Resumo: O presente artigo tem como objetivo analisar a negociação coletiva de trabalho como um direito fundamental. Este artigo parte da analise conceitual do conflitos coletivos de trabalho, seguido pelo estudo da negociação coletiva de trabalho como direito fundamental, com fundamento na Constituição da República Federativa do Brasil de 1988, nas convenções da Organização Internacional do Trabalho ratificadas pelo Brasil sobre a matéria e na legislação nacional sobre o tema, com a recentemente aprovada Lei nº 13.467, de 13 de julho de 2017 que, com a vacatio legis, entrará em vigor 120 dias após a sua publicação. Os novos artigos 611-A e 611-B da Consolidação das Leis do Trabalho propõem força de lei para a negociação coletiva de trabalho, afastando as hipóteses que fazem parte do rol dos direitos fundamentais sociais trabalhistas previstos no artigo 7º da Constituição Federal e que não podem ser objeto de negociação. Abstract: [This article aims to analyze collective bargaining as a fundamental right. This article is based on the conceptual analysis of collective labor conflicts, followed by the study of collective bargaining as a fundamental right, based on the Constitution of the Federative Republic of Brazil of 1988, the International Labor Organization conventions ratified by Brazil on the subject and In the national legislation on the subject, with the recently approved Law no. 13467 of July 13, 2017 which, with the vacatio legis, will come into force 120 days after its publication. The new Articles 611-A and 611-B of the Consolidation of Labor Laws propose a force of law for the collective bargaining of labor, removing the assumptions that form part of the list of fundamental social labor rights provided for in article 7 of the Federal Constitution and which do not Can be traded. O DUMPING SOCIAL E A PROTEÇÃO AOS DIREITOS SOCIAIS DOS TRABALHADORES THE SOCIAL DUMPING AND THE PROTECTION OF WORKER’S SOCIAL RIGHTS RESUMO: O presente artigo versa sobre o dumping social e a proteção aos direitos dos trabalhadores. Inicialmente, faz-se um breve histórico sobre a legislação antidumping, a seguir, aborda-se o conceito jurídico de dumping e de dumping social. Por fim, traz-se a discussão internacional acerca da cláusula social e dos padrões trabalhistas no âmbito da Organização Mundial do Comércio - OMC e da Organização Internacional do Trabalho - OIT. O principal objetivo assenta-se em saber se realmente existe uma preocupação com os direitos dos trabalhadores diante do dumping social, ou se as medidas discutidas não passam de protecionismo disfarçado. Para a materialização da pesquisa, quanto ao método de abordagem utilizar-se-á o método indutivo; quanto ao procedimento, adotar-se-á o método monográfico; e quanto aos procedimentos técnicos, a técnica de pesquisa será a bibliográfica e documental, recorrendo-se a doutrina, a publicações em periódicos, a jurisprudência e a dissertações e teses sobre o tema. PALAVRAS-CHAVE: Direitos Sociais; Dumping Social; Cláusula Social; Padrões Trabalhistas. ABSTRACT: The present article deals with social dumping and the protection of worker’s rights. Initially, it is made a brief review of the anti-dumping legislation, next, it is approached the legal concept of dumping and of social dumping. Finally, it is brought the international discussion on social clause and the World Trade Organization - WTO and International Labor Organization - ILO labor Standards. The main objective is to know if there is really any concern for the worker’s right in face of the social dumping or if the actions taken are nothing more than masked protectionism. For the development of this research, it will be used the inductive method as approach method; the monographic method will be used as procedure; about the technical procedures, the research techniques will be bibliographical and documentary, using doctrine, articles in scientific journals, case law and dissertations and theses on the subject. KEYWORDS: Social Rights. The International Labor Organization (ILO) is not an effective force for raising labor standards in the developing world and could become considerably more effective by taking account of two of the most important and interrelated recent theoretical developments in understanding labor standards. First, countries derive no comparative advantage in the global trading system from most very low labor standards. The ILO should therefore concentrate its energies on lifting these, rather than (as it so often does) concentrating on labor standards that are a source of comparative advantage, the elimination of which is resisted strongly and effectively. Second, the tools of game theory may be used to identify the collective action problems that prevent countries from lifting their own labor standards, and create a role for a transnational agency that may assist them.

This theoretical essay proposes to understand how the contemporary conception of Human Rights is configured, and from that, to articulate the affirmative actions for Indigenous peoples inserted in this conception. In other words, it reflects on how this process took place in Latin America, that is, whether these actions proposed in Latin America for Indigenous peoples adopt a perspective constituted by the “subject of law” being seen in its particularity and peculiarity, and whether there have been advances or setbacks. The results showed that, specifically, from the conceptions presented at the International Labor Organization (OIT) there was a break in the integrationist paradigm, showing a real advance in the expressions of these conceptions and the ways in which indigenous societies are understood, at least in the applied legislation in Latin America. However, there is still much to reflect on and fight for.

It traces the history of the emergence of international labour law and describes the action and innovation of the International Labor Organization (ILO). It suggests that the ILO�s structural machinery and guiding principles served as the global reference point for setting and supervising standards on workers� rights, freedoms, and entitlements.

La Organización Internacional del Trabajo (en adelante OIT) se creó tras la Primera Guerra Mundial con el objetivo de facilitar la definición de estándares mínimos universales de derechos sociolaborales. La OIT desarrolla su función normativa a través de la aprobación de convenios y/o recomendaciones, que los Estados miembros pueden o no ratificar e incorporar o no, en consecuencia, a sus ordenamientos jurídicos internos. Su especificidad radica, por un lado, en su carácter de Organización internacional con vocación de universalidad y, por otro lado, en el tripartismo que caracteriza su funcionamiento, con la participación en sus órganos principales no solo de representantes de los gobiernos de los Estados miembros, sino también de las principales organizaciones sindicales y empresariales de los mismos[1]. Estas características esenciales dotan de legitimidad específica la actividad normativa de la OIT, haciéndola especialmente relevante para el reconocimiento, protección y promoción internacional de los derechos sociolaborales[2].[1] Para Philip Alston, desde el inicio del nuevo siglo asistimos a una progresiva pérdida de protagonismo de las organizaciones sindicales en la regulación de las relaciones laborales, lo que debería poner en cuestión también el tripartismo en la OIT (Alston, P., “Facing Up to the Complexities of the ILO’s Core Labour Standards Agenda”, European Journal of International Law, 2005, Vol. 16, núm. 3, pp. 467-480, p. 475). Con todo, consideramos que esta forma de funcionar que da entrada en la Organización a intereses diferentes a los estrictamente gubernamentales es un logro al que no cabe renunciar a la ligera y, por tanto, es todavía hoy una especificidad relevante a la espera de nuevas evoluciones.[2] Jordi Bonet abunda en ello al afirmar que “la OIT ha mantenido una aproximación integrada respecto de los derechos humanos: el ser humano es, en el ámbito socio-laboral, titular de un conjunto de derechos y libertades que son objeto de un tratamiento jurídico no diferenciado” (Bonet Pérez, J., Mundialización y régimen jurídico internacional del trabajo. La Organización Internacional del Trabajo como referente político-jurídico universal, Barcelona, Atelier/ANUE/UB, 2007, p. 163).

Cooperativism is based on the principles of cooperatives. They are applied, in practice, the cooperative values of free association and democracy for its members and are based on the fundamental rights. However, in the last two decades, in Brazil, the cooperatives began to hire workers on a low wage salary in a continuous and accelerated process. Taking into consideration that the hiring of workers by the cooperativism was not considered by its founding members, the formal hiring generated by cooperatives, all around the world, has increased. It is important to mention that the fundamental working rights notions started to exist due to the emergence of the concept of Decent Work. This concept was formalized by the International Labor Organization (ILO) in 1999, with the aim of promoting quality work opportunities, under the conditions of human freedom, equity, security and dignity. They are considered essential conditions for overcoming poverty, reducing social inequalities, guaranteeing democratic governance and sustainable development. In the research carried out in Brazil about this subject, it was identified that the employment opportunities generated by the cooperatives are closer to the concept of Decent Work when compared to those generated by the private sector. Thus, the present article aims to identify the connection between cooperativism and Decent Work through a bibliometric revision of literature. The methodological process used in the research was the bibliometric approach by applying co-word analysis. From the results obtained, it was not possible to establish a direct connection between cooperativism and Decent Work.  Nevertheless, the connection was identified indirectly in the articles that focused on this theme. Even though, the focus was on the associated membership and not on the hired employees.

Consumption adequacy of pension systems in post-Soviet countries in 2005–2017Adequacy, together with stability and modernization, are the goals which are set for pension systems by many researchers from various scientifi c disciplines. This is because more and more countries struggle with the problem of providing adequate fi nancing for social transfers, including pensions. This means that despite paying contributions for a signifi cant part of life, many citizens receive a low pension at the end of their working lives. Therefore, it is important to maintain the standard of living from earlier years. Consumption adequacy is responsible for this, which helps to smooth the consumption in the last period of the individual’s life. This aspect is also important due to the decline in the value of benefi t during its collection despite valorization and, at the same time, the growth of some needs along with the retiree’s age including care services. The aim of this article is to organize particular pension systems in post-Soviet countries in terms of consumption adequacy from the most adequate system to the least understood as smoothing consumption. In the next step, there will be an attempt to evaluate the indicator. This work employs a critical analysis of the literature on the subject, as well as a comparative analysis. The source of the empirical data is the statistical offi ces of the individual states, which were created after the collapse of the Union of Soviet Socialist Republics USSR. The research shows that the Baltic States have one of the most adequate pension systems from the studied group of countries. Only fi ve of them meet the requirements of the International Labor Organization. None of the analyzed countries in 2017 had a replacement rate above 50%.

O presente artigo visa abordar a questão da efetividade dos Direitos Sociais a partir da análise da Emenda Constitucional nº 90/2015, que inseriu o transporte no rol dos Direitos Sociais da Constituição Federal. Para tanto, adota-se a metodologia de abordagem dedutiva, posto partir da análise doutrinária do direito material para compreender seus desdobramentos fáticos e, no desenvolvimento da pesquisa, emprega-se a técnica de documentação indireta, mediante o recurso à bibliografia de juristas que discorrem sobre o tema. Depreende-se que o reconhecimento do direito ao transporte como Direito Social apresenta-se como oportunidade para refletir acerca do conceito e da natureza jurídica dos Direitos Sociais e de seu lugar no ordenamento jurídico. Como Direitos Fundamentais, os Direitos Sociais privilegiam a igualdade material na sociedade e, para tanto, demandam prestações por parte do Estado em benefício da população carente. Juridicamente eficazes, a eficácia social ou efetividade encontra óbice na teoria da reserva do possível, por meio da qual o Estado alega insuficiência de recursos a serem dispendidos para a concretização desses direitos. Além disso, há também o poder de disposição do Estado para geri-los discricionariamente, por meio do qual age, por vezes, desconsiderando as expectativas da sociedade. Ao final, propõe-se o aprimoramento dos instrumentos que garantam a participação popular na gestão democrática do orçamento público e na tomada de decisões, em vista da superação dos problemas relativos à efetividade dos Direitos Sociais e, consequentemente, da distância existente entre a norma e a realidade.Palavras-chave: Transporte. Discricionariedade.AbstractThis article aims to approach the issue of the effectiveness of social rights from the analysis of Constitutional Amendment 90/2015, which inserted the transportation in the roll of social rights of the Federal Constitution. For that, the methodology of deductive approach is adopted, based on a doctrinal analysis of the material law to understand its unfolding events and, during the research development,the technique of indirect documentation is used, through the use of the jurists’ bibliography who discourse about the subject. It seems that the recognition of the right to transportation as a social right presents itself as an opportunity to reflect on the concept and legal nature of social rights and their place in the legal system. As fundamental rights, the social rights privilege the material equality in the society and, therefore, demand State provisions in benefit of the poor population. Legally effective, the social effectiveness or effectiveness finds obstacle in the reserve of the possible theory, whereby the State claims insufficient resources to be spent for the realization of these rights. In addition, there is also the State’s power to dispose of it at its own discretion, by means of which it sometimes acts in disregard of the society expectations. In the end, it is proposed to improve the instruments that guarantee popular participation in the democratic management of the public budget and in decisionmaking, in order to overcome the problems related to the effectiveness of social rights and, consequently, the distance between the norm and the reality. Keywords: Transportation.
