Prospects for the development of labor protection legislation in the digital economy

The article highlights the main directions of development of legislation on labor protection in the Russian Federation. It draws attention to the fact that in the digital economy there is a change in approaches to the regulation of labor protection. In particular, there is a gradual departure from strict regulation of relations in the field of labor protection and the transition to more flexible forms. The author concludes that in the future legislation on labor protection will develop in the direction of expanding understanding of labor protection, providing flexibility to respond to the emergence of new areas of professional activity while individualizing approaches to preserving the health of workers. Among the priorities will remain such areas as improving the mechanisms for preventing occupational injuries and occupational morbidity, encouraging employers and workers to improve working conditions and maintaining health, motivating workers to maintain a healthy lifestyle.

The transformation of the socio-economic sphere based on the widespread use of information and communication technologies (ICTs) has allowed us to form fairly stable trends in the development of the digital economy in many countries of the world. The innovative system of economic relations in developed countries has shown its effectiveness. Digital technologies have an impact on the decision-making about what to produce and what to buy, digital markets have a short formation period, they have fewer entry barriers, they are more dynamic. The digital format of modern life leads to the development of new economic relations and to significant changes in the process of learning, professional activity, leisure activities, allows you to think differently, plan and make decisions. In Russia, in 2017, the program "Digital Economy of the Russian Federation" was approved, according to the strategic goals of which, the use of digital technologies should lead to an increase in the competitiveness and well-being of the country's population. The program provides for improving the level of management based on planning (strategic, tactical, operational), coordination, and monitoring the practical implementation of the goals set. Funding for the program is provided at the level of 100 billion rubles per year, the total budget for 2018-2024 is 1634.9 billion rubles. The article considers the target program "Digital Economy of the Russian Federation", determines the possibility of its practical implementation in the context of digital globalization and identifies the factors that hinder its development: the imperfection of the regulatory framework; low volume of digital technologies used in enterprises, insufficient level for their financing; insufficient level of digital competencies, technologies and readiness for technological breakthrough; "digital inequality" among the population of the country; insufficient targeted state funding of innovative digital companies and high cybercrime.

The subject. The article deals with topical issues of ensuring the realization of the employee's right to healthy and safe working conditions.The purpose of the study is to identify the main directions of improvement of the Labor Code of the Russian Federation in the field of labor protection.The methodology includes formal-legal method, the analysis of the components of the right to healthy and safe working conditions, as well as the right to information and related rights.The main results. The author formulates proposals for amending a number of articles of the Labor Code, including those containing the most important branch principles, as well as those on termination of the employment contract and ensuring the right of an employee to a workplace that meets the requirements of labor protection.Examples from judicial practice show a low level of legal awareness of Russian employers and their disdainful attitude to labor legislation. This is expressed not only in violation of labor protection rules, but also in the absence of proper registration of an employee, when a written labor contract is not concluded with him. Thus, the relationship between the norms of different labor law institutions is expressed, expressed in their protective potential. The existing approach to understanding labor protection in a broad sense to a certain extent may be in demand even now. For example, by improving the norms on the conclu-sion, modification and termination of an employment contract, it is possible to achieve in parallel a certain improvement in working conditions for workers. This is due to the fact that legal registration of employment in most cases is associated with a higher level of security, since an employee without clearance does not actually exist for the state control and supervisory bodies.Conclusions. Understanding of labor protection as all-round protection of labor capacity of the person, being so widespread in Soviet time, looks quite justified nowadays too. The Labor Code of the Russian Federation, as the central regulatory legal act, should be considered as an instrument not only of legal regulation, but also of a powerful ideological impact on domestic employers, and changes and additions to labor legislation concerning labor protection should be made according to above-mentioned conclusion.

More than 160 million occupational diseases detected for the first time are registered annually around the world [1,2]. At the mining enterprises Of Kazakhstan, this indicator has remained consistently high for many years. Currently, in the Republic of Kazakhstan, the only procedure for identifying dangerous and / or harmful factors of the production environment and labor process and assessing the degree of their impact on the employee is the periodic certification of production facilities for working conditions (pout), which is analogous to the procedure for special assessment of working conditions (SOUT) in the Russian Federation. The relevance of the research is due to the need to improve the legal framework for labor protection in the Republic of Kazakhstan. The aim of this work is to improve working conditions at mining enterprises in Kazakhstan by improving the methodology for developing measures based on the results of periodic certification of production facilities for working conditions. To achieve this goal, a «List of measures to improve working conditions»is being developed based on the results of the PA-POUT. At the moment, this list is compiled in the image and likeness of practically the same at all mining enterprises. The article proposes the principle of grouping activities, which allows us to make a more detailed focus on the dangerous and harmful factors of a particular enterprise, as well as the reasons for their occurrence. The proposed ranking is necessary to take into account the specifics of each specific mining enterprise.

The article investigates the ways and means of improving and perfecting the state of labor protection at transport enterprises of Ukraine through the implementation of international standards for risk management and occupational safety. A detailed analysis of international standards for occupational safety, and their main benefits that improve the health and safety of enterprises. The object of research is international standards on occupational safety and risk management. The purpose of the work is to analyze the implementation and use of international standards on occupational safety and risk management at Ukrainian transport enterprises. Research methods - analytical. Quality management of labor protection at enterprises is one of the priority areas of transport enterprises in order to reduce occupational injuries and improve working conditions. In order to effectively manage labor protection in transport enterprises, the authors of the article propose the introduction of international standards in the field of occupational safety and risk management in Ukraine. Examining the chosen topic, it was found that in many works that devoted to the application of international standards on occupational safety was not a generalization of all regulations and standards on labor protection and risk management in the enterprise. The main directions for the implementation of international standards for occupational safety and risk management in transport enterprises of Ukraine are proposed. The results of research can be recommended for implementation in the management system of labor protection at transport enterprises of Ukraine. Labor productivity depends on various factors, including appropriate working conditions. Work in the field of radiation medicine can have both harmful working conditions associated with equipment, drugs that must be used in the work, and psychological factors associated with the need to communicate with patients with complex diagnoses, psychological fatigue, which can become chronic if preventive measures are not taken in time. Statistical data from the official websites of the State Labor Service of Ukraine and the Ministry of Health of Ukraine were used in the work, students were interviewed using the Google survey form. Methods of rational criticism, dialectical, comparative-legal and formal-legal methods are used. It has been established that the inclusion of a special course on labor protection in educational programs will be an urgent preventive measure. To reduce the risk of burnout, it is necessary to conduct training, it is also necessary to conduct surveys of medical practitioners to identify problematic factors that need to be addressed. To improve the culture of a healthy lifestyle, to protect workers in the field of radiation medicine from the effects of hazardous production factors, it is necessary to strengthen preventive measures to prevent accidents at work and occupational diseases, as well as other exposure to hazardous production factors. To do this, it is proposed to improve two areas of preventive work. The first is to strengthen information work among students who obtain the profession of a medical worker in the field of radiation medicine, by introducing a special course on labor protection. Thus, the special course should be developed under features of work in the field of radiation medicine. In order to provide effective information, narrow specialists should be involved in lecturing. The second is to conduct simulation and psychological trainings for medical practitioners. The Social Insurance Fund of Ukraine should be involved in financing preventive measures. It is also advisable for the Foundation to submit its proposals to the methodological developments of new preventive measures.

Objective: Analysis of labor legislation on labor protection in the Russian Federation and the People’s Republic of China with the aim of constantly improving working conditions, ensuring safety and harmlessness of operations which are unsafe and harmful to health, mechanization and automation of heavy manual labor, as well as the implementation of safe and civilized production. Methods: An analysis of legislation on labor protection was applied in terms of employment, labor contracts, working hours and rest breaks, wages, labor protection, social insurance, vocational training, etc. Based on its results, negative and positive consequences of legislation on labor protection in China and Russia were identifi ed. Results: The constitutions and labor legislation of both countries contain the rights of workers to legal protection, including the right to work in conditions that meet safety requirements, there are standards for investigating accidents at work, and special attention is paid to the labor protection of women and children. It was revealed that in the Russian Federation, in contrast to China, a greater number of regulatory laws and regulations were developed, and special labor assessments were effectively regulated, therefore, the safety level in the Russian workplace is higher. Practical importance: In accordance with the legislation on labor protection, state bodies, economic departments, enterprises and their leaders at all levels must take various organizational and technical measures to create safe, hygienic and comfortable working conditions for workers which prevent and eliminate accidents, industrial poisoning and occupational diseases, protect the health and safety of workers, maintain and improve their long-term working capacity, avoid unnecessary losses of social labor and material benefi ts. Constantly improving labor legislation allows working safely and protects the legal rights of employees.

We presented the analysis of the working conditions of teachers, from which it becomes clear that low indicators of health and professional self-awareness characterize the modern teacher. The negative consequences of professional activity in school include the emergence of overvoltage of the nervous system, leading to internal emotional devastation and the development of “emotional combustion” syndrome among teachers; development of hypodynamics leading to disorders in the musculoskeletal system and cardiovascular system; overwork and problems with vision, speech apparatus, gastrointestinal tract, respiratory system. Among the leading factors of the occurrence of the listed diseases, teachers refer to the tension of professional activity, insufficient motor activity, low level of material support, absence of a system of social support for pedagogical personnel. The preservation, strengthening and restoration of the professional health of the teacher should be based on self-preservation behaviour and healthy lifestyle of the members of the profession. We assumed that the formation of a system of knowledge and skills related to professional safety, health protection, prevention of certain diseases of teachers should be laid down during the period of study at the university, including in the process of introducing digital technologies into the physical education of students.

To investigate the state of industrial injuries (including fatalities) in Ukraine in general and in the agro-industrial complex for the period from 2011 to 2017, and to identify ways to increase the level of occupational safety.Investigation of the condition of occupational injuries in the conditions of the agro-industrial complex of Ukraine was carried out using the probabilistic-statistical method of analysis. In the study, we used the statistical method of analysis of occupational injuries in Ukraine from 2011 till – 2017, which is based on the study of injuries according to the report of the State Labor Service of Ukraine.For the first time the analysis of occupational injuries in Ukraine from 2011 till-2017was carried out according to the report of the State Labor Service of Ukraine. The ways of raising the level of labor protection in agriculture are proposed.On the basis of analysis of the data of the State Labor Service of Ukraine for the period of 2011-2017, it has been established that the state of occupational injuries is declining, both in Ukraine as a whole and in the agro-industrial complex. Despite the fact that the level of injuries in the aforementioned years decreased, it should be noted that the industry of the agro-industrial complex in the period 2011-2014 took the third place in Ukraine by the level of injury and the second place – by the level of injuries with fatalities, and in the period 2015-2017 – third and first place respectively.In 2011, in the agro-industrial sector, 10,0% of the total number of traumatized people was injured at enterprises of Ukraine, and 17.9% of the total number of deaths were injured, in 2012, respectively, 9,9 and 18,6 in 2013 – 9,9 and 16,4, in 2014 – 10,9 and 17,3, in 2015 – 14,1 and 22,4, in 2016 – 13,1 and 20,8, and in 2017 – 12,5 and 20,5%.An analysis of the state of occupational injuries in the areas of supervision was conducted. The obtained results may be used as to prevent and eliminate potential hazards.In order to improve the work of the service on labor protection, it is continuously necessary to analyze the state of occupational injuries in the areas of supervision. This will enable you to prevent and eliminate potential hazards. Therefore, in order to create safe and harmless working conditions, it is constantly necessary to improve the legal regulation of labor protection in agriculture, to update the rules, norms, standards, instructions, regulations in accordance with the development of NTP and modern technical support of the agro-industrial complex and apply the experience of the world.To reduce occupational injuries, it is necessary to develop and implement a sectoral system of labor protection management; to increase the efficiency of labor protection work at agricultural enterprises of all types of property; to provide employees with regulatory and labor protection laws, which take into account modern labor safety requirements; to intensify control over compliance with safety standards and working conditions in the workplace, paying particular attention to the technical aspects of occupational safety.The analysis of the condition of occupational injuries in the field of supervision provides an opportunity to assess the dynamics of occupational injuries (including fatalities), to anticipate, eliminate potential hazards in production and to propose perspective ways to increase the level of labor protection in Ukraine.Keywords: occupational safety, innovations, legal regulation, the raised danger, an industrial traumatism, the dynamics of fatal injuries, agro-industrial complex, sectoral regulations on labor protection.кандидат сільськогосподарських наук,  доцент, І. Не зважаючи на те, що рівень травматизму у вищезгадані роки зменшувався, слід відзначити, що галузь агропромислового комплексу в період 2011-2014 роки займала третє місце в Україні за рівнем травматизму та друге місце – за рівнем травматизму зі смертельними випадками, а в період 2015-2017 рр. – третє та перше місце, відповідно.За 2011 рік у галузі агропромислового комплексу травмовано 10,0 % від загальної кількості травмованих осіб на підприємствах України, та загинуло – 17,9 % від загальної кількості смертних випадків, за 2012 рік відповідно – 9,9 та 18,6, за 2013 рік – 9,9 та 16,4, за 2014 рік – 10,9 та 17,3,  за 2015 рік – 14,1 та 22,4,  за 2016 рік – 13,1 та 20,8  й за 2017 рік – 12,5 та 20,5 %Для вдосконалення роботи служби з питань охорони праці, слід постійно проводити аналіз стану виробничого травматизму в галузях нагляду. Це дасть можливість достроково запобігти та вилучити можливі небезпеки. Отже, для створення безпечних та нешкідливих умов праці, необхідно постійно вдосконалювати правове регулювання охорони праці в сільському господарстві, оновлювати правила, норми, стандарти, інструкції, нормативно-правові акти відповідно до розвитку НТП та сучасного технічного забезпечення агропромислового комплексу та застосовувати досвід країн світу. Для зменшення виробничого травматизму необхідно розробити і впровадити галузеву систему управління охороною праці; підвищити ефективність працеохоронної роботи на сільськогосподарських підприємствах усіх видів власності; забезпечити працівників нормативно-правовими актами з охорони праці, де враховано сучасні вимоги безпеки праці; активізувати контроль за додержанням нормативів безпеки та умов праці на робочих місцях, звернувши особливу увагу на технічні аспекти охорони праці. The statistics of occupational injuries in the Russian Federation are analyzed. For 2019–2020 there was an increase in occupational injuries and fatal injuries. It was also revealed that among incidents at the workplace, electrical injuries are less common, but cases of electric shock most often result in high-severity injuries and fatal case. As a rule, electrical personnel suffer from electrical injuries. Professional selection of electrical personnel is proposed as one of the ways to reduce occupational injuries. Electrical personnel must have certain qualities (developed at the required level of thinking, attention, responsibility for the result of work, for their own and other people lives, communicative potential, moral standards, etc.) that allow employees to carry out their activities, which will contribute to improving occupational safety. Therefore, professional selection must consider the peculiarities of working with electrical installations. Occupational safety is also influenced by the tension of the labor process. In this regard, the fragments of the protocols on the indicators of the intensity of electrical personnel labor process, which were drawn up during the assessment of working conditions, were analyzed. It is noted that each profession related to electrical personnel differs in the class of working conditions according to the factors of labor process intensity at the workplace. Situations can also be observed when one profession at the different workplaces can have a different class of working conditions for the same indicators of labor process intensity. Based on the analysis of the protocols, it can be concluded that professional selection should consider the characteristics of the electrical personnel, as well as the classes of working conditions according to the indicators available in the protocols of the labor process intensity.
