There can be no development without human rights, just as there are no human rights without development. Furthermore, peace and security are essential for development and respect for human rights. A phrase that sums up and frames very well what the 2030 Agenda means: a roadmap to the world that we want and that we are already building. To help stabilize an economic model in democracy that puts the human person at the center and promotes social inclusion must create conditions that allow decent work. The challenges posed by globalization need human faces for world, regional and national development, through the reaffirmation of essential and universal values. In this context, work constitutes an ethical value, a decisive and determining factor for production. From this premise arises the right to work as a source of personal dignity, family stability and consolidation of social cohesion. It synthesizes the aspirations of people during their working life. It means the opportunity to access a productive job that generates a fair income, security in the workplace and social protection for families; better prospects for personal development and social integration, and equal opportunities and treatment for women and men. Decent Work, that ethical-evaluative assessment designed by the ILO in the 90s at the 89th annual meeting, today in 2021 is still a search paradigm. We are convinced that the worker must be the central axis of the system, subject to preferential guardianship. For this we need all workers to respect their fundamental labor principles and rights, enjoy a fair income, a work environment without gender discrimination or of any other type, where social protection is provided.

Abstract. Employment development as integral part of national development based on Pancasila and the 1945 Constitution, is held in order development human completely and development the entire Indonesian community for improve dignity, respect and self-esteem of workers and manifest the society whose prosperous, fair, affluent physically and spiritually. Given the importance of the role of laborers in development, especially in the production process, it is naturally that protection, maintenance and development for the welfare of laborers, especially women laborers, should be carried out. Because the laborer position is very weak in compare with the bussinesmen. The position of weak laborer requires the bussiness men to give away social protection guarantee to their laborers. Social guarantee is the right of entire citizen including permanent foreigners. Violations of the implementation of social guarantee means violations of human rights (HAM). This is in line with the mandate of the 1945 Constitution that has been amended namely article 28 letters d (1 and 2),  letter h (3), and article 34 (2); state that the country protects every citizens and entitled on protection from all kinds of danger, intimidation and equal treatment in carrying out their life. In fact, not all companies giving socal guarantee for their laborers, especially women laborers. In which many women laborers are still catagorized as single even though they are the backbone of the family,—because of having unemployed husband or as single parent. Thus, real action in form of advocacy is needed to change the company’s policies. Advocacy is a powerful way to bring positive changes and empower people in their lives.Abstrak. Pembangunan ketenagakerjaan sebagai bagian integral dari pembangunan nasional berdasarkan Pancasila dan Undang-undang dasar 1945, dilaksanakan dalam rangka pembangunan manusia seutuhnya dan pembangunan masyarakat Indonesia seluruhnya untuk meningkatkan harkat, martabat dan harga diri tenaga kerja serta mewujudkan masyarakat sejahtera, adil, makmur dan materiil maupun spriritual. Mengingat pentingnya peranan buruh dalam pembangunan khususnya dalam proses produksi, sudah sewajarnya dilakukan perlindungan, pemeliharaan dan pengembangan terhadap kesejahteraan buruh khususnya buruh perempuan, karena posisi buruh yang sangat lemah jika dibandingkan dengan posisi pengusaha. Posisi buruh yang lemah mengharuskan pengusaha untuk memberikan perlindungan jaminan sosial terhadap para pekerjanya. Jaminan sosial merupakan hak setiap warga negara bahkan termasuk warga negara asing yang menetap. Pelanggaran terhadap pelaksanaan jaminan sosial berarti pelanggaran terhadap hak asasi manusia (HAM). Hal ini sejalan dengan amanat UUD 45 yang telah diamandemen yaitu pasal 28 huruf d (1 dan 2) dan huruf h (3) juga pasal 34 (2); pasal-pasal tersebut menjelaskan bahwa negara melindungi setiap warganya dan berhak atas perlindungan dari segala macam bahaya, intimidasi dan perlakukan yang sama dalam menjalankan hidupnya. Dalam pelaksanaan dilapangan, tidak semua perusahaan melaksanakan jaminan sosial bagi para buruhnya, terutama buruh perempuan. Dimana banyak buruh perempuan yang masih dikategorikan lajang padahal mereka adalah tulang punggung keluarga, baik karena suami yang tidak bekerja maupun sebagai single parent. Sehingga dibutuhkan tindakan nyata dalam bentuk advokasi untuk merubah kebijakan perusahaan tersebut. Advokasi adalah cara ampuh untuk membawa perubahan positif dan memberdayakan orang dalam kehidupan mereka.

Abstract This paper examines the right to freedom of thought in the European Convention on Human Rights against the background of technological developments in neuroscience and algorithmic processes. Article 9 echr provides an absolute right to freedom of thought when the integrity of our inner life or forum internum is at stake. In all other cases, where thoughts have been manifested in some way in the forum externum, the right to freedom of thought is treated as a qualified right. While Article 9 echr is a core focus of this paper, we argue that freedom of thought is further supported by Articles 8, 10 and 11 echr. This complex of rights carves out breathing space for the individual’s personal development and therefore supports the enjoyment of freedom of thought in its fullest sense. Charged with ‘maintaining and promoting the ideals and values of a democratic society’ as well as ensuring that individual human rights are given ‘practical and effective protection’, this paper predicts that the ECtHR will make greater use of the right to freedom of thought in the face of the emerging challenges of the Fourth Industrial Revolution.

The article is devoted to the partnership of social workers and ombudsmen as an influential tool for the citizens' rights protection. The common aspects of professional activity of social workers and ombudsmen in the citizens' rights protection of Ukraine and European countries are analyzed. Analyzed the annual reports of the National Ombudsman, clarified the dynamics of the receipt of citizens' reports about violations of their rights. There is a growing number of human rights violations in the field of social protection. The ombudsman has the right to make recommendations to the central executive bodies, which are ripe after the monitoring visits. Through the activities of social workers and the ombudsman, the state assumes the main functions of ensuring human rights in the social sphere. Foreign experience on the significant role of «natural allies» (social workers and ombudsmen) in drafting a formal protocol of strategic and tactical cooperation to optimize the residents' interests based on a friendly advisory approach have been highlighted. Most often, social workers and ombudsmen are forced to act as intermediaries between people and the state or other bodies to uphold justice and provide protection in cases where measures taken by the state in the interests of society as a whole threaten the rights and freedoms of individuals or groups. There is a need to intensify cooperation between the ombudsman's offices, social protection departments and social service providers (for example, through the joint Commissions on the quality of social services establishment, joint investigations into unsatisfactory social or medical care complaints). It seems relevant to expand the positions of specialized ombudsmen (for social protection (security), military ombudsman) as independent officials in communities (municipalities) for Ukraine.

There are a plethora of governance instruments for operationalizing human rights obligations on water and sanitation at multiple levels of governance. The realization that the human right to water and sanitation depends on the discourses and approaches used in a country to implement it implies that it is not self-evident that implementing the right will lead to inclusive development. The inclusive development aims at not only social inclusion but also ecological and relational inclusion, where the latter aims at ensuring that the structural causes of inequality are also addressed. Relying on an extensive literature review and jurisprudence on the human right to water and sanitation, we develop an ideal-typical conceptual framework for assessing the human right to water and sanitation with inclusive development as an imperative. Our framework is based on the premise that governance instruments are valueladen tools which can steer social changes depending on the contextual political paradigm which can be garnered from the goals, ownership models, accountability mechanisms and incentives of actors involved in the governance process. We, therefore, propose a simple model for assessing whether the governance instruments for operationalizing the human right to water and sanitation will, in fact, lead to inclusive development.Keywords: Human Rights, Governance, Water and Sanitation

‘Disability may increase the risk of poverty, and poverty may increase the risk of disability.’ Breaking this cycle is a major challenge for the international community, especially the countries of the Global South. As the most recent human rights treaty of the United Nations, the UN Convention on the Rights of Persons with Disabilities also specifies the right to social protection. This study deals with the question of to what extent a human rights-based approach characterised by need orientation and accessibility can be derived from specific state obligations. In addition, it examines the efforts to implement such an approach in Sub-Saharan Africa. In this context, the study shows that it has been possible to both develop innovative concepts that consider the realities of the lives of local people with disabilities in Uganda and Ghana and, at the same time, to ensure the implementation of international human rights law in those two countries.

The UN Convention on the Rights of Persons with Disabilities (UNCRPD) features interesting labour law related aspects. The goals of this article are to reconcile horizontal human rights and contract law in the context of reasonable accommodation in working life and to establish guidelines by which to assess the obligation to make accommodation, for example in relation to the EU Employment Equality Directive. This article utilises the framework of just social practice, which makes reference to welfarism in Nordic contract law. Just social practice creates a theoretical framework in which to investigate the rights and obligations attached to reasonable accommodation in working life, because it may be argued that its basic premises correspond to the ultimate justification of the accommodation rights provided for by the UNCRPD: the idea of social inclusion. The first part of the article seeks to identify common features between the UNCRPD and contract law. It sketches the theoretical framework of just social practice, in which contract law and human rights coincide within the context of employment. The second part of the article elaborates what the process of reasonable accommodation within the framework of just social practice constitutes and introduces specific steps that are followed when the right to accommodation is in question. The article also identifies the factors that have an influence on reasonableness evaluations as being either internal or external to the contractual relationship and exemplifies how contract law principles are to be applied when assessing reasonableness. The article argues that reconciliation of the goals of private law and human rights within the framework of just social practice makes it possible to argue that contract law principles can function as a tool for social inclusion.

The fundamental goal of the International Labour Organisation is the achievement of decent and productive work for both women and men in conditions of freedom, equity, security and human dignity. The South African government has pledged its commitment to the attainment of decent work and sustainable livelihoods for all workers and has undertaken to mainstream decent work imperatives into national development strategies.  The four strategic objectives of decent work as identified by the ILO are: i) the promotion of standards and rights at work, to ensure that worker's constitutionally protected rights to dignity, equality and fair labour practices, amongst others, are safeguarded by appropriate legal frameworks; (ii) the promotion of employment creation and income opportunities, with the goal being not just the creation of jobs but the creation of jobs of acceptable quality; (iii) the provision and improvement of social protection and social security, which are regarded as fundamental to the alleviation of poverty, inequality and the burden of care responsibilities; and (iv) the promotion of social dialogue and tripartism. This article considers the progress made towards the attainment of these decent work objectives in South Africa, using five statistical indicators to measure such progress namely: (i) employment opportunities; (ii) adequate earnings and productive work; (iii) stability and security of work; (iv) social protection; and (v) social dialogue and workplace relations. It concludes that high levels of unemployment and a weakened economy in South Africa have given rise to a growing informal sector and an increase in unacceptable working conditions and exploitation. The rights of workers in the formal sector have not filtered down to those in the informal sector, who remains vulnerable and unrepresented. Job creation initiatives have been undermined by the global recession and infrastructural shortcomings and ambitious governmental targets appear to be unachievable, with youth unemployment levels and gender inequalities remaining of grave concern. Social protection programmes fail to provide adequate coverage to the majority of the economically active population. Social dialogue processes and organisational structures fail to accommodate or represent the interests of the informal sector. Until these problems are overcome, the article concludes, it remains unlikely that decent work imperatives will be attained.
