State Conformity with Federal Tax Changes

ABSTRACT: We examine the decisions by state legislatures to conform to or decouple from federal tax legislation. We use a generalized estimating equations (GEE) approach to estimate the parameters of a model of factors associated with the state legislative decisions to conform their own tax systems to accommodate 11 federal tax reductions implemented between 2002 and 2008. Our model predicts that state legislators consider political, budgetary, and ease of compliance factors when considering whether to adopt federal tax changes into their own states’ tax codes. Our results are generally consistent with expectations, identifying several factors that are associated with the probability that a state will incorporate revenue-reducing tax changes implemented by the federal government. Our results also suggest that although state legislators appear to value conformity with the tax initiatives of the federal government, given rising budgetary pressures, state conformity with such legislation is likely to decrease in coming years.

State legislators routinely run for the state Senate after having served in the state House; however, this rarely occurs in the other order. Do members simply look to move up based on the conventional view of the political ambition ladder? Alternatively, do institutional reasons exist that make the Senate the preferred chamber? I examine the differences between the state legislative chambers and discuss institutional reasons why members may prefer the Senate to the House. Overall, I find chamber size is an important intra-institutional variable in explaining this variation along with the professionalism of the legislatures and term limits.

This chapter discusses the fact that state constitutions create a legislative branch that is substantially different from the federal Congress. Most importantly, state legislatures exercise reserved, plenary power subject only to limitations in the state or federal Constitutions. The federal Congress, by contrast, exercises enumerated, delegated power. In addition, the state legislatures are subject to a variety of limitations on the process of lawmaking that are contained in state constitutions. The chapter discusses the variety of approaches to judicial enforcement of these procedural limitations. Finally, in a number of states, the state legislature's lawmaking power is shared with the people, who can enact or defeat laws through direct democracy, or the initiative and referendum processes.

Abstract Background The burden of malaria in Uganda remains high, but has become increasingly heterogenous following intensified malaria control. Travel within Uganda is recognized as a risk factor for malaria, but behaviours associated with travel are not well-understood. To address this knowledge gap, malaria-relevant behaviours of cohort participants were assessed during travel and at home in Uganda. Methods Residents from 80 randomly selected households in Nagongera sub-county, Tororo district were enrolled into a cohort to study malaria in rural Uganda. All participants were given long-lasting insecticidal nets (LLINs) at enrolment and were evaluated every 4 weeks at the study clinic. Participants were asked if they had travelled overnight from their home, and if so, a questionnaire was administered to capture information on travel details and behaviours. Behaviour while travelling was assessed within 4 weeks following travel during the study clinic visit. Behaviour while at home was assessed using a similar questionnaire during two-weekly home visits. Behaviours while travelling vs at home were compared using log binomial regression models with generalized estimating equations adjusting for repeated measures in the same individual. Analysis of factors associated with LLIN adherence, such as destination and duration of travel, time to bed during travel, gender and age at time of travel, were assessed using log binomial regression models with generalized estimating equations adjusting for repeated measures in the same individual. Results Between October 2017 and October 2019, 527 participants were enrolled and assessed for travel. Of these, 123 (23.2%) reported taking 211 overnight trips; 149 (70.6%) trips were within Tororo. Participants were less likely to use LLINs when travelling than when at home (41.0% vs. 56.2%, relative risk [RR] 0.73, 95% CI 0.60–0.89, p = 0.002); this difference was noted for women (38.8% vs 59.2%, RR 0.66, 95% CI 0.52–0.83, p = 0.001) but not men (48.3% vs 46.6%, RR 0.96, 95% CI 0.67–1.40, p = 0.85). In an adjusted analysis, factors associated with LLIN use when travelling included destination (travelling to districts not receiving indoor residual spraying [IRS] 65.8% vs Tororo district 32.2%, RR 1.80, 95% CI 1.31–2.46, p < 0.001) and duration of travel (> 7 nights 60.3% vs one night 24.4%, RR 1.97, 95% CI 1.07–3.64, p = 0.03). Conclusions Travellers, particularly women, were less likely to use LLINs when travelling than when at home. LLIN adherence was higher among those who travelled to non-IRS districts and for more than 1 week, suggesting that perceived malaria risk influences LLIN use. Strategies are needed to raise awareness of the importance of using LLINs while travelling.

Paper money, a major component of the colonial money supply, was critical to the economic policies of the colonial legislatures. Why did the state legislatures relinquish the power to issue money to the new federal government through the ratification of the Constitution? Hostility between states with radically different philosophies regarding paper money raised concerns about the viability of the union, and it was this fear which led to the clause in the Federal Constitution that prohibited state paper money issues.

This chapter explores the history and operation of state legislatures. The urban-rural divide characterizes stark political and social differences that fuel legislative behavior. The content of public policies across the United States is influenced by these divisions and contributes to either the support of or opposition to social change. State legislators are on the front lines of these geographic ideological divides. These variations by region contribute to the increase in single-party control and have generated pronounced policy differences.

This chapter analyzes the indirect elections of U.S. senators in state legislatures within a broader theoretical framework of how parties interact with institutional and electoral settings to affect electoral and policy outcomes. It identifies key participants in Senate campaigns during this period—candidates for U.S. Senate, business interests, political party organizations, and state legislators—and constructs a model for how these stakeholders interacted with each other within the structure of legislative choice for U.S. senator along four dimensions—candidate identification, candidate nomination, election criteria, and system responsiveness. It also discusses how an anticipated indirect Senate election might have affected voter turnout in the preceding state legislative election.

The president's party consistently loses partisan control of state legislatures in midterm elections, a pattern similar to the loss of seats in the U.S. House of Representatives in midterms. This study examines presidential coattails as a possible explanation of these losses. Aggregate state legislative election outcomes between 1944 and 1984 in 41 states are examined. The analysis indicates that the president's party gains seats in presidential elections in proportion to the presidential vote in a state, and subsequently loses seats in midterm elections also in proportion to the prior presidential vote in the state. The presidential coattail and the midterm repercussion effects are evident even when gubernatorial coattail effects are introduced, but are fairly modest in states lacking competitive parties.

The race for the White House is at the top of the ticket, but voters will also choose more than 5,000 state legislators in November 2016. While voters elect and hold the president responsible for one job and state legislators for another, the outcomes of their elections are remarkably related. In analyses of elite and voter behavior in state legislative elections, I show that legislators affiliated with the president’s party—especially during unpopular presidencies—are the most likely to be challenged, and compared with individual assessments of the state legislature, changes in presidential approval have at least three times the impact on voters’ decision-making in state legislative elections. Thus, while state legislatures wield considerable policymaking power, legislators’ electoral fates appear to be largely out of their control.

This book adopts a multifaceted approach to study of black state legislators across the country. Using the descriptive representation framework, multiple facets of black representation are studied. Black seat share is the primary facet considered, and it is measured as the proportion of seats held by blacks in the state legislature. The black representation ratio measures the black seat share relative to the black population share. Parity exists when blacks are represented in the state legislature at a rate that matches their population share. Legislative black caucuses are also studied in this work, representing the institutionalization of the black presence in state legislatures. The first half of the book shows that while black people are critical for explaining black representation in state legislatures, that institutional and non-racial demographic factors also account for the black seat share, black representation ratio, and emergence of state legislative black caucuses. A “demographics is destiny” explanation insufficiently accounts for blacks gaining voice in state legislatures. The second half the book considers the consequences of black representation in state government. On the one hand, a greater black presence increases education spending, black political involvement, and liberalizes black public opinion. On the other hand, an increased black presence is linked with less liberal welfare policy, in particular in places where Democrats hold the majority of state legislative seats. Thus, an increased black presence in the legislature can be seen as a double-edged sword.
