The relations arising in the activity of public administration concerning the provision of human rights and freedoms, which are recognized as a priority component of the subject matter of administrative regulation, are characterized.  It is emphasized that one of the main, conceptual, most important and at the same time the most controversial issues is still the understanding of the subject matter and system of administrative law. The tasks concerning the assertion of the rights and freedoms of citizens, in particular the completeness of the settlement of their guarantees, are analyzed.  It is established that it can be carried out in different ways and means: by utterances in declarations, statements, enshrined in the Constitution and laws; participation in the preparation and adoption of international human rights instruments, accession to relevant international treaties, etc. Regarding administrative regulation, it is an issue of consolidating human and civil rights and freedoms in the sources of administrative law and recognizing their priority. The essence of the concept of "provision" and its elements are defined, which means the recognition and settlement with due fullness of these rights and freedoms, providing a real opportunity to use them, promoting implementation (positive guarantee), protection and defense from violations, renewal if allowed and responsibility of the state for them. It is emphasized that the protection and defense of the rights of citizens in modern administrative and legal theory are rarely considered as part of the constitutional principle of their approval and provision. Moreover, the emphasis in many works is exclusively made on the so-called "service" activities of public administration, which provide the most positive promotion of the rights and freedoms of citizens. However, it is no less important to maintain proper public order and security, to counteract to various illegal manifestations that infringe on these rights and freedoms, causing some damage, sometimes quite significant. The conclusion is made about the expediency of taking into account the relations concerning the provision of human rights and freedoms and its elements, in particular protection and defense in the construction of the system of administrative law.

In the administrative and legal science there is a refinement, change and expansion of the subject of the dynamic branch of administrative law, aimed at eliminating the resulting lag of legal theory from the legal reality. In our view, of the three basic categories that characterize the subject of administrative law, “public administration”, “executive power” and “administrativepublic activity”, the main generalization category is the category “administrative and public activities”. The phenomenon of the subject of administrative law refracts the problems and discussions inherent in the industry as a whole. In view of the existence of different points of view on the subject of administrative law, the legal science has not yet formulated a single definition of it. There is a tendency to overcome the conflict between different types of understanding, to bring together the positions of different concepts of understanding of administrative law in order to form a “universal” concept of it, to develop its common concept.

This paper considers and examines the extent of the applicability of the principles of fair hearing in administrative adjudication in Nigeria. The paper holds the view that administrative adjudicatory bodies are compulsorily bound by the principles of fair hearing as most of their functions affect the rights and obligations of individuals appearing before them. Bearing in mind that these principles of fair hearing (and others ancillary to them) are however not straight jacket principles, hence this paper. In achieving this purpose, the paper adopts the thematic and doctrinal methods of research. The paper adopts the analytical, critical, expository and comparative methods of presentation, with copious reference to the 1999 Constitution of the Federal Republic of Nigeria; Textbooks on Constitutional and Administrative Law and Human Rights Law; Statute books; Law Reports (Case Laws); National Assembly Gazettes, Local and International Journals as primary and secondary sources of material on the subject-matter.

The subject matter of the penitentiary oversight of the Prosecutor's Office in terms of the range of acts includes: Universally recognised (i.e. recognised by the vast majority of states) norms (principles) of international law in terms of establishing basic natural (inalienable) human rights, including in relation to persons held in places of detention and (or) serving measures of detention, which are part of the Russian Federation legal system and are directly incorporated into Russian national law: Universal Declaration of Human Rights, 1948; International Covenant on Civil and Political Rights, 16 December 1966; International Covenant on Economic, Social and Cultural Rights, 16 December 1966. Constitution of the Russian Federation. Duly ratified international treaties and agreements, which may be divided into two groups A) duly ratified multilateral international treaties and agreements (conventions). B) bilateral treaties and agreements on international legal assistance (cooperation) in terms of defining the procedure and conditions of extradition (transfer) of convicts for serving the sentence and other measures of compulsory isolation, as well as application of measures of preliminary isolation from society to those suspected or accused of committing a crime. Some 60 such treaties have now been ratified. At the national legislative level, the Office of the Procurator-General also supervises implementation of and compliance with federal laws, in addition to the Constitution of the Russian Federation. The laws may be conventionally divided into two groups. The first includes laws directly regulating the execution (serving) of penitentiary isolation measures. The second group covers laws that regulate activities directly related to compulsory isolation, as well as the activities of state bodies and institutions for which the execution of sentences serves as an additional function to the main activity. The next set of laws and regulations that form the subject matter of the penitentiary over-sight of the Public Prosecutor's Office are the subordinate laws and regulations. The subject is covered by by-laws of both general and departmental nature. The main peculiarity of deter-mining the scope of supervision in relation to departmental acts is that, on the one hand, the prosecutor supervises the implementation and compliance with the requirements contained in these acts, on the other hand, they themselves serve as a subject of supervision in terms of their compliance with the legislation in force. In this regard, the adoption of key ones usually requires the approval of the Prosecutor's Office, represented by the Prosecutor General of the Russian Federation or relevant subordinate prosecutors.

In her interesting and useful book, Karin Buhmann evaluates the potential for civil rights and ‘good-governance’ reforms to improve public administration and human rights in China and Vietnam. She argues that ‘good governance’ reforms promoting transparency and accountable discretionary power, more effectively enhance human rights observance than civil rights dialogues. The book examines the pre-modern indigenous roots of administrative rule in China and Vietnam, searches for comparative East Asian human rights and then evaluates complementalities between Western ‘good governance’ and East Asian public administration.

The subject of this article is the problems of the nature, essence and purpose of prosecutorial activity. The purpose of the article is to study and justify the role of the human rights function in prosecutorial activities in the concept of a modern legal state. At the heart of prosecutorial activity is the implementation of the main function of the Prosecutor’s office – its rights and freedoms, their protection. This means that any type (branch) of Prosecutor's supervision is permeated with human rights content in relation to a citizen, society, or the state. This is confirmed by the fact that the Federal law “On the Prosecutor's office of the Russian Federation” establishes an independent type of Prosecutor's supervision-supervision over the observance of human and civil rights and freedoms. It is argued that the legislation enshrines the human rights activities of the Prosecutor's office as its most important function. It is proposed to add this to the Law “On the Prosecutor's office of the Russian Federation”.

This chapter expounds on the Islamic perspective on freedom and human rights, and draws references from multiple Islamic thinkers on the subject. It asserts that freedom, according to the Islamic worldview, is a trust, a responsibility, an awareness of the truth, a commitment to follow it, and a dying to self for its sake. According to its literal meaning, freedom is permission and choice, or simply following one's instincts. Freedom is thus the power to choose between good and evil—a divinely appointed responsibility. Furthermore, according to the specialists in legal theory, in its ethical and legal meaning freedom means “conformity.” Freedom is to exercise responsibility in a positive way, fulfilling one's duty in in a spirit of obedience by following what is commanded and avoiding what is forbidden.

<p>O objetivo deste artigo é contribuir ao debate acerca da gestão do Poder Judiciário tendo como referência o princípio constitucional da eficiência na administração pública e os princípios da gestão da qualidade. Sob esse enfoque são abordados os temas da crise na administração pública e na administração judiciária. Através de uma revisão bibliográfica em livros e artigos levantou-se as contribuições de autores sobre o tema em análise. Uma correlação entre os princípios da qualidade e a realidade encontrada na administração de unidades judiciárias, através das fontes analisadas para o estudo, é realizada com o fim de demonstrar a validade da aplicação dos princípios para nortear as mudanças necessárias para a melhoria da prestação jurisdicional e a aumentar a satisfação da sociedade. O artigo apresenta a aplicabilidade de um sistema de gestão da qualidade, conforme o modelo da norma ABNT NBR ISO 9001:2015, como uma alternativa eficaz para que o Poder Judiciário apresente a resposta mais adequada para a necessidade de melhoria na eficiência da gestão do Poder Judiciário.</p><p> </p><p>The purpose of this article is to contribute to the debate about the management of the Judiciary having as point of reference the constitutional principle of efficiency in the Public Administration and the principles of quality management. This approach addresses the issues of crisis in the public administration and judicial administration. Through a bibliographical review in books and articles the contributions of authors on the subject under analysis were compiled. A correlation between the principles of quality and the reality found in the management of judicial units, through the sources analyzed for the study, is established in order to demonstrate the validity of the application of the principles to guide the changes necessary to improve the jurisdictional performance and to increase the satisfaction of society. The article presents the applicability of a quality management system, according to the model of ABNT NBR ISO 9001: 2015, as an effective alternative for the Judiciary to provide the most appropriate response to the need of improving the efficiency of the Judiciary management.</p><p> </p>

Haremos un recuento de su evolución, vigencia y cómo se evidencia su modalidad aplicada, a través de diferentes aportes desarrollados en el marco de la Organización de Naciones Unidas, así como de la doctrina estudiosa del tema. Su vigencia en la Administración Pública es de primer orden, puesto que el Estado y sus entidades adscritas, deben tener muy en cuenta que el enfoque citado, sirve para conocer si las políticas públicas, están atendiendo necesidades de individuos y comunidades concretas; generando transparencia pública a través de rendición de cuentas, así como evitando cualquier tipo de discriminación. Finalmente, se analizará su vigencia e impacto en algunos antecedentes jurisprudenciales de la Corte Interamericana de Derechos Humanos. ABSTRACT: This article intends to expose the scope of the «Human Rights Based Approach», in order to understand what variables and concepts it involves. We will recount its evolution, validity and how its applied modality is evidenced, through different contributions developed within the framework of the United Nations, as well as the doctrine studious of the subject. Its validity in the Public Administration is of the first order, since the State and its affiliated entities must take into account that the aforementioned approach serves to know if public policies are addressing the needs of specific individuals and communities; Generating public transparency through accountability, as well as avoiding any type of discrimination. Finally, its validity and impact will be analyzed in some jurisprudential antecedents of the Inter-American Court of Human Rights.

The subject matter of the present paper is the analysis of particular normative solutions as well as the position of the judiciary and the interpretations of the doctrine in the scope of political freedom and rights that may be applied by a child. A child, as an entity equipped with the attribute of inherent and inalienable dignity, is a benefciary of the guarantees concerning the protection of human rights and freedoms proclaimed in both the national and international standards. Due to the existence of some objective obstacles such as age or developmental issues, certain rights cannot be fully applied by a child. While analyzing the indicated issues, the author of the study evaluates existing regulations as well as presents proposals for changes that could have a positive impact on children’s situation concerning the implementation of his/her political rights.

This article is a book review of Stephanos Stavros The Guarantees for Accused Persons under Article 6 of the European Convention on Human Rights: An Analysis of the Application of the Convention and a Comparison with Other Instruments (Martinus Nijhoff, Dordrecht, 1993) 388 pp (including 3 appendices), price (hbk) £87.00. This book is a detailed analysis of the case law of the organs of the European Convention on Human Rights on the interpretation and application of Article 6 of the Convention. That article guarantees fair trial rights in the determination of criminal charges and in the determination of civil rights and obligations. The scope of Dr Stavros' study is the rights of an accused under Article 6. Butler praises Dr Stavros for being thorough in his treatment of both case law and international law, providing a closely argued critique alongside the law presented, and for his general enthusiasm for the subject matter (reflected in the book's readability). Despite its limitations, Butler commends this book's high standard of scholarship overall.
