In the digital era the co-creation of content by several authors has become easier in a number of ways. Networks, the symbol of today's information society, are reshaping and supporting our communication, education, creativity and professional development. Embracing the prospective of co-creators, this paper aims to provide a new insight into the on-going debate on the effectiveness of copyright rules in the European Union (EU). The focus lies on the scientific sector, which offers both empirical evidence of the co-production phenomenon and specific policy goals set by the EU legislator with regard to collaborative knowledge production. The analysis shows how the EU copyright framework neither includes a comprehensive body of harmonized rules on co-authorship nor displays prospective plans to do so, while the related national regulations present highly diverging approaches. The paper highlights how the impact of this regulatory inhomogeneity is increasingly at odds with the policy objective of a collaborative and high-profile European Research Area, thus calling for a more substantial harmonization under an inclusive definition of co-author and an enhanced valorization of joint endeavours in the networked system of production of knowledge.

This book explores the impact of the judgments of the Court of Justice of the European Union (CJEU) outside the borders of the EU on the legal systems of countries in the European neighbourhood. Considering that ‘export’ of some of the acquis communautaire to neighbouring countries appears to be an EU policy objective, and that legal approximation provisions are included in all of the EU’s agreements with these countries, one must ask whether this objective applies also to EU case law, or only to written laws and regulations. If actual harmonization of rules and standards is desired, the rules must be interpreted and implemented similarly to how this is done in the EU. And where CJEU judgments are cited and followed in neighbouring countries, what are the factors bringing about such influence? Is it a result of these international obligations of legal approximation, or are other, more unilateral and spontaneous modes of influence of CJEU judgments at work, such as territorial extension or the ‘Brussels Effect’? We have brought together scholars from the countries involved who have each explored, documented, and analysed the extent of citing of CJEU judgments in their respective country and assessed what influence such judgments have had on their legal systems. The contributions cover the legal systems of Armenia, Azerbaijan, Georgia, Israel, Jordan, Russia, Switzerland, Tunisia, Turkey, and Ukraine, and also the Eurasian Economic Union. There are also chapters on the modes of external influence of the CJEU, and on how the CJEU uses external sources.

Abstract This article considers the impact of the recent judgment of the Court of Justice of the European Union in Case C-673/16 Coman and Others in which same-sex marriages where found to fall under the definition of ‘spouse’ in the Citizenship Directive. In light of recent societal and case law developments in Europe it is possible that Coman may come to be an important foundational case which will form part of the groundwork for the CJEU to advance the rights of unmarried couples in the EU migration context. This article examines the current position of unmarried couples (including registered or civil partners) under EU migration legislation as well as recent developments under the European Convention of Human Rights to argue that there are clear indications that EU migration laws need to be adapted to better suit a wider range of relationships than marriage.

One of the ways of implementing the concept of sustainable development by the European Union is their energy policy. Among the three main objectives in its energy policy is a reduction in greenhouse gases (mainly CO2) emissions to at least 20% below 1990 levels by 2020. This study aims to assess the impact of international trade on actual CO2 emission in the EU, China and the USA for the period 1997–2017. For this aim, the Actual-Open CO2 emissions were calculated, taking into account the transfer of CO2 in exported products and services from China and the USA to the EU and vice versa. It is concluded that the actual CO2 emissions in China, the USA, and the EU differed from the traditionally calculated emissions. This has serious consequences for policy, as the factual level of implementation of the EU energy policy goals may be different from what is assumed. Without including the goals of energy policy into trade policy, the effectiveness of measures may be limited. This also has implications for the effectiveness of environmental management systems. When improvements rely on increasing trade with large CO2 emitting countries, the final effect may be opposed to the assumed effect.

The article deals with economic sanctions and their impact on the state and prospects of the neighboring partner economies - the European Union (EU) and Russia. It provides comparisons of current data with that of the year 2013 (before sanctions) to demonstrate the impact of sanctions on both sides. Despite the fact that Russia remains the EU’s key partner, it came out of the first three partners of the EU. The current economic recession is caused by different reasons, not only by sanctions. Both the EU and Russia have internal problems, which the sanctions confrontation only exacerbates. The article emphasizes the need for a speedy restoration of cooperation.

In the discussion on the future of the EU, the topic of differentiated integration has become a strategic issue, with different variants beginning to appear as modus operandi of the European Union, which has become a subject of controversy among Member States. Significantly, the debate on differentiated integration began to be accompanied by reflections on disintegration. This article attempts to define disintegration on the assumption that it should be defined through the prism of integration, and that such a defining process can not be limited to concluding a one-way contrast between disintegration versus integration and vice versa. This is due to the assumption that the European Union is a dichotomous construct in which integration and disintegration mutually exclude and complement each other. This dichotomy is most evident in the definition of integration and disintegration through the prism of Europeanisation top-down and bottom-up processes that generate, reveal, visualize, stimulate integration mechanisms what allows to diagnose their determinants.

The article describes and sets the definition of different farm models under the categories of being family, small, and large-scale commercial farms. The distinction was based on the structure of the workforce and the relationship between agricultural income and the minimum wage. Family farms were dominated by the farming family providing the labour and their income per capita exceeded the net minimum wage in the country. The larger commercial farms feature a predominance of hired labour. Based on surveys, it was found that in 2016 in the EU-28 there were 10,467,000 farms (EU-13—57.3%, EU-15—42.7%). They carried out agricultural activities on an area of 173,338,000 ha (EU-13—28.5%, EU-15—71.5%). Countries of the EU-28 generated a standard output (SO) amounting to EUR 364,118,827,100 (EU-13—17.2% and EU-15—82.8%). After the delimitation, it was shown that small farming (70.8%) was the predominant form of management in the European Union (EU-13—88.2% and EU-15—79.8%) compared to family farming (18.4%) (EU-13—10.5% and EU-15—29%). In most EU countries the largest share of land resources pertains to small farms (35.6%) and family farms (38.6%) (UAA—utilised agricultural area of farms).

Aluminium is a metal of high economic importance for the European Union (EU), presenting unique properties (e.g., light weight and high corrosion resistance) and with applications in important sectors (e.g., transportation, construction and packaging). It is also known for its high recyclability potential, but relevant losses occur in its life cycle, compromising the amount of aluminium available for secondary production. A novel methodology that allows the identification of these losses and their impact on the aluminium flows in society is the MaTrace model. The objective of this article is to perform a dMFA of the secondary production of aluminium in the EU technosphere using the modified version of MaTrace, in order to estimate flows of the metal embedded in 12 product categories. Twelve scenarios were built in order to assess the impact of changes in policies, demand and technology. The flows were forecasted for a period of 25 years, starting in 2018. The results of the baseline scenario show that after 25 years, 24% of the initial material remains in use, 4% is hoarded by users, 10% has been exported and 61% has been physically lost. The main contributor to the losses is the non-selective collection of end-of-life products. The results of the different scenarios show that by increasing the collection-to-recycling rates of the 12 product categories, the aluminium that stays in use increase up to 32.8%, reaffirming that one way to keep the material in use is to improve the collection-to-recycling schemes in the EU.

This perspective discusses the impact of political economy on the regulation of modern biotechnology. Modern biotechnology has contributed to sustainable development, but its potential has been underexplored and underutilized. We highlight the importance of the impacts of regulations for investments in modern biotechnology and argue that improvements are possible via international harmonization of approval processes. This development is urgently needed for improving sustainable development. Policy makers in the European Union (EU) in particular are challenged to rethink their approach to regulating modern biotechnology as their decisions have far ranging consequences beyond the boundaries of the EU and they have the power to influence international policies.

Spain and Portugal are highly dependent on energy from abroad, importing more than 70% of all the energy they consume. This high energy dependence could involve important effects on the level and stability of their electricity prices as a half the gross electricity generated in both countries came from power stations using imported combustible fuels (such as natural gas, coal and oil). In general, changes in the prices of these fossil fuels can directly affect household electricity prices, since generation costs are likely to be transmitted through to the wholesale electricity market. Moreover, in the framework of the European Union Emission Trading System, electricity production technologies tend to incorporate their costs of carbon dioxide emission allowances in sale offers with the consequent increase of the electricity prices. The objective of this paper is to analyze the influence of fossil fuel costs and prices of carbon dioxide emission allowances in the EU on the Spanish and Portuguese electricity prices. With this aim, a maximum entropy econometric approach is used. The obtained results indicate that not only the price of imported gas are very important in explaining Spanish and Portuguese electricity prices but also the price of carbon dioxide emission allowances in the EU.

Research background: Economic crisis hit all the European Union Member States hard, with the impact of crisis varying considerably. The low growth performance in the EU has increased concerns regarding an increasing wage dispersion, income inequality at large, and social exclusion in line with poverty. Inequality should be seen as a cornerstone of both sustainable and inclusive growth under the Europe 2020 Strategy. Social inequality in the EU is a real problem, which hampers sustainable economic growth. Purpose of the article: The purpose of this study is to introduce evaluation of social development convergence and divergence trends between the EU Member States in the context of the Europe 2020 Strategy. The study gives an outline of the issues of the labour market and income disparities and poverty. Policymakers must be clear about what social objectives they are aiming to achieve, therefore special attention is paid to headline national goals of the Europe 2020 Strategy. Methods: The main task of this study is to assess social dimension and inequalities problems in the EU27 by applying Data Envelopment Analysis method, resp. time-series dynamic efficiency analysis in the form of output-oriented Malmquist Productivity Index. This study contains changes of key social equality indicators related to the Europe 2020 Strategy and compares objectives and general outlines of period 2010-2015, as well as the impact on national economics and living conditions. Findings & value added: Results contain elements of typology premises of the EU28 and point to a large diversity in inequality patterns, as the Author observes both increases and decreases in inequality at the EU level. Recent changes in social inequality have been associated with the business cycle, particularly with the accessibility of the labour market and, of course, with income inequality. Additionally, the development challenges are discussed for improvement of the socioeconomic well-being of the EU and to avoid social disparities.
