Marriage is a religious order and is a worship, in the context of carrying out worship that is muamalah. Muamalah in Islam is highly recommended to record it in a State document that has legal force as the Decree of the Minister of Religion of the Republic of Indonesia. No. 298, 2003, to match the document data with the facts. Before the registration of marriage in the Office of Religious Affairs, it is necessary to do rafa '(examination of marriage to prospective brides) so that the data received is valid authentic away from lies and even hoak. The purpose of Rafa 'is nothing but an examination for the validation of the terms of marriage harmony in both the State administration and Islamic law. When there is a mismatch between the administrative data of marriage with the original and its personnel, then the marriage can be canceled by the KUA and even make the marriage invalid both according to positive law and Islamic law. Marriage is a sacred bond which is ideally only held once in a lifetime. Both Islamic law and positive law require an eternal happy marriage. To support this the Koran proclaims marriage as mitsaqan galiza. The marriage is then registered in the state administration. In line with this, the laws and regulations are formulated in such a way as to make divorce more difficult. However, when there are acceptable reasons and due to coercive conditions, divorce can be done through a judicial process. The divorce must then be registered by taking certain procedures. The court delivered the notice and sent a copy of the decision to the marriage registrar to file the divorce properly. The implementation of this divorce record was not effective. The separation of the Religious Courts Institution from the Ministry of Religion has become a factor that causes the registration task not to be carried out. The loss of the obligation to submit a copy of the decision on the judge's ruling caused the recording to be constrained. The unavailability of shipping costs also contributed to the failure to register divorce. Even though there is a threat to the Registrar who neglects to deliver a copy of the verdict, unclear sanctions make this ineffective. As a result of the lack of recording of divorce, the status of husband and wife becomes unclear and opens opportunities for abuse of that status.

Under the new law on travel documents, in addition to authority that has the Government of Serbia, in terms of issuing travel documents and a shared competence between the Ministry of Internal Affairs and the Ministry of Foreign Affairs depending on the type of travel document in question. Ministry of Foreign Affairs is authorized to issue a diplomatic passport, official passport and travel document, while all other travel documents are issued by the Ministry of Internal Affairs. When it comes to the passport as the most important travel document the jurisdiction of the Ministry of Internal Affairs is fully established. Diplomatic and Consular Missions of the Republic of Serbia abroad can now only receive requests for passport, but the issuance of travel documents of this type is exclusive jurisdiction of the Ministry of Internal Affairs. Such jurisdiction of the state administration in the process of issuing travel documents, along with other novelties which significantly modernize this kind of special administrative procedures should in practice very quickly enable the efficient issuance of travel documents, thus achieving the complete freedom of movement as one of the rights guaranteed by the Constitution to the citizens of the Republic of Serbia.

Negara Hukum Pancasila esensinya berpangkal pada asas kekeluargaan, musyawarah mufakat berlandaskan hukum adat, dan perlindungan hak asasi manusia dengan prinsip keseimbangan antara hak dan kewajiban dan fungsi hukum pengayoman. Sebagaimana yang terkandung dalam Sila Kelima Pancasila yaitu keadilan sosial bagi seluruh rakyat Indonesia, dan pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 terkait frase “memajukan kesejahteraan umum” merupakan rumusan dasar ideologi welfare state kemudian dimanifestasikan ke dalam batang tubuh konstitusi negara Indonesia untuk dijadikan pedoman hidup berbangsa dan penyelenggaraan kenegaraan.

The existence of the Administrative Court in the judicial system in Indonesia as a manifestation of the commitment of the state to provide legal protection of individual rights and the rights of the general public so as to achieve harmony, harmony, balance, and dynamic and harmonizing the relationship between citizens and the State. But the execution of the decision of the Administrative Court which have permanent legal force by the State Administration officials are not fully effective, although the mechanisms and the stages of execution has been carried out. Factors causing poor execution of the decision of the Administrative Court, among others; absence of rule of law that forced the officials to implement the State Administrative Court's decision: the commandment of the judge's decision that dare not include the forced payment of a sum of money when the state administration officials concerned did not implement the decision of the Court; factor and compliance officials in carrying out the State Administrative Court decision. Marriage is the necessity of every human being in fulfilling the needs of his life as a social creature. Because the issue of marriage is an important affair to maintain the benefit of the whole community, then the State has the right to regulate this business in the form of clear rules with the aim to provide protection of law and order in the life of society. This study examines the legal aspects of marriage that occur in the community i.e. the marriage of Sirri. The marriage is lawful or not in the view of Islamic law and the positive law that often becomes a polemic in society causes a negative impact on the parties involved both husband, wife and child. The results of this research, can be concluded that the marriage of Sirri is valid either by Islamic law or positive law, but in the view of the Islamic law of marriage is unlawful.

In relation to the positive law, the management of marine and coastal natural resources, there is also the rule of customary law. Customary law that still lives and develops in indigenous peoples also regulates the management system and utilization of natural resources in coastal and marine areas. Recognition of the rights of indigenous peoples is constitutionally contained in the 1945 Constitution of the State of the Republic of Indonesia where the state recognizes the existence of the Customary Law Community. In Maluku, marine potency management in general is still done traditionally known as marine customary rights that have been going on for generations but not yet fully recognized either by the government or entrepreneurs who are actually important partners in the development process.

Abstrak.Wacana tentang hubungan Islam dan negara masih menjadi pembahasan yang menarik. Masalahnya, Indonesia negara yang mayoritas warganya beragama Islam tidak menjadikan hukum Islam sebagai dasar konstitusinya, namun Indonesia juga bukan negara sekuler. Indonesia dapat dikatakan sebagai negara yang moderat, dimana hukum ketatanegaraan tidak bertentangan dengan hukum Islam Hukum Islam di tengah masyarakat Indonesia mempunyai kedudukan yang lebih penting dari pada dua ciri hukum lainnya yaitu hukum positif dan hukum hukum, tetapi tentunya tidak secara normatif atau ideologis. rasa ordogmatis, lebih secara tekstual tetapi secara kultural. Islam sebagai agama yang dianut oleh mayoritas penduduk Indonesia tentunya sangat mempengaruhi gaya hidup bangsa Indonesia. Dalam pandangan masyarakat Indonesia, hukum Islam merupakan bagian penting dari ajaran agama dan Islam merupakan ruang utama ekspresi pengalaman beragama dan menentukan keberlangsungan serta identitas sejarahnya.Kata kunci. Article 29 paragraph 1 of the 1945 Constitution of the Republic of Indonesia states that "the State is based on the One Supreme Godhead." This means that the state has given legitimacy to Islamic law as formal law in the Indonesian constitutional system. Islamic law has a great opportunity to be formalized into regulations, because the majority of Indonesians are Muslims. Perda Syariah itself in its journey has shown significant developments. There have been 433 regional regulations issued in Indonesia since 1998, however, these regional regulations with Islamic nuances have generated pro-contra attitudes from various parties. This study uses a qualitative research method with a literature approach. The results of the study state that there are still some parties who feel that regional regulations were born only as political needs that are less effective in their implementation, and others think that sharia regulations are an effort to regulate people's behavior so that they are in accordance with living norms.Keywords: Sharia Regional Regulation; Regional Autonomy; Formalization of Islamic Law Abstrak: Pasal 29 ayat 1 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyatakan bahwa “Negara berdasarkan atas Ketuhanan Yang Maha Esa.” Artinya negara telah memberikan legitimasi hukum Islam sebagai hukum formal dalam sistem ketatanegaraan Indonesia. Hukum Islam memiliki peluang yang besar untuk diformalkan menjadi peraturan, karena mayoritas bangsa Indonesia adalah pemeluk agama Islam. Perda Syariah sendiri dalam perjalanannya telah menunjukkan perkembangan yang signifikan. Telah ada 433 Perda lahir di Indonesia sejak tahun 1998, namun Perda-perda bernuansa Islam tersebut menimbulkan sikap pro-kontra dari berbagai pihak. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan literatur. Hasil penelitian menyatakan bahwa masih ada sebagian pihak merasa bahwa Perda lahir hanya sebagai kebutuhan politik yang kurang efektif dalam pelaksanaannya, dan  sebagian lain beranggapan bahwa Perda syariah adalah sebuah upaya untuk menertibkan perilaku masyarakat agar sesuai dengan norma-norma yang hidup.Kata Kunci: Perda Syariah; Otonomi Daerah; Formalisasi Hukum Islam
