The article is devoted to the current state of digitalization aimed at solving urgent problems of combating corruption in the field of public administration and private business sector. The work considers the experience of foreign countries and the influence of digital technologies on the fight against corruption. It is noted that the digitalization of public administration is becoming one of the decisive factors for increasing the efficiency of the anti-corruption system and improving management mechanisms. Big Data, if integrated and structured according to the given parameters, allows the implementation of legislative, law enforcement, control and supervisory and law enforcement activities reliably and transparently. Big Data tools allow us to analyze processes, identify dependencies and predict corruption risks. The author describes the most significant problems that complicate the transfer of offline technologies into the online environment. The paper analyzes promising directions for the development of digital technologies that would lead to solving the arising problems, as well as to implement tasks that previously seemed unreachable. The article also describes current developments in the field of collecting and managing large amounts of data, the “Internet of Things”, modern network architecture, and other advances in the field of IT; the work provides applied examples of their potential use in the field of combating corruption. The study gives reasons that, in the context of combating corruption, digitalization should be allocated in a separate area of activity that is controlled and regulated by the state.

We examine the question of prevention of crimes committed by persons with negative changes in the psyche. The relevance of the topic is confirmed by the fact that in modern conditions, preventive activities against crimes of persons with mental disabilities has acquired high importance and has become the main concept of general and forensic psychiatry, but the lack of scientific research on the prevention of crimes committed by persons with mental disorders, has a negative impact on the fight against crime. The effectiveness of the fight against crime largely depends on organizational and methodological prerequisites. Prevention of crimes committed by persons with negative changes in mental activity has an integrative nature and is possible only with the comprehensive development of tactical methods of preventive measures, criminological methods of prevention of crimes committed by persons and the development on this basis of practical recommendations to improve preventive activities. Prevention consists of two main areas: socially oriented and biologically based measures. We propose to emphasize the special field of prophylaxis and prevention measures against crimes – socio-psychiatric prophylaxis, justifying it by the fact, that prophylaxis is a complex measure. We draw a conclusion that it is possible to ensure sustainable and effective preventive work only with the coordinated mutual work of doctors and law enforcement officers, first of all, the internal affairs bodies, as well as social workers.

Preventive measures are coercive criminal law enforcement institutions, aimed at the deprivation or restriction of individual liberty, by which the suspect or defendant is prevented from undertaking certain activities that would adversely affect the conduct of the criminal proceedings or the achievement of its purpose. They have been instituted by the legislator for specific purposes, namely: to ensure the proper conduct of criminal proceedings, to prevent the abstraction of the suspect or defendant from trial and to prevent the commission of new offenses (art. 202 para. 1 of the Criminal Procedure Code). Preventive measures are not inherent in any ongoing criminal trial, but are exceptional measures (art. 9 para. 2 of the Criminal Procedure Code), and the court can decide to sease the measure or make use of the measure in the light of the specific circumstances of each case. Of the five preventive measures, three are deprivation of liberty - detention, house arrest and pre-trial detention, and two are non-custodial: judicial control and judicial control on bail. All these measures are only applicable to the natural person. Specific preventive measures may be taken against legal persons, but those are regulated by the provisions of art. 493 of the Criminal Procedure Code.

Penelitian bertujuan untuk menganalisis perlindungan hukum terhadap anak korban kekerasan seksual, dan menganalisis faktor yang mempengaruhi perlindungan hukum terhadap anak korban kekerasan seksual. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian bahwa; Perlindungan hukum terhadap anak yang menjadi korban kekerasan seksual dalam praktik penegakan hukum pidana oleh Kepolisian di Polewali Mandar adalah perlindungan dalam proses penyelidikan serta melalui upaya preventif/pencegahan dengan bekerja sama dengan Lembaga Swadaya Masyarakat (LSM) di Kabupaten Polewali. Sedangkan perlindungan hukum oleh Pengadilan Negeri Polewali adalah perlindungan dalam proses persidangan yang berupa korban anak tidak disumpah, hakim dalam memberikan pertanyaan sangat hati-hati dan tidak formal, serta adanya pendamping yang dipercaya oleh korban anak. Perlindungan hukum terhadap anak korban kekerasan seksual tidak berjalan secara efektif dikarenakan masih terdapat tindak kekerasan seksual anak yang pada kenyataannya saat ini masih banyak yang menimpa anak di Kabupaten Polewali Mandar. This study aims to analyze the legal protection of child victims of sexual violence, and to analyze the factors that influence the legal protection of child victims of sexual violence. This type of research is juridical empirical. The paper analyzes the provisions of the criminal procedure law determining the grounds and procedures for the application of preventive measures when deciding a sentence. The paper attempts to identify their constitutional and legal meaning. According to the author, the remand of a defendant in custody on the sole basis of the need to execute a real imprisonment sentence is unacceptable. Doctrinal representations of the theory of procedural decisions allow us to conclude that the decision on the measure of restraint cannot be taken simultaneously with the sentence and should not be an integral part of it. Under the current legal regulation, the defense is forced to refuse to express the position on the measure of restraint in the pleadings and the last plea if the position of the defendant is aimed at acquittal. The impossibility for the defense to make an immediate appeal on the formulated in the sentence decision on detention makes the appeal meaningless in general. Uncertainty of the procedure for sending persons sentenced to real imprisonment in all penal institutions but colony-settlements to the place of serving their sentence, for whom the court did not choose detention, reveals a gap in the law. The author claims that these and other defects in the legal regulation listed in the paper contribute to the existence of an accusatory bias in law enforcement practice, since they predetermine the detention decision and must be eliminated. Measures of restraint must be considered immediately after the verdict is sounded in a separate court session at the request of the prosecution or at the initiative of the court.

This study discuss legal issues concerning control of reclamation without possessing land rights as the result of the unregistered reclamation by communities in the Village of Tanddan, Sub-district Campling in the Sampang Regency. The aim of this study is to show legal implications and analyze effectivity of law enforcement on the accomplishment land control of reclamation without possession. By using empirical legal research with socio-juridical approach, the result of study shows that legal subject cannot control over and build houses over land of reclamation withou posession of land rights. In other words, houses built over land of reclamation without land rights can be evicted without any compensation. Therefore, such land of reclamation should be registered  as the governmental land to the National Agrarian Board or Badan Pertanahan nasional (BPN) in the Sampang regency. It also affirms that there is a problem of effeciency of law enforcement on the accomplishment of land control of reclamation without any repressive and preventive measures. Often, epileptics die at the time of a pronounced seizure attack, especially in status epilepticus; otherwise they die either at the time of the attack, or immediately after it in an unconscious state, from completely random circumstances, which are sometimes completely impossible to prevent even with careful observation of the patient and which are fatal for the given subject. All cases of this kind are very instructive, indicating once again what kind of careful supervision epileptics require, even in the setting of special institutions, where they seem to be in the greatest safety from death due to lack of preventive measures or oversight on the part of the caring staff.

Penelitian ini bertujuan untuk menganalisis wewenang Penyidik Pegawai Negeri Sipil dalam kasus asusila dengan mengambil studi kasus di Kota Palembang. Data yang digunakan adalah data Primer yang dikumpulkan melalui metode wawancara dengan Satuan Polisi Pamong Praja. Hasil penelitian ini menunjukkan bahwa Penyidik Sipil memiliki beberapa wewenang, yaitu: menerima laporan atau pengaduan dari individu tentang tindak pidana, Mengambil sidik jari jari dan menembak seseorang, Memanggil orang untuk didengar dan diperiksa sebagai tersangka atau saksi, membawa ahli dalam hubungannya dengan pemeriksaan kasus ini, penghentian penyelidikan setelah menerima instruksi dari penyidik bahwa ada cukup bukti dan bukan merupakan tindak pidana, melakukan tindakan lain yang secara hukum dapat dibenarkan. Selain itu, dalam rangka pelaksanaan fungsi kepolisian Kota untuk kasus yang terjadi di Kota Palembang, Penyidik Pegawai Negeri Sipil juga memiliki kewenangan untuk melakukan tindakan preventif melalui penyuluhan, bimbingan, pelatihan, pengawasan dan bantuan pembinaan, baik perorangan maupun kelompok orang diyakini sebagai sumber munculnya pengemis galandangan dan Pelacur. Dalam menjalankan tugasnya tersebut, Penyidik Pegawai Negeri Sipil menghadapi sejumlah kendala, seperti faktor undang-undang, dimana kewenangan yang dimiliki oleh Polisi Pamong Praja dalam konteks penegakan hukum terbatas pada non-yudisial, seperti hanya terbatas pada pelaksanaan dan penegakan peraturan daerah. Selain itu, faktor yang paling berpengaruh dalam menegakkan hukum adalah faktor penegak hukum khususnya menyangkut kemampuan dan profesioanlitasnya. <br /><br /><br /><em>This study aims to analyze the Civil Servant authority in investigating the immoral cases and their barriers. This study takes a case in the city of Palembang. The data used is Primary data were collected through interviews with the Civil Service Police Unit. The results of this study indicate that the Civil Investigators have some authority, namely: to receive reports or complaints from individuals regarding the crime, taking finger prints and shoot someone, Calling people to be heard and questioned as a suspect or witness, bringing experts in conjunction with the examination of this case, termination of the investigation after receiving instructions from the investigator that there is sufficient evidence and is not a criminal offense, other actions that may be legally justified. Moreover, in the framework of the implementation of the City police function for the case in Palembang, Civil Servant Investigators also have the authority to take preventive measures through counseling, guidance, training, supervision and coaching support, both individuals and groups of people believed to be the source of the emergence of a beggar galandangan and Prostitutes. In carrying out these duties, Civil Servant Investigators face a number of obstacles, such as legislation factor, where the authority of the Municipal Police in the context of law enforcement is limited to non-judicial, as only limited to the implementation and enforcement of local regulations. In addition, the most influential factor in enforcing the law is a factor, especially regarding the ability of law enforcement and profesioanlitasnya.</em>
