This research basically is to find the position of ‘urf as one of the theories that can provide legal changes in an authoritative-inclusive way to fiqh in the word khalwat in the definitive aspects of syar'iyyah in relation to culture of riding with fiancees in the Madura area. As an external consideration in cultural studies, ‘urf is one of the continuous theories with the discussion of adat to determine law in an authoritative-inclusive manner. In this study using a type of field research (field research) because it involves empirical data that views law as a set of behaviors, actions, and reality. In addition, also library research (library research) to obtain data about a norm while reviewing theories with a qualitative approach because it cannot be obtained by mathematical or numerical statistical procedures, so that it can contain about people's lives (culture), history, ethics, social movements , or family system. From the process of analyzing the meaning of khalwat using the theory of ma'na al-haml with the consideration of 'urf in which there are several elements of maslahat, this study concludes that' urf can change the position of Islamic law by combining consideration of several conditions through the process of changing meaning used in redefining the word khalwat. So as to enable culture to be engaged during the engagement period as happened in the Sumenep and Madura communities in general as a consideration of ‘valid urf. Keywords: Relationship in Engagement, ‘Urf, and Madura.

AbstractAlthough an increasing amount of empirical research has been linked to the impact of management control and governance on corporate social responsibility (CSR) issues since the financial crisis of 2008/09, heterogeneous results have characterised this research field. Regarding the group level of corporate governance, the efficacy of board committees (e.g., audit, compensation or CSR committees) has been included in recent research designs. However, analyses of corporate governance at the individual level are related to the effects of top management members [e.g., chief executive officer (CEO), chief financial officer (CFO) or chief sustainability officer (CSO)] on CSR outcomes. This paper aims to convey a detailed understanding of sustainable management control’s impact as CSR-related board expertise. In more detail, we focus on the influence of both CSR committees and CSOs on three CSR measures mainly analysed in empirical-quantitative research: (1) CSR reporting; (2) CSR assurance (CSRA); and (3) CSR performance. We motivate our analysis with increased relevance from practical, regulatory and research perspectives, and we employ a systematic literature review of the symbolic vs. substantive effects of sustainability-related board composition. Based on our theoretical model (legitimacy theory, stakeholder theory and upper-echelons theory), we selected 48 quantitative peer-reviewed empirical studies on this research topic. Our analysis shows that CSR committees positively influence CSR reporting and performance. Thus, there are indications that the implementation of a CSR committee is not a symbolic act, but instead substantively contributes to CSR activities. However, in light of inconclusive empirical research results and a lack of studies that have analysed CSO-related effects, a notable research gap has been identified. Moreover, we note the main limitations of prior research in this review and develop an agenda with useful recommendations for future studies.

This paper provides critical reflections on Manuel Castells’ (2012) book Networks of Outrage and Hope. Social Movements in the Internet Age that analyses the “nature and perspectives of networked social movements” (p. 4) and gives special focus to the role of “social media” in movements that emerged in 2011 in Tunisia, Iceland, Egypt, Spain and the United States. I situate Castells’ book in an intellectual discourse that focuses on the political implications of social media and that has involved Clay Shirky, Malcolm Gladwell and Evgeny Morozov. The article also discusses the role of social theory and empirical research in Castells’ book, presents as an alternative a theoretical model of the relationship between social movements and the media, discusses the implications that some empirical data that focus on social media in the Egyptian revolution and the Occupy Wall Street movement have for Castells’ approach, discusses how Castells positions himself towards capitalism and compares his explanation of the crisis and his political views to David Harvey’s approach. One of the causes of divorce which was decided by a Religious Court judge was because of the apostasy of one of the spouses. Divorce due to apostasy leaves problems in parenting. To whom the child custody will be given must be considered by the judge. This research is empirical research (field study) with fiqh and family psychology approach to get an understanding of the basic considerations of judges in establishing child custody in the case of an apostate partner. Through interviews and documentation, the study found, that the consideration of judges based on three things: first, normative basis, which is based on the consideration of Constitution No. 1 of 1974, Compilation of Islamic Law, Constitution No. 7 of 1989 Jo. Constitution Number 30 of 2006 concerning Childcare, and Number 23 of 2002, Supreme Court jurisprudence Number 210 / K / AG / 1990. Second, fiqh basis, which refers to the requirements of the Hadhanah which are in line with fiqh and the provisions of the Hadhanah based on Syafii's Madzab. Third, the psychological basis, which considers all psychological problems related to children. By using this integrative analysis the judge considers that the requirements for Muslims to care for children are in line with psychological values, that the family must provide Islamic education to shape the child's mental spirit.

The paper analyzes key achievements in sociocultural research of economic development for the last twenty years. Firstly, the paper describes the main approaches in sociocultural studies and key trends in empirical research (including causality issues). Secondly, it poses critical open questions in sociocultural research concerning the relationship between culture and institutions, within-country cultural differences, and culture in dynamics. It demonstrates how the research into culture is connected to the studies of social capital. Finally, the paper formulates the theses of the sociocultural economics research field.

Political parties and social movements activists refere to the notion of justice as founding principle of critism. Demirovi? argues that the norm of justice is not able to motivate criticism and action. The norm of justice plays an important role in professional moral philosophy as is the case in the approaches of Martha Nussbaum or John Rawls. The offer arguments for their claims to give people and states a moral perspective. But the claim of universality that is inherent in moral discourses, always fail. The implication is that people who expect moral philosophy to be an advising knowledge become disappointed and perplexed. This is confirmed by the outcome of empirical research on justice among workers. To explain the dilemma of justice – claiming for universality and being particularistic and part of historical state form – the article takes up arguments developed by Marx and Horkheimer on justice as an ideological form.

<p>Addendum is worth reviewing with KHES and Fatwa DSN-MUI review, because in Islamic law merchantly buying and selling not only bring profit only, but must based on syariat and to avoid risk. This study aims to find out why BRI Syariah issued addendum and review of KHES and Fatwa DSN-MUI. This type of field research (field research) or referred to as empirical research, this study includes empirical research that examines the phenomenon of law. The approach used is the sociological juridical approach. The primary data collection method is the direct and secondary interviews used by the literature and documentation. Data analysis method used is qualitative data analysis. Data processing methods make the following efforts; editing re-examines files related to addendum and interview results of legal officers and customer service, clasifying and classifying edited data to facilitate analysis, verification of collected data to determine the validity of data, analytical data analysis procedures and application of addendum and concluding conclusions to obtain answer. The results of the study are: 1) addendum is done as an effort to avoid bank losses and maintain business continuity. 2) Addendum BRI Syariah Malang Branch Office is allowed due to the agreement of both parties.</p><p>Addendum layak dikaji dengan tinjauan KHES dan Fatwa DSN-MUI, karena dalam hukum Islam kegaitan jual-beli tidak hanya mendatangkan keuntungan semata, namun harus berdasarkan syariat dan untuk menghindari resiko. Penelitian ini bertujuan untuk mengetahui alasan BRI Syariah mengeluarkan addendum dan tinjauan KHES serta Fatwa DSN-MUI. Jenis penelitian ini lapangan (field research) atau disebut sebagai penelitian empiris, penelitian ini termasuk penelitian empiris yang meneliti fenomena hukum. Pendekatan yang digunakan adalah pendekatan yuridis sosiologis. Metode pengumpulan data primer adalah wawancara langsung dan sekunder yang digunakan kepustakaan dan dokumentasi. Metode analisis data yang digunakan adalah analisis data kualitatif. Metode pengolahan data melakukan upaya sebagai berikut; editing meneliti kembali berkas yang berkaitan dengan addendum dan hasil wawancara legal officer dan customer service, clasifiying menyusun dan mengklasifikasi data hasil editing untuk mempermudah analisa, verifiying memeriksa data yang terkumpul untuk mengetahui keabsahan data, analysing analisis data prosedur dan penerapan addendum dan concluding kesimpulan untuk mendapat jawaban. Hasil penelitian adalah: 1) addendum dilakukan sebagai upaya bank menghindari kerugian dan menjaga kelangsungan usaha. 2) Addendum BRI Syariah Kantor Cabang Malang diperbolehkan karena adanya kesepakatan kedua belah pihak.</p>

This paper is about the means and ends of geographical inquiries into technology and technoscience. In working through a body of literature commonly grouped together under the collective phrase ‘science, technology, and society’, and in seeking to work upon empirical research on electricity networks, the author draws attention to the ontological and representational issues that are confronted when thinking through geographies of technology and geographies of techno-scientific knowledge. In the first part of the paper the ontological status of nonhumans and the politics of representation are discussed as a consequence of a rejection of technical and social determinisms. In the second part, the author turns to review some of the analytical metaphors that are conjured with in order to address the issues raised in the first part. In the third part of the paper the more overtly spatial metaphors of the literature of science, technology, and society are confronted and the move from a measured and ordered managerialist approach to the spatiality of technologies and technoscience is reviewed. In the fourth section, some lessons for the politics of a reconfigured geographical engagement with technology and technoscience are raised.

Alterglobalization is the name for a large spectrum of global social movements that present themselves as supporting new forms of globalization, urging that values of democracy, justice, environmental protection, and human rights be put ahead of purely economic concerns. This article develops a framework for the study of the influence of alterglobalization on sport by: outlining a periodization of social movements and sport; proposing a typology of responses to the politics of globalization; and proposing a typology of recent social movements associated with sport. The article does not report on an empirical research project, but provides a stock take of what has happened since the 1990s regarding the politics of globalization and the politics of sport, with specific reference to global social movements. The questions raised in this article include: What form do the movements challenging the world sports order today take? Does an alterglobalization movement exist in sport? What alternative models of sport do they propose?

The objective of this paper is to contribute to an important debate concerning the interaction between place-based social movements and the science, technology and innovation system. Our central proposition is that place-based social movements can facilitate unique local heterogeneous alliances with key actors of the science and technology system. A process of bricolage can emerge from these alliances whereby social movements are supported by the technical knowledge of the science community, and in turn, the priorities of the scientists are influenced by the agendas of the social movements, leading to new forms of knowledge production. We build on this to argue that these place-based engagements can create significant agency towards changes in socio-technical and socio-ecological systems in urban environments, especially in societies where regulatory oversight is weaker and social movements in areas that overlap science, technology and innovation are a common expression of civil society demand for change. Our argument is developed through a study of a social movement in defence of an urban wetland in Bogota.
