THE CURRENT STATE OF OCCUPATIONAL TRAUMATISM IN THE CONDITIONS OF THE UKRAINIAN AGRO-INDUSTRIAL: PROBLEMS AND PERSPECTIVES

To investigate the state of industrial injuries (including fatalities) in Ukraine in general and in the agro-industrial complex for the period from 2011 to 2017, and to identify ways to increase the level of occupational safety.Investigation of the condition of occupational injuries in the conditions of the agro-industrial complex of Ukraine was carried out using the probabilistic-statistical method of analysis. In the study, we used the statistical method of analysis of occupational injuries in Ukraine from 2011 till – 2017, which is based on the study of injuries according to the report of the State Labor Service of Ukraine.For the first time the analysis of occupational injuries in Ukraine from 2011 till-2017was carried out according to the report of the State Labor Service of Ukraine. The ways of raising the level of labor protection in agriculture are proposed.On the basis of analysis of the data of the State Labor Service of Ukraine for the period of 2011-2017, it has been established that the state of occupational injuries is declining, both in Ukraine as a whole and in the agro-industrial complex. Despite the fact that the level of injuries in the aforementioned years decreased, it should be noted that the industry of the agro-industrial complex in the period 2011-2014 took the third place in Ukraine by the level of injury and the second place – by the level of injuries with fatalities, and in the period 2015-2017 – third and first place respectively.In 2011, in the agro-industrial sector, 10,0% of the total number of traumatized people was injured at enterprises of Ukraine, and 17.9% of the total number of deaths were injured, in 2012, respectively, 9,9 and 18,6 in 2013 – 9,9 and 16,4, in 2014 – 10,9 and 17,3, in 2015 – 14,1 and 22,4, in 2016 – 13,1 and 20,8, and in 2017 – 12,5 and 20,5%.An analysis of the state of occupational injuries in the areas of supervision was conducted. The obtained results may be used as to prevent and eliminate potential hazards.In order to improve the work of the service on labor protection, it is continuously necessary to analyze the state of occupational injuries in the areas of supervision. This will enable you to prevent and eliminate potential hazards. Therefore, in order to create safe and harmless working conditions, it is constantly necessary to improve the legal regulation of labor protection in agriculture, to update the rules, norms, standards, instructions, regulations in accordance with the development of NTP and modern technical support of the agro-industrial complex and apply the experience of the world.To reduce occupational injuries, it is necessary to develop and implement a sectoral system of labor protection management; to increase the efficiency of labor protection work at agricultural enterprises of all types of property; to provide employees with regulatory and labor protection laws, which take into account modern labor safety requirements; to intensify control over compliance with safety standards and working conditions in the workplace, paying particular attention to the technical aspects of occupational safety.The analysis of the condition of occupational injuries in the field of supervision provides an opportunity to assess the dynamics of occupational injuries (including fatalities), to anticipate, eliminate potential hazards in production and to propose perspective ways to increase the level of labor protection in Ukraine.Keywords: occupational safety, innovations, legal regulation, the raised danger, an industrial traumatism, the dynamics of fatal injuries, agro-industrial complex, sectoral regulations on labor protection.кандидат сільськогосподарських наук,  доцент, І. Не зважаючи на те, що рівень травматизму у вищезгадані роки зменшувався, слід відзначити, що галузь агропромислового комплексу в період 2011-2014 роки займала третє місце в Україні за рівнем травматизму та друге місце – за рівнем травматизму зі смертельними випадками, а в період 2015-2017 рр. – третє та перше місце, відповідно.За 2011 рік у галузі агропромислового комплексу травмовано 10,0 % від загальної кількості травмованих осіб на підприємствах України, та загинуло – 17,9 % від загальної кількості смертних випадків, за 2012 рік відповідно – 9,9 та 18,6, за 2013 рік – 9,9 та 16,4, за 2014 рік – 10,9 та 17,3,  за 2015 рік – 14,1 та 22,4,  за 2016 рік – 13,1 та 20,8  й за 2017 рік – 12,5 та 20,5 %Для вдосконалення роботи служби з питань охорони праці, слід постійно проводити аналіз стану виробничого травматизму в галузях нагляду. Це дасть можливість достроково запобігти та вилучити можливі небезпеки. Отже, для створення безпечних та нешкідливих умов праці, необхідно постійно вдосконалювати правове регулювання охорони праці в сільському господарстві, оновлювати правила, норми, стандарти, інструкції, нормативно-правові акти відповідно до розвитку НТП та сучасного технічного забезпечення агропромислового комплексу та застосовувати досвід країн світу. Для зменшення виробничого травматизму необхідно розробити і впровадити галузеву систему управління охороною праці; підвищити ефективність працеохоронної роботи на сільськогосподарських підприємствах усіх видів власності; забезпечити працівників нормативно-правовими актами з охорони праці, де враховано сучасні вимоги безпеки праці; активізувати контроль за додержанням нормативів безпеки та умов праці на робочих місцях, звернувши особливу увагу на технічні аспекти охорони праці. The article investigates the ways and means of improving and perfecting the state of labor protection at transport enterprises of Ukraine through the implementation of international standards for risk management and occupational safety. A detailed analysis of international standards for occupational safety, and their main benefits that improve the health and safety of enterprises. The object of research is international standards on occupational safety and risk management. The purpose of the work is to analyze the implementation and use of international standards on occupational safety and risk management at Ukrainian transport enterprises. Research methods - analytical. Quality management of labor protection at enterprises is one of the priority areas of transport enterprises in order to reduce occupational injuries and improve working conditions. In order to effectively manage labor protection in transport enterprises, the authors of the article propose the introduction of international standards in the field of occupational safety and risk management in Ukraine. Examining the chosen topic, it was found that in many works that devoted to the application of international standards on occupational safety was not a generalization of all regulations and standards on labor protection and risk management in the enterprise. The main directions for the implementation of international standards for occupational safety and risk management in transport enterprises of Ukraine are proposed. The results of research can be recommended for implementation in the management system of labor protection at transport enterprises of Ukraine. The value of supervision over industrial institutions at the stage of active formation of industrial production in Russia in the 19th — early 20th centuries is shown. The role of the factory inspectorate and other state bodies aimed at controlling the production process, as well as the spheres of interaction of the enterprises with the state is defined in the article. Based on the example of the activities of the factory inspectorate, the criteria are formed to determine the desired balance of rights and obligations in the structure of legal relations, which is required to comply with the interests of the state and business entities. Delineation of the powers of the factory inspectorate helps to identify the areas where state control is needed. At the same time, further study of the implementation of control and supervisory functions of the state in the field of industrial production is substantiated. The need to regulate this kind of relationship is indicated considering the modern realities where the merger of technological and organizational processes is objectively taking place, and the algorithms are built into the structure of legal relations. The issues of legal regulation of the industrial sector of the economy raised in the study indicate the unsolved fundamental problems of the theory of law, namely, the scope and significance of technical and legal regulation in the mechanism of management of the society, its scope in the structure of social regulation. The studied historical material allows to assert that the supervision in industry creates the basis for safety and real labor protection at the industrial objects. Introduction of the institute of factory inspectors became an important factor in building the labor protection system at the factories and plants. With the help of this institute, the norms were implemented aimed at ensuring trouble-free functioning, including at explosive and fire-hazardous industries of the Russian Empire in the 19th — early 20th centuries.

Subject. The article focuses on contemporary trends in the industrial and socio-economic development of Russia during the technological transformation of its sectors. Objectives. The study is an attempt to analyze what opportunities and difficulties may arise for the development of the industrial sectors in Russia. We also examine the dynamics of key development indicators of the industrial sectors, point out inhibitors of their competitiveness. Methods. The methodological framework comprises general methods of systems, structural-functional and comprehensive approaches to analyzing economic phenomena. We applied graphic, economic-statistical methods of research, conventional methods of grouping, comparison and generalization, and the logic, systems and statistical analysis. Results. We display how industrial sectors develop over time by type of economic activities. The article provides the rationale for structural rearrangements and further innovation-driven development of the industries. We display that the Russian industries technologically depend om imported production technologies. We substantiate the renewal of assets and technologies at industrial enterprises, and retain and develop human capital. Conclusions and Relevance. Primarily, the Russian economy should be digitalized as a source of the long-term economic growth. Notably, industrial enterprises should replace their linear production method with that of the circular economy and implement resource-saving innovative technologies. The State evidently acts as the leading driver of technological retrofitting of the industrial sector. If the State holds the reasonable and appropriate industrial policy at the federal and regional levels and configure its tools to ensure the modern approach to developing the industries in a competitive fashion, the industrial complex will successfully transform into the innovative economy.

Often, the employers allocate funds for occupational safety on the residual principle without considering the real needs in creating safe working conditions for the employees. This is especially topical for the small and medium-sized enterprises, whose budget, as a rule, does not allow to allocate sufficient funds for occupational safety. The substantiation is given concerning the need to improve modern systems for assessing the state of working conditions by integrating the missing elements, which are part of similar systems, selected during the analysis of domestic and foreign studies. In the critical review of foreign publications in the field of assessing the state of working conditions, the tools developed over the past 15 years are considered. The lines of business are selected related to the improvement of system for assessing the state of working conditions at the small and medium-sized Russian enterprises. To determine the most optimal methods, an algorithm is proposed for selecting the tools to assess the state of working conditions based on determining the efficiency parameter corresponding to each tool. Modern Russian methods are assessed in a similar way. As a result of the study, two tools for assessing the state of working conditions that are most optimal for small and medium-sized enterprises are selected. The analysis showed that the first selected method allows to assess the state of the personnel working conditions, i.e., gives a subjective assessment. The second method serves for an objective study of the estimated parameters, as well as for assessing the level of occupational hazard. Combined use of both tools can become the basis for the formation of a methodology for a comprehensive assessment of the state of working conditions at the small and medium-sized enterprises.

The purpose of the article is to present an analytical system that allows users to proces data necessary for an industrial risk analysis and management, to monitor the level of industrial safety in a given site, and to fulfil essential tasks within the field of occupational safety. This system’s implementation will make the industrial safety management at industrial sites more effective. Multifactorial, probabilistic, determined models of accidents’ hazard and severity indexes are integrated into the computing core of the Information and Analytical System. Then, statistical methods determine the risk assessment of occupational injuries and diseases. The <em>Information and Analytical System for Hazard Level Assessment and Forecasting Risk of Emergencies in the Republic of Kazakhstan</em> allows users to work efficiently with large volumes of information and form a united analytical electronic report about the state of industrial safety. The main objective of the monitoring system is to conduct a comprehensive analysis and assessment of the state of accidents, traumas and occupational sickness rates at industrial sites, the results being classified by the degree of hazard and insalubrity of manufacture. The introduction of the computer monitoring system in the specialized services of the Emergency Management Committee and the Ministry of Investment and Development of the Republic of Kazakhstan, and at industrial enterprises throughout the country, will allow users to analyse the state of the industrial and occupational safety constantly and objectively; as a consequence, the implementation will go a long way towards comprehensively approaching the task of increasing safety levels at industrial sites.

It is necessary to carry out work to analyze the harmful factors of accidents during the production, operation and transportation of raw materials in oil and gas fields and assess their compliance with the requirements of the standards of the Republic of Kazakhstan. The main goal of labor protection is to create safe working conditions for employees, as well as to prevent personnel from illnesses. In this regard, it is necessary to have a system of accounting, analysis and assessment of the state of labor protection, as well as management of labor protection. This article proposes ways to quickly assess the state of health and safety at work by calculating a number of occupational risk indicators based on information available in the modules for assessing occupational safety by industrial risk indicators. The efficiency of using the OSH management systems software proposed by the authors is based on a specific task from four main modules "Employees", "Events", "Equipment", "Ecology" and a number of submodules. In addition, this work uses matrix methods for assessing risks in the "Probability or Consequences of an Event" coordinate system, "Elmeri" system, "Fine Kinney" method, "Risks". Modern expert methods are compared and presented under the title "Five stages of assessment"

Problem setting. Social stability, a high-quality living standard for the population, and the creation of prerequisites for a decent level of living and development of society directly depend on the level of ensuring social security as a component of the national security of Ukraine. Recent research and publications analysis. Some aspects of the regulatory labor protection support are shown in the works of M. Baru, V. Venediktova, S. Voloshyna, D. Karpenko, L. Lazor, I. Shamshyna, V. Chernadchuk, O. Yaroshenko, and others. However, the peculiarities of labor protection as a social component of national safety in the context of Ukraine’s integration into the European Union require some further scientific research, and the regulation of these features definitely needs to be improved. The article aims to analyze the regulatory support of labor safety as a social component of national security, taking into account the processes of European integration of Ukraine, and to clarify the regulatory context of reforming its system. Highlighting previously unsettled parts of the general problem. The contradiction and inconsistency of the provisions in the Ukrainian legislation as for labor safety and the presence of numerous gaps in it determines the necessity to study this problem of the regulatory support for labor protection as a social component of the national security of Ukraine in the context of European integration. Paper main body. The main priority for ensuring national security is the protection of life and health, human and civil rights, and freedoms. National security is a system of measures to ensure the state of the Ukrainian people (nation) as an independent subject of political power and an equal participant in international relations, the bearer of sovereignty and the main source of power in their country, when the vital interests of a person and citizen, society and the state are optimally balanced and protected. There are no threats to the national interests, national values, and national way of life, and its independence, stability, self-development, and progress are ensured. National security is a complex multidimensional phenomenon that combines military, social, economic, political, informational, and environmental components. So, labor safety is an important social component of national security, because it provides for the adoption of necessary measures aimed at preserving life, health, and working capacity of a person in the process of work and avoiding accidents in future. Providing public stability and meeting Ukrainian national interests largely depends on ensuring labor safety. The law of Ukraine “On labor protection” of 14.10.1992 establishes a single procedure for organizing labor protection by regulating relations between an employer and an employee on issues of labor safety, health and the working environment, and the determination of basic provisions on the realization of the constitutional right of workers to protection of their life and health in the course of labor activity, to proper, safe and healthy working conditions. Ukrainian legislation defines labor protection as a phenomenon related to almost all spheres of society (socio-economic, political, legal, etc.). At the same time, the scientific community considers the concept of labor protection in various aspects. In this case, the concept of “labor protection” covers its definition of “labor safety” as the protection of the employee from the risks associated with the labor process. Thus, labor safety as an element of worker protection is the social component of national security that involves necessary measures to saving human life, health, and working ability and avoiding future accidents. Conclusions of the research and prospects for further studies. Based on the previous information, we can conclude that labor safety is an important social component of the national security of Ukraine. The international legal system and European standards of labor protection are based on the principles of protection and defense of human and civil rights. Therefore, the adaptation of local legislation to international and European legislation will help to improve existing legal norms and create new ones that will contribute to labor safety and stability in society and strengthening the national security of Ukraine. In the case of Ukrainian adaptation to international and European legislation, the requirements of European norms and standards in the field of labor safety provide for the solution of the following urgent tasks: ensuring safe working conditions, prevention of occupational injuries and diseases, providing the safety of products and services. At the same time, the use of economic levers and incentive principles is crucial. Legislative adaptation has to be based on systematic and preventive approaches to ensure workers their labor safety and health.

The subject. The article deals with topical issues of ensuring the realization of the employee's right to healthy and safe working conditions.The purpose of the study is to identify the main directions of improvement of the Labor Code of the Russian Federation in the field of labor protection.The methodology includes formal-legal method, the analysis of the components of the right to healthy and safe working conditions, as well as the right to information and related rights.The main results. The author formulates proposals for amending a number of articles of the Labor Code, including those containing the most important branch principles, as well as those on termination of the employment contract and ensuring the right of an employee to a workplace that meets the requirements of labor protection.Examples from judicial practice show a low level of legal awareness of Russian employers and their disdainful attitude to labor legislation. This is expressed not only in violation of labor protection rules, but also in the absence of proper registration of an employee, when a written labor contract is not concluded with him. Thus, the relationship between the norms of different labor law institutions is expressed, expressed in their protective potential. The existing approach to understanding labor protection in a broad sense to a certain extent may be in demand even now. For example, by improving the norms on the conclu-sion, modification and termination of an employment contract, it is possible to achieve in parallel a certain improvement in working conditions for workers. This is due to the fact that legal registration of employment in most cases is associated with a higher level of security, since an employee without clearance does not actually exist for the state control and supervisory bodies.Conclusions. Understanding of labor protection as all-round protection of labor capacity of the person, being so widespread in Soviet time, looks quite justified nowadays too. The Labor Code of the Russian Federation, as the central regulatory legal act, should be considered as an instrument not only of legal regulation, but also of a powerful ideological impact on domestic employers, and changes and additions to labor legislation concerning labor protection should be made according to above-mentioned conclusion.

Purpose: The purpose of current work is to study the decriminalization of the agro-industrial complex as the most important factor in food security, as well as a way to solve problems affecting the state of food security of the Russian Federation, problems of legal support of national priorities related to food independence. Design/methodology/approach: The methodological basis of the research was formed by general scientific and private scientific methods. Findings: Today the agro-industrial sector is faced with a fundamentally new socio-economic and political-legal situation. It is not coordinated with the state policy in the field of agriculture, food production and food security, although initially this policy is intended to be a tool for the development, maintenance and functioning of the agro-industrial complex. Originality/value: The conducted research allowed us to draw the following conclusions: given the significant contribution of the agro-industrial complex to the national economy, it is self-sufficient and can develop independently; federal spending on said government support should provide agricultural producers with a margin that provides incentives to improve worker efficiency and an affordable credit system for the technical and technological upgrades of equipment needed to produce competitive goods; issues of increasing the competitiveness of agricultural products require solutions, first of all, at the federal legislative level.

The purpose of the article is to analyze the trends in the innovative development of the agro-industrial complex and outline further ways of this process. Research methods. Dialectical methods of cognition of processes and phenomena were used, monographic (analysis of the implementation of innovations in the agro-industrial complex), abstract-logical (theoretical generalizations and the formation of conclusions), comparative analysis (the reasons and differences in the development of innovative activity in the agro-industrial complex are determined), empirical (comprehensive assessment and analysis of the object of study). Research results. The indicators and development trends of key institutions of agrarian sector of the economy are analyzed, the state of scientific activity in the agro-industrial sector and its impact on the agrarian sector of the economy is assessed, the market infrastructure of the agro-industrial complex and its influence on the innovative development of the agricultural sector are investigated. Scientific novelty. Theoretical and practical provisions for assessing the state of innovative development of the agro-industrial complex have been further developed; the necessity of development of innovative infrastructure of agro-industrial complex is substantiated. Practical significance. The main provisions and conclusions set out in the article contain certain methodological and practical recommendations for assessing the state of innovative development of AIC. Not only key institutions of the agricultural sector of the economy are analyzed, but also scientific activity in the field of agro-industrial complex and market innovation infrastructure, which has an impact on the innovative development of the agrarian sector.
