Resumo. O presente artigo aborda aspecto da denominada de “Reforma Trabalhista”, concernente à prevalência do negociado sobre o legislado, empreendendo análise crítica sobre a possibilidade de edição de normas negociais que não incrementem a condição social dos trabalhadores, sobretudo considerando o primado constitucional da dignidade e da cidadania.Abstract. This article addresses the aspect of the so-called "Labor Reform", concerning the prevalence of the negotiated over the legislated, undertaking a critical analysis on the possibility of publishing negotiating norms that do not increase the social condition of the workers, especially considering the constitutional primacy of dignity and of citizenship.

In recent years cultural definitions of »gender« have had extraordinary institutional success. This paper analyses visual worlds that have been motivated by constructivist gender concepts that often display a pronounced symmetry. It relates them to competing images which present difference as scandal, as a mirrored form of the self, or as figurations, and which politicize a-symmetrical forms. The study looks into the social condition of publicity that is constituted by such »picture acts«.

This article suggests that over recent decades Catalan literary criticism has paid too little attention to the aesthetic attributes of Catalan literature and emphasised the social, political and cultural at the expense of discussions of narrative poetics. Through an analysis of Montserrat Roig’s metaphorical use of the city in her first novel Ramona, adéu, I put forward the view that the aesthetic features of Catalan literature need to be re-claimed. This article provides a critical analysis of the aesthetic importance of Roig’s representation of the city in her first novel and argues that she uses Barcelona as a critical tool through which to explore questions of both female emancipation and aesthetic freedom. Following a detailed discussion of Roig’s descriptions of how her female characters interact with particular urban spaces, I examine how Roig makes subtle shifts in her semantic register during these narrative accounts when her prose moves into the realm of the poetic. I conclude that this technique enables us to read her accounts of urban space as metaphors for aesthetic freedom and are inextricably linked to her wider concerns on the importance of liberating Catalan literature from the discourse of political nationalism.

This book presents a detailed critical analysis of a period of significant formal and thematic innovation in Muriel Spark’s literary career. Spanning the mid-1950s to the mid-1970s, it identifies formative instances of literary experimentation in texts including The Comforters, The Driver’s Seat and The Public Image, with an emphasis on metafiction and the influence of the nouveau roman. As the first critical study to draw extensively on Spark’s vast archives of correspondence, manuscripts and research, it provides a unique insight into the social contexts and personal concerns that dictated her fiction. Offering a distinctive reappraisal of Spark’s fiction, the book challenges the rigid critical framework that has long been applied to her writing. In doing so, it interrogates how Spark’s literary innovations work to facilitate moments of subversive satire and gendered social critique. As well as presenting nuanced re-readings major works like The Prime of Miss Jean Brodie, it draws unprecedented attention to lesser-discussed texts such as her only stage play, Doctors of Philosophy, and early short stories.

The Companies Amendment Bill, 2018 proposes certain changes to the social and ethics committee established in terms of s 72(4) of the Companies Act 71 of 2008 and reg 43 of the Companies Regulations, 2011. These new provisions are critically discussed in this article. Although some of these provisions are commendable, others give rise to certain concerns examined here: the lack of clarity in the functions of the social and ethics committee, the proposed amendments regarding its appointment and composition, and the ambiguity in the exemptions from the requirement to appoint this committee. This article also suggests further amendments to the current legislative provisions regarding this committee.

RESUMOO presente artigo propõe uma análise crítica acerca do cárcere e seus efeitos no tratamento estatal dado à população socialmente vulnerável, traçando uma relação entre o Estado Social e o Estado Penal. Questionando o interesse que norteia a (in)eficácia do sistema prisional e como ele se legitima socialmente através de um discurso político de segurança pública amparado pelo pânico propagado pelos meios de comunicação, pretende-se expor a seletividade tanto da normal penal quanto do sistema criminal, que, somadas, resultam na construção do perfil do delinquente e no encarceramento em massa dos pobres. A partir de uma exposição crítica, almeja-se fomentar o debate do papel da criminalização da pobreza na gestão das ilegalidades pelos interessados nos produtos do cárcere.PALAVRAS-CHAVEDireito Penal. The article is a critical analysis of neoliberal approach to system of social protection in Slovakia, especially after the year of 2004, when a major reform of the Social Security Law and social policy took place. The focus is on specific sub-systems of the social protection – i.e. the system of social insurance, the system of state support and the system of social assistance – in the light of the constitutional and fundamental principles of law (liberty, equality, justice and solidarity), the actual content of the abovementioned systems of social protection and values and principles of the European social model of welfare state – and leads to author’s overview of major flaws and spaces for improvement.

ABSTRACTDisease and disability are two concepts closely linked for a long time, so that the second seems to be merely a consequence of the first. Even today both realities are treated as if they were the same thing in many public contexts and legal documents. However, this link between disease and disability is not as unavoidable as is often implied. According to the approach outlined in this paper it comes to different realities that are interpreted as part of the same thing under the code of the medical gaze. This paper presents and critically analyzes the archaeological origin of the interpretation of the person with disabilities and chronically ill in the discourse called «medical rehabilitation». Under this paradigm is imposed on the person with disabilities the social mandate to rehabilitate and/or cure to, so, be reintegrated and contribute to society. Otherwise, will be doomed to exclusion.RESUMENEnfermedad y discapacidad son dos conceptos estrechamente vinculados entre sí desde hace mucho tiempo, de manera que la segunda no parece más que una consecuencia de la primera. Aún hoy se tratan ambas realidades como si fueran la misma cosa en multitud de contextos públicos y documentos jurídicos. Sin embargo, este vínculo entre enfermedad y discapacidad no es tan ineludible como a menudo se da a entender. Según el planteamiento expuesto en este trabajo, se trata de realidades distintas que son interpretadas como parte de una misma cosa bajo el código de la mirada médica. Este trabajo presenta y analiza de forma crítica el origen arqueológico de la interpretación de la persona con discapacidad como un enfermo crónico dentro del discurso que se denomina «médico-rehabilitador». Bajo este paradigma se impone a la persona con discapacidad el mandato social de que se rehabilite y/o se cure para, de esta manera, poder reinsertarse y aportar a la sociedad. De lo contrario, quedará condenado a la exclusión.
