Chapter 5 analyzes Schmitt’s theory of dictatorship. Schmitt’s theory of dictatorship was part of his broader criticism of positivism and its inability to effectively respond to the instabilities mass democracy wrought on the state and constitution. Positive laws, including constitutional amendment procedures, could themselves become threats to the fundamental commitments of public order. The suspension of positive laws might be justified. Schmitt argued dictatorship was a necessary final bulwark against this sort of revolutionary threat. The dictator, as guardian of last resort capable of acting outside positive law, could become necessary for a state to survive internal enemies. Yet, although dictatorship could suspend positive law, Schmitt argued it did not suspend the fundamental public order of the state and constitution—a distinction positivism was unable to recognize. This chapter concludes with an analysis of Schmitt’s discussion of the role of the president as guardian of the constitution.

Abstract In recent years, interest in the psychology of fake news has rapidly increased. We outline the various interventions within psychological science aimed at countering the spread of fake news and misinformation online, focusing primarily on corrective (debunking) and pre-emptive (prebunking) approaches. We also offer a research agenda of open questions within the field of psychological science that relate to how and why fake news spreads and how best to counter it: the longevity of intervention effectiveness; the role of sources and source credibility; whether the sharing of fake news is best explained by the motivated cognition or the inattention accounts; and the complexities of developing psychometrically validated instruments to measure how interventions affect susceptibility to fake news at the individual level.

Изучалась биография и творчество выдающегося отечественного психолога, философа и представителя российского психологического зарубежья В.В. Зеньковского (1881-1962 гг.). Рассмотрены его ранний период эмиграции и работа в г. Белграде (Королевство сербов, хорватов и словенцев) и г. Праге (Чехословакия) (1920-1926 гг.). Проанализированы фундаментальные психологические идеи В.В. Зеньковского в общей, детской и педагогической психологии, сформулированные им в его монографии «Психология детства» (1924 г.) и курсах лекций «Педагогическая психология» (1924 г.) и «Курс общей психологии» (1925 г.) (на основе архивных материалов). Рассмотрены также его научные концепции в области теории и методологии психологии (структура психологической науки, строение душевной жизни, о ведущей роли эмоциональной сферы в психике человека), детской психологии (педологические основы психологии ребенка, задачи и методы детской психологии, проблемы понимания и самостоятельности феномена детства, роль игры в биологическом, психическом и социальном развитии ребенка) и педагогической психологии (социально-психологические основы педагогической психологии, социально-психологические феномены педагогического процесса, классификация социальных ролей ученика и учителя, психология поведения класса). В.В. Зеньковский представляется как оригинальный теоретик и методолог психологии, разработчик основ изучения психики ребенка, создатель социально-психологического подхода в педагогической психологии. Его концепции этого периода могут быть востребованы в настоящее время при решении методологических вопросов психологии, социально-психологических проблем педагогики, проблем социального воспитания личности, при изучении развития психических процессов и личности ребенка. The author refers to the biography and work of the outstanding Russian psychologist, philosopher and representative of the Russian psychological abroad community V.V. Zenkovsky (1881-1962 y.). The early emigration period of his life and work in Belgrade (the Kingdom of Serbs, Croats and Slovenes) and Prague (Czechoslovakia) (1920-1926 y.) is considered. The author discusses the fundamental psychological ideas of V.V. Zenkovsky regarding general psychology, child psychology and pedagogical psychology, which he formulated at that time in his monograph “Psychology of Childhood” (1924) and lecture courses “Pedagogical Psychology” (1924) and “The Course of General Psychology” (1925) (based on archival materials). There are significant scientific concepts of V.V. Zenkovsky in the field of theory and methodology of psychology (the structure of psychological science, the structure of mental life, the leading role of the emotional sphere in the human psyche), child psychology (pedological foundations of child psychology, tasks and methods of child psychology, the problem of understanding and independence of the childhood phenomenon, the role of the game in biological, mental and social development of the child) and pedagogical psychology (social-psychological foundations of pedagogical psychology, social-psychological phenomena of educational process, the classification of social roles of student and teacher, the psychology of class behavior). V.V. Zenkovsky is presented as an original theoretician and methodologist of psychology, pedologist, developer of the basics of studying the child’s psyche and creator of the social-psychological approach in pedagogical psychology. Nowadays the analyzed concepts of the Russian psychologist can be demanded when solving methodological issues of psychology, social-psychological problems of pedagogics, problems of social education of a person, when studying and designing the development of child’s mental processes and personality.

The problem of studying consciousness has been quite relevant and significant throughout the lifetime of psychology, since it is the consciousness that builds the inner picture of the world and forms a semantic representation of reality, performing the reflective, regulatory and instrumental functions of the human psyche. Consciousness arises and forms in the process of regulation of social activity and allows a person to set himself a certain goal, to isolate himself from the outside world, to determine his attitude to the objects and phenomena of the outside world. The objective necessity of successful socio-economic development of the Ukrainian society, the task of formation of the state of law, implementation of a complex of measures related to the implementation of legal reform lead to an increase in the role of professional   attorney, their responsibility for the results of their activities. The professional consciousness of   attorney is a special phenomenon of modern reality, the study of which is possible only with a thorough analysis of it as a theoretical and legal construction. Proceeding from the approaches developed in psychological science, in some cases, this kind of consciousness can be regarded as a set of views, ideas, theories, representations and feelings of a group of people with a certain status of a   attorney, with respect to the law, current and desirable. In others - as a "reflection of legal reality" by   attorney in the process of carrying out their professional activities. Features of the content of professional consciousness of   attorney should be analyzed, based on the following elements: professional knowledge, attitude to the profession, skills of professional behavior

The article is devoted to the study of such an important psychological phenomenon as an attitude of women to their own motherhood. It is summarizes the study of the problem of motherhood in psychological science in general. The article analyzes the problem of the influence of the relationship with the mother in childhood on the formation of a woman's attitude to her own motherhood in adult age. It is illuminates views of foreign and national researchers on the study of this phenomenon, as well as the essence of different areas of research on this phenomenon. Based on the theoretical analysis of the literature on this topic, the concept of "motherhood", its content and psychological essence is studied. Cultural-historical, biological, physiological and psychological aspects to the study of motherhood are singled out. The main content of scientific views on the formation of the phenomenon of motherhood is generalized. The main factors influencing the development of a woman's maternal sphere and the formation of the attitude to one's own motherhood are analyzed and considered. The content of such basic concepts as "mother's image" and "maternal relations" is revealed. The psychological features of the formation of an adequate image of the mother in the theoretical analysis of the ontogenesis of the maternal sphere are analyzed. The article also reveals the dynamics of motherhood in ontogenesis. The types of maternal relations and their role in the life of a mature woman are determined, as well as the influence of these relations on the formation of a woman's attitude to her own motherhood. The influence of different types of relationships between women and their own mothers on the level of formation of their attitude to personal motherhood has been empirically studied. Two groups of women were studied, one group had a positive relationship with their own mother, and the other had a negative one. In the course of the research the differences between different types of maternal relations and the level of formation of a woman's personal attitude to motherhood are singled out.

AbstractTraditional conceptions of the international community have come under stress in a time of expanding international public order. Various initiatives purport to observe a reconceived international community from a variety of perspectives: transnational, administrative, pluralist, constitutional, etc. The perspectives on this changing dynamic evidenced by the International Court of Justice, however, have been largely neglected. But as the principal judicial institution tasked with representing the diversity of legal perspectives in the world, the Court represents an important forum by which to understand the changing appreciation of international community. While decisions of the Court have been restrained, an active discourse has been carried forward among individual judges. I look at part of that discourse, organized around one perspective, which I refer to as innate cosmopolitanism, introduced to the forum of the ICJ by the opinions of Judge Álvarez. The innate cosmopolitan perspective reflects an idea of the international community as an autonomous collectivity, enjoying a will, interests, or ends of its own, independent of constituent states. The application of that perspective under international law is put most to test in matters of international security, in particular where the interest in a discrete, global public order runs up against the right to self-defence vested in states. The innate cosmopolitan perspective has not, in these cases, achieved a controlling position – but, over time, it has been part of a dialectical process showing a change in the appreciation of international community before the Court, and a changing perception from the bench of the role of the Court in that community.

Police in the face of petty offences - that is, a few words about how the law of petty offences has developed and what role of the Police is (and has been) in fighting against them since Poland regained its independence. Petty offences are minor acts and there are many of them in the surrounding area . These are actions that are very burdensome for residents and affect their sense of security. A petty offence is the most frequently committed prohibited act that society is, and has historically been, confronted with, and the main reason for citizens to report to police officers. Petty offences, in particular those related to disturbing public order, quiet hours , littering and drinking alcohol in prohibited areas are, due to their nature and frequency, the most burdensome acts in society. These acts are often combined with each other and are committed simultaneously. Due to the prevalence of petty offences, they affect the general public. The Code of Petty Offences contains a catalog of penalties and a number of other ways of responding to petty offenses committed. The ways in which the police react and practice have changed over the years, just as the whole of the broader law of petty offences has changed. Its development began after Poland gained its independence in 1918. The Constitution of March 1921 did not directly decide on the model of adjudication in cases of petty offences, but adopted an important principle - the citizen's right to a fair trial (Articles 72 and 98).

This chapter discusses the limits of normative ethics in new moral domains linked to the development of AI. In these new domains, people have the possibility to opt out of using a machine if they do not approve of the ethics that the machine is programmed to follow. In other words, even if normative ethics could determine the best moral programs, these programs would not be adopted (and thus have no positive impact) if they clashed with users’ preferences—a phenomenon that can be called “ethical opt-out.” The chapter then explores various ways in which the field of moral psychology can illuminate public perception of moral AI and inform the regulations of such AI. The chapter’s main focus is on self-driving cars, but it also explores the role of psychological science for the study of other moral algorithms.
