Penetapan ukuran kerugian konstitusional memiliki kedudukan strategis sebagai pintu gerbang atas pengujian norma yang hendak diuji. Mahkamah Konstitusi merumuskan syarat kerugian konstitusional berdasarkan penafsiran Pasal 51 ayat (1) Undang-Undang Mahkamah Konstitusi. Doktrin kerugian konstitusional terdiri dari lima syarat yang dapat diklasifikasikan dalam dua kelompok. Kelompok pertama berisikan unsur-unsur yang harus dipenuhi pemohon terdiri dari (i) adanya hak dan/atau kewenangan konstitusional dan (ii) ada kerugian. Kelompok kedua merupakan prosedur pengujian mengenai ukuran kerugian yang diderita pemohon yang didalamnya yang terdiri dari (i) bentuk kerugian, (ii) hubungan kausalitas dan (iii) pemulihan kerugian. Kelima syarat ini bersifat kumulatif. Dalam penerapannya, doktrin kerugian konstitusional ini sangatlah dinamis. Ada kecenderungan bahwa doktrin ini menyimpan permasalahan. Tulisan ini berupaya mengidentifikasi masalah yang ada dalam penerapan doktrin kerugian konstitusional. Salah satunya adalah tumpang tindihnya antara pembuktian hak konstitusional pemohon dalam bagian kedudukan hukum dengan pengujian norma dalam pokok perkara. Sedangkan konkretisasi pembuktian unsur kerugian berkelindan dengan pengujiannya dalam kelompok doktrin kedua. Oleh karenanya, tulisan ini berkesimpulan bahwa telah ada kebutuhan untuk melakukan penyempurnaan doktrin kerugian konstitusional dengan melakukan penafsiran ulang atas Pasal 51 ayat (1) Undang-Undang Mahkamah Konstitusi dan tidak lagi mencantumkan kelompok pertama dalam doktrin kerugian konstitusional untuk pemeriksaan pengujian Undang-Undang di masa yang akan datang.The concept of constitutional injury is a substantial pre-requisite in the examination of judicial review case. The Constitutional Court drafted the concept as an interpretation of Article 51(1) of the Law on the Constitutional Court. It consists of five conditions that can be classified into two groups. The first group contains elements that must be met by the applicant which are (i) constitutional rights and/or authorities and (ii) injuries. The second group is the test in regard to the size of the injury suffered by the applicant therein consisting of (i) forms of injury, (ii) causality and (iii) redressability. The requirement is accumulative. Yet in practice the doctrine is variedly applied. There is tendency the doctrine itself causes problems. This paper seeks to identify the problems and aimed to give solution to the problem. Two problems are identified, one is an overlap examination of constitutional rights in standing and also in ratio decidendi. Another one is that the injury element in the doctrine intertwined with its own testing in the second group of the doctrine. Therefore, this paper concludes that there is a need to revise the doctrine with reinterpretation of Article 51 (1) of the Law and recommend not to exclude the first group of the doctrine.

Tulisan ini hendak membahas mengenai konsistensi putusan-putusan mahkamah konstitusi dalam pengujian undang-undang berdasarkan asas preseden. MK beberapa kali dipandang tidak konsisten karena kerap mengeluarkan putusan yang bersifat overrulling. Namun, sebenarnya tidak sedikit juga putusan MK yang konsisten mengikuti preseden. Meskipun penggunaan asas preseden hanya dikenal di negara yang menganut tradisi common law, MK ternyata juga menerapkannya. Putusan MK tentang pengujian UU Pencegahan Penodaan Agama adalah salah satu bentuk dianutnya asas preseden di MK. Putusan ini secara konsisten menyatakan bahwa UU Pencegahan Penodaan Agama tetap konstitusional karena akan terjadi kekosongan hukum apabila UU Pencegahan Penodaan Agama diputus inkonstitusional. Dalam perkara tersebut, MK mempertahankan ratio decidendinya terhadap konstitusionalnya UU Pencegahan Penodaan Agama karena meskipun MK sadar bahwa UU a quo banyak mengandung kelemahan. Konsistensi standing MK terhadap UU Pencegahan Penodaan Agama ini merupakan salah satu bentuk dari dipraktekannya doktrin preseden.This paper will discuss the consistency of the constitutional court decision in the judicial review cases based on the principle of precedent. MK several times deemed inconsistent because often issued a ruling that is overruling. However, there were actually a lot of MK decisions that consistently followed the precedent. Although the use of the precedent principle is only known in common law tradition, the Constitutional Court apparently also applies it. The Constitutional Court’s decision regarding the Blasphemy Prevention Act was one form of the principle of precedent in the Constitutional Court. This decision consistently states that the Blasphemy Prevention Act remains constitutional because a legal vacuum will occur if the Blasphemy Prevention Law was decided to be unconstitutional. In this case, the Court retained its ratio decidendi to the constitutionality of the Blasphemy Prevention Law, even though the Court was aware that the Law contained many weaknesses. The consistency of the Constitutional Court on the judicial review of the Blasphemy Prevention Act is one form of the practice of precedent doctrine.

Abstract: This article discusses about Jimli Asshiddiqie thinking about of MPR RI judicial review against the Constitution 1945. According to Jimli Asshiddiqie, eighth of Tap MPR/S is must be considered equivalent position with the law, because in our legal system was no longer recognized the existence of law products above the law, even though the form of law not the Consideration, but materially eighth of Tap MPR RI is Law. And when the Decree of MPR/S assessed has caused the loss of constitutional rights of certain parties, it can be requested testing (judicial review) in the Constitutional Court, as a constitutional test case stipulated in Law No. 24 of 2003 about Constitutional Court. In political jurisprudence perspective, authority of the Constitutional Court in resolving cases of judicial review Tap MPR against the Constitution 1945 as Jimli Asshiddiqie thought, has some similarities with the agency wilayah mazalim, the authorities is investigate and examine cases public beneficiaries are that can’t be carried by hisbah officers. In a formal legal framework in Indonesia, wilayah mazalim can be equated to the Constitutional Court.Keywords: Judicial review, MPR, Jimli Asshiddiqie, political jurisprudence

The study aims to provide a constitutional analysis of judicial review (PK) in civil cases for more than once. The research-based is the decision of the Constitutional Court No. 108 / PUU-XIV / 2016 and No. 34 / PUU-XI / 2013 in which the two judgments provide a different classification between criminal and civil cases. The method used in this research is a normative juridical with a conceptual, legislation, and case approach. The results of the study assert that: first, the opportunity for judicial review (PK) more than once in a criminal case is an effort to uphold justice substantively by the Constitutional Court. Whereas the restriction of judicial review (PK) only once in civil cases is intended to guarantee legal certainty. Secondly, there is rational inconsistency in the arguments of the Constitutional Court which is indicated in Decision No. 108 / PUU-XIV / 2016 and No. 34 / PUU-XI / 2013. Both criminal and civil cases must seek to establish and maintain substantial justice, especially since there is a due process of law principle that requires that everyone can get the same opportunity before the law.

One of the authorities of the Constitutional Court governed by the Constitution of the Republic of Indonesia in 1945 was the examining of laws against the contitution or judicial review. Inside the regulations which governing the implementation of this authority, the Constitutional Court only acts as a negative legislator, namely canceling or reinforcing a norm tested by the Petitioner. But in practice, the Constitutional Court has changed its role to become a positive legislator, who is forming a new legal norm, which is the authority of legislators. The Constitutional Court should not be able to form a new legal norm because there is no legal basis which regulate that. But Constitutional Court can form a new legal norm in some urgent circumstances, relating to Human Rights, and preventing legal vacuum. In addition, the establishment of laws by lawmakers that require a long process and time. This is compelling Constitutional Court to make substitute norm before the law was established by the legislators. In the Decision of the Constitutional Court Number 46/PUU-XVI/2016, the Court actually wants to establish a new legal norm, but because the articles in the petitioned have criminal sanctions, and if the Constitutional Court approves the petition, the Constitutional Court has formulated a new criminal act that can only be formed by the lawmaker. Whereas in the Decision of the Constitutional Court Number 21/PUU-XII/2014, the Constitutional Court established a new norm because in the article a quo there were no criminal sanctions.

The Constitutional Court is one of the perpetrators of judicial power, in addition to the Supreme Court as referred to in Article 24 paragraph (2) of the 1945 Constitution. The Constitutional Court is also bound to the general principle of an independent judicial power, free from the influence of other institutions in enforcing law and justice. The Constitutional Court is the first and last level judicial body, or it can be said that it is the only judicial body whose decisions are final and binding. The existence of the Constitutional Court is at the same time to maintain the implementation of a stable state government and is also a correction to the experience of constitutional life in the past caused by multiple interpretations of the constitution. Judicial review towards the constitution is one of the authorities of the Constitutional Court that attracted attention. This shows that there has also been a shift in the doctrine of the parliamentary supremacy towards the doctrine of the supremacy of the constitution. The law was previously inviolable, but now the existence of a law is questionable in its alignment with the Constitution. The authority to examine the Law towards the Constitution is the authority of the Constitutional Court as the guardian of the constitution. This authority is carried out to safeguard the provisions of the Act so that it does not conflict with the constitution and / or impair the constitutional rights of citizens. This shows that the judicial review towards the Constitution carried out by the Constitutional Court is basically also to provide protection for human rights.

Pada hakikatnya judicial review dilaksanakan demi terciptanya keseimbangan hukum dan terpenuhinya hak konstitusional setiap pemangku kepentingan untuk bertindak dan mengajukan permohonan pembatalan suatu undang-undang kepada Mahkamah Konstitusi dengan menyatakan undang-undang tersebut telah bertentangan dengan UUD RI 1945. Pengujian undang-undang terhadap UUD 1945 dilakukan dalam upaya penyempurnaan hukum yang berlandaskan konstitusi. Setiap undang-undang haruslah dilandasi oleh aturan dasar yang tidak hanya tercantum pada konsiderannya saja, melainkan dibuat serta dilaksanakan berlandaskan nilai dan norma konstitusionalitas. judicial review yang selama ini dilakukan oleh banyak pihak pada Mahkamah Konstitusi membuktikan bahwa kualitas produk hukum atau aturan hukum yang selama ini dilahirkan oleh pembuat undang-undang seringkali bertolak belakang dengan keteraturan hukum, sehingga diperlukan langkah hukum preventive demi menjaga integritas lembaga pembentuk undang-undang agar tidak dianggap melahirkan produk hukum yang asal-asalan. Oleh karena itu, di dalam penelitian ini akan mengkaji dan menginisiasi pembentukan produk hukum yang berkualitas konstitusi sehingga Mahkamah Konstitusi sebagai lembaga pengawal konstitusi memberikan kontribusi dengan cita konstitusi dan melahirkan produk hukum dengan kualitas konstitusi. Dalam penelitian ini metode yang yang digunakan adalah yuridis normatif dengan menggunakan pendekatan undang-undang dan konseptual. Hasil penelitian ini menggambarkan betapa pentingnya upaya preventive sebelum suatu aturan hukum kemudian ditetapkan, disahkan dan dilaksanakan, dimana ada persoalan konstitusionalitas terhadap implementasi suatu produk hukum yang kemudian oleh Mahkamah Konstitusi dinyatakan bertentangan dengan Undang-Undang Dasar Republik Indonesia 1945.Basically, judicial review has done to create a balance of law and to fulfill the constitutional right for every stakeholder to act and apply for application to constitutional court by stating the rule was contradicted to the constitution of Republic of Indonesia 1945. The application was made as an effort to perfect the law which is based on the constitution. Each rule has to be based on the basic rules, not only on its consideration but also is made and implemented in basic values and norms of contitutionality. Judicial review done by many people on constitutional court has proven that the quality of law product or rules of law made by the legislative often contradict with constitutional order of law, so it is necessary to take a step on preventive legal measurer to keep up the integrity of the rule maker of being judged making unqualified legal products. Therefore, this research reviews and initiates the production of law product so that the Constitutional Court can give preventive contribution on each legal products made, to be able to run with the ideals of the constitution and create legal products with constitution quality. This research used juridical normative method with legal and conceptual approaches. The results of this study illustrate how important preventive efforts before a rule of law are then set, ratified and implemented. In which there is a constitutional issue on the implementation of a legal product, that will be later declared by the Constitutional Court to be contradictory to the 1945 Constitution of the Republic of Indonesian.

Abstract: Questioning the Religious Freedom and blasphemy in Indonesia. The presence of the Constitutional Court in the reform era is the strengthening of the foundations of constitutionalism in the Constitution of the Republic of Indonesia Year 1945. The Court in this case a role to enforce and the protector of the citizen's constitutional rights and the protector of the human rights. Including in this case, the right to religion and religious practices and teachings of their respective religions, in accordance with the constitutional mandate. However, on the other hand there is the discourse of freedom of expression and freedom of speech includes freedom to broadcast religious beliefs and understanding of the "deviant" and against the "mainstream" religious beliefs and understanding in general, as in the case of Ahmadiyah. The Court in this case is required to provide the best attitude when faced judicial review in this case still required in addition to guarding the constitution in order to run properly.   Abstrak: Menyoal Kebebasan Beragama dan Penodaan Agama di Indonesia. Kehadiran lembaga Mahkamah Konstitusi di era reformasi merupakan upaya penguatan terhadap dasar-dasar konstitusionalisme pada Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. MK dalam hal ini berperan menegakkan dan melindungi hak-hak konstitusional warga negara (the protector of the citizen’s constitutional rights) dan pelindung HAM (the protector of the human rights). Termasuk dalam hal ini, hak untuk memeluk agama dan menjalankan ibadah serta ajaran agamanya masing-masing, sesuai dengan amanat konstitusi. Namun, disisi lain ada wacana kebebasan berekspresi dan kebebasan berpendapat termasuk didalamnya kebebasan untuk menyiarkan keyakinan dan pemahaman keagamaan yang “menyimpang” dan bertentangan dengan “mainstream” keyakinan dan pemahaman keagamaan pada umumnya, seperti dalam kasus Ahmadiyah. MK dalam hal ini dituntut untuk mampu memberikan sikap terbaik saat dihadapkan judicial review dalam kasus ini selain tetap dituntut untuk mengawal konstitusi agar dapat berjalan sebagaimana mestinya. DOI: 10.15408/jch.v2i2.2314

Jaminan konstitusi terkait hak konstitusional untuk mendapatkan pekerjaan dalam Pasal 28D ayat (2) UUD NRI 1945 dan hak konstitusional untuk membentuk keluarga dalam Pasal 28B ayat (1) UUD 1945 telah dibatasi dengan adanya ketentuan Pasal 153 ayat (1) huruf f Undang-Undang No 13 Tahun 2003 tentang Ketenagakerjaan. Keberadaan perjanjian kerja menghalangi hak pekerja untuk menikah dalam satu institusi karena pekerja harus mengalami pemutusan hubungan kerja untuk dapat melaksanakan haknya membentuk keluarga yang sebenarnya dijamin dalam konstitusi dan peraturan perundang- undangan. Pengujian Pasal 153 ayat (1) huruf f UU No 13 Tahun 2003 dalam Putusan Mahkamah Konstitusi Nomor 13/PUU-XV/2017 telah menyatakan frasa "kecuali telah diatur dalam perjanjian kerja, peraturan Perusahaan, atau perjanjian kerja bersama" bertentangan dengan UUD 1945. Artikel ini hendak menjawab kekuatan mengikat dan akibat hukum putusan, sekaligus Penegakan putusan dengan memetakan penyelesaian terkait peraturan perundang-undangan dan perjanjian kerja yang tidak tidak sesuai dengan putusan dan bertentangan dengan prinsip kebebasan berkontrak. Penelitian ini didasarkan pada penelitian kualitatif, dimana sumber analisis yakni Putusan MK terkait permasalahan yang diangkat, peraturan perundang-undangan, buku dan artikel ilmiah. Artikel ini hendak memetakan penyelesaian yang sesuai terkait kepada perjanjian kerja yang tidak menjamin hak pekerja yang dijamin dalam konstitusi, serta bertentangan dengan prinsip kebebasan berkontrak. yakni: pertama, penyelarasan peraturan perundang undangan di bawah Undang-undang judicial review di Mahkamah Agung, kedua, penyelesaian perselisihan hak melalui Pengadilan Hubungan Industrian yang akan menguji penegakan putusan dalam perjanjian kerja, peraturan perusahaan, atau perjanjian kerja bersama.The constitutional guarantee regarding constitutional rights to obtain employment in Article 28 D paragraph (2) of the 1945 Constitution of the Republic of Indonesia and the constitutional rights to form a family in Article 28 B paragraph (1) of the 1945 Constitution has been limited by the provisions of Article 153 paragraph (1) letter f Law No. 13 of 2003 concerning Labor. The existence of a work agreement prevents the right of workers to get married in one institution because workers must experience termination of employment to be able to exercise their rights to form a family which is actually guaranteed in the constitution and legislation. Testing Article 153 paragraph (1) letter f of Law No. 13 of 2003 in the Decision of the Constitutional Court Number 13/PUU-XV/2017 has stated the phrase "except as stipulated in work agreements, company regulations, or collective labor agreements" contrary to the 1945 Constitution. This article is about to answer the binding and consequent legal power of the decision, as well as Enforcement of decisions by mapping out solutions related to legislation and work agreements that are not incompatible with decisions and are contrary to the principle of freedom of contract. This research is based on qualitative research, where the source of analysis is the Constitutional Court Decision related to the issues raised, legislation, scientific books, and articles. This article intends to map appropriate solutions related to work agreements that do not guarantee workers’ rights guaranteed in the constitution, as well as contrary to the principle of freedom of contract. namely: first, alignment of legislation under the judicial review law in the Supreme Court, secondly, settlement of rights disputes through the Industrial Relations Court which will test enforcement of decisions in work agreements, company regulations, or collective labor agreements.

The formation of the 1974 Marriage Law is based on Islamic Law, which became a problem when the Constitutional Court gave a decision on the judicial review of the Marriage Law with a decision that was considered by the public that the decision was against Islamic law. The research problem in this article is, How is the Politics of Law in the Reform of Legislation in the Post-Constitutional Court Ruling on Marriage related to the status of children outside of marriage? Does the Constitutional Court Decision No 46 / PUU-VII / 2010 contradict Islamic law?The research approach used in this research is normative juridical. The results of the study indicate that children who are born must receive legal protection. If this is not the case, then the children who are born outside of marriage will suffer losses. The relationship between the child and the father does not only occur because of a legal marriage, but can also be based on evidence of a blood relationship between the child and the boy as the father. This is because birth is a legal result of a legal relationship in which there are reciprocal rights and obligations between the child, mother and father. This decision refers, because there is a relationship that is carried out without any legal conditions for marriage, both religiously and in a state, so that it does not cause harm which implies a child who has not done anything wrong. In conclusion, the Constitutional Court granted the renewal of the norm in article 43 of the Marriage Law No. 1 of 1974, which is to provide constitutional rights for children born out of wedlock whether born from a legally valid marriage or not. The decision of the Constitutional Court related to the addition of article 43 paragraph (1) of this marriage law is still in the spirit of Islam as the struggle of Muslims to be able to apply their religious values in this law is not only legally religiously or nationally. Abstrak Pembentukan Undang-Undang (UU) Perkawinan Tahun 1974 berdasarkan Hukum Islam, menjadi permasalahan saat Mahkamah Konstitusi (MK) memutuskan judicial review atas UU perkawinan, bagi masyarakat bertentangan dengan hukum Islam. Permasalahan penelitian ini,  Bagaimana Politik Hukum dalam Pembaharuan Peraturan Perundang-Undangan dalam UU Perkawinan Pasca Putusan MK terkait dengan status anak diluar nikah? Apakah Putusan MK No 46/PUU-VII/2010 bertentangan dengan hukum Islam? Pendekatan penelitian ini yuridis normatif. Hasil penelitian menguraikan, anak yang lahir harus mendapat perlindungan hukum. Jika tidak, yang dirugikan adalah anak yang dilahirkan diluar perkawinan. hubungan anak dengan bapak tidak semata-mata terjadi karena adanya sebuah perkawinan yang sah, tapi berdasar pembuktian adanya hubungan darah antara anak dan laki-laki sebagai bapak. Hal ini karena kelahiran adalah akibat hukum dari hubungan hukum yang terdapat hak dan kewajiban secara timbal balik. Putusan ini mengacu, sebab adanya hubungan yang dilakukan tanpa adanya syarat pernikahan yang sah, baik secara agamadan negara, sehingga tidak menimbulkan kerugian yang berimplikasi pada anak yang tidak melakukan kesalahan. Pembaharuan norma dalam pasal 43 UU  Perkawinan No. 1 Tahun 1974, memberikan hak konstitusional  anak yang dilahirkan di luar nikah baik yang lahir dari pernikahan yang sah secara agama atau tidak. Putusan MK terkait penambahan pasal 43 ayat (1) UU perkawinan masih bernafaskan Islam sesuai perjuangan ummat Islam untuk dapat menjalankan nilai-nilai agamanya dalam UU ini hannya tidak sah secara agama  dan Negara.

 Timbulnya pengakuan kesehatan sebagai hak asasi menunjukan perubahan paradigma yang luar biasa, karena kesehatan tidak lagi dipandang hanya sebagai urusan pribadi namun sebagai bentuk tanggung jawab negara dan hak hukum (legal rights). Tujuan diberlakukannya berbagai undang-undang terkait kesehatan adalah untuk memberikan jaminan konstitusionalitas hak atas kesehatan, namun dengan diberlakukannya berbagai undang-undang tersebut tidak berarti terjaminnya hak konstitusional atas kesehatan, hal ini tergambar dengan banyaknya uji materi terhadap berbagai undang-undang tersebut. Banyaknya permohonan uji materi tersebut menarik untuk diteliti terhadap prinsip-prinsip atau asas-asas yang melandasi materi muatan berbagai undang-undang terkait kesehatan dan konsistensi antar putusan Mahkamah Konstitusi (MK) dan konsistensi Putusan MK dengan prinsip atau asas yang melandasi materi muatan undang-undang terkait kesehatan. Dengan menggunakan metode penelitian yuridis normatif disimpulkan bahwa prinsip-prinsip atau asas mempunyai arti penting sebagai landasan materi undang-undang sehingga dapat dijadikan sebagai batu uji dalam melakukan pengujian undang-undang. Kesimpulan lainnya yakni terdapat inkonsistensi antar putusan MK dan inkonsistensi putusan MK dengan prinsip atas asas yang melandasi materi muatan berbagai undang-undang terkait kesehatan.The emergence of the recognition of health as a human right shows an extraordinary paradigm shift, because health is no longer seen only as a private matter but as a form of state responsibility and legal rights. The purpose of the enactment of various laws related to health is to provide a constitutional guarantee of the right to health, however, the enactment of these various laws does not mean the guarantee of constitutional rights to health, this is showed by the number of judicial review of various laws. The number of requests for material tests is interesting to be examined on the principles that underlie the contents of various health related to laws and consistency between decisions of the Constitutional Court (MK) and consistency of decisions of the Constitutional Court to the principles that underlie the content of laws related to health. By using the normative juridical research method, it can be concluded that principles have an important meaning as a basis for the material of the law so that they can be used as a touchstone in conducting the testing of laws. Another conclusion is that there are inconsistencies between the Constitutional Court's decisions and the inconsistency of the Constitutional Court's decision to the principle on the basis of the material content of various laws related to health.
