<p align="justify">Con el fin de garantizar la aplicación de la Directiva 89/665/CEE modificada por la Directiva 2007/66/CE, la Ley 34/2010, introduce en el ámbito estatal la creación de un órgano administrativo independiente de carácter especializado para resolver el recurso especial en materia de contratación, las cuestiones de nulidad y las reclamaciones en los procedimientos de adjudicación en los sectores del agua, energía, transportes y servicios postales. En el ámbito de las Comunidades Autónomas, el artículo 41.3 del TRLCSP encomienda la creación de dicho órgano a la respectiva normativa autonómica. En cumplimiento de la normativa comunitaria y estatal aludida, el Consejo de Gobierno de la Junta de Andalucía crea el Tribunal Administrativo de Recursos Contractuales de la Junta de Andalucía a través del Decreto 332/2011, de 2 de noviembre, objeto de este trabajo.</p> <p align="justify"><b>In order to ensure the implementation of Directive 89/665/EEC amended by Directive 2007/66/EC, the Law 34/2010, introduced at the state level to create an independent administrative body of a specialized nature to solve the resource particular procurement, the issues of invalidity and complaints procedures for the award in the water, energy, transport and postal services. In the area of the Autonomous Communities, Article 41.3 of TRLCSP entrusted the creation of that body to the relevant regional rules. In compliance with EU regulations and state aforementioned, the Governing Council of the Andalusian creates the Administrative Tribunal of Contract Resources of the Andalusian by Decree 332/2011 of 2 November, the subject of this work.</p>

LABURPENA: Landa-errentamenduaren kontratua arautzen du estatuko 49/2003 Legeak, 26/2005 Legearen bidez aldatuak, baina ez da aplikagarria Zuzenbide zibil berezi bat daukaten autonomia-erkidegoetan. Euskal Autonomia Erkidegoan orain arte ez da kontratu mota horri buruzko araurik hartu, baina Galizian eta Katalunian legegilea bere eskumenez baliatu eta xedapenak hartu ditu, kontuan hartuz zer nolakoak diren lurraldea, bertako ondasunak, eta errenta-emaileen eta errenta-hartzaileen beharrak. Halaber, aipagarria da beste autonomia-erkidego batzuetako arautegia, non landa-errentamenduarekin harreman estua duten nekazaritza-kontratuak agertzen diren. RESUMEN: El contrato de arrendamiento rustico queda regulado, a nivel estatal, por la Ley 49/2003, modificada mediante la Ley 26/2005, si bien la misma no resulta aplicable en aquellas comunidades autonomas que disponen de un Derecho civil propio escrito en la materia. A diferencia de lo que ocurre en el Pais Vasco, donde, hasta la fecha, no se ha adoptado norma alguna relativa a este tipo contractual, en Galicia y Cataluna el legislador ha ejercido la competencia que ostenta en la materia y ha adoptado disposiciones que tienen muy presentes las caracteristicas de su territorio, de los bienes sitos en el mismo y de las necesidades de sus arrendadores y arrendatarios. Asimismo, resulta destacable la normativa existente en otras comunidades autonomas, en la que se regulan distintos contratos agrarios que guardan una estrecha relacion con el arrendamiento rustico. ABSTRACT: The contract of land tenancy is regulated at the state level by Act 49/2003 amended by Act 26/2005 even though it is not applicable to those autonomous communities with their own written civil law on the subject. Unlike in the Basque Country, where no regulation has been adopted regarding this type of contract so far, in Galicia and Cataluna the legislators have exercised their competence on the subject and have adopted provisions that have the characteristics of their territories, goods placed therein and the needs of tenants and lessors very present. Likewise, it is remarkable the existing normative in other autonomous communities where different agrarian contracts with a close connection with land tenancy are regulated.

This essay theorizes how the enforcement of universal norms contributes to the solidification of sovereign rule. It does so by analyzing John Locke’s argument for the founding of the commonwealth as it emerges from his notion of universal crime in the Second Treatise of Government. Previous studies of punishment in the state of nature have not accounted for Locke’s notion of universal crime which pivots on the role of mankind as the subject of natural law. I argue that the dilemmas specific to enforcing the natural law against “trespasses against the whole species” drive the founding of sovereign government. Reconstructing Locke’s argument on private property in light of universal criminality, the essay shows how the introduction of money in the state of nature destabilizes the normative relationship between the self and humanity. Accordingly, the failures of enforcing the natural law require the partitioning of mankind into separate peoples under distinct sovereign governments. This analysis theorizes the creation of sovereign rule as part of the political productivity of Locke’s notion of universal crime and reflects on an explicitly political, rather than normative, theory of “humanity.”

In recent years, the idea that constitutional modes of government are exclusive to states has become the subject both of sustained challenge and of strong defence. This is due to the development at new regional and global sites of decision-making capacities of a scale and intensity often associated with the demand for constitutional governance at state level, to the supply at these same new sites of certain regulatory institutions and practices of a type capable of being viewed as meeting the demand for constitutional governance, as well as to a growing debate over whether and in what ways these developments in decision-making capacity and regulatory control should be coded and can be constructively engaged with in explicitly constitutional terms. The aim of the article is threefold. It asks why taking the idea and associated ethos and methods of constitutionalism ‘beyond the state’ might be viewed as a significant and controversial innovation, and so in need of explanation and justification – a question that requires us to engage with the definition of constitutionalism and with the contestation surrounding that definition. Secondly, taking account of the various arguments that lie behind these definitional concerns, it attempts to develop a scheme for understanding certain key features of constitutionalism and of its post-state development that is able to command broad agreement. Thirdly, and joining the concerns of the first two sections, it seeks to identify the key current tensions – or antinomies – surrounding the growth of post-state constitutionalism with a view to indicating what is at stake in the future career of that concept.

This article explores the creation of the image of a Soviet woman within the Soviet cinematography. The subject of this research is the female image formed by the Russian cinematography at certain stages and its dynamics. The author suggest understanding of the image of woman as a combination of sensible images, which include representations on the place, role, functions, traits that are potentially common to her, but are yet to be formed and realized. Detailed analysis of the films of the early XX century allows examining creation of the female image, the expectations, moods, perceptions of the future presented in the films, as well as tracing the correlation between semantic content and its visualization. Due to the fact that the image was designed gradually, the author considered the key social and political factors that affected its creation and found reflection within it. Special contribution of the author into the research of this topic consists in demonstration of a relatively holistic image of a Soviet woman in cinematography, which was comprise bit by bit and transformed, meeting the challenges, demands and needs of society and the state. &nbsp;

The subject of the research is General trends and changes in the field of resource conservation occurring in the economy at the national level, in the aspect of state regulation. The purpose of the work is to determine the level of resource efficiency of the Russian economy, to formulate the key directions of state policy implementation for activating resource-oriented projects. The basic approaches to the interpretation of the category “resource saving” are worked out, the content essence of the definition is established. The analysis of foreign experience in implementing and supporting resource-saving measures at the state level is carried out. Determined main tasks of implementation of resource-saving policy of the state; developed tools to enhance and regulate the resources; formed and grounded conceptual positions of methodical maintenance of transition of the national economy of Russia to the path of sustainable development.

Everyone in Russia has been preparing to the 75th anniversary of the victory in World War Two despite the fact that the state-level commemoration events are being impeded by the global disaster which may be compared to a world war: the COVID‑19 pandemic. Like a war, it will eventually end but the memory about the anniversary must and will live on. Therefore, the subject of the article is topical: commemoration light and memory in light of an eternal flame and artistic and sacral illumination (Tribute in Light, like it was in New York in 2001). Numerous issues of architectural lighting of memorial sites and monuments in different Russian cities are under consideration. Positive and negative examples of light design solutions are described. It is also noted that information on contemporary state of this area is extremely insufficient.

The article is devoted to the socio-philosophical and religious studies analysis of the charitable activities in Islam. The subject of the research is the theological foundations of caritative activity in Islam. The mechanism of interfaith interaction in the field of charity is considered on the example of the Vladimir Mukhtasibat of the Central Spiritual Directorate of Muslims of Russia. Recommendations for the creation of applied strategies in the field of caritative partnership are given. The modern policy of the state is aimed at the implementation of interfaith interaction, including the interaction of religious organizations with government authorities. At the present time, the norms of socio-caritative relations between religious organizations and the state are mostly declared, definitions are generalized and are unable to concretize most of the interaction mechanisms. The key to the successful functioning and development of caritative activity is the equality of religious organizations and the absence of priority spiritual directions for state bodies when building a policy of caritative interaction.

THE EVOLUTION OF THE MUNICIPAL NETWORK OF THE STATE OF PARANÁ AND THE RECENT PROPOSITIONSLA EVOLUCIÓN DE LA MALLA MUNICIPAL DEL ESTADO DEL PARANÁ Y LAS PROPUESTAS RECIENTESO presente artigo aborda a evolução da malha municipal no estado do Paraná a partir da criação de novos municípios, destacando os processos constitucionais e os elementos estimuladores que ocasionaram na atual configuração territorial. Além disso, tendo em vista as recentes proposições sobre a temática no Brasil e no Paraná, apresentam-se também os PLS recentes sobre a temática e a sugestão do Tribunal de Contas do estado do Paraná – TCE-PR para a fusão de municípios com baixo índice populacional, demonstrando as potencialidades caso estas proposições se efetivassem. Desta forma, pode-se afirmar que a divisão do território paranaense em unidades político-administrativas está vinculada a própria formação histórico-geográfica do estado e, mais recentemente, ao que se refere aos municípios pequenos, a Constituição Federal de 1988 que promoveu a criação de municípios com baixo índice populacional no interior do estado. No tocante as proposições recentes, em especial ao estudo para fusão de municípios do TCE-PR, apresenta-se a percepção da política local em municípios pequenos do estado do Paraná, demonstrando resistência à proposta. Todavia, os PLS e a proposta do TCE-PR permanecem apenas como proposições e o Brasil necessita de regulamentações para a fusão, incorporação e criação de municípios em todos os estados da federação.Palavras-chave: Emancipações; Município; Projetos recentes.ABSTRACT The present article approaches the evolution of the municipal network in the state of Paraná, starting from the creation of new municipalities, highlighting the constitutional processes and the stimulating elements that have caused in the current territorial configuration. In addition, in view of the recent proposals on the subject in Brazil and Paraná, we also present the recent PLS on the subject and the suggestion of the Court of Auditors of the state of Paraná - TCE-PR for the merger of municipalities with low population index, demonstrating the potentialities if these propositions become effective. In this way, it can be affirmed that the division of Paraná's territory into political-administrative units is linked to the state's own historical-geographical formation and, more recently, to what refers to small municipalities, the 1988 Federal Constitution that promoted creation of municipalities with low population index in the interior of the country. With regard to the recent proposals, especially to the study for the merger of municipalities of the TCE-PR, the perception of local politics in small municipalities of the state of Paraná is presented, demonstrating resistance to the proposal. This article shows how members of the contemporary art world in Poland understand the concept of the brand: how they define and validate it; what associations it evokes; and what kind of language is used to speak about it. The article summarizes part of the research conducted in 2015 with members of the art world within the framework of the project ‘The Artistic Brand as a Social Phenomenon: The Creation, Differentiation, and Role of Artistic Brands in Contemporary Poland.’ Thoughts on the subject of art brands lead to a description of the state of contemporary art in Poland. The definitions formulated by the respondents are compared to marketing theories, thus making it possible to determine the respondents’ level of knowledge of such theories. In conclusion, definitions of artistic brands are reviewed and supplemented on the basis of the material obtained from the research.

Este estudio aborda el tema de las califi caciones que los estatutos de las Regiones italianas y de las Comunidades autónomas dan a sus respectivos ordenamientos. La materia se encuadra en el contexto (de teoría general, de semántica jurídica y de Derecho comparado) que se refi ere al titular de las califi caciones: la pregunta de establecer que cosa es un ente incumbe tanto a la doctrina como al legislador. En el tema de la descentralización, la naturaleza federal, descentralizada, unitaria, etc. del Estado normalmente es declarada por la Constitución, pero no siempre la doctrina se muestra de acuerdo con los adjetivos utilizados. A menudo, las fórmulas utilizadas por las Constituciones son usadas también por los entes periféricos (Estados miembros, Regiones, Cantones, Comunidades autónomas, etc.), pero no siempre en absoluta concordancia. A veces, por razones políticas, en la periferia se acentúan algunas características (el carácter de nación, de comunidad histórica, etc.) En el casoo de Italia y de España, en general, las defi niciones y las fórmulas constitucionales circulan de arriba a abajo y horizontalmente, con procesos imitativos difusos, y por lo demás, los entes periféricos renuncian a califi car los entes con adjetivos no usados por las respectivas Constituciones (por ejemplo, soberano), a pesar de la fuerza cultural que una calificación podría tener en sede política y jurídica/interpretativa. Azterlan honetan, Italiako eskualdeek eta autonomia-erkidegoetako estatutuek bakoitzak bere ordenamenduei ematen dien kalifi kazioak landuko ditugu. Kalifi kazioen titularrari buruzko testuinguruan kokatu behar da lana, hots, teoria orokorra, semantika juridikoa eta zuzenbide alderatua: entea zer den jakiteko galdera doktrina berari dagokio, legelariari bezainbeste. Estatuaren deszentralizazioa, edo izaera federala, deszentralizatua, unitarioa eta abar dela-eta, hori guztia normalean konstituzioak izendatzen du, baina doktrina ez da beti bat etortzen erabilitako adjektiboekin. Askotan, konstituzioek erabiltzen dituzten formula horiek berak erabiltzen dituzte ente periferikoek ere (estatu kideek, eskualdeek, kantoiek, autonomia-erkidegoek...), baina ez erabateko konkordantziaz beti. Batzuetan, arrazoi politikoak direla-eta, zenbait bereizgarri askoz gehiago nabarmentzen dira periferian (nazio izaera, komunitate historiko izatea, etab.). This study deals with the topic of the denomination given to their respective legal orders by Statutes from the Italian Regions and the Spanish Autonomous Communities. The subject is framed within the context (of general theory, legal semantics and comparative law) which refers to whom gives the denomination: the question about establishing what an entity is both scholar¿s and legislators¿s bussiness. In the fi eld of descentralization, the State¿s federal, decentralized or united nature is usually proclaimed by the Constitution, but scholars do not always agree with those adjectives. The expressions often used by the Constitutions are also used by periferic entities (Member states, Regions, Cantons, Autonomous Communities, etc.) although with not absolute concordance. Sometimes, some features are stressed in the periphery (the characteristic of nation, historical community, etc.) because of political reasons. As for the Italian and Spanish examples, in general, defi nitions and constitutional expressions work vertical and horizontally, with difuse imitative procedures, and apart from that peripherical entities relinquish to use adjetives not used by their own respective Constitutions (for instance, sovereign) despite the cultural impetus an adjective might hold from a political and legal/interpretative point of view.
