justice and Human Rights of Indonesia, as well as discussion material prepared by the Community Service Team. Oleh karena itu, kami tergerak untuk melakukan pengabdian dengan memberikan sosialisasi, penyuluhan, konsultasi dan pendampingan bagi warga masyarakat Kabupaten Kuningan dalam hal ini warga binaan lembaga pemasyarakatan kelas IIA Kuningan yang ingin mencari keadilan. kegiatan ini mendapat respon yang sangat baik, tidak saja bagi warga binaan, tetapi juga bagi aparat dan pegawai yang bertugas. Materi yang diberikan berupa pemutaran film tentang bantuan hukum yang dibuat oleh BPHN dan Kementerian Hukum dan HAM RI, juga materi diskusi yang disiapkan oleh Tim Pengabdian Masyarakat. Luaran yang diharapkan dari pengabdian ini adalah terbukanya akses terhadap jaminan hukum bagi masyarakat tidak mampu dan terpinggirkan, sehingga prinsip dasar Negara hukum yaitu equality before the law terpenuhi.Kata kunci : Bantuan Hukum, Warga Binaan, Persamaan

Law No. 18 of 2003 concerning Advocates emphasizes the status of Advocates as one of the law enforcers who have roles and functions that are equal to the Police, Prosecutor's Office and Judicial Power as law enforcement officers, but there is specialness given by the law to lawyers, namely the independence of advocates in carrying out their duties and profession. The independence of advocates aims to support the implementation of a justice system that is free from power and political intervention in law enforcement, and with that independence the Advocate Profession is said to be a very noble profession (offiicium nobile). As a noble profession, of course, advocates are bound by ethical values ​​that become the guidelines in the implementation of their duties and authorities, where those values ​​are posited as a Professional Code of Ethics. Talking about advocates, of course it cannot be separated from law enforcement, talking about law certainly cannot be separated from the state system or the political colors of certain countries and so on. This article wants to explain how the code of ethics of the advocate profession in upholding the law is how the role of advocates in providing justice to society based on applicable law. In conclusion, this article wants to explain that the code of ethics can compensate for the negative aspects of the profession and with the existence of a code of ethics, community trust in a profession can be strengthened, because every client has the assurance that his interests will be guaranteed, and the implementation of legal aid must be in line with the breath that becomes the goal is protection human rights and ideals of justice.

Integrated Law Enforcement in criminal Action of Legislative General Election in Makassar City. The research aimed to investigate the law enforcement in following up the criminal action of the legislative general election, the factors influencing the effectiveness of the law enforcement of the criminal action of the legislative general election carried out by the law enforcement apparatus in Makassar City. The research was conducted in the General Election Supervising Board of South Sulawesi Province, Makassar City Resort Police, Office of the Counsel for the Prosecution of Makassar, District Court of Makassar City. Data were collected by an interview and documents related to the problems examined. The research result indicates that the law enforcement authority in handling the legal matters in the legislative general election, has been carried out in line with he mandate of the acts. However, the factors such as: the substance, structure, human resources, facilities, infrastructures and culture mostly influence the course of the law enforcement. Besides, there is also the dominant factor namely the evidence determination which is imposed on the general election supervisors, very short handling time, lack of community’s participation in supervising the legislative general election, so that the law enforcement in the legislative general election carried out by the law enforcement apparatus is less maximal.

Equality before the law should be applied to all citizens impartially. However, there are still discriminatory cases against those who are in lower strata than others. So we need a legal revolution that guarantees the fulfillment of justice which is then used as a source in law enforcement practices, legal protections, and legal services for poor people or groups. In addition to Indonesia, the State of Malaysia is also trying to provide justice for all its citizens by trying to provide legal aid guarantees for its citizens who are experiencing legal problems but are not able to afford it economically. This research is intended to analyze the legal comparison of the implementation of legal aid in the State of Indonesia and the State of Malaysia for the sake of creating justice. The research also aims to find out what obstacles are encountered in the implementation of legal aid in the State of Indonesia and the State of Malaysia for the sake of creating justice.
