In between a state of epidemic and a state of natural disaster – COVID-19 and certain human rights The article examines the means of restricting selected human rights and freedoms during a state of epidemic against the requirements of the Constitution of the Republic of Poland. The analysis particularly concerns the practice of restricting these rights and freedoms through ordinances as well as the imposition of fines and penalties for violations of epidemic orders and bans.

AbstractWith the stipulation of Corona Virus Disease 2019 (Covid-19) as a national disaster through Presidential Decree (Keppres) of the Republic of Indonesia Number 12 of 2020 concerning the Determination of Non-Natural Disaster for the Spread of Corona Virus Disease 2019 (Covid-19) as a National Disaster, Minister of Law and Rights Human Rights conducts one of the efforts to prevent the transmission of covid-19 in prisons, detention centers and special guidance institutions for children by ratifying policies related to assimilation and integration for prisoners and children, this policy is then added to a system of guidance and guidance as well as supervision by the Correctional Center through Supervisors Community services carried out online with the aim that the prisoner does not commit a criminal act again, but this provision is not accompanied by stricter sanctions against inmates who commit repeated crimes, this is evidenced by the increase in criminality which then causes asked in the community regarding the effectiveness of the programKeywords: Assimilation and Integration; Covid-19; Repetition of Criminal Acts.AbstrakDengan ditetapkannya Corona Virus Disease 2019 (Covid-19) sebagai bencana nasional melalui Keputusan Presiden (Keppres) Republik Indonesia Nomor 12 Tahun 2020 tentang Penetapan Bencana Non-Alam Penyebaran Corona Virus Disease 2019 (Covid-19) Menteri Hukum dan Hak Asasi Manusia melakukan salah satu upaya pencegahan penularan covid-19 di lembaga pemasyarakatan, rumah tahanan dan lembaga pembinaan khusus anak dengan mengesahkan kebijakan terkait asimilasi dan integrasi bagi narapidana dan anak, kebijakan tersebut kemudian ditambah dengan sistem pembinaan dan pembimbingan serta pengawasan oleh Balai Pemasyarakatan melalui Pembimbing Kemasyarakatan yang dilakukan secara daring dengan tujuan agar narapidana tidak melakukan perbuatan tindak pidana lagi ,namun ketentuan tersebut tidak dibarengi dengan sanksi yang lebih tegas terhadap narapidana yang melakukan pengulangan tindak pidana, hal tersebut dibuktikan dengan meningkatnya kriminalitas yang kemudian menimbulkan tanya di masyarakat terkait keefektifan program tersebut. On 2 August 2002 South Africa signed the Southern African Development Community (SADC) Protocol on Tribunal and the Rules of Procedure Thereof, thus effectively recognising and accepting the jurisdiction of the SADC Tribunal. Among the cases received by the SADC Tribunal was a complaint involving allegations of human rights violations by the government of Zimbabwe. It ruled that the government of Zimbabwe had violated human rights. Consequently, Zimbabwe mounted a politico-legal challenge against the existence of the Tribunal. This resulted in the review of the role and functions of the Tribunal in 2011 which resulted in the Tribunal being barred from receiving new cases or proceeding with the cases that were already before it. Furthermore, on 18 August 2014, the SADC Summit adopted and signed the 2014 Protocol on the Tribunal in the SADC which disturbingly limits personal jurisdiction by denying individual access to the envisaged Tribunal, thus reducing it to an inter-state judicial forum. This article critically looks at the decision of 18 August 2014, specifically the legal implications of the Republic of South Africa’s signing of the 2014 Protocol outside the permissible procedure contained in article 37 of the SADC Protocol on the Tribunal. It proposes that South Africa should correct this democratic deficit by introducing public participation in treaty-making processes in order to prevent a future situation where the executive unilaterally withdraws from an international treaty that is meant to protect human rights at a regional level. To achieve this, this article makes a comparative study between South Africa and the Kingdom of Thailand to learn of any best practices from the latter.

He gives characteristics of the foreign policy under different presidents of South Africa from 1994 to 2018 and analyzes the political activities of South Africa in the area of peacekeeping and human rights on the African continent.

The relevance of the study is determined by the fact that in order to improve the legislation of the country, it is necessary to study the successful experience of other countries. The purpose of the study is to propose a number of measures that will help improve labour legislation in Kazakhstan. The work uses primarily the analytical method. It is determined by the fact that apart from statutory labour protection rules, some safety standards are contained in collective agreements that speci-fy and sometimes supplement relevant legislative provisions. The paper states the fact that it is necessary to factor in world experience in organizing and operating a system of supervision and control over compliance with labour legislation for the Republic of Kazakhstan. The novelty of the study is that with a study of the legislation on labour regulation in Western countries, the authors identify a number of measures that will be relevant for implementation in the Republic of Kazakhstan. The practical significance of the study is determined by the incompatibility of iso-lation from the outside world, including from the international labour market with objectives of development.

By the early eighteenth century, the economic primacy, cultural efflorescence, and geopolitical power of the Dutch Republic appeared to be waning. The end of this Golden Age was also an era of natural disasters. Between the late seventeenth and the mid-eighteenth century, Dutch communities weathered numerous calamities, including river and coastal floods, cattle plagues, and an outbreak of strange mollusks that threatened the literal foundations of the Republic. Adam Sundberg demonstrates that these disasters emerged out of longstanding changes in environment and society. They were also fundamental to the Dutch experience and understanding of eighteenth-century decline. Disasters provoked widespread suffering, but they also opened opportunities to retool management strategies, expand the scale of response, and to reconsider the ultimate meaning of catastrophe. This book reveals a dynamic and often resilient picture of a society coping with calamity at odds with historical assessments of eighteenth-century stagnation.

Since introduced with Universal Declaration at 1948 by United Nations Organization, human rights  has becoming a main instrument in international law and national laws. In Indonesia, regulations  concerning human rights has been legalized by Act Number 39 Year 1999. Study is needed to  explosure the extend of the rules of human rights that has determined in Indonesia Laws. This  journal analyze Indonesia Nationality Law based on universal instrument of human rights by  descriptive analysis research. Its found that Act Number 12 Year 2006 concerning Nationality of the  Republic of Indonesia has accommodate universal instrument of human rights.

In accordance with the Decree of the Minister of Justice and Human Rights Number M-05 HT.01.01 of 2002 concerning the Enforcement of the Legal Entity Administration System at the Directorate General of General Legal Administration of the Ministry of Justice and Human Rights of the Republic of Indonesia, determines that all legal entity settlements include the ratification of the deed of establishment PT, application for approval and submission of deed reports, amendments to articles of association, fiduciary registration, will registration, are carried out with the online Legal Entity Administration System. So the notary has the authority to register all these legal acts online. The purpose of this research is to find out the role of the Notary in registering deeds and legalization of legal entities through the Directorate General of AHU Online services and to find out the responsibilities of the Notary if there are problems in registering deeds and legal entity approval through the services of the Directorate General of AHU Online. This study uses a normative juridical research method using a statutory approach and a conceptual approach. The results of the research, namely, the role of the notary in registering deeds and ratifying legal entities is entering deed data, checking all deed data to avoid data entry errors and the notary has the responsibility if there is an error from the notary's office, the notary will make corrections at a cost of Notary, however in this regard there is still cooperation from the applicant regarding the required data.

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

This paper discusses the normative framework of regulating the right to protection of personal data relating to biomedical treatment procedures of patients as human rights. The subjects of analysis are the European Convention, the Convention on Human Rights and Biomedicine and the relevant provisions of the Constitution of the Republic of Serbia. The right to protection of personal data in the field of biomedicine is analyzed comparatively in terms of the content of this right and in terms of basis for limiting this right. The analysis is carried out to find answers to the question if the constitutional framework is consistent in terms of exercising this right, taking into account the constitutional provision on the direct application of human rights guaranteed by international treaties and other provisions that determine the status of international sources of law in our legal system.
