The legal assessment of export cartels today is one of the most pressing problems in the field of antitrust regulation, including in relation to transnational markets. The authors analyze the essence of the export cartel phenomenon, judicial and other law enforcement practice in cases of export cartels, identify its characteristic features and propose ways to solve the problem, including in relation to the Eurasian Economic Union.

The Eurasian Economic Union (EAEU) was established on the basis of the Treaty on the EAEU, signed on May 29, 2014 in Astana and entered into force on January 1, 2015. Thus, at present, this integration association is celebrating the first five years of its development. Traditionally, in the analysis of integration processes, there is Euro centricity and comparison with trends and successes in the development of the European Union. Recently, however, researchers are increasingly using the theory of new open regionalism and allow the development of integration without the rigid framework of classical regionalism and integration. The article gives a brief analysis of the development of Eurasian integration and the Eurasian Economic Union over the past five-year development period. Statistics are presented that demonstrate a generally positive track in the development of integration processes. The analysis of foreign and domestic trade, the EAEU rating and the current agenda in digitalization format are given. The article also presents the author’s point of view on the opportunities and challenges of Eurasian integration and development prospects.

The article examines the main problems faced by Belarusian higher education in the framework of internationalisation over the past five years, analyses the integration of Belarus into the international educational space. This period was marked by new challenges – the process of entering the European Higher Education Area was complicated by the difficult fulfilment of a number of requirements, and in the Eurasian Economic Union education is not among the priority areas. Inbound mobility flows have declined due to external factors. The current situation requires a comprehensive solution that includes strategic and tactical changes in the educational sphere. The article proposes ways of solving new problems of higher education.

The article deals with the peculiarities of violation of the rights of trademark owners. The article reflects the nuances of the term “counterfeit” in modern economic conditions. The author defines the forms in which counterfeit can manifest itself and the legality of its forms on the territory of the Russian Federation and the Eurasian economic Union. A parallel is drawn between the terms “counterfeit” and “trademark”. The key institution that plays one of the main roles in the fight against counterfeiting is identified. The article analyzes and identifies the key countries that supply counterfeit products to the territory of the Russian Federation. The main objects of counterfeit goods on the territory of Russia are reflected. The author analyzes the statistics of counterfeit goods detected by customs authorities over the past 5 years. The methods of importing counterfeit products and the reasons why consumers prefer to buy them are identified. On the example of Vladimir region the analysis of avoided damage that would be dealt to the owner of the intellectual property. The analysis and systematization of types of liability for illegal use of a trademark is carried out. The number of cases initiated by the customs authorities of the Russian Federation under article 14.10 of the Administrative Code of the Russian Federation in 2015–2019 is analyzed.


Subject Kazakhstan's oil-based economy. Significance President Nursultan Nazarbayev addressed the nation in his traditional 'State of the Union' address on November 30, taking stock of the past year and laying out new objectives for 2016. The president acknowledged a difficult economic period in Kazakhstan due to sharp declines in the price of oil and other export commodities. According to Nazarbayev, his government has worked out emergency plans for the worst-case scenario, whereby the price of oil drops to 20 dollars per barrel. Impacts The current recession in Russia will degrade the attractiveness of the Eurasian Economic Union. The economic slump heightens the risk of political instability in case of a sudden presidential succession. Astana will focus on ensuring socioeconomic stability and trying to avoid social unrest like that in Zhanaozen in late 2011.

The paper, based on comparative analysis of the legislation of the Russian Federation and acts of the Eurasian Economic Union, examines the legislative definition of the concept of import of goods, different approaches to understanding of the concept under consideration. The legislator’s definition of imports as importation of goods without the obligation to re-export them is not entirely consistent with the description of customs procedures in customs legislation, which gives rise to problems in law enforcement. In particular, the importation of alcoholic products by duty-free shops is considered as imports, which results in the requirement to obtain a license for the purchase (import) of alcohol products. The author highlights the discrepancy between this requirement and the law of the Eurasian Economic Community and the lack of uniformity of judicial practice on this issue. Conflicts of this kind in accordance with the Constitution of the Russian Federation and the Customs Code of the EAEU should be resolved in favor of international agreements. It is proposed to exclude the obligation to obtain a license to import alcohol products for duty-free shops.

The paper is devoted to the analysis of development prospects and problems of Eurasian Economic Union (EAEU) of Russia, Kazakhstan, Belarus and Armenia. It considers integration problems inside EAEU, interactions of EAEU with other CIS countries and with countries from the rest of the world. The paper shows that the major integration challenge inside EAEU is the domination of the redistributive motive over the creative one. It estimates the value of the oil and gas transfer from Russia to other EAEU members and the influence of the Russian tax maneuver on this transfer. The paper shows the need in redistribution mechanism inside EAEU as a necessary condition for getting the potential positive economic effects of free trade with other countries. It also assesses the risks for EAEU due to Russian embargo for food imports from countries of the sanctions list and possible application of tariff in the trade with Ukraine.

The paper appraises current progress in establishing the Customs Union and the Eurasian Economic Union (EAEU). Although the progress has slowed down after the initial rapid advancement, the Union is better viewed not as an exception from the general rules of regional economic integration but rather as one of the functioning customs unions with its successes and stumbling blocs. The paper reviews the state of Eurasian institutions, the establishment of the single market of goods and services, the situation with mutual trade and investment flows among the member states, the ongoing work on the liquidation/unification of non-tariff barriers, the problems of the efficient coordination of macroeconomic policies, progress towards establishing an EAEU network of free trade areas with partners around the world, the state of the common labor market, and the dynamics of public opinion on Eurasian integration in the five member states.
