The development of the motor vehicle industry sector is currently growing rapidly both domestically and imported from abroad so that in this business such as manufacturers, dealers and traders of vehicles competing with each other to provide facilities to consumers in order to increase turnover trading. In this research, it discusses efforts to resolve disputes between business owners who are harmed by consumers in the non-litigation process, and analyzes the obstacles that occur in the resolution of such disputes. The method used in this study is the empirical research method. The data used are primary and secondary data. The results showed that efforts to resolve disputes between business owners, especially motor vehicle leasing when harmed by consumers, were carried out by non-litigation, namely by using an alternative dispute resolution outside the court with mediation and negotiation mechanisms to the tenants who had apologized by returning the money agreed by both parties. In addition, the inhibiting factor in efforts to resolve disputes between business owners who are disadvantaged by consumers in the dispute resolution process is the rule of law factor. In this case because the loss is classified in the civil realm, it requires time to prove the loss that must get legality from the court. Not only the rule of law, but also law enforcement factors that process cases for so long and slow respond.

<p align="center"><strong><em>Abstract</em></strong></p><p><em>The purpose of this reseach is to describe the reality of peace at investigation levels,  then compared to islah according to Islamic law as the reason of criminal removing, to find / to know the relevance. Based on the relevance, it possible become material for the legislators to formulate islah as a model of law enforcement at the level of investigation. This research is the normative research supported by empirical research. The data used was primary and secondary data. Data was collected by means of study documentation and interviews. Data were analyzed quatitatively dan and presented quatitatively. The research showed that the completion of criminal case based on the agreement between perpetrator and victim, along the case have not reached the judge. If the agreement is violated, they agreed to use the formal law. Criminal case which are resolved with peace/islah personalized and value of the loss is relatively small. Islam placing islah as an alternative the completion of criminal matters, along the case have not reached the judge. In the literature and practice, settling disputes with peace  known as Alternative Dispute Resolution (ADR), which is based on Restorative Justice Theory. Al Qur’an has set peace/islah as a model the completion of criminal matters, long before these theories arises.  Peace/ islah in the completion of a criminal case at the level of investigation relevant to satisfy the principle of fast, simple, and inexpensive.</em></p><p><strong><em>Keyword : </em></strong><em>Islah, Islamic Law, Relevance and Investigation</em></p><p align="center"><strong>Abstrak</strong></p><p>Tujuan penelitian ini adalah mendeskripsikan realitas perdamaian pada tingkat penyidikan, selanjutnya akan dibandingkan dengan islah menurut hukum Islam sebagai alasan penghapus pidana, untuk diketahui/ ditemukan relevansinya. Berdasarkan relevansi tersebut, dimungkinkan menjadi bahan bagi pembentuk undang-undang  untuk menformulasikan islah sebagai model penegakan hukum pidana pada  tingkat penyidikan. Penelitian ini merupakan penelitian normatif  yang didukung dengan penelitian  empiris. Data yang digunakan mencakup data primer dan data sekunder. Teknik pengumpulan data  dilakukan dengan cara studi dokumentasi dan wawancara. Data dianalisis secara kualitatif dan disajikan secara deskriptif. Hasil penelitian menunjukan penyelesaian perkara pidana dengan perdamaian pada tingkat penyidikan mendasarkan kesepakatan pelaku dan korban. Apabila kesepakatan itu dilanggar, mereka sepakat untuk menggunakan hukum formal. Perkara pidana yang diselesaikan dengan perdamaian/ islah, bersifat personal dan nilai kerugiannya relatif kecil. Islam menempatkan perdamaian/islah sebagai alternatif penyelesaian perkara pidana, sepanjang perkara tersebut belum sampai ke tangan hakim. Dalam literatur dan praktik,  penyelesaian perkara dengan perdamaian disebut <em>Alternative Disput Resolution </em>(ADR) yang mendasarkan pada teori <em>Restorative Justice. Al-Qur’an </em>telah menetapkan Perdamaian/ Islam sebagai model penyelesaian perkara pidana, jauh sebelum teori-teori itu muncul<em>. Perdamaian/ Islah  </em>dalam penyelesaian perkara pidana ditingkat penyidikan, relevan untuk pemenuhan asas cepat, sederhana dan biaya ringan.</p><p><strong>Kata Kunci: </strong>Islah, Hukum Islam, Relevansi dan Penyidikan</p>

In resolving land acquisition disputes for the public interest, it is fitting for the state to pay attention to values outside of the rule of law itself, including the value of social justice and the value of benefits to guarantee the basic rights of affected communities. This study aims to find out what factors cause the settlement of land acquisition disputes in terms of juridical aspects not reflecting the value of justice and benefit for the parties and formulating land acquisition dispute resolution models in a legal socio perspective that can realize the value of social justice and benefits for party. an appropriate method is needed that can accommodate the value of social justice and the benefits in resolving the dispute, among others, promoting the Consensus Meeting and the Need for Alternative Dispute Resolution (ADR) as an alternative solution. Abstract Palestine’s alternative dispute resolution process, the ṣulḥa system, is utilized in the vast majority of civil and criminal disputes. Despite the popularity of the ṣulḥa process, there exists, to date, no international legal assessment of such proceedings. This article assesses Palestinian ṣulḥa’s adherence to international rule of law standards. Using rule of law theory to assess the fairness, equity, and accessibility of the ṣulḥa system, this article determines that Palestinian ṣulḥa proceedings satisfy the major requirements of international rule of law standards.

The workplace is a focal point for debates about religion and public life. This article examines the question of religion at work, and how to fairly resolve the conflicts it generates. Specifically, it advocates for the use of alternative dispute resolution to address these conflicts. Alternative dispute resolution refers to a set of dispute processing methods, mainly arbitration and mediation. Unlike litigation, these procedures rely on the consent and cooperation of the parties involved. I argue that alternative dispute resolution is best conceived of as a desirable complement to the rule of law rather than a cheaper alternative. It conveys a distinctive approach to procedural fairness, which is attentive to individual circumstances, and it frames the relationship between disputants in a cooperative way. Alternative dispute resolution is thus a valuable tool for the accommodation of religious diversity in the professional world.

One of the authorities of the Consumer Dispute Settlement Agency (BPSK) is to receive both written and unwritten complaints from consumers regarding the occurrence of violations of consumer protection. Article 52 Sub-Article g of the Consumer Protection Law (UUPK) au- thorizes BPSK to summon business actors who allegedly violate consumer protection. However, in practice in the field, BPSK is not authorized to force involuntary calling of business actors so that many business actors refuse to be present at consumer dispute resolution in BPSK. This research is Normative and Analytical Descriptive Research. In this case, it is a Nor- mative Legal Research in the form of research to find the Law of Concreto, the research to find the law for a case in concreto is an attempt to find out whether the appropriate law to apply in cocreto in order to solve a particular case and see the rule of law is found . This research will illustrate various legal issues and other symptoms related to cases concerning consumer protec- tion and BPSK Implementation of consumer protection law enforcement in practice is not yet fully fea- sible. It can be seen apart from awareness of the ability and independence of consumers to protect themselves against the rights and kewajibanya, also can be seen from law enforcement officers who have not performed optimally. efforts that can be made by BPSK after forced calling of business actors who refuse to attend the consumer dispute resolution can make a verdict verdict if the business actor is not present 3 times on the summons of the session by BPSK as stipulated in Article 52 UUPK and Kemendag. 35/2001.

AbstractThe purpose of this article is to examine the interaction between the court and alternative dispute resolution (ADR) in the legal administration of civil justice. It addresses the following questions. What is the relationship between ADR and the concept of justice? How do we make sense of the anti-ADR views, in particular the serious threat to the rule of law? What role does, and should, the court play in alternative processes? It argues that integrating ADR into the court system broadens the notion of justice and its access, and that, under the rule of law, judges should play a more central role to ensure the use, quality and integrity of alternative processes. This paper extends our understanding of the relationship among justice, ADR and the court from an internal perspective. It also points out the need to expand the case management responsibilities of judges, and their delegates in the Online Court, on ADR.

The Constitution of Kenya, 2010, envisions a prominent role for alternative dispute resolution, including traditional dispute resolution mechanisms. This is in addition to other legislative frameworks which provide for non-formal methods of dispute resolution. A thesis is made that formal forums such as litigation through courts of law have various disadvantages including complexity, high costs, and technical procedures, delays, amongst others, which make a strong case for the usually convenient and available ADR mechanisms. Put to good use, these mechanisms have potential to spur economic development through enhanced access to justice and the rule of law. The authors, indeed, argue that there is a golden thread that weaves across the themes of rule of law, human rights and access to justice and development.

Rule of law is the foundation of modern democracies. It envisages, inter alia, participatory lawmaking, just and certain laws, a bouquet of human rights, certainty and equality in the application of law, accountability to law, an impartial and non-arbitrary government, and an accessible and fair dispute resolution mechanism. This work’s primary goal is to understand and explain the obvious dichotomy that exists between theory and practice in India’s rule of law structure. The book discusses the contours of the rule of law in India, the values and aspirations in its evolution, and its meaning as understood by the various institutions, identifying reason as the primary element in the rule of law mechanism. It later examines the institutional, political, and social challenges to the concepts of equality and certainty, through which it evaluates the status of the rule of law in India.

Corrupted state assets certainly hurt the country narrowly, but also broadly where it harms the country and its people. However, the formal approach through the current criminal procedure law has not been able to recover the losses suffered by the state. In fact, state losses resulting from corruption are state assets that must be saved. Then there needs to be a new breakthrough to recover state losses through the asset recovery model. When looking at the country from the perspective of the victims, the state must obtain protection, in this case recovery from the losses suffered due to corruption. This paper examines the model of returning assets resulting from corruption in the law enforcement process that focuses on the rule of law in the 2003 UNCAC Convention and the mechanism of returning state assets in terms of Law No. 20 of 2001 concerning amendments to Law No. 31 of 1999 concerning Eradication of Corruption Crimes.
