Through the exploration of the existing relevant literature, this article found that the COVID-19 pneumonia epidemic has had a profound impact on consumption willingness, consumption patterns, and consumption objects, and, as such, has newly expanded the theoretical model of consumer behavior. Results: Through reviewing the literature, this paper found some results. For example with regard to consumption patterns, early studies and the impact of COVID-19 was focused on online consumption, however in the context of COVID-19, scholars proposed paying attention to the combination of online and offline development. Superficially, the control of trafficking of counterfeit cigarettes in the name of illegal business operation goes against the spirit of modest and restraint, as well as the doctrine, of the Criminal Law; substantially, however, it is the realistic portrayal of the cross-border governing of market misconduct with “reification” criminal law. In recent years, modern criminal law has opened the way to a transformation of functionalism upon the demand for security governance derived from risks to society. It has gone from being a passive night watchman to being a positive leader and pusher, highlighting the trend of “reification” of functionalism-oriented criminal law. The reification not only weakens the contractual value of crime and punishment but also causes dysfunction of the integral legal order. In this regard, while affirming the legitimacy of the functionalism transformation of criminal law, this paper corrects the trend of "reification" of functionalism-oriented criminal law by declaring the modest value of classical humanity-oriented criminal law, and promotes its return to the modest value of "humanity-oriented" criminal law. Based on the principle of unity of legal order, this paper proposes to build a two-tier judgment model consisting of "general violation" and "punishable violation" in an attempt to provide intellectual support for the processing of criminal cases involving tobacco.

Objectives: It is necessary to unify the subjective and objective factors to determine that the unlicensed transportation of tobacco constitutes the crime of illegal business operation, which objectively has the elements of serious circumstances and subjectively has the elements of “clearly knowing”. “Clearly knowing” means that the actor has subjective fault and is imputable. If there is evidence to prove that those who are entrusted to transport tobacco are “unaware” of others’ unlicensed business activities, they should carefully identify unlicensed tobacco transport activities as illegal business activities, and it is more in line with the principle of unification of subjectivity and objectivity. Unlicensed tobacco transportation seized in transit should be deemed as attempted illegal business operation.

China’s journalism education has been changing all the time to meet new demands brought by the political and economic reforms over the last two decades in the 21st century. However, the covert wars between ideology and practice, between classrooms and newsrooms have caused the “split personality” and general confusion among China’s journalism educators and students. Several educational and practical problems thus arise as a result of the tug-of-war between economic and ideological demands. The problems of China’s journalism education are not only from its complex social and economic environments, but also from its weight of history and culture. Although both journalism educators and some media organizations in China are making great effort to heighten awareness of problems and actively attempting to take remedial measures, the transition from the classroom to the newsroom is made more difficult by the complicatedness of the business operation of schools and media organizations, and the systematicity of journalism education remains problematic.
