This chapter examines the recent changes to the Vietnamese Civil Code and its impact on contract formation and third party beneficiaries. Since the enactment of the first modern civil code in 1995, major revisions have been made every ten years with the 2015 Code repealing more than 50 per cent of the 2005 Code; representing more than 300 articles of the 2005 Code. Concepts like apparent authority were only recognized in 2005, while the notion of an offer to the world (rather than to specific parties) was only recognized in 2015. The 2015 Code was a product of the move from a planned economy to a socialist-oriented free market economy. The challenge of the Code was to address state interest and regulatory concerns to modify the norms of contractual freedom found in the Code.

Hundreds of books were written in the Arab world during the Bosnia and Kosovo wars, overwhelmed with rhetoric aimed at arousing a sense of Islamic solidarity. However, they have no scientifi c basis and are, therefore, of no scientifi c value. They were either along the lines of the West’s Balkan political campaign or were intended to elicit voluntary donations that were, more often than not, followed by large-scale fi nancial scandals. For this reason, it is also necessary to shed light on the insincerity of some fundamentalist structures in the Arab world that have raised their voice in support of Kosovo Albanian Muslims, irrespective of the fact that their claims are illegitimate. At the same time, these structures turn a blind eye and a deaf ear to the claims of other Muslims, despite the fact that their claims are legitimate. In order to answer these questions, one should realistically and honestly say that NATO was only keen, exclusively and solely, to remove the obstacle to its further conquests, obstacle called Yugoslavia, particularly Serbia. That country was such obstacle to Western world–lords that they attributed to her, through their powerful political and media machinery, every single evil and villainy. West spared no money and means to dismantle and destroy Yugoslavia and particularly Serbia. So we faced such paradox that separatist movements were described as ‘revolutionary’ and ‘liberation armies’. Yet, if these things are natural for America and Europe, what is then natural for fundamentalists in Arab and Islamic world? There is no convincing answer but to describe our fundamentalists loyal to West as unionists loyal to their Vatican. Fundamentalists in Arab and Moslem world use our faith in a very bad manner, abusing it in the interest of politics. They mortify their faith in accordance to the needs of those forces in the world that are interested only for egoistic increase of their own power.

The emergence of the major transnational terrorist movement called Al Qaeda became possible first and foremost because of the Soviet intervention in Afghanistan. A local peasant rebellion against the radical left wing regime in a faraway country was immediately transformed into jihad, a real crusade against the invading “infidels”. What followed was the gradual evolution of an insignificant group of young volunteers from the Arab countries who soon became the nucleus of a powerful global movement challenging the Western world. Bin Laden’s motto was: “After overcoming one superpower we will deal with another one”. The large scale terrorist campaign culminated in the 9/11 terrorist action called “the Manhatten operation” by its perpetrators. Summing up the results of the jihadists’ activities, the author comes to the conclusion that the terrorist network is probably in the initial stage of decline due not only to the leaders’ death but also to its failure to mobilize the world of Islam under its banner.

The aim of this paper is to examine the development of microfinance in Vietnam from the early 1980s. This provides a particularly interesting case study in view of the large-scale changes that have taken place in the economy over the period, which has experienced the transition from a Central Economic Planning System towards a ‘socialist-oriented market economy’, with increased integration in the world economy. Starting from a framework, or taxonomy, of microfinance organisations, the paper explores how the two main objectives of microfinance organisations - of meeting the economic needs of borrowers and being sustainable - have eventually been met using a diversity of organisational forms.

Indigenous Peoples in Canada and around the world have, for years, used blockades and direct action when alternative means of asserting their rights have failed. The Secwépemc First Nation of British Columbia, Canada, has a myth where a character, Sk’elép, encounters strangers who try to “transform” him, but fail. He tells them he could turn them to stone, but he will not. This myth is used as a lens to reflect, from a settler perspective, on the potential for future Indigenous-led blockades, which could reach the point of mass economic shutdowns, in response to a lack of action on both Indigenous rights and climate change. Up until now, the policy of most colonial nations has been to deal with Indigenous blockades by force or at best with localised solutions. This policy will not work regarding climate change. This article proposes that the Western world faces a stark choice: truly embrace “free, prior, and informed consent” (FPIC), or else face the possibility of large scale shutdowns from a growing alliance of Indigenous Peoples, environmentalists, and concerned citizens.

The fall of communism in Eastern Europe in the beginning of the 90-ies of the 20th century marked the beginning of a historical process of triumph of market economy in a wide geographical area and a large population, which had to have an influence on global developments. This age is characterized not only by a comprehensive ruling of capitalist market economy, but also by a series of important structural changes in economies of various countries, national and international mechanisms of market functioning, and relevant institutions thereto. Distinct authors have various opinions on characteristics and positive and negative outcomes of a globalized economy era. Some consider the globalization of world economy as a quantitative and qualitative expansion of market economy throughout the world, similar to the situation before the World War I. Other more serious authors consider the globalization of world economy as a new qualitative era, with important consequences on many areas.

The paper overviews the basic ideas of the book by N. V. Smorodinskaya. It focuses on some definite as well as still not so definite changes in world pubic and economic structures. The main vector of the research is reorganization of today’s pubic and economic structures and establishing a net structure on this basis. The author follows these processes beginning with the first steps of forming a net structure. She examines the logic of changes of rigid hierarchical models of management and coordination of the free market for horizontal and net forms of organization. A new institutional space rests upon developed net interactions. Two main trends are in the focus of the author’s attention. First, collaboration phenomenon on all the levels of economy including so called “triple helix”, i.e., collaboration of the state, science and business. Second, cluster nets, i.e., orga- nization and management of collaboration. The cluster-net approach in industrial policy all over the world and topicality of such approach for modernization of Russian economy are presented in the monograph too.
