Default is an omission or negligence, breaking a promise, or violating what has been agreed. One example of an engagement default is case number: 41/Pdt.G/2016/PN.PA. This case began with an agreement between Indoria Hi. The Mpasu brothers were represented by Alfian Chaniago as the authority holder with Lang Hartoyo and Rizal Tjahyadi through a letter of the agreement made by notary XX. Indoria Hi. The Mpasu brothers were unwilling to fulfill the agreement's contents and decided to cancel the agreement unilaterally because they felt they were never involved in the agreement. Based on the case above, a further question arises about how to guarantee legal certainty for authentic deeds and the consequences of the legal deed of agreement that does not follow the procedure. This study is normative legal research, which examines aspects of written law. The approach to the problem in this study is normative juridical, that is, it is based on applicable laws and regulations. In conclusion, the binding deed of the agreement made before a notary does not always go as expected. An authentic deed that does not meet formal requirements is considered imperfect, so it does not have an element of legal certainty. The legal consequence of the deed of the agreement under the power of attorney to sell that is not following the procedure is that the agreement will be null and void.

 Type of research in doctrinal law or better known as normative legal research which is also called normative juridical (legal research) concerning the legal issues at hand. The approach to the law (statue approach) is carried out by examining the laws and regulations. In writing with primary and secondary data obtained from library materials namely Law No. 42 of 1999 concerning Fiduciary Guarantees, Law No. 10 of 1998 concerning Banking, Government Regulations, Civil Code, KUH Trade and literature, lecture materials and other sources related to credit agreements with fiduciary guarantees and problems in particular. In granting credit with fiduciary guarantees through the stages of the procedure for credit application and the making of a fiduciary deed at the notary who is registered with the Office of Fiduciary Registration to provide legal certainty for creditors (banks). Credit settlement process if the debtor is malicious, the bank is based on a substitution power of attorney from the debtor made a notariil Fiduciary deed and registered with the Fiduciary Office, the debtor makes a sale under the hands, the sale of collateral is voluntary, the result is submitted to the bank to repay the loan, the bank can conduct the auction in general and through the Court.

AbstractThis research aims to analyze whether a husband/wife has the right to act by themselves in the case of land right purchase or mortgage, also the means that can be done to induce legal certainty in this matter. The purchase of land rights using money from the marital property should be done together by the husband and wife, or with a statement of approval from the husband/wife. The mortgage of a land right which is a part of a marital property or inheritance property must be done together by all the joint-owners; if an authority is required, it must be given in the form of Power of Attorney to Impose Mortgage. The means that can be done to induce legal certainty in this matter is by making some changes in the laws and regulations concerning marriage, land, and mortgage. IntisariPenelitian ini bertujuan untuk menganalisis apakah seorang suami/istri berwenang untuk bertindak sendiri dalam membeli dan/atau menjaminkan harta bersama berupa hak atas tanah serta upaya untuk mewujudkan kepastian hukum dalam hal tersebut. Pembelian hak atas tanah menggunakan uang dari harta bersama seharusnya dilakukan bersama-sama oleh suami-istri atau diberikan pernyataan persetujuan dari istri/suaminya. Penjaminan hak atas tanah yang merupakan harta bersama maupun harta warisan seharusnya dilakukan bersama-sama oleh para mede-eigenaar; jika menggunakan kuasa, harus dalam bentuk Surat Kuasa Membebankan Hak Tanggungan. Upaya untuk mewujudkan kepastian hukum dalam hal ini adalah mengubah beberapa ketentuan peraturan perundang-undangan mengenai perkawinan, pertanahan dan Hak Tanggungan.

The purpose of this study is to determine legal certainty regarding the use of electric vehicles. The legal research used is a normative research method which focuses on positive laws that exist in laws and regulations as well as library materials and literature. Regarding driving licenses, as the researchers described above, of course, the application for electric vehicles is still not fully covered. For now, the driving license for electric vehicles is temporarily applied to electric motorcycles which need to be recalled in Article 7 of Law no. 22-2009 is one category of motorized vehicles. As for the license for this 4-wheeled vehicle, the researcher concludes that the temporary 4-wheeled vehicle driving license is no different from 4-wheeled vehicles in general because, as the researcher explained above, this autopilot vehicle has a system called a decision. Penelitian hukum yang digunakan yaitu metode penelitian normatif yang dimana berfokuskan pada hukum positif yang ada pada peraturan perundang-undangan serta bahan pustaka dan juga literatur. Mengenai surat ijin mengemudi seperti yang peneliti paparkan di atas tentu saja penerapan untuk kendaraan elektrik ini masih belum tercakup semua. Untuk saat ini surat ijin mengemudi untuk kendaraan elektrik ini sementara diterapkan pada sepeda motor listrik yang dimana perlu diingat kembali pada Pasal 7 UU No. 22-2009  merupakan salah satu kategori kendaraan bermotor. Sedangkan untuk surat izin untuk kendaraan beroda 4 ini peneliti mempunyai kesimpulan bahwa surat ijin mengemudi kendaraan roda 4 untuk sementara, tidak berbeda dengan kendaraan roda 4 pada umumnya dikarenakan seperti peneliti paparkan diatas bahwa kendaraan autopilot ini memiliki sebuah sistem bernama keputusan yang terdiri dari dari pihak yang dimana pihak manusia selaku pengedara dan kendaraan.

One of the legal products made by notary as a part of their authorities is a deed, both authentic deeds and underhand-made deeds. In addition to these deeds, a notary also has the authority to issue a certificate which is commonly referred to as a covernote. A certificate or covernote is a statement or note in the form of information confirming that a land ownership deed is in the process of a certificate making that is due to a process of roya, transfer of name of land ownership and splitting of one certificate into two. This study examines two issues related to notary authority, namely the basis for the notary’s authority in issuing a covernote and the legal consequences of making the covernote. This study uses a normative legal research method and a conceptual approach as well as a statutory approach. The results showed that the covernote issued by a notary was actually an ordinary certificate, not a legal product of a notary. Covernote only contains an explanation of the deed that is in the process of certification which has not been completed and will be completed within a period determined by the notary itself, so the covernote is not legally binding. The notary is authorized to make a covernote, but it is not regulated in the laws and regulations so that, if it is concluded, the covernote is not a legal product of a notary. The legal consequences for the notary if they fail to carry out the covernote, they can be held liable to solve them immediately. The legal consequence of not fulfilling the contents of the covernote is a violation of Article 1366 of the Criminal Code because notaries are considered negligent in carrying out their duties and authorities.

The Judge's decision is closely related to how the Judge expresses his opinion or consideration based on the facts and evidence in the trial and the Judge's confidence in a case he is trying. Even though the Judge has free or independent power to impose his decision, the prison sentence is still below the specific minimum limit, causing controversy or debate, especially regarding what legal norms are used by the Judge in deciding the case, so that the Judge leaves aside the special minimum threat which is expressly regulated in the Child Protection Act. The verdict in the form of imprisonment imposed under this special minimum threshold can be considered too light and it is feared that it will not cause a deterrent effect for the perpetrators in the future and may damage the legal certainty as mandated in the Child Protection Act. This can be seen in the Padang district court's decision Case number 38 / Pid.Sus / 2019 / PN Pdg, the judge handed down a prison sentence below the specific minimum against the Defendant. The method used in this research is normative juridical method. This type of research is descriptive using secondary data. The results of the study show that 1) Judge's considerations in imposing a criminal sentence under the threat of a specific minimum prison sentence against the Defendant are based more on non-juridical considerations which are then used as judicial considerations of the Judge by observing the reconstruction of legal facts revealed at the trial and guided by Circular Supreme Court Number 1 Year 2017; 2) Judge's consideration of the conviction under a special minimum threat as the case above raises legal uncertainty both at the normative level and at the practical level.

An agreement will not always be able to run according to the agreement of the parties. Certain conditions can be found, such as, the occurrence of various things that result in an agreement cannot be implemented, namely the buy-back right by the seller which has been agreed upon and results in losses for the buyer and on a court decision that sentences the seller to carry out the agreement seven days after the verdict, but the implementation of the sale and purchase agreement has not yet been carried out. This paper examines the legal protection for the buyer against the sale and purchase agreement for building use rights in terms of default. This type of research is a normative juridical legal research applying a case study approach and statue approach. The preventive legal protection for the buyer, namely legal protection is by requesting for irrevocable power of attorney, referred to as absolute power of attorney. Meanwhile, repressive legal protection is legal protection after the occurrence of a dispute, namely based on the consideration of a judge's decision which can provide a sense of certainty and justice to the aggrieved buyer.   Suatu perjanjian tidak selamanya akan dapat berjalan sesuai dengan kesepakatan para pihak. Kondisi tertentu dapat ditemukan terjadinya berbagai hal yang berakibat suatu perjanjian tidak dilaksanakan yaitu dengan hak membeli kembali oleh penjual yang telah disepakati dan mengakibatkan kerugian bagi pihak pembeli dan atas putusan pengadilan yang menghukum pihak penjual untuk melaksanakan perjanjian tujuh hari setelah putusan, akan tetapi pelaksanaan perjanjian jual beli tersebut belum juga terlaksana. Jenis penelitian ini adalah penelitian hukum yuridis normatif dengan menggunakan pendekatan studi kasus dan pendekatan perundang-undangan. Perlindungan hukum secara preventif bagi pihak pembeli yaitu perlindungan hukum yaitu permintaaan pemberian kuasa yang tidak dapat ditarik kembali yang disebut surat kuasa mutlak. Sedangkan perlindungan hukum secara represif adalah perlindungan hukum setelah terjadinya sengketa yaitu berdasarkan pertimbangan putusan hakim yang bisa memberikan rasa kepastian dan keadilan terhadap pembeli yang dirugikan.

The purpose of carrying out the elimination of related fiduciary guarantees so that objects that are used as fiduciary collateral objects with the debt fiduciary debt paid off, then the object can be re-registered the same fiduciary guarantee. In the regulations regarding Fiduciary Guarantees namely Law Number 42 of 1999 does not regulate sanctions against parties who are given the mandate by statutory regulations to abolish fiduciary guarantees. The purpose of this paper is to analyze the sanctions against those appointed by the laws and regulations that do not abolish electronic fiduciary guarantees and who can eliminate electronic fiduciary guarantees. This study applies a method which is normative legal research and the approach is the statutory approach. The result of this research is that the sanction given is civil sanction, in the form of a claim for compensation which refers to the provisions of Article 1365 of the Civil Code and the party that can carry out the removal of fiduciary guarantees ie is a fiduciary recipient either through his power of attorney or representative, the attorney referred to is a Notary Public.

Humans in carrying out their lives must meet certain requirements of life which consists of several levels based on their interests, including the most basic primary needs met first by Humans, Secondary Needs that arise and support primary needs and tertiary needs that can be fullfiled after primary and secondary needs. Basic needs in this case will describing human needs for shelter or a place to stay as their needs to living. The need for flats is inevitable to meet the need for shelter for the people of Indonesia, especially related to the dense population in urban areas. However, the existing regulations cannot provide legal certainty due to material and formal requirements that need to be provided in providing legal certainty have not been regulated so that it can be implemented optimally. This research was conducted using a legal approach that prioritizes several legal theories to analyze and test the laws and regulations related to the limitations of ownership of flats that are timed to be associated with building ownership so that ownership is expected to provide recommendations and suggestions for developing policies that provide significant benefits in reforming the legal provisions and the usefulness, justice and legal certainty in Indonesia.

The development of globalization in era of free market economy has caused many problems to protection of plant varieties. Therefore, it’s deemed necessary to make specific arrangements of supervision in the protection of plant varieties in Indonesia. The writing of this article aims to examine the regulatory aspects of supervision in plant varieties and the importance of regulating of supervision in plant varieties. This article uses normative legal research methods, which research the laws and regulations that have legal problems. The results of the study shows that the aspects of supervision in regulations relating to the protection of plant varieties haven’t been regulated in detail and concretely. The absence of regulations regarding the supervision, causes supervision can’t be carried out optimally, and the supervision can’t be said to be legal according to law. Supervision is very important to regulated, because it carried out with the aim of preventing the emergence of fraudulent practices such as deception, monopolistic practices, and other activities that have a negative impact on the economy in terms of protecting plant varieties. Juridical arrangements regarding supervision related to the protection of plant varieties need to be carried out to provide a foundation for the relevant agencies in carrying out their supervisory duties as well as to increase protection or provide legal certainty for parties holding the rights to protect plant varieties. In addition, it’s also to prevent fraudulent acts committed by irresponsible persons. Perkembangan globalisasi di era ekonomi pasar bebas, menimbulkan banyak problematika terkait dengan perlindungan varietas tanaman. Oleh karena itu, dipandang perlu melakukan pengaturan secara spesifik mengenai aspek pengawasan dalam perlindungan varietas tanaman di Indonesia. Penulisan artikel ini bertujuan untuk mengkaji mengenai pengaturan aspek pengawasan dalam perlindungan varietas tanaman serta arti penting pengaturan aspek pengawasan dalam perlindungan varietas tanaman di Indonesia. Adapun metode penelitian dalam penulisan artikel ini menggunakan metode penelitian hukum normatif, berupa penelitian dengan mengkaji peraturan perundang-undangan yang memiliki kaitan dengan permasalahan hukum yang terjadi. Hasil studi menunjukkan bahwa aspek pengawasan dalam peraturan perundang-undangan yang berkaitan dengan perlindungan terhadap varietas tanaman belum diatur secara mendetail dan konkrit. Ketiaadan pengaturan mengenai pengawasan terkait perlindungan varietas tanaman  menyebabkan pengawasan tidak dapat dilaksanakan secara maksimal, serta pengawasan yang dilakukan oleh instansi terkait tidak dapat dikatakan sah menurut hukum. Pengawasan pada dasarnya merupakan hal sangat penting untuk diatur, karena pengawasan dilaksanakan dengan maksud untuk mencegah timbulnya praktik kecurangan seperti penipuan, praktik monopoli, maupun kegiatan lain yang menimbulkan dampak negatif terhadap perekonomian dalam hal perlindungan varietas tanaman. Pengaturan secara yuridis mengenai pengawasan terkait perlidungan varietas tanaman perlu dilakukan untuk memberikan landasan berpijak kepada instansi terkait dalam melaksanakan tugasnya terkait pengawasan sekaligus guna meningkatkan perlindungan maupun memberikan jaminan kepastian hukum bagi pihak yang memegang hak perlindungan varietas tanaman. Selain itu juga untuk mencegah terjadinya tindakan kecurangan yang dilakukan oleh oknum-oknum yang tidak bertanggungjawab.

Based on Article 96 of Law No. 2 of 2004 concerning Industrial Relations Dispute Settlement states that in essence that if the Company is proven at the first session not to carry out its obligations under Article 155 Paragraph (3) Law No. 13 of 2003 concerning Manpower, the Judge may decide interim. In the Decision of the Industrial Relations Court Number: 181/Pdt.Sus-PHI/2016/PN.Bdg jo Decision of the Industrial Relations Court Number: 82/Pdt.Sus-PHI/2016/PN.Bdg, the Judge decides on the request for payment of process wages at interlocutory decisions and final decisions, thus raising problems, how is the legal certainty of the application for process wage payments in the Industrial Relations Court and how to prove in the request for payment of process wages in the Industrial Relations Court. This study uses normative legal research methods, which are prescriptive in nature, with methods of data collection in the form of library studies, and supported by the results of interviews with Labor Law Experts. The results of the study show that, first, legal certainty in the request for payment of process wages on interlocutory decisions must be logical and not cause doubt. Second, the evidence applied at the time of the Industrial Relations Dispute is not in accordance with the situation that occurred in practice, so that it burdens the Workers. In the decision of the Industrial Relations Court Number: 181/Pdt.Sus-PHI/2016/PN.Bdg jo Industrial Relations Decision Number: 82/Pdt.Sus-PHI/2016/PN.Bdg is not in accordance with the Laws and Regulations in Indonesia.
