Bay‘ al-‘īnah is a buying and selling contract that becamethe debate of classical and contemporary scholars interms of law and its implementation. Therefore, it isnecessary to have an article describing the concept ofbay‘ al-‘īnah to determine the law of the bay‘ al-‘īnah. Inthis article the author will explain the concepts, laws andapplications of bay‘ al-‘īnah according to contemporaryschools and scholars by stating their reasons forchoosing strong opinions. The fuqaha agree to forbidthe bay‘ al-‘īnah if there is a condition that ma‘qud ‘alayhmust be resold to the seller of origin. Likewise, if thereis a hint of the existence of ḥīlah do the usury then thelaw also is void. What is fuqaha debate is that if there isno such requirement and no referent. In this case theauthors hold that the bay‘ al-‘īnah contract is haram if theintention of doing usury is not stated in contract. However, the status of the contract is valid or not voidas long as there is no requirement of mabī‘ to be resoldto the original seller and the absence between the twoparties who intend to do usury. This is because with theintention, although outside the contract then theintention of usury has been declared and can cancel thecontract. Keywords: Murābaḥah, Instrumen Pembiayaan, KeuanganIslam Modern

This article reports the results of a study on how to fill the free market program of ASEAN Economic Community (AEC). Indonesia has significant demographic bonus when compared to other ASEAN countries, so that specifically Indonesia will become an easy target for economic activity (read: free market flow transactions) carried out by all members of ASEAN. Demographic bonus is an opportunity and challenge for the Indonesian people, both for those who live in cities or in the countryside. This condition will be more complicated, if the mapping potential of the population does not become a serious concern for the government and stakeholders so that the people of Indonesia will become the largest consumer for products of ASEAN countries. One of the potential populations of Indonesia is women, because they have specific skills that are able to be directed towards an income. The purpose of this study is to prepare the people of Indonesia who have the skills, especially women in entering the AEC both urban and rural communities. This study uses a qualitative method of observation, interviews and review of documents, such as books, newspapers and others.

The imamah (leadership) of twelve imams is considered as a concept coming from Shi’ite tradition. Hadith literature of Sunni, however, has numerous hadith on imamah as exemplified by Shahih Bukhari, Muslim, Sunan Abi Dawud, al-Tirmidzi, al-Nasa’i, Ibn Majah, and Musnad Imam Ahmad. Although these hadith have some differences in terms of their structure, the hadith have in common in their meaning and substance. Sunni scholars consider the quality of transmitters and content of hadith on twelve imams is shahih. In contrast, Shi’ite scholars do not consider them as mutawatir. Sunni scholars of hadith are not in agreement in determining the figures considered as a twelve imam. However, they agree that all the twelve imams were from Quraish tribe and sworn in by ummah. The restriction of some imams to twelve is not absolute since there is a hadith stating that the number of imam and caliphate would emerge after the death of the Prophet saw. Muslim were obliged to put their loyalty on and obey them. The name of twelve imams derives from the fact that during their leadership, Muslims achieved the glorious period in terms of religious, scientific and political field.

The interpretation of the Qur'an is often disputed. The terms of custom, culture and ideology is not one thing that descends from the sky. It is shaped by humans and socialized from one generation to other. Biological determinism has also reinforced the view. In such situations, the differences, discrimination, and injustice resulting from mistakes in understanding and interpreting the universal doctrine, create injustices against women, including the women’s rights and position in Lampung Sebatin customary law community. This article discusses the rights and position of women in Lampung Sebatin customary law community and the form of injustice for women in the society. The conclusion shows that, firstly, women's rights and position in Lampang Sebatin customary law community are far from fair principles. Not fair either in marriage law or inheritance law. Second, the form of injustice for women in indigenous communities of Lampung Sebatin, from gender analysis is marginalization, penomorduaan and labeling, violence, and excessive workload.
