Construído a partir de questões discutidas em uma dissertação de mestrado a respeito do princípio constitucional da gestão democrática do ensino público, este trabalho apresenta discussões sobre gestão democrática, autonomia, conselho escolar, participação e tomada de decisão, categorias de análise que contextualizam o tema e orientaram as técnicas utilizadas na investigação. Conclui que a alteração estrutural sem efetiva descentralização, autonomia, formação e recursos demonstrou insuficiência para promover a participação e democratizar o poder nas escolas. Abstract Derived from questions debated in a masters dissertation regarding the constitutional principle of the democratic management of the public education, this work presents questions on democratic management, autonomy, school council, participation and decision taking, categories of analysis that contextualize the subject and orient the techniques used in the research. It concludes that the structural alteration without effective decentralization, autonomy, formation and resources were not sufficient to promote participation and to democratize schools. <p>O objetivo deste artigo é contribuir ao debate acerca da gestão do Poder Judiciário tendo como referência o princípio constitucional da eficiência na administração pública e os princípios da gestão da qualidade. Sob esse enfoque são abordados os temas da crise na administração pública e na administração judiciária. Através de uma revisão bibliográfica em livros e artigos levantou-se as contribuições de autores sobre o tema em análise. Uma correlação entre os princípios da qualidade e a realidade encontrada na administração de unidades judiciárias, através das fontes analisadas para o estudo, é realizada com o fim de demonstrar a validade da aplicação dos princípios para nortear as mudanças necessárias para a melhoria da prestação jurisdicional e a aumentar a satisfação da sociedade. O artigo apresenta a aplicabilidade de um sistema de gestão da qualidade, conforme o modelo da norma ABNT NBR ISO 9001:2015, como uma alternativa eficaz para que o Poder Judiciário apresente a resposta mais adequada para a necessidade de melhoria na eficiência da gestão do Poder Judiciário.</p><p> </p><p>The purpose of this article is to contribute to the debate about the management of the Judiciary having as point of reference the constitutional principle of efficiency in the Public Administration and the principles of quality management. This approach addresses the issues of crisis in the public administration and judicial administration. Through a bibliographical review in books and articles the contributions of authors on the subject under analysis were compiled. A correlation between the principles of quality and the reality found in the management of judicial units, through the sources analyzed for the study, is established in order to demonstrate the validity of the application of the principles to guide the changes necessary to improve the jurisdictional performance and to increase the satisfaction of society. The article presents the applicability of a quality management system, according to the model of ABNT NBR ISO 9001: 2015, as an effective alternative for the Judiciary to provide the most appropriate response to the need of improving the efficiency of the Judiciary management.</p><p> </p>

<p>Analysis of the incidence of the Statute of Introduction to the Rules of Brazilian Law (in the writing given by Act 13.655/2018) on the interpretation of public law rules: interpretative operations and general principles of administrative law</p><p> </p><p>O presente trabalho pretende analisar as inovações legislativas produzidas pela Lei nº 13.655/2018, bem como suas consequências jurídicas. Tal Diploma Legal modificou o Decreto-Lei nº 4.657/1942, denominado de “Lei de Introdução às Normas do Direito Brasileiro”. Para tanto, o trabalho se dividiu em seis eixos teóricos: primeiro se disserta sobre as modificações legais que traçam parâmetros interpretativos com foco no “consequencialismo” e o “realismo” da interpretação do direito público. Por conseguinte, analisam-se as disposições relativas à segurança jurídica. Em um terceiro plano, confere-se ênfase aos mecanismos legais que franqueiam maior participação e consenso entre a administração pública e o cidadão. Ainda, tratar-se-á de analisar a reponsabilidade das autoridades públicas e dos agentes que atuam na função consultiva. Também a eficiência administrativa será objeto de estudo, percebendo o que a legislação mencionada inovou no tema. Por fim, será demonstrado como a motivação das condutas administrativas, já merecedora da devida importância, dado seu status de princípio constitucional, restou ainda mais prestigiada pela Lei nº 13.655/2018. Analisar-se-á dissertativamente tal legislação, essencialmente em relação aos aspetos relativos à aplicação da Lei de Introdução às Normas do Direito Brasileiro (na redação dada pela Lei nº 13.655/2018) no que concerne à interpretação e aplicação de normas de direito público e, muito particularmente, ao modo como, nessas operações interpretativas, se enformam certos princípios gerais de direito administrativo, a fim de se perceber analiticamente as mudanças e potencialidades feitas pela edição da recente norma.</p><p> </p><p>The present work intends to analyze the legislative innovations produced by Legal Act nº 13.655/2018, as well as its legal consequences. This legislation modified Legal Act nº 4.657/1942, called “Statute of Introduction to the Rules of Brazilian Law”. In order to do so, the work was divided into six theoretical axes: first, it discusses the legal modifications that draw interpretive parameters with a focus on “consequentialism” and the “realism” of the interpretation of Public Law. Consequently, the provisions on legal certainty are examined. In a third plan, emphasis is placed on the legal mechanisms that lead to greater participation and consensus between the Public Administration and the citizen. Also, it will be a question of analyzing the responsibility of the public authorities and of the agents that act in the advices function. Also the administrative efficiency will be object of study, realizing what the mentioned legislation innovated in the subject. Finally, it will be demonstrated how the motivation of administrative conduct, already deserving of due importance, given its status as a constitutional principle, remained even more prestigious under Legal Act nº 13.655/2018. Such legislation will be analyzed, essentially in relation to the aspects related to the incidence of the Statute of Introduction to the Rules of Brazilian Law (in the wording given by Legal act nº 13.655/2018) regarding the interpretation of norms of Law Public and, in particular, to the way in which, in these interpretative operations, certain general principles of Administrative Law are formed, in order to understand analytically the changes and potentialities made by the edition of the recent norm.</p>

The article raises the question of the causes of the public education crisis, both the crisis in recent past and that conditioned by several centuries of Poland’s past. The position of Adam Podgórecki on the subject of comprehensive analyses of Polish society is particularly important. It combines two positions. He believes that Polish systemic crises can be put down to the experiences of post-totalitarianism and Polish unique defects persisting for several centuries. The author of the article negatively assesses the possibility of overcoming the crisis of public education by academic elites, which are responsible for the collapse of universities and the crisis of higher education. Common beliefs about public education have turned out to be illusions. The author sees the hopes of improving the state of public education in resistance to the destruction of democracy and to the strong ideological and political pressure. Openness to Europe and the world, which Poles do not give away, inspires hope, too.

RESUMOPropõe-se nesse artigo discutir sobre o processo de elaboração/execução do Projeto Político Pedagógico para a educação básica do campo. Na tentativa de desvendar objeto de investigação nas suas determinações histórico-sociais, buscou-se como referência metodológica a perspectiva materialista histórico-dialética, por contemplar o desafiode captar o movimento/contradições da realidade estudada, cujo lócus são as escolas dos assentamentos conquistados pelo Movimento dos Trabalhadores Rurais Sem Terra – MST, este, que historicamente luta por escolas públicas para campo. Inicialmente, percebeu-se que a luta desse movimento foi por educação para educar os filhos dos que lutavam pela conquista da terra. Dessa forma, surgem as primeiras escolas nos assentamentos e tem início as discussões sobre a Educação no e do campo. Atualmente, o debate tem motivado a realização de pesquisas e uma produção significativa, além da conquista dos instrumentoslegais e da realização de importantes eventos visando assegurar a educação pública. Por outro lado, cresceu a necessidade de se elaborar um Projeto Político-Pedagógico para as escolas de educação básica do campo. Assim, estaca-se a importância de refletir sobre a educação e oprojeto educativo que se quer para o campo. Nesse intuito, sustenta-se essa análise numa concepção ampliada de educação, a qual deve ser fundamentada nos âmbitos político, técnico e ético para a formação humana, nos diferentes contextos da realidade do campo. Essa, portanto, é uma proposta contrária a atual lógica de formação, voltada, predominantemente, para o mercado. Com base nesse pressuposto, cabe contribuir criticamente para o elineamento do Projeto Político Pedagógico (PPP) das escolas do campo, pois o mesmo deve ser construído coletivamente, uma vez que este se constitui instrumento estruturante da identidade escolar, da gestão democrática e da ação docente.Palavras-chave: Projeto Político Pedagógico. Educação do Campo. Movimento dos Trabalhadores Rurais Sem Terra.ABSTRACTIt is proposed in this article a discussion on the process of developing / implementing the Political Pedagogical Project for rural basic education. As an attempt to unravel the subject of investigation in its historical and social determinations, it sought as a methodological reference to historical and dialectical materialism, to contemplate the challenge of capturing the movement / contradictions of reality studied, whose locus are schools of settlements won by Landless Workers’ movement - MST, this, that historically struggle for rural public schools to. Initially, it was realized that the struggle of this movement was for education to educate the children of those who fought for land. Thus, there are the first schools in the settlements and opened discussions on education in and the countryside. Currently, the debate has motivated the development of research and significantproduction in addition to the achievement of the legal instruments and as part of major events to ensure public education. On the other hand, it increased the need to develop a political-pedagogical project for rural basiceducation schools in the. Thus, there is the importance of thinking about education and educational project that wants to countryside. To that end, it is claimed that analysis in a broad view of education, which should be based on political, technical and ethical spheres to the human, in the different contexts of the reality of the countryside. This therefore is a proposal contrary to current lineup of logic, geared redominantly to market. On that basis, it is critically contribute to the design of the Political Pedagogical Project (PPP) of schools in the countryside, as it should be built collectively, since this constitutes a structural instrument of school identity, democratic management and teaching activities.Keywords: Pedagogical Political Project. Inicialmente, se dio cuenta de que la lucha de este movimiento fue la educación para educar a los hijos de los que lucharon por la tierra. Por lo tanto, existen las primeras escuelas en los asentamientos y discusionesabiertas sobre educación en y del campo. En la actualidad, el debate ha motivado el desarrollo de la investigación y la producción significativa, además de la consecución de los instrumentos legales y como parte de importantes eventos para garantizar la educación pública. Por otro lado, aumentó la necesidad de desarrollar un proyecto político-pedagógicopara las escuelas de educación básica en el campo. Por lo tanto, existe la importancia de pensar la educación y el proyecto educativo que quiere a campo. A tal efecto, se afirma que el análisis de una visión amplia de la educación, que debe basarse en las esferas políticas, técnicas y éticas para el ser humano, en los diferentes contextos de la realidad del campo. Por lo tanto, esta es una propuesta contraria a la alineación actual de la lógica, orientada principalmente al mercado. Sobre esa base, se contribuye críticamente para el diseño del Proyecto Político Pedagógico (PPP) de las escuelas en el campo, ya que debe ser construida colectivamente, ya que esto constituye un instrumento estructural de la identidad de la escuela, la gestión democrática y actividades de enseñanza.Palabras clave: Proyecto Político Pedagógico. The paper actualizes the problem of discourse pragmatics. The authors provide the detailed description of the communicative techniques for enhancing the pragmatic utterance effect of the medical discourse subject in the open communication situation. The study is based on the texts of conference reports and interviews of representatives of the medical and scientific elite who have addressed the topic of a new coronavirus infection pandemic in 2020-2021 and those are solving the task of the public education in the area. Based on this analysis the authors provide a system of speech tactics that ensure the solution of this problem, and linguistic techniques for their implementation, which together form the pragmatic effect of the statements of the subject of medical discourse.

The subject of project financing provides the opportunity to consider a new model of public intervention characterised by co-operation with the private sector, and the transformation of the public sector from the owner of the work into the entity that plans and monitors the activities rendered. At contractual level, this new paradigm of action demands the adoption of forms of contract and protective instruments functional to a relation between public and private interests characterised not by antagonism, but by "necessary co-operation". In this perspective, the goal pursued is that of reconstructing the discipline of project financing as a homogenous regulatory corpus inspired by the constitutional principle of horizontal subsidiarity, a microsystem within the context of public contracts.

Despite the long history of the science of geography, its current educational position is uncertain. Meanwhile, it offers knowledge elements useful in everyday life, required for literacy in natural sciences. The subject is unique in giving information necessary for orientation in the social-economic field and reveals the relationship between the society and the environment. In Hungary the public educational requirements for a subject include the incorporation of social scientific results or the transfer of integrated knowledge founding such results. This requirement is met fully in the curriculum of geography, however, continuously decreasing the number of lessons reduces its efficiency. The questionnaire survey covering 1218 respondents focuses on the position of geography as a subject in public education and on the opinion regarding the knowledge it provides and assesses the depth of geography people have from what they learnt in school. This article aims to understand the implications of the School Development Plan (PDE) in public school planning. The PDE is taken as representative of the managerial policy in development in Brazil, particularly in the state network in Pernambuco, the locus of this investigation. Using the public policy cognitive approach (MULLER; SUREL, 2002), the data were analyzed from a dialectical view of management, in which the subject plays a preponderant role in the coordination of action. It was observed that the development of this policy increased the regulation of schools through their planning and strengthened control of learning outcomes. The participation process instituted by the PDE ended up reducing the function of the collegiate, while at the same time did not favor the perception of the school in its complexity. After almost two decades of the development of this plan, allied to the policy of reward for results established in Pernambuco, it can be concluded that the PDE has contributed to raise the passivity posture observed in the teachers' discourse, against the principles of managerialism in school management emphasized by this Plan. Democratic management is still far from being achieved, since the principles of autonomy and participation, fundamental in this power system, assume in the EDP a technical and operational significance to the detriment of the expected political-pedagogical sense.
