An organization if you want to continue to grow then the main requirement is to have enough professional resources that can support all kinds of vision, mission or goals of the organization. To get members who have a high professionalism of course required a good recruitment and not just random, because how many members of an organization would be meaningless if not have adequate competence. Conversely, if an organization, although having few members but in each member has adequate competence, then the rate of development of the organization will run well then it is important that large organizations such as Muhammadiyah looking for the right pattern in recruitment cadres in order to support organizational performance. Furthermore, in this research will use descriptive qualitative research method by taking samples from three twigs in Ponorogo regency which represents the central city area, the central area and the periphery. The conclusion this research is recruitment pattern owned by the Muhammadiyah organization is Muhammadiyah educational institution, employee charity Muhamamdiyah, and the general public and there is no direct recruitment process.Orientation or encouragement of prospective members to participate in Muhammadiyah organization other than it is as a medium of learning and means of worship (non-profit oriented). This is very different from the existing recruitment theory where recruitment theory in general is on profit oriented organizations or companies.

 Perkembangan teknologi khususnya internet telah mempermudah masyarakat untuk mengakses dan mendistribusikan informasi. Namun, kegiatan seperti copy-cut-paste (menyalin-memotong-menempel), menyunting (editing) ataupun berbagi dokumen (file sharing) justru menimbulkan hal kontradiktif terhadap hukum hak cipta. Berdasarkan hal tersebut tahun 2002 sebuah organisasi nirlaba membuat inovasi dan terobosan yang memungkinkan berbagi dan menggunakan kreativitas dan pengetahuan melalui alat hukum gratis. Metode penelitian yang digunakan dalam tulisan ini adalah metode penelitian yuridis normatif dengan fokus pada pendekatan perundang-undangan dan analisis konten. Berdasarkan analisis pembahasan creative commons bukanlah alternatif dari hukum hak cipta, melainkan bekerja berdampingan dan mampu membuat pencipta/pemegang hak cipta memodifikasi haknya ke dalam keadaan yang paling sesuai dengan kebutuhan. Lisensi creative commons di Indonesia penggunaannya dimungkinkan menurut Pasal 9 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Lalu pemegang hak berdasarkan Pasal 81 UU Hak Cipta, dapat mengumumkan dan/atau berhak memberikan lisensi kepada pihak lain berdasarkan perjanjian lisensi untuk melaksanakan perbuatan sebagaimana dimaksud dalam Pasal 9 ayat (1), memperbanyak ciptaannya/produk hak terkaitnya dengan persyaratan tertentu. Selanjutnya berdasarkan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik Pasal 1 ayat (5), kegiatan yang dilaksanakan oleh creative commons adalah kegiatan penyelenggaran sistem elektronik.Kata Kunci: Creative Commons; Hak Cipta; Lisensi. The development of technology, especially the internet, has made it easier for people to access and distribute information.  However, activities such as copy-cut-paste, editing or file sharing may actually harm the copyright law.  Based on that, in 2002, a non-profit organization made a breakthrough innovation where it is possible to share and use creativity and knowledge through free legal tools. The research method used in this paper is a normative juridical research method with a focus on the statutory approach and content analysis. Based on the analysis of the discussion, creative commons is not an alternative to copyright law, but rather work side by side and is able to make the creator/copyright holder to modify their rights in the most appropriate circumstances.  The use of creative commons licenses in Indonesia is possible according to Article 9 paragraph (1) of Law Number 28 of 2014 concerning Copyright. Furthermore, the rights holder, based on Article 81 of the Copyright Law, able to announce and/or has the right to grant license to other parties based on the license agreement to carry out the action referred to in Article 9 paragraph (1), reproduce their rightful works/products with certain conditions. Furthermore, based on Law Number 11 of 2008 concerning Electronic Information and Transactions Article 1 paragraph (5), the activities carried out by the creative commons are the activities of organizing an electronic system. The most fundamental problem in education in Indonesia is the quality that has not exceeded the desired standards, including education staff, facilities, funding, management, processes and student achievement. Referring to the citation of the problem of financing which comes from the diversity of the current state of educational institutions, it raises the idea that it is very easy to build an organization that is based on profit or non-profit, but in the process, an organization should have to survive in the face of its environmental conditions. If you are able to adapt to the environment, so that the organization will survive, otherwise if not, ultimately only a name. Of course it's very easy to solve this problem. Another problem is the lack of funds, this problem is a fundamental reason that impedes the goals of an organization. The need for preventive measures in the procurement of funds is to build business units that generate profits for the establishment of an independent institution. The research in this article was conducted at Islamic education institutions, especially at Muhammadiyah 2 Sidoarjo High School, which aims to have educational institutions that have the right management in managing their business units, so that they receive income that can support the independence of educational institutions. The Business Unit to be investigated is specialized in leasing several business units owned by the Muhammadiyah 2 Sidoarjo High School. In this article, research conducted using a qualitative approach, the culminative approach is an approach that produces descriptive data in the form of written or oral words from people and observed behavior. The results of this study indicate that of the total business unit revenue only 17% is used for operational purposes, and 83% is left to the Sidoarjo SMAMDA educational institution. Thus it can be concluded that the entrepreneurship owned by Muhammadiyah 2 Sidoarjo High School in the form of several business units, with good management so as to provide income to the institution, this has helped Muhammadiyah High Schools to become independent educational institutions.

<p>Abstract<br />This article aims to examine the legal issues to find out the liability of the foundation trustee  who manages a hospital. The research method uses non doctrinal research method or empirical research, which finding the secondary data at the beginning, later on proceeded to the primary data. Law Number 44 Year 2009 on Hospital emphasizes that explains that hospitals can be managed by a non-profit legal entity, Law Number 16 Year 2001 jo. Law Number 28 Year 2004<br />on Foundation emphasizes that foundation trustee is fully responsible for the management of the foundation for the interests and objectives of the foundation and has the right to represent the foundation both inside and outside the court. This study that the validity of hospital managed by foundation could be valid if referring to the Constitutional Court Decision Number: 38 / PUU-XI / 2013. It was found that Aria Sentra Medika Hospital is valid and the Fatmawati Foundation<br />Trustee is the party charged with liability for hospital management.<br />Keyword: Foundation; Foundation Trustee; Hospital; Validity; Liability</p><p>Abstrak<br />Artikel ini bertujuan mengkaji isu hukum untuk mengetahui pertanggungjawaban pengurus  yayasan yang mengelola rumah sakit. Metodologi penelitian yang digunakan adalah metode penelitian non doktrinal atau penelitian Empiris, yaitu meneliti data sekunder pada awalnya, untuk kemudian dilanjutkan penelitian terhadap data primer di lapangan. Undang – Undang  Nomor 44 Tahun 2009 tentang Rumah Sakit menjelaskan bahwa rumah sakit dapat dikelola oleh <br />badan hukum nirlaba, Undang – Undang Nomor 16 Tahun 2001 jo. Undang – Undang Nomor 28 Tahun 2004 tentang Yayasan menegaskan bahwa pengurus yayasan bertanggung jawab penuh atas kepengurusan Yayasan untuk kepentingan dan tujuan yayasan serta berhak mewakili yayasan baik di dalam maupun di luar Pengadilan Hasil penelitian ini diketahui bahwa sahnya suatu rumah sakit yang dikelola oleh yayasan dapat dinyatakan sah jika merujuk pada Putusan Mahkamah Konstitusi Nomor : 38/PUU-XI/2013. Pada hasil penelitian, diketahui bahwa Rumah Sakit Aria Sentra Medika adalah sah dan pengurus Yayasan Fatmawati adalah pihak yang dibebankan pertanggungjawaban atas kepengelolaan rumah sakit.<br />Kata Kunci: Yayasan; Pengurus Yayasan; Keabsahan; Pertanggungjawaban</p>

In the discipline of Islamic law research, strong proofing and clear Istinbat method are key pillars in the construction of Islamic law based on the application of the science of usul al-fiqh and maqasid al-shari'ah. However, what happens at the state of Johor’s fatwa institution is the opposite. The fatwa research methods applied by the Fatwa Committee of Johor in resolving current fatwa issues is not based on the right and true discipline of Islamic law research. In fact, current inputs related to fatwa issues are not explicitly stated in the method of determining the law either in the form of reality or scientifically verified. Therefore, this paper will discuss the fatwa procedures undertaken by the Fatwa Committee of Johor based on the methods applied in resolving current issues. The research methodology adopted is library and interview methods. This study shows that fatwa management and production in the state of Johor is placed under the jurisdiction of the Mufti of Johor’s Department. The methods adopted by the Fatwa Committee of Johor covers two methods, namely: internal research methods including literature review through the application of original source and proofs based on syarak. Second: field research method that includes an external review or going to the location of study such as conducting observation, questionnaires and interviews including referrals to specialists of different fields. Maslahah and mafsdah consideration are also implemented by the Fatwa Committee in every fatwa decision based on the standard that meets the interests of maqasid al-shari'ah. Namun begitu, apa yang berlaku di institusi fatwa negeri Johor adalah sebaliknya. Kaedah penyelidikan fatwa yang diaplikasi oleh Jawatankuasa Fatwa Negeri Johor dalam menyelesaikan isu fatwa semasa tidak berasaskan kepada disiplin penyelidikan hukum Islam yang tepat dan sebenar. Malahan input-input semasa yang berkaitan dengan isu fatwa juga tidak dinyatakan secara jelas dalam kaedah penentuan hukum sama ada dalam bentuk realiti yang berlaku atau pembuktian secara saintifik. Justeru, kertas kerja ini akan membincangkan prosedur fatwa Jawatankuasa Fatwa Negeri Johor berdasarkan metode-metode yang diaplikasi dalam menyelesaikan isu-isu yang bersifat semasa. Metodologi kajian yang digunakan dalam kajian ini adalah melalui metode perpustakaan dan metode lapangan. Hasil kajian menunjukkan bahawa pengurusan dan pengeluaran fatwa di negeri Johor hanya terletak di bawah bidang kuasa Jabatan Mufti Johor. Metode fatwa yang diamalkan oleh Jawatankuasa Fatwa Negeri Johor merangkumi dua metode iaitu pertama, kaedah penyelidikan dalaman yang merangkumi kajian kepustakaan menerusi pengaplikasian dari sumber asas dan dalil-dalil syarak. Kedua, kaedah penyelidikan lapangan yang meliputi kajian luaran atau turun ke lokasi kajian seperti observasi, soal selidik dan temubual dan rujukan kepada pakar dalam bidang yang berlainan. Pertimbangan maslahah dan mafsdah juga dimplementasikan oleh Jawatankuasa Fatwa dalam setiap keputusan fatwanya berasaskan standard yang menepati kepentingan maqasid al-shari’ah. The study deals with 16th and 17th century Hungarian printed polemical works considering religious disputes a typical form of communication in the age of Reformation and Catholic renewal. Its conceptual framework is the paradigm or research method of the long Reformation as an efficient assistance to the discovery and appreciation of early modern theological-religious diversity. The analysis examines several kinds of communication which occurs in the (religious) dispute, and explores the rules and conventions along which the (verbal) fighting takes place. Research shows that the opponents repeatedly refer to the rules of dialectics refuting each other’s standpoints accusing them of faulty argumentation, i.e., the wrong use of syllogisms. Dialectics is, namely, in this context not the ars with the help of which truth is found but with which evident truth is checked and justified in a way that the opponents can also be educated to follow the right direction.

With the enactment of the Education System Act no 20 of 2003 (better known as the Sisdiknas Act), the State has determined that educational institutions should have a legal umbrella in the form of a legal entity, or better known as the Legal Entity Education. As a non-profit organization, the Foundation is the right legal entity that becomes a place for educational institutions, especially private schools. Therefore, of course, Notary has a very crucial role in making notary deed in the form of establishment and deed of change, such as example how in making the right basic budget and not multi interpresatasi for stake holders in the foundation. This research examines the development of traditional culinary culture,  Bakpia and Wingko Babat XYZ with the aim of preserving the local culinary heritage located in Bantul. Bakpia and Wingko Babat XYZ  is a special traditional business place that sells traditional Yogyakarta food in the Bantul area which still uses traditional methods. This business has been around for a long time since 1997. Lack of the right strategy is the cause when local and foreign visitors do not know much information about the culinary business of Bakpia and Wingko Babat XYZ. Based on this, this study aims to identify and analyze the marketing process carried out by Bakpia and Wingko Babat XYZ, to determine the potential of traditional culinary culture and to explore strategy formulations in Bakpia and Wingko Babat XYZ. The research method in this study is a qualitative research method, by conducting direct and in-depth interviews with key persons, observation, and literature study. The qualitative method used is descriptive qualitative which will describe how the right strategy is based on the results of the analysis. The interview data were analyzed by several stages, namely the SWOT stage in the internal and external environment, the weight and ranking calculation stage, the IFE-EFE and IE matrix analysis stage, and the conclusion stage. In the research analysis, the IFE and EFE matrix values were obtained, where the IFE value was 2.774 and the EFE value was 2.842. This condition shows that Bakpia and Wingko Babat XYZ  is in the V quadrant position, which means Hold and Maintain, in this position the right strategy is market penetration and product development, and in the SWOT quadrant in quadrant II Cobination supports the Diversification strategy, this is requires making alternative strategies that can be used to increase existing strengths so that they can overcome threats.Keywords: culinary culture, SWOT, IE.AbstrakPenelitian ini meneliti tentang  budaya kuliner tradisional yaitu Bakpia dan Wingko Babat XYZ dengan tujuan untuk menjaga warisan budaya kuliner lokal yang terletak di Bantul. Bakpia dan Wingko Babat XYZ merupakan tempat usaha tradisional khusus yang menjualkan makanan tradisional khas Yogyakarta di daerah bantul yang masih menggunakan cara-cara tradisional. Usaha ini sudah lama berdiri sejak 1997. Kurangnya strategi yang tepat menjadi penyebab ketika pengunjung lokal maupun mancanegara tidak mengetahui banyak informasi mengenai usaha kuliner Bakpia dan Wingko Babat XYZ. Berdasarkan hal tersebut, penelitian ini bertujuan untuk mengidentifikasi dan menganalisa proses pemasaran yang dilakukan Bakpia dan Wingko Babat XYZ, untuk mengetahui potensi budaya kuliner tradisional dan mengeksplorasi formulasi strategi di Bakpia dan Wingko Babat XYZ. Metode  penelitian pada penelitian ini adalah metode penelitian kualitatif, dimana dengan melakukan wawancara kepada key person secara langsung dan mendalam, observasi, dan  studi pustaka. Metode kualitatif  yang  digunakan yaitu kualitatif deskriptif yang akan mendeskripsikan bagaimana strategi yang tepat berdasarkan hasil analisis. Data  wawancara dianalisis dengan beberapa tahap-tahapan yaitu tahap SWOT pada lingkungan internal dan eksternal, tahap perhitungan bobot dan peringkat, dan tahap analisis matriks IFE-EFE dan IE, serta tahap kesimpulan. Pada analisis penelitian diperoleh nilai matriks IFE dan EFE, dimana nilai IFE sebesar 2,774 dan nilai EFE sebesar 2,842. Kondisi ini menunjukkan bahwa Bakpia dan Wingko Babat XYZ  berada pada posisi kuadran V yaitu berarti Hold and Maintain, pada posisi ini  strategi yang  tepat adalah penetrasi pasar dan pengembangan produk, serta pada kuadran SWOT  pada kuadran II Cobination mendukung stategi Diversifikasi, hal ini mengharuskan membuat alternative strategi yang dapat digunakan untuk meningkatkan Kekuatan yang ada sehingga dapat mengatasi ancaman.Kata Kunci: budaya kuliner, SWOT, IE. Author:Maria : Institut Seni Indonesia Yogyakarta References: Agustim, W., & Nurhidayat, M.
