The purpose of this writing is to fulfill and supplement the requirements for the Magiter degree of legal sciences at the Faculty of Law of Udayana University. The specific purpose of this writing is to know the evidence and the jurisdiction of crime between the law in the trial and the construction of laws in Indonesia's laws and regulations. The method used is a normative legal research method through a statutory approach and a concept approach. Techniques used through literature studies obtained directly from the primary legal material in the form of legislation and related legal literature. The barriers to the proving process of cyber crime and jurisdiction are not in the legitimate electronic proof tool in the criminal CODE, still in the testimony of De Auditu, and difficult to find witnesses who are competent in witnessing cyber crime activities. Regarding the jurisdiction in cyber crime activities also need to be rearranged considering that it is difficult to ensure where the event, when it does and how the perpetration, considering this crime is a global crime that is unclear its jurisdiction in addition to the cyber space that the perpetration of invisible eyes. The policy on Cyber Crime is through the modernization of criminal law as some alternative such as eliminating some of the articles on Cyber Crime laws that are not used anymore (obsolete), amend KUHP, amend KUHAP, amend the Information Technology law, in proving Cyber Crime law enforcement officials, especially the judges must dare to do "rechtsvinding".

Because of these accusations, Budi Pego was charged with a 10-month prison sentence in the Banyuwangi District Court. The problem faced is how criminal liability on the perpetrators of the spread of the teachings of communism in terms of Article 107A of the Criminal Code (case study of decision No. 559 / Pid.B / 2017 / PN.Byw)? The research method used is normative legal research. The results showed that criminal liability on the perpetrators of the spread of the teachings of communism in terms of Article 107A of the Criminal Code in Decision No. 559 / Pid.B / 2017 / PN.Byw. it is inappropriate if this criminal liability model is applied to criminal liability to individuals. Considering that individual accountability still requires actions and mistakes as a basic element of accountability. That is, without any deeds and mistakes, there is no criminal liability. Regarding the Budi Pego case, the policy of criminalizing the ideology of Communism/Marxism-Leninism was decriminalized. If this cannot be done, then the legislators need to revise Law No. 27 of 1999 with the concept of eliminating articles containing formal offenses and replacing them with the formulation of material offenses and in the formulation of the weight of sanctions.

One of the legal products made by notary as a part of their authorities is a deed, both authentic deeds and underhand-made deeds. In addition to these deeds, a notary also has the authority to issue a certificate which is commonly referred to as a covernote. A certificate or covernote is a statement or note in the form of information confirming that a land ownership deed is in the process of a certificate making that is due to a process of roya, transfer of name of land ownership and splitting of one certificate into two. This study examines two issues related to notary authority, namely the basis for the notary’s authority in issuing a covernote and the legal consequences of making the covernote. This study uses a normative legal research method and a conceptual approach as well as a statutory approach. The results showed that the covernote issued by a notary was actually an ordinary certificate, not a legal product of a notary. Covernote only contains an explanation of the deed that is in the process of certification which has not been completed and will be completed within a period determined by the notary itself, so the covernote is not legally binding. The notary is authorized to make a covernote, but it is not regulated in the laws and regulations so that, if it is concluded, the covernote is not a legal product of a notary. The legal consequences for the notary if they fail to carry out the covernote, they can be held liable to solve them immediately. The legal consequence of not fulfilling the contents of the covernote is a violation of Article 1366 of the Criminal Code because notaries are considered negligent in carrying out their duties and authorities.
