The article considers educational migration as part of the general intellectual. The main trends associated with the movement of large masses of the population are identified. The main problems of the legal regulation of educational migration in modern Kazakhstani conditions are investigated. The current legislation in the field of education and science, which is the key to regulating legal relations, is analyzed. The norms of the formation of the state educational order as the main way of financing higher and postgraduate education are studied.

The textbook reveals the role of control in ensuring the effective operation of a commercial organization, and sets its purpose and objectives. The emphasis has been placed on the fact that the state has the main responsibility for the formation of state policy in the field of education and the development of effective mechanism for its implementation. The author has emphasized that without the development of effective mechanism for the implementation of the educational function of the state it will be impossible to ensure the proper functioning of all spheres of public life: political, economic, cultural, environmental, informational, law enforcement, etc. In this regard, it has been focused on the importance of clarifying the content of the educational function of the state, developing effective mechanisms for its implementation. The education has been offered to be understood as a complex process regulated by the norms of national legislation, to ensure its quality we create relevant entities, entitled to provide educational services, which allows recipients of such services to realize personal potential based on their abilities, interests, needs, motivation, capabilities and experience. It has been established that the understanding of education as the result or process is the feature of the expediency of legal interpretation of this term, since procedural issues related to the organization of the educational process, education, establishment and operation of educational institutions, education management, etc. are regulated by law, primarily by administrative law. As a result of revealing the essence of the categories “function of the state” and “education” the author has formulated own definition of the concept of “educational function of the state” as the direction conditioned by the social purpose of the state, during which the state (in the form of state and non-state subjects of educational activity) creates proper conditions to meet the needs of citizens for their intellectual, spiritual, physical and cultural development, to provide them with equal access to educational services, which, as a consequence, may lead to the achievement of the planned learning outcomes. The conclusion about the two-component purpose of the educational function of the state has been made. It has been substantiated that the implementation of the educational function of the state is mainly carried out with the help of administrative and legal tools. The characteristic features inherent in the educational function of the state as an object of administrative and legal regulation have been outlined. The author has distinguished the main prerequisites for ensuring the proper implementation of the educational function of the state: a) the existence of a coherent system of regulatory acts, the provisions of which determine the priority areas of the state educational policy and take into account European educational standards, while developing an effective mechanism for implementing regulations; b) clearly defined range of subjects of management in the field of education with the consolidation of their administrative and legal status at the legislative level; c) the system of financial and logistical support of procedures for the provision and consumption of educational services must be scientifically sound and take into account modern innovative tendencies in the education sphere; d) development of an effective mechanism for motivating the employees in the field of education to use innovative technologies.

The article analyzes the measures of the state-confessional policy of the Russian Empire in relation to the education of children of Old Believers in the 19th — early 20th centuries and their implementation in the Perm province. It is concluded that the religious policy of the state in relation to the education of the children of Old Believers was inconsistent and underwent all the fluctuations of the government course: from discriminatory measures in the second quarter of the 19th century until the softening of the policy of the authorities in the second half of the century. The conclusion is made about the ineffectiveness of prohibitive measures of the state in relation to teachers and schools of Old Believers, about a certain discrepancy in legislation and its application in the Perm province. The article provides data on the number of Old Believers’ students in various schools of the Perm province at the beginning of the 20th century, which indicates that only a small number of Old Believers preferred education in state educational institutions to traditional home education.

The article considers the geographical dimension and the main problems of educational migration in Ukraine. The main problems of mass departure of Ukrainian citizens abroad are identified, since they are the most concerning. The analysis of manifestations of educational migration is carried out. It was found that in addition to the decrease in quality of education and the difficult socio-economic situation in the country, the strengthening of external educational migration is caused by the systemic policy of the countries of Europe, Russia and the United States to attract Ukrainians to study under various programs (scholarship, bachelor’s, master’s, doctoral, postdoctoral). The legal regulation of academic mobility in Ukraine as an institutional form of educational migration is studied, the dynamics of the migration movement of Ukrainian youth of the current population of the country is determined. The main trends of educational migration from Ukraine are analyzed, the list of the world countries that are the most popular among Ukrainian students is defined. Current trends and dynamics in changes in migration priorities of the youth Ukrainian population are considered. The popularity of the western vector of the migration movement among intellectual migrants is emphasized. The statistical analysis of regularities of migration processes in Ukraine and around the world is carried out. The main tendencies, factors and relevant institutions that determine directions and intensity of educational migration are identified. Recommendations for the State policy of Ukraine in this direction are offered. The causes and positive/negative consequences of educational migration for Ukrainian society in the future are summarized. The main components of the institutional environment as a technological basis for the management of educational processes migration in European countries are defined. The directions of the State regulation of educational migration in Ukraine in the interests of preservation and development of intellectual capital and ensuring competitive positions in the international market of educational services are formulated.

The article is devoted to covering the issues of legal regulation of employment relations of persons receiving postgraduate education. The analysis of the educational and labor legislation on the state of regulation of the exercise of the right to work by the lifelong learners is made. The positions of scientists on defining the concept of education are given, the forms of postgraduate education are indicated. The use of the term "postgraduate education" has not been proven correct, instead it is suggested to use the concept of lifelong education or adult education instead. It is concluded that in modern Ukrainian conditions, both employers and employees, as well as the state and society as a whole, show interest in the effective development of education throughout life, which is a reflection of the global tendency to increase the importance of education as an important factor of socio-economic development. Emphasis is placed on the importance of labor relations in the aspect of the development of lifelong learning. It is argued that lifelong learning should be understood as an important socio-pedagogical phenomenon that, if developed and approved in the state, can overcome such a phenomenon as unemployment. It is stated that the system of national institutes of formal education is a fundamental source of lifelong learning. Approaches of foreign countries to become a lifelong education institute are analyzed. It is proposed to review the approach currently available in the current labor law and in the draft Labor Code to cover education and labor relations. It is noted that educational- labor relations contain a much larger range of legal regulation issues than just “benefits for workers who combine work with training”. It is noted that lifelong learning becomes the link between the dynamic development of information technology, the emergence of new social relations, the emergence of new forms of employment. It focuses on the need to create a sound synthesis of educational and labor relations in order to ensure a decent standard of living for the population in today's market economy.

The article discusses the features of procurement in the framework of the state defense order by conducting trade procedures. The analysis shows that the regulatory framework for state defense orders includes both general acts for the entire public procurement system and special acts regulating relations specifically in the field of defense orders. The features of legal regulation in this sphere are determined, first of all, by the defense order specifics, but, primarily, this sphere as a whole is subject to the rules of legal regulation common to the sphere of public procurement.

This paper analyses the ways transfer of the discourse on interculturality and intercultural education, as it has been coined and shaped by European anthropologists and pedagogues, towards educational actors and institutions in Latin America. My ethnographic data illustrate how this intercultural discourse is currently transferred through intellectual networks to different kinds of Mexican actors who are actively “translating” this discourse into the post-indigenismo situation of “indigenous education” and ethnic claims making in Mexico. On the basis of fieldwork conducted in two different institutions in the state of Veracruz, the appropriation and re-interpretation of, as well as the resistance against, the European discourse of interculturality are studied by comparing the training of “intercultural and bilingual” teachers through the state educational authorities and the notion of intercultural education, as applied within the so-called “Intercultural University of Veracruz”.

In article the legislative base, which is the foundation of functioning of the state system of medical-social examination, is considered and analyzed. The questions of legal regulation of the state activity in the sphere of social policy concerning disabled people are discussed. The methods of sociological research and logical analysis of literature and official normatively-legal papers, being the basis of activity of the system of medico-social examination and sphere of giving to the invalids the equal with other citizens possibilities in realization of constitutional rights and freedoms, public welfare and establishment, are applied to the invalids as the measures of government support. In conclusions the emphasis is placed on need of carrying out radical restructurings for system of medico-social examination. It is offered to modify the existing classification of indexes of health and indexes, related to the health taking into account the socio-economic, climatic and other features; to strength the control of execution of government programs in the medico-social sphere; to modify the traditional classification of groups of disability; to change a way of features accounting of disabled people with various functional violations proceeding from a complex assessment of dysfunction of the neuro-physiological and psycho-physiological statuses; to use the innovative technologies of diagnostics, treatment, rehabilitation in correction of the functional violations with taking in mind not only the nosologic group of disease, but by an individual approach.
