The long history of Islamic scholarship on caliphate, shari’ah-oriented policy (siyasah shar'iyyah) and system of government (nizam al-hukm) has yielded a rich legacy which is, nevertheless, beset with uncertainties in conjunction with modern developments on government and constitutional law. Uncertainties have persisted over the basic concept and definition of an Islamic polity and the existence or otherwise of a valid precedent and model for an Islamic state. This is partially caused by a tendency in modern writings to apply the nation-state ideas of eighteenth-century Europe to the events of early Islam some twelve centuries earlier and doubtful parallels that have been attempted to be drawn between them. This article attempts first to identify the causes of the problem and then proceeds with an overview of the evidence in the Qur’an and Sunnah and contributions of a cross-section of schools and scholars on the subject. This is followed by a general characterisation of an Islamic system of rule under five sub-headings, the first of which describing Islamic government whether Islamic state, and Iran in particular, is a theocracy, whether Islam stands for a qualified democracy, and whether it also upholds separation of powers. The last section discusses freedom of religion and religious pluralism in an Islamic polity followed by a conclusion and recommendations.

The article deals with the love of Zygmunt Krasiński to Delfina Potocka. The point of departure is the poet's definition of love as looking and reads Krasiński's relationship with his beloved in the context of two phenomena that fascinated him at the time: daguerreotype and magnetism. The invention of the daguerreotype in which the history of photography and spiritism comes together becomes a pretext for the formulation of a new concept of love and the loving subject. In the era of painting the woman was treated as a passive object of the male gaze; photography reverses this scheme of power. Love ceases to be a static relationship of the subject in love and the passive object – the beloved. The philosophy of developing photographs (and invoking phantoms) allows Krasiński - the writing subject to become like a light-sensitive material that reveals the image of the beloved.

Abstract Today there is a consensus on the definition of the term ‘rococo’: it designates a style both particular and homogeneous, artistically related to the reigns of Louis XV and Louis XVI. But we must not forget that in its primitive formulations, the rococo has no objective existence. As a witty, sneering, and impertinent word, it can adapt itself to the most varied discourses and needs, far beyond references to the eighteenth century. Its malleability guarantees its sparkling success in different languages, but also its highly contradictory uses. By tracing the genealogy of the word ‘rococo’, this article will show that the association of the term with the century of Louis XV is a form of historical discrimination that still prevails widely in the history of the art of the Enlightenment.

AbstractAs dialectical theology rose to prominence in the years following World War I, the new theologians sought to distance themselves from liberalism in a number of ways, an important one being a rejection of Schleiermacher’s methods and conclusions. In reading the history of Weimar-era theology as it has been written in the twentieth century one would be forgiven for assuming that Schleiermacher found no defenders during this time, as liberal theology quietly faded into the twilight. However, a closer examination of this period reveals a different story. The last generation of liberal theologians consistently appealed to Schleiermacher for support and inspiration, perhaps none more so than Georg Wobbermin, whom B. A. Gerrish has called a “captain of the liberal rearguard.” Wobbermin sought to construct a religio-psychological method on the basis of Schleiermacher’s definition of religion and on his “Copernican turn” toward the subject and resolutely defended such a method against the new dialectical theology long after liberal theology’s supposed demise. A consideration of Wobbermin’s appeals to Schleiermacher in his defense of the liberal program reveals a more complex picture of the state of theology in the Weimar period and of Schleiermacher’s legacy in German Protestant thought.

The article is devoted to the history of formation and development of Ukrainian constitutionalism. It is shown that during the times of Kievan Rus and the Galicia-Volyn principality monarchical states with elements of a democratic state and political regime were formed on Ukrainian lands. It is highlighted that the formation of the Ukrainian nation and its path to its own state was carried out under the conditions of aristocratic democracy of the Grand Duchy of Lithuania and the Polish-Lithuanian Commonwealth. It is emphasized that the Ukrainian people in the XV century became part of a large European society, which became the basis for the emergence of constitutional ideas in the Ukrainian ethnic lands, the creation of the Cossacks and the revival of their own Ukrainian state in the former Kievan Rus. It is noted that the results of the development of Ukrainian constitutionalism in the eighteenth century was presented in the Constitution of Hetman P. The work Prodromus Monographiae Cheloniorum, published by Schweigger in 1812, has recently been the subject ofseveral studies. One result of these studies—the rediscovery of the Testudo gigantea Schweigger, 1812holotype—triggered an intense debate in The Bulletin of Zoological Nomenclature, where, among other issues in dispute,the identity and nature of the specimen indicated as the holotype for the species is put in question. Using historical sources,mostly unpublished, and analysis and comparison of taxidermic characteristics of the specimen with other specimens ofthe same nature, we can clearly trace its origin to the extinct Royal Cabinet of Natural History of Ajuda in Lisbon, fromthe “philosophical journey” of Alexandre Rodrigues Ferreira to the specimens transported to Paris by Geoffroy Saint-Hilaire in 1808, thus helping dispel any doubts regarding the identity and nature of what is being identified as the Testudogigantea holotype, along with other chelonian specimens. This information is of great importance in the current taxonomicdebate as well as in recognizing the historic importance of the Royal Cabinet of Natural History of Ajuda and Geoffroy Saint-Hilaire’s 1808 mission to Lisbon.

Replete with a cast of giants in Islamic thought and philosophy, Ahmad S. Dallal’s pathbreaking intellectual history of the eighteenth-century Muslim world challenges stale views of this period as one of decline, stagnation, and the engendering of a widespread fundamentalism. Far from being moribund, Dallal argues, the eighteenth century--prior to systematic European encounters--was one of the most fertile eras in Islamic thought. Across vast Islamic territories, Dallal charts in rich detail not only how intellectuals rethought and reorganized religious knowledge but also the reception and impact of their ideas. From the banks of the Ganges to the shores of the Atlantic, commoners and elites alike embraced the appeals of Muslim thinkers who, while preserving classical styles of learning, advocated for general participation by Muslims in the definition of Islam. Dallal also uncovers the regional origins of most reform projects, showing how ideologies were forged in particular sociopolitical contexts. Reformists’ ventures were in large part successful--up until the beginnings of European colonization of the Muslim world. By the nineteenth century, the encounter with Europe changed Islamic discursive culture in significant ways into one that was largely articulated in reaction to the radical challenges of colonialism.

One of the most exciting and influential areas of research in eighteenth-century history over the last fifteen years has been the study of crime and the criminal law. It is the purpose of this essay to map the subject for the interested nonspecialist: to ask why historians have chosen to study it, to explain how they have come to approach it in particular ways, to describe something of what they have found, to evaluate those findings, and to suggest fruitful directions for further research. Like all maps, the one presented here is selective. The essay begins with a general analysis of the ways in which the field has developed and changed in its short life. It then proceeds to consider in more detail four areas of study: criminality, the criminal trial, punishment, and criminal legislation. This selection makes no pretense of providing an exhaustive coverage. A number of important areas have been omitted: for example, public order and policing. However, the areas covered illustrate the range of approaches, problems, and possibilities that lie within the field. The essay concludes with a discussion of the broader implications of the subject.The Development of the FieldBefore the 1960s crime was not treated seriously by eighteenth-century historians. Accounts of crime and the criminal law rarely extended beyond a few brief remarks on lawlessness, the Bloody Code, and the state of the prisons, often culled from Fielding, Hogarth, and Howard. There were exceptions, but they fell outside the mainstream of eighteenth-century history. The multiple volumes of Leon Radzinowicz's monumental History of the English Criminal Law and Its Administration from 1750 began to appear in 1948, but Radzinowicz worked in the Cambridge Law Faculty and the Institute of Criminology, and, as Derek Beales has pointed out, his findings were not quickly assimilated by historians.

The title, and subject, of this piece is ‘satisfaction’, though its main locus in time is the sixteenth and seventeenth centuries. I chose the subject because it fitted in with our president’s preoccupations, and because it interested me; it turns out, to my surprise, to jog our elbow about some contemporary matters, as I guess he wished.We had better start with the word, where there are two distinctions to be considered. The obvious one is between making up for, paying for, making amends, making reparation; and contentment, gratified desire, giving satisfaction, what you can’t get none of. I shall say that the first is the strong meaning, the second the weak one. The first is always other-directed, and entails an offence previously committed; the second is principally self-directed. ‘To content’ is a classical meaning of satisfacere, but it means to content someone else: to do something (facere), as against receiving something. A short history of the word in Latin and English records that the strong meaning emerged into late Latin as a description of church penance, and so passed into English in the fourteenth century. Its heyday was from then until the eighteenth. It referred to ecclesiastical penance (interrupted by the Reformation), the theology of the Redemption (encouraged by the Reformation), and in general public usage to the meeting of any kind of obligation, payment, atonement or compensation. From the eighteenth century it passed from public use, superseded by the weak meaning except in technical or professional fields. One professional usage, to which The Oxford English Dictionary gives a good deal of attention, is ‘to satisfy the examiners’: they think it is a case of ‘content’; may it be a case of ‘avert wrath’?

Religious studies cannot agree on a common definition of its subject matter. To break the impasse, important insights from recent discussions about post-foundational political theory might be of some help. However, they can only be of benefit in conversations about “religion” when the previous debate on the subject matter of religious studies is framed slightly differently. This is done in the first part of the article. It is, then, shown on closer inspection of past discussions on “religion” that a consensus-capable, contemporary, everyday understanding of “religion,” here called Religion 2, is assumed, though it remains unexplained and unreflected upon. The second part of the article shows how Religion 2 can be newly conceptualized through the lens of Ernesto Laclau’s political theory, combined with concepts from Judith Butler and Michel Foucault, and how Religion 2 can be established as the historical subject matter of religious studies. Though concrete historical reconstructions of Religion 2 always remain contested, I argue that this does not prevent it from being generally accepted as the subject matter of religious studies. The third part discusses the previous findings in the light of postcolonial concerns about potential Eurocentrism in the concept of “religion.” It is argued that Religion 2 has to be understood in a fully global perspective, and, as a consequence, more research on the global religious history of the 19th and 20th centuries is urgently needed.

J.H. le Roux had a passion for philosophy. His writings contain recourse to the history of philosophy in a way that bespeaks a deep underlying interest in the subject. This much is relatively well-known. This contribution, by contrast, aims at reconstructing something hitherto mostly covert: Le Roux�s philosophy of religion. Of interest is what his writings presuppose about the nature of religion, religious language, the nature of God, the existence of God, religious epistemology, the relation between religion and morality and the problem of religious pluralism.
