As an intellectual process, critical thinking plays a dynamic role in reconstructing human thought. In Islamic legal thought, this intellectual tool was pivotal in building a full-fledged jurisprudential system during the golden age of Islamic civilization. With the solidification of the science of Islamic legal theory and the entrenchment of classical Islamic jurisprudence, this process abated somewhat. Recent Islamic revival movements have engendered a great zeal for reinstituting this process. The current state of affairs in constructing and reconstructing Islamic jurisprudence by and large do not, however, reflect the dynamic feature of intellectual thought in this particular discipline. Thus this article attempts to briefly delineate this concept, unveil the reality on the ground, and identify some hands-on strategies for applying critical thinking in contemporary ijtihad.

This article surveys the three approaches—source-critical, phenomenological, and hermeneutical-theological—that prevail in the historiography of consensus in early, classical, and modern Islamic legal thought. The source-critical approach dominates the historiography of the early period. Scholars using this approach question the narrative found in classical Islamic legal theory: that specific verses of the Qur’an or Hadith of Muhammad establish consensus as a source of law. They believe instead that consensus emerged gradually, in response to the social needs of the Muslim community. Scholars using the phenomenological approach seek to define the doctrine of consensus in classical Islamic legal theory whilst scholars using the hermeneutical-theological approach view consensus as a powerful argument in issues of Islamic thought today. These approaches are not mutually exclusive and scholars often combine them. The article ends with identification of the areas for growth in future studies of consensus.

<p>Islamic finance continues to grow over the world, the development of technology plays a crucial role to support Islamic finance. The great innovation of technology may come to dig up the potential of Islamic financing, yet digital system needs for sharia compliance, both are in similar needs for sharia overviews regardless different opinions of ijtihad in this modern time. Emphasizing case by case of Islamic finance has been done by the sharia scholars in producing the new product of Islamic banking and financing. The Islamic jurisprudence however should consider the substence and maqasid form of sharia. The objective of this paper is to enlight some vital parts of Islamic legal theory as part of Islamic law in implementing sharia compliance. Furthermore, provide the role of legal system which takes a crucial place in implementing the system, it should be harmonized in the existing condition of Islamic finance. This paper is qualitative methods with deep analysis on Islamic legal theory among muslim scholars.</p>

It is an admitted fact that the stagnation and the crisis of thought in the Islamic Ummah is one of the most important reasons for its backwardness and for the malaise of its contemporary civilization. It is also an admitted fact that a reform of the methodology of the Islamic Thought on the one hand, and Islamization of social sciences and humanities, and of knowledge on the other, are greatly needed if we wish to overcome the crisis of thought and move into the modern life.We will need this new orientation, if we want to benefit from what the humanity has achieved in terms of knowledge and the progress of civilization up till now, and to interact with it from the Islamic perspective in order to realize the Islamic goals of human life and civilization. Ever since the importance of the reform in Islamic thought was crystallized in the minds of the Muslim youth who had awareness and commitment to Islam and had knowledge of the scientific and academic achievements of the western world, and ever since these youth established The Association of Muslim Social Scientists thirteen years ago, and finally since the establishment of the International Institute of Islamic Thought five years ago, as an independent academic institution fully dedicated to function as a backbone to serve the message of Islam, the idea of reform of the Islamic thought and Islamization of knowledge and of social sciences and humanities has gained acceptance, and efforts have been made to realize that goal. It will be noticed that in view of the focus of concern and action, of course a politically motivated concern to achieve strength and power to defend and combat, concentration has been on disciplines of education and economics. The latest trend regarding the study of contemporary thematic Islamic jurisprudence (fiqh) is built upon a paradigm that fiqh, as a science developed in the Islamic tradition, is able to respond to every modern challenge. This paradigm seems to be incompatible with the study of the Islamic legal theory (Ushū al-fiqh) which is considered stagnant. However, the study of Ushū al-fiqh is, the initial gate to the discussion of legal reasoning which enables those who master it come up with theoretically correct rulings and hopefully responsive to the needs of the times. Discussing the thematic Islamic jurisprudence (fiqh) without going through the Ushū al-fiqh thinking framework may lead to a serious gap to the product of the thematic fiqh study. The thematic fiqh studies such as fiqh siyāsah (Islamic jurisprudence on constitution), fiqh munākahat (Islamic jurisprudence on marriage), and Islamic jurisprudence on health issues are not infrequently distorted from the actual context. This article offers a way of dealing with the gaps. In this case, the terminology presented is para-fiqh. Para-fiqh is a term to bridge the trend between the thematic fiqh studies and the stagnancy of Ushū al-fiqh study which, in turn, give birth to the antithesis in the form of thematic Ushū al-fiqh. This article employs the conceptual-doctrinal approach which seeks to present the problems of various classical literatures of the Muslim scholars. By scrutinizing the concept para-fiqh, it is hoped that: first, this article presents a universal legal argument on some particular legal themes; second, it explains the principles of Ushū al-fiqh to understand the thematic fiqh products. The findings emphasize that the para-fiqh concept is important for enriching the intellectual tradition of Muslim communities, as well as being a bridge between the gaps created by the study of Islamic jurisprudence (fiqh) and the study of Islamic legal theory (Ushū al-fiqh).Keywords: para-fiqh; thematic ushūl, thematic fiqh, Ushūl jināyat; Ushūl mu`āmalat. AbstrakTrend terbaru mengenai kajian fiqh tematik kontemporer saat ini membangun paradigma bahwa fiqh adalah salah satu ilmu yang berkembang dalam tradisi Islam yang mampu merespon tantangan zaman. Paradigma ini seakan tidak sebangun dengan kajian Ushul fiqh yang dianggap stagnan. Namun demikian, kajian Ushul fiqh sebenarnya adalah gerbang awal pembahasan penalaran hukum sehingga melahirkan keputusan-keputusan hukum yang tepat. Membahas fiqh tematik tanpa melalui kerangka berfikir ushuliy  membawa gap yang serius terhadap produk kajian fiqh tematik tersebut. kajian-kajian tematik seperti fiqh siyāsah, fiqh, munākahat, fiqh kontemporer dan kesehatan tidak jarang terserabut dari konteks yang sebenarnya. Artikel ini menawarkan sebuah jalan lintas mengenai gap yang terjadi. Dalam kasus ini, terminology yang dihadirkan adalah para-fikqh. Para-fiqh adalah istilah untuk menjembatani antara trend kajian fiqh tematik dengan stagnasi kajian ushul fiqh; sehingga melahirkan antitesa berupa ushul fiqh tematik. Kajian dalam artikel ini bersifat konseptual-doktrinal yang berusaha menyajikan persoalan dari berbagai pustaka klasik sarjana Muslim. Artikel ini menemukan ada 2 tujuan: pertama, menghadirkan argumen hukum universal pada beberapa tema hukum yang partikular. Kedua, menjelaskan prinsp-prinsip ushūl   guna memahami produk fikih tematik. Hasil dari artikel ini menekankan bahwa para-fiqh penting untuk memperkaya khazanah intelektual tradisi intelektual masyarakat Muslim, sekaligus menjadi jembatan penghubung dari gap yang terjadi karena persoalan fiqh dan ushūl fiqh.Kata Kunci: para-fiqh; ushūl tematik, fikih tematik, Ushūl jināyat; Ushūl mu`āmalat.

The Fourth International Conference on Islamization of Knowledge,sponsored by the International Institute of Islamic Thought, was held in collaborationwith the University of Khartoum January 15-20, 1987. The themeof the conference was “Methodology of Research, Behavioral Sciences andEducation.” The call for papers was published in the American Jouml ofIslamic Social Sciences in July, 1984 and the invitations were circulated widelyamong Muslim scholars. It was in response to these calls that abstracts werereceived and finally selected on the basis of their relevance and quality.The conference was inaugurated by the Prime Minister of the Sudan, Mr.al Sayyid al Sadiq al Mahdi. Thirty-seven research papers were presented byforeign, as well as local Sudanese scholars. The subjects includedmethodology, epistomology , education, psychology, sociology, and anthropology.The conference proved to be an historic event, especially in termsof the participation of large numbers of local scholars, teachers, students andother interested Muslims.Each presentation was followed by lively discussions and critiques. Theextraordinary interest shown by the Sudanese Muslims regarding the issues ofthe Islamization of Knowledge, was evidence of this nation’s commitment tothe process of Islamization. The director of the Friendship Hall announced atthe final session that the conference had attracted the largest crowd ever at theauditorium. In addition, the lobbies, the offices and the grounds around theauditorium were all crowded and the loud speakers had to be openedeverywhere.The following are the titles of some of the research papers presented:1. The first decade of the 15th century Hijrah is over. It saw the establishmentof the International Institute of Islamic Thought (IIIT) and was markedby the development of cooperation and collaboration between various Islamicorganizations and institutions around the world. The results have been mostencouraging. This collaboration has contributed toward the initiation of anera of discussions and debates on the Islamization of knowledge and thedevelopment of a methodology for the reconstruction of Islamic thought.Among the consequences has been the unfolding of various intellectual forums.One such intellectual forum for the last five years has been the AmericanJournal of Islamic Social Sciences (AJISS) published jointly by the IIIT andthe Association for Muslim Social Scientists (AMSS). Purpose The purpose of this paper is to discuss the methodology of integrated knowledge in Islamic economics and finance and seek to offer collective ijtihād as one way to find solutions to the existing problems in the field. Design/methodology/approach The study is based on the idea of multidisciplinarity or interdisciplinarity, which uses not only traditional sources of Islam and economics, such as uṣūl al-fiqh, fiqh mu’amalat, econometrics, statistics, microeconomics and macroeconomics but also looks into behavioural and natural sciences for inspiration and solutions. This paper is constructed using the methodology of “the two readings”, as promoted by the International Institute of Islamic Thought, and which combines the revealed and the existential sciences. Findings This paper proposes the collaborative multidisciplinary methodology as the main approach to studying the modern problems and challenges, as well as for finding solutions in the fields of Islamic economics and finance. Practical implications Studying and researching issues, particularly in the field of Islamic economics and finance, from an interdisciplinary perspective, effectively broadens practical applications and possibilities in Islamic finance. Originality/value This paper contributes to social sciences, especially the field of Islamic finance, and calls upon researchers to engage in multidisciplinary studies.
