ADJUSTMENT OF THE CONCEPTED APPARATUS IN THE FIELD OF GENE ENGINEERING FOR THE FORMATION OF PRODUCT-ORIENTED LEGISLATION

The issues of legal regulation of GMOs in Russia are reviewed. It is shown that for transformation to innovative development, it is necessary to correct the conceptual framework and develop product-oriented legislation.

A relevance of development new meanings on the trajectory of sustainable development of economy of the Russian Federation has been justified. It has been offered to introduce into circulation a concept from area of the eco-oriented innovative development (further - EOID) of a look “a system -a model - a strategy - an algorithm”. Components of the offered concept have been presented. Verbalization of the specified concept has been considered. Semantic elements of a conceptual framework of the considered concept have been adduced. An application of developed concept on the example of investigation of status and level of implementation of the eco-oriented innovative development (EOID) of one region of the country has been demonstrated. Communication of concepts of this subject area and innovative policy of regions of the country has been shown.

Ecological safety is not a new area of scientific research, however, there is still no single definition of the concept, and no signs and measures to ensure ecological safety are studied. The paper attempts to consider special aspects of the conceptual framework of environmental and technogenic safety enshrined both in domestic and foreign legislation. The author examines the environmental legislation norms, both Russian and foreign enshrining legal security values in this area, as well as the practice of the Constitutional Court of the Russian Federation; analyzes various views on the concept of ecological safety. The research sets a goal to identify differences in the content of categories under the study, which is a prerequisite for the efficient activity of an executor of law in the sphere of provision of corresponding types of safety. The author attempts to develop a unified approach to the understanding of ecological and technogenic safety firstly as scientific categories, which in the future can become the basis for consistent implementation of national security policy in the framework of the legal protection of the environment to balance private and public interests. The novelty of the study is in the conclusions about the scope and content of the concepts of environmental and technogenic safety. As a result of the study, the author formulates the differences in the wording of such categories as ecological safety and technogenic safety, attributes of ecological and technogenic safety, and gives their definitions.

The conceptual and terminological analysis of the model and national legal system on counteraction of extremist activity of the states — participants of the CIS is given. The following problems of this sphere of the legislation are revealed: lack of a full­-fledged legal basis of counteraction to extremism; mismatch of a conceptual framework; existence of a large number of estimated concepts; pretentiousness of legal regulation.

The article is devoted to the analysis of the legal protection of subsoil. Based on the analysis of legislation, the author distinguishes the theoretical features of the concepts of "subsoil" and "legal protection of subsoil," an attempt was made to formulate an author's definition of these concepts. The author concludes that it is necessary to recognize the subsoil as an object of environmental and legal protection, taking into account their properties not only as a repository of minerals, energy and other resources, but also as a complex and basic component of the natural environment. The author believes that from the point of view of the interests of subsoil protection, it is advisable to distinguish between the requirements for ensuring the rational use of subsoil and the requirements aimed directly at the protection of subsoil, with the separation of the latter into a separate article of the Subsoil Code of the Republic of Belarus "Subsoil Protection," which will contribute to the development of the environmental focus of legal regulation in this area.

In the research were considered the factors of innovative development of the enterprise and the assessment of their impact on innovation activity on the example of the enterprises in a port industry. The key problems of the crisis state of scientific and technical sphere in Ukraine are revealed, among which are the state of legal regulation of scientific-technological and innovative activity, reduction of state allocations for science and search for alternative sources of financing in this sphere, almost complete lack of demand for research results during the economic crisis, a sharp decline in investment activity in the country, the lack of state science and technology policy. Researched factors influencing the innovation activity at the enterprise level and the peculiarities of their formation for the enterprises of the port industry, including: the strategic importance of the port industry in the national economy; the presence of high capital intensity of innovation and significant risks associated with the long- term implementation process; the existence of a close relationship and the need to for harmonize the innovative activities of the port enterprises with the work of the shipping companies, shipyards, freight forwarding companies, design organizations of various forms of ownership. The main problems that limit the effective functioning of port enterprises and their innovative development in terms of economic, political, legal, organizational and social nature are described. It is proposed to consider the formation of the indicators of innovation activity of the port industry enterprises in the context of a systematic approach to the areas of analysis in terms of indicators of influencing factors with a division into general and individual. The use of the above areas of analysis and a system of the interrelated indicators allows for systematic analysis to achieve optimal efficiency of innovation products, is the basis for creating information and analytical support for forecasting and identifying patterns and trends.

Currently, the need to reform the system of statutory (normative) and legal regulation of genetic engineering is pending. It is fundamentally important to elaborate a federal law that will facilitate the development, introduction and use of genetically modified products, rather than create obstacles to them, for the purpose of economic development of the Russian Federation. One of the directions of improvement of the legislation in the field of genetic engineering and its further effective regulation includes consolidation of basic principles and their implementation as guidelines for the bodies implementing their authority in the area under consideration. The paper highlights the basic principles of regulation in the field of gene-engineering, determines their content and provides examples of implementation in a specified field. Thus, the principles of separation of powers, federalism, legitimacy, respect for human and citizen rights, transparency and responsibility have been determined as the fundamental principles of state regulation. However, these principles were not consolidated in the Federal Law of July 5, 1996 No. 86-FZ “On State Regulation in the Field of Gene-Engineering Activities". In this regard, it is proposed to improve the regulatory and legal framework and to include a number of principles as guiding ideas in the Federal Law.

Innovative development is a prerequisite for the long-term sustainable functioning of agro-industrial enterprises. Activation of the innovation process, considered as a prerequisite for economic growth, is constrained by the lack of formalized decision-making apparatus and the assessment of its consequences. In order to manage the innovative development of agroindustrial enterprises in contemporary conditions, it is necessary to study the theoretical and methodological foundations of modeling and forecasting of their innovation activity, which has become a characteristic tendency of the economic situation in agriculture in recent years. The complexity of agricultural production and its specificity determine the peculiarity of approaches and methods of managing innovation activity, combining different types of innovations, strengthening the role of the state in their promotion. The agrarian sector of the economy is practically completely dependent on foreign manufacturers of technology, which, of course, also reduces the level of food security of our country. The existing innovative potential in agriculture in Ukraine is not used in full. The meaning of state innovation policy is that, while maintaining the accumulated scientific and technical potential to the maximum extent, and develop mechanisms that stimulate not only the development of innovative processes, but also the development of their results. The main directions of innovation policy in agriculture include: provision of legal regulation of innovation development and protection of the interests of its participants; implementation of direct and indirect support of agricultural producers in the creation and development of innovations; definition and implementation of the priority development of agrarian industrial complex; development of effective forms of partnership and cooperation, formation of appropriate organizational and economic structures; training of personnel in the field of innovation activity; priority development of material and technical base; development of international cooperation in the field of innovations. The state, based on the recommendations of science, should be called in a timely manner to send agribusiness clear and clear signals about the most promising areas of production activity, to orientate and direct its business activity in the necessary direction for society, to indicate ways to overcome the lag of our agriculture from the level of highly developed countries of the world.
