<p><strong>O APLICATIVO UBER: UM ESTUDO DE CASO BASEADO NOS PRINCÍPIOS E FUNDAMENTOS DA ORDEM ECONÔMICA NA CONSTITUIÇÃO FEDERAL DE 88 </strong></p><p><strong>Resumo:</strong> Os princípios da ordem econômica são positivados na atual Constituição da República Federativa do Brasil com o escopo de conferir segurança jurídica na economia brasileira. Considerando que o Estado delimita em sua Lei Fundamental quando e como pode interferir no mercado, bem como esclarece quais princípios norteiam sua política econômica, o presente estudo propõe-se a tecer uma preocupada análise acerca da proibição equivocada do serviço de transporte de passageiros na modalidade privada no Brasil. Uma prestadora desses serviços, a Uber do Brasil Tecnologia LTDA, tem sido alvo de questionamentos da legalidade de suas atividades. O presente trabalho problematizará a questão das novas tecnologias no direito, mormente quando a prestação do serviço ou o exercício da atividade afrontam a legislação atual, um direito administrativo engessado e a doutrina clássica em desafinação com o tempo presente. O objetivo deste artigo é demonstrar que o transporte individual de passageiros em sua modalidade privada está em consonância com o atual ordenamento econômico da Constituição, a Política Nacional de Mobilidade Urbana, e o posicionamento do Ministério Público Federal, resguardando, assim, a autonomia do particular no exercício legal de sua profissão e contribuição com a economia do país.</p><p><strong>Palavras-chaves:</strong> Ordem econômica constitucional; princípios econômicos; transporte privado; Uber; mobilidade; novas tecnologias; atividade econômica; serviço público.</p><p><strong>THE UBER APPLICATION: A CASE STUDY BASED ON THE PRINCIPLES AND FOUNDATION OF ECONOMIC ORDER IN THE FEDERAL CONSTITUTION OF 88</strong></p><p><strong>Abstract:</strong> The principles of economic order are implemented in the current Constitution of the Federative Republic of Brazil with the aim of providing legal certainty to the Brazilian economy. Whereas the State delimits under its Basic Law when and how to intervene in the market, and clarifies what principles should guide its economic policy, the purpose of this monograph is to offer a concerned analysis on the mistaken prohibition imposed on private passenger transport service in Brazil. A supplier of such services, Uber do Brasil Tecnologia LTDA, has been undergoing some questioning regarding the legality of their activities. This paper will question the matter of new technologies under the Law, particularly when the service performance or the exercise of the activity is against current legislation, a plastered administrative law, and the classical doctrine in disagreement with present time. This controversy will be addressed in an exclusive chapter and will be present throughout this study. IntroductionMost sub-Saharan African countries endure a high burden of communicable infections but also face a rise of non-communicable diseases (NCDs). Interventions targeting particular epidemics are often executed within vertical programmes. We establish an Adaptive Diseases control Expert Programme in Tanzania (ADEPT) model with three domains; stepwise training approach, integration of communicable and NCDs and a learning system. The model aims to shift traditional vertical programmes to an adaptive diseases management approach through integrating communicable and NCDs using the tuberculosis (TB) and diabetes mellitus (DM) dual epidemic as a case study. We aim to describe the ADEPT protocol with underpinned implementation and operational research on TB/DM.Methods and analysisThe model implement a collaborative TB and DM services protocol as endorsed by WHO in Tanzania. Evaluation of the process and outcomes will follow the logic framework. A mixed research design with both qualitative and quantitative approaches will be used in applied research action. Anticipated implementation research outcomes include at the health facilities level for organising TB/DM services, pathways of patients with TB/DM seeking care in different health facilities, factors in service delivery that need deimplementation and the ADEPT model implementation feasibility, acceptability and fidelity. Expected operational research outcomes include additional identified patients with dual TB/DM, the prevalence of comorbidities like hypertension in patients with TB/DM and final treatment outcomes of TB/DM including treatment-related complications. Findings will inform the future policies and practices for integrating communicable and NCDs services.Ethics and disseminationEthical approval was granted by The National Research Health Ethical Committee (Ref-No. NIMR/HQ/R.8a/Vol.IX/2988) and the implementation endorsed by the government authorities. Findings will be proactively disseminated through multiple mechanisms including peer-reviewed journals, and engagement with various stakeholders’ example in conferences and social media.

AbstractIn this paper, we analysed the efflorescences present in the frescos of a monumental complex named S. Pietro a Corte situated in the historic centre of Salerno (Campania, Italy). The groundwater of the historic centre is fed by two important streams (the Rafastia and the Fusandola) that can be the sources of water penetration. The aims of this work are to (i) identify the stream that reaches the ancient frigidarium of S. Pietro a Corte and (ii) characterize the efflorescences on damaged frescos in terms of chemical nature and sources. In order to accomplish the first aim, the water of the Rafastia river (7 samples) and the water of the Fusandola river (7 samples) were analysed and compared with the water of a well of the Church (7 samples). The ionic chromatography measurements on the water samples allowed us to identify the Rafastia as the river that feeds the ancient frigidarium of S. Pietro a Corte. To investigate the nature and the origin of the efflorescences (our second aim), anionic chromatography analyses, X-ray diffraction measurements, and the isotopic determination of nitrogen were performed on the efflorescences (9 samples) and the salts recovered from the well (6 samples). Results of these analyses show that efflorescences are mainly made of potassium nitrate with a δ15N value of + 9.3 ± 0.2‰. Consequently, a plausible explanation for their formation could be the permeation of sewage water on the walls of the monumental complex.

Polydipsia is a disorder that has received little attention in the research literature. Treatment has been mainly confined to medical or pharmacological intervention. Few studies have reported the use of contingency management techniques and none have sought to encourage self-management. This study shows how such a procedure brought about a significant change in rates of water drinking in a thirty-one year old man with a mild learning disability.
