EVOLUTION OF THE PROCEDURE FOR REVISING THE CONSTITUTION OF THE RUSSIAN FEDERATION AND MAKING AMENDMENTS TO IT: SIGNIFICANCE AND CURRENT PROBLEMS

Эволюция - это естественный исторический процесс развития, совершенствования, в том числе и основных государственных законов. Порядок пересмотра и внесения поправок - это процесс, который предусмотрен и происходит при конституционном становлении любого государства. Статья посвящена изучению характера некоторых поправок, внесенных в Конституцию Российской Федерации с недавнего времени. Кроме того, в статье проанализирована роль Конституции Российской Федерации как основного законодательного акта в стране, раскрыты основные принципы, изложенные в Конституции РФ и имеющие значение для внесенных поправок. Авторы отмечают, что внесение поправок в Конституцию РФ затронуло только содержание с третьей по восьмую главы, поскольку внесение изменений в первую, вторую и девятую главы Конституции РФ невозможно и влечет принятие новой Конституции страной. Тем не менее актуальность даже некоторых корректоров в основополагающем законодательном акте Российской Федерации обусловлена взаимосвязью всех положений Конституции, и после изменения хотя бы одной нормы Конституции неизбежно следуют некоторые поправки в иных нормах этого же акта. Далее авторы анализируют внесенные поправки относительно отображения в Конституции титульной нации. До недавнего времени данное положение отсутствовало, в отличие от положений конституций некоторых зарубежных государств, приводимых авторами в исследовании. Кроме того, отмечаются некоторые изменения преамбулы, которые нашли свое отражения в ст. 67 Конституции РФ, а также особенности установления идеологии на территории Российской Федерации. Относительно последнего авторы справедливо указывают, что, несмотря на запрет установления идеологии в стране, согласно внесенным поправкам в Конституцию РФ Российская Федерация должна придерживаться концепции патриотизма. В статье приводится точка зрения о нарушении порядка принятия поправок в Конституцию РФ, а также негативные последствия данного нарушения. В заключение авторы указывают, что, несмотря на особенности внесения поправок в Конституцию РФ, они тем не менее были реализованы, хотя и не решили существующих проблем в Российской Федерации. Evolution is a natural historical process of development, improvement, including the basic state laws. The procedure for revision and amendment is a process that is provided for and occurs during the constitutional formation of any state. The article is devoted to the study of the nature of some amendments made to the Constitution of the Russian Federation recently. In addition, the article analyzes the role of the Constitution of the Russian Federation as the main legislative act in the country, analyzes and reveals the basic principles set out in the Constitution of the Russian Federation and are relevant for the amendments made. In the study, the author correctly notes that the amendments to the Constitution of the Russian Federation affected only the content of the third to eighth chapters, since the introduction of amendments to the first, second and ninth chapters of the Constitution of the Russian Federation is impossible and entails the adoption of a new Constitution by the country. Nevertheless, the relevance of even some correctors in the main legislative act of the Russian Federation is conditioned by the interrelation of all the provisions of the constitution with each other and the change of at least one norm of the Constitution is inevitable by some amendments to other norms of the same act. Further, the author analyzes the amendments made regarding the inclusion of the titular nation in the Constitution, since this provision was absent until recently. This, in turn, cannot be said about some foreign countries, the provisions of whose Constitutions the author cites in the study. In addition, the author notes some changes in the preamble, which are reflected in Article 67 of the Constitution of the Russian Federation, as well as features of the establishment of ideology on the territory of the Russian Federation. Regarding the latter, the author rightly points out that despite the ban on the establishment of ideology in the country, according to the amendments to the Constitution of the Russian Federation, the Russian Federation should adhere to the concept of patriotism. The article presents the point of view about the violation of the procedure for adopting amendments to the Constitution of the Russian Federation, as well as the negative consequences of this violation. In conclusion, the author points out that despite the peculiarities of the amendments to the Constitution of the Russian Federation, they were nevertheless implemented, although they did not solve the existing problems in the Russian Federation.

The relevance of the article stems from the adoption by the constituent entities of the Russian Federation of rules on administrative liability for failure to implement decisions of the anti-terrorist bodies of the constituent entities of the Russian Federation in situations of conflict with federal law regulations, caused by adoption of the Federal Law No. 82-FZ of 18 April 2018. This contradiction calls into question the conformity of the adopted norms of the laws on administrative liability of the constituent entities of the Russian Federation with the principle of legality, as one of the basic principles of the State’s legal system construction. The purpose of the article is to develop a position on legal conduct in a situation of con-flict with the legal norms of federal legislation in establishing administrative liability by the constituent entities of the Russian Federation. The possibility of establishing administrative liability at the level of the constituent entities of the Russian Federation is enshrined in the Constitution of the Russian Federation and the Code of Administrative Offences of the Russian Federation After the adoption of the Federal Law No 82-FZ of 18 April 2018 «On Amendments to the articles 5 and 5.1 of the Federal Law «On Counteracting Terrorism» legal conflict in the regulation of these powers has arisen. These changes affected not only the regulation of the above-mentioned powers of the constituent entities of the Russian Federation, but also the system of sources of administrative liability, since Code of Administrative Offences of the Russian Federation states: administrative liability source system refers only to the Code and the laws of the constituent entities of the Russian Federation. The article contains an analysis of possible interpretations of the provisions of federal laws on the powers of the constituent entities of the Russian Federation to establish adminis-trative liability for failure to implement decisions of the anti-terrorist bodies of the constituent entities of the Federation. Possible interpretations of the term «decisions of an anti-terrorist body» are analyzed from the point of view of the goals and tasks of formation of these bodies, their powers and organizational-steam form. The study concludes that it is necessary to comply with the provisions of the Code of Administrative Offences of the Russian Federation when determining responsibility for failure to implement decisions of the anti-terrorist bodies of the constituent entities of the Russian Federation. It is recommended that the legislatures of the constituent entities of the Russian Federation refrain from adopting such norms. It is recommended that the judicial authorities should take into account the provisions of the Decision of the Plenum of the Supreme Court of the Russian Federation of 24 March 2005 No 5 « On certain issues raised by the courts in the application of the Code of Administrative Offences of the Russian Federation».

This article examines various aspects of institutional problematic in the research of sociologists. Analysis is conducted on the theses on sociology (for the period from 2016 to 2019), which provide the results of studying social institutions and social practices. The author determines the modern trends in examining the problem of “institutionalization – deinstitutionalization”, and reveals the connection between social institutions and particular practices. The tendency to generalize the material on local manifestations of the institutions and practices in the thesis is noted. At the same time, the questions are raised concerning the development of relatively new institutions, the establishment of which is associated with the peculiarities of modern social reality. Attention is give to cross-disciplinary nature of theses dedicated to studying the institutional problematic. The author assesses the role of the theses of sociologists in formation of the picture of development of the institutions and practices in the Russian Federation, its constituent entities, and foreign countries. Emphasis is placed on the aspect of regionalization of institutions. The article outlines the problems related to the scientific analysis of “basic institutions” in regional development. The significance of theses for the formation of representations on correlation between the “basic institutions” and relevant social issues in the constituent entities of the Russian Federation is indicated. Focus is also made on the prevalence of the tendency to studying the role of the regional traditional values and norms in the development of certain social institutions and practices.

The article highlights the role of prof. A.L. Makovsky in the creation of the new Civil Code of the Russian Federation of 1994–2006, as well as in the organization of the practice of its application and the development of the Concept for the Development of Civil Legislation of the Russian Federation in 2009. Special attention is paid to the activities of A.L. Makovsky on the preparation of the Fourth Part of the Civil Code of the Russian Federation and the concept of intellectual rights enshrined by it, opposing the traditional archaic concept of “intellectual property”. The importance of the need to increase the attention of civil law to the issue of protecting the rights and interests of citizens and other weakest participants in civil legal relations in their opposition to the interests of large companies striving to take a privileged position in property turnover is shown. From this point of view, the author substantiates the need for a significant adjustment in the understanding of the balance of private and public interests, which is the basis of civil law regulation.

One of the most difficult issues of civil law is the determination of the criteria for abuse of rights prohibited by Article 10 of the Civil Code of the Russian Federation. Among numerous points of view on this issue, the following has become very widespread in judicial practice: an abuse of the right can be established based on the negative consequences that have occurred for third parties as a result of the exercise of the right. Since these consequences are evident, then the exercise of the right constituted an abuse. Substantial support for this approach is provided by the Constitutional Court of the Russian Federation opining that the rule of Art. 10 of the Civil Code of the Russian Federation is aimed at implementing the principle enshrined in Part 3 of Art. 17 of the Constitution of the Russian Federation. Having studied the origins of this point of view and its legal foundations, the author noted a number of inherent shortcomings. In particular, this point of view does not distinguish between inflicting unacceptable harm and admissible actions causing harm to another person; it does not take into account the competition of legal norms; it does not take into account that causing harm prohibited by law is an offense and, therefore, it is not an act of exercising subjective rights. These and other shortcomings of the concept of causing harm, noted by the author of the paper, lead to the conclusion that the feature of “causing harm” in itself is insufficient to qualify the act as an act of abuse of the right and the application of Art. 10 of the Civil Code of the Russian Federation. In addition to the indicated feature, which is a prerequisite for the application of Art. 10 of the Civil Code of the Russian Federation, the court must establish another (key) factor, namely: the fact that, in its opinion, allows to distinguish between legal abuse and other lawful and unlawful phenomena.

The article provides an analytical review of the experience of foreign countries in the creation of industrial parks and shows their role in the economy of individual regions, each individual state. The importance of the creation and development of industrial parks as an institution for the development of industrial and innovative production in the economy of the Russian Federation is indicated. The main problems of the development of industrial parks in the Russian Federation and methods of their solution are considered. The conclusion is made about the current level of development of the institute of industrial parks as a driver of economic growth in the Russian Federation.

The paper examines and compares the systems of minimum wage settings existing in foreign countries and the Russian Federation. The comparisons are made in the following directions: methods of minimum wage setting, coverage of the employees, frequency of adjustment and availability of sub-minimum rates for young workers. As a result of this analysis the author offers recommendations how to improve the mechanism for setting minimum wages in the Russian Federation at whole and its particular regions.

The testimony of witnesses represents the type of evidence, without which practically no criminal case can do. It is the significance of this type of evidence that determines the legislative requirements for the regulation of preparation and the procedure for the interrogation of a witness, as well as for the recording of evidence. This is of particular importance both from the standpoint of ensuring the admissibility and reliability of evidence, as well as from the point of view of ensuring the rights and legitimate interests of persons involved in criminal proceedings. The national legislation of modern states creates its own standards for the use of witness testimony in proving criminal cases. With all the variety of approaches, the importance of information technology in the collection, testing and evaluation of witness testimony can be viewed in the following main areas: as a means of fixing an investigative action, as a way of establishing the actual circumstances relevant to the case, as a means of ensuring the production of an investigative action, and as a means of transmitting information. Based on the analysis of the criminal procedure legislation of the Russian Federation and some foreign countries, the paper examines the problems of legislative regulation of the use of digital technologies during the interrogation of witnesses, including remote interrogation and deposition of witness testimony. Special attention is given to distant interrogation at the request of foreign countries.

The implementation of the sanctions policy of the United States and Western Europe in relation to the Russian Federation has been analyzed. The objectives of the USA and European Union sanctions policies have been identified. The study has been based on the principles of a three-level classification of sanctions aimed at destabilizing the economy of the Russian Federation. Sectors of the economy and companies have been identified, that, have become objects of sanctions policy and have suffered more from USA and European Union sanctions. The role of sanctions as a toolkit, which can influence the political and economic balance of power in the world, has been defined. The opinion of representatives of business of foreign countries on the formation of anti-Russian sanctions has been reflected within the article. The features of the implementation of the sanctions policy in the digital block and cyberspace have been noted.

Затрагиваются острые проблемы взаимодействия СМИ с органами власти в иностранных государствах. Поднимаются вопросы взаимодействия частного капитала со средст- вами массовой информации в других государствах. Выявляются проблемы взаимодействия органов государственной вла- сти со СМИ в зарубежных странах и тем самым предлагается учитывать данный опыт иностранных государств в Российской Федерации. Annotation. This article examines the legal framework governing the activities of mass media in foreign countries. The acute problems of interaction between the media and the authorities in foreign countries are touched upon. The questions of interaction of private capital with mass media in other states are raised. The problems of interaction of state authorities with the media in foreign countries are identified, and thus it is proposed to take into account this experience of foreign states in the Russian Federation.


Small and medium-sized enterprises in the modern market economy play the role of one of the main sectors that determine the vector and rates of economic growth of the gross domestic product. All developed countries strongly support the small and medium-sized business sector, since the structure and quality of GDP directly depends on it. This article examines the impact of small and medium-sized businesses on the economy of the Russian Federation and the Slovak Republic. The article compares the analysis and identifies the necessary conditions for starting business in the countries under consideration. The authors provide statistical data on the structure of small and medium-sized businesses identifies problems that slow down the development of small businesses and suggests ways to solve existing problems in this sector of the economy.
